all of this helps >> banking on bud. oakland city hall is the center for the california cannabis community this weekend. organizers say it could provide a big economic boost. good afternoon. i'm john alston in for alan wang. thousands are expected for the cannabis and hemp expo being held at oakland city hall plaza. and that's where sergio is this afternoon with the attendance there. sergio? >> john, i have actually been walking some big lines here throughout the afternoon. this is where people are checking in for their tickets and at $20 a pop things have been going quickly this afternoon. we have been getting estimates as to how many people are here. organizers say about 20,000, but oakland police say it is more like 5,000. nonetheless, there is still a lot of people here enjoying a sunny day at oakland city

hall. since 1999 annette has been a medical marijuana user. it has been instrumental in her therapy. >> i got ran over by a car in 1988. >> prior to her marijuana use, she was on prescription painkillers. now she is one of the attendants. as a nurse, jackson is an advocate of getting the word out on medical marijuana use. >> especially our veterans. they are very afraid. they are challenged when they do decide this is the method of self-medication jie. jackson is also a medical marijuana user. she is one of dozens of exhibiters at this third annual expo. this is the first year it has been held on the front steps of oakland city hall, and organizers say their hope is to make oakland the place to go for pot tourism. >> we have a school and a

museum and a lot of these different businesses that really do cater to the cannabis industry. the smos -- the most important thing to take away is safely consuming the medicine. >> not everybody is happy about the pot fest on the steps of city hall. he is concerned about people lighting up in the city's seat of government, and the message it sends to kids. >> we don't want this in our neighborhoods. they are dumping in the community. >> for linda jackson, her hope is to get as many people using medical marijuana as possible. >> it is feeling relaxed and good. we are not thinking of pulling the trigger. >> now, as big a deal that this is, this is at oakland city hall. it is interesting, we were not permited to take pictures of

people lighting up with city hall in the background. i have been trying to get uh hold of a few people at the mayor's office to explain the rule to me. i haven't been able to. it is a holiday weekend, so i am not going to get word on that until at least tuesday. reporting live in oakland, abc7 news. >> thank you. at this hour, the widow of the man killed at a lab explosion in menlo park said her husband died because of, quote, unsafe surroundings. the blast occurred at the membrane technology and research at willow road in menlo park. fire officials say it was around 4:00 in the afternoon when the explosion ripped through the lab. 56-year-old adrian martin from san jose is said to have been working with a pre gas mixture of methane, helium and nitrogen at the time. co-workers got him outside, but he suffered card -- cardiac arrest and died at the scene. a female woos blown out of the door at the force of the explosion. >> he was transported outside as the hearing and the

eardrum-related issues more than likely from the over pressure from the explosion of the confined area. she did have medical issues, but according to the co-workers, the complaint was minimal. >> the building was ventilated and red taged. that means it is off limits until tuesday when cal-osha begins a full-fledged investigation. the san jose mercury news hopes, quote, martin knew his work was not as safe as it should be. people with plans to hit the beach are being warned about the potential for high surf conditions. the national weather service extended the high surf advisories on the california beaches through sunday night. it is a thrill for surfers at ocean beach, but the big swells can be dangerous. the rough surf was formed in new zealand where it is now winter. high surf forced officials to close two southern california beaches. a spokeswoman for orange county parks says waves damaged a boardwalk and some

steps at capistrano beach in dana point. they crashed on to the parking lot of aliso beach. let's get the latest from leigh glaser. some dangerous conditions out there this holiday. >> absolutely. the advisories are in southern california, no advisories in bait area here. a lot is being generated from what we call the southern hemisphere swell. it is pushing up and affecting our south facing beaches. the potential for a rip current risk and we are looking at marin county and stinson beach, be advised there. and there is around big sur. there is a look at wave heights from as much as three to six feet. four feet in san francisco and six at half moon bay and as well as monterey bay. these swells and the high surf

should start to decrease a bit overnight tonight. we will have another look at our accu-weather forecast coming up. >> and -- and a strong storm engulfed two swimmers and critically 0ed a third. it started in oahu in an area where there are signs posted warning of the strong current. they were walking toward a tiny island when the tide was low. they got cause in the -- caught in the rising tide when they were returning. several rushed to their aid. >> he was yelling there is still somebody out there. there is still somebody out there. that's when the rescue guys came out. >> a woman was survived and was not seriously hurt. they have not released the names of the victims, but say they were stationed at scofield barracks in honolulu. they hit the picket lines at the country club. they were locked out for more than a year. it all began in february of

last year and last week the national labor relations board issued a complaint saying the lockout game illegal last august. a hearing is set for november 7th. the main disagreement is over healthcare benefits and senority. >> we don't feel any security in the job to go back and work that way. that's why we are here. >> castle wood country club management declined to comment today. the bleakest jobs report was feared. the economy could fall back into another recession. numbers released show employers added no net jobs last month. the national unemployment rate stayed at 9.1%. 14 million people are unemployed. and another 11 million are working part-time or want a full time job or have given up looking at all. we reached out to a panel of the brightest economic minds to find out what can be done to create jobs in this country. dan harris reports.

>> it is a moment of fear. it is peril less juncture for america. >> the worst jobless report in years. >> it is bad and worse than expected. >> how can we fix things? here are ideas from our panel of experts. idea number one, washington needs to end the partisan bickering. something the president eluded to in his weekly address this morning. >> there is a lot of talk in washington about creating jobs. it doesn't help when those folks risk losing hundreds of thousands of jobs because of political gamesmanships. >> they won't hire until both sides sit down and craft a long-term plan on taxes and spending. >> suppose you are playing on the field and you don't know what the rules are. the game becomes very confusing. at some point you say i am going to the sideline. >> after the jobs numbers came out, they unleashed a blizzard of releases blaming the other

party. not a good sign. idea number two, restrain workers. those who lost their jobs in construction, real estate and retail need to be given new skills for industries that are hiring like healthcare and high-tech. joy it is the program that can transition people through this difficult time, of at least getting a paycheck instead of a fast-food paycheck. >> idea number three comes from the u.s. chamber of commerce say figure they allow drilling in the gulf of mexico it would create 200,000 jobs. that is cobts verse sal after last -- controversial after the oil leak last year. >> and the next idea comes from the other side of the spectrum that congress should support the president's plan of extending unemployment benefits that are about to expire. and idea number five comes from the man who runspimco services. they need to hire a few extra level workers.

it can give employers flexibility when it comes to covering vacation and retirement. >> we hire people, and what we have found is that happens us tremendously. >> president obama will address a joint session of coming next thursday about his new jobs plan. we will air the speech here on abc7. you can see is live at 4:00 p.m. the man who lost his job due to a sexual assault case and maybe the president of france is changing addresses. dom niece strauss-kahn walked through media with a half dozen pieces of luggage. he and his daughter headed for the airport where they were joined by strauss-kahn's wife at the air france terminal. strauss-kahn's the front-runner for the presidency was arrested in may on charges of assaulting a hotel maid in new york. prosecutors dropped it saying they no longer trusted the may. a bay area rocker is booted off a flight.

has resolved an incident involving green day front man who was kicked off a southwest airlines flight for wearing baggy pants. he sent this tweet, "just got kicked off a southwest flight because my pants saged too low. no joke." armstrong was trying to fly from oakland to burbank. 7 life producer was on the flight and witnessed the whole

thing. >> a flight attendant approaches him and says, "pull your pants up" and so he said," don't you have better things to do than worry about that? ". when the flight attendant said again "pull your pants up or you are coming off the plane." >> southwest spokesman released a statement saying, "we reached out to apologize. we followed up and understand from the customer the situation resolved to his satisfaction." end quote. armstrong was allowed on the next flight to burbank and he had no further complaints. this past june a you university of new mexico football player was arrested at sfo when he allegedly refused a u.s. airway's attendant to pull up his low riding pants. he was arrested for resisting arrest and trespassing and for refusing to leave the plane. the san mateo county district attorney though refused to bring charges. facing a tuesday deadline, residents outside menlo park have submitted a plan to save

the granny tree. some say the olympic oak stands in the way of progress. the utility district is laying a pipeline. last may the neighbors objected to the district plans to chop down the granny tree. instead they want construction fews to tunnel under granny so she can survive. that adds $200,000 to the project that could only be justified if a public benefit were created, thus the tiny park proposal to be reviewed by san mateo county officials. tomorrow is expected to be the last day of business for a family that has run a concession stand at golden gate park stow lake for 26 years. bruce mccleland is closing up shop on monday and will be out on september 15th to make way for a new operator. mccleland's lease for the waterfront property expired and the city approved a new vendor. ortega family interest prizes out of nevada promises to

upgrade the boating and refresh meant stand when it takes over operations. mccleland has a lawsuit pending. in the suit he teex to maintain the business. he says the awarding of the new contract was not fair. leigh glaser is back with another look at the forecast. >> a nice day as we extend into our holiday labor day weekend. outside we go and you can see from the high definition cam, the fog is starting to make it over the bay. on the east bay, you can barely see the mountain way, way in the background there. they are enjoying clear skies and maybe even warm temperatures. antioch is 92. we had 88 in fairfield and novato 81. 62 in san francisco. half moon bay is 60. 81 los gatos and clear sky and 76 degrees. we will go with areas of dense fog over the cost and the bay. gradually cooling as we head through this weekend. it is tomorrow right through the holiday monday. and then after that, it looks

like we will have a couple of days where the temperatures will warm back up. you can see the wall or the deck of fog sitting off the coast. stronger onshore wind component will move that overnight. be advised of that. it will hang toward santa cruz and ocean beach and point reyes by tomorrow morning. the temperatures will keep most locations in the 50s a bit warmer though. the extreme east bay locations , and temperatures in the interest 90s and you will get in the mid to low 60s. higher pressure will be in charge for a couple more days, and that's definitely going to mean a little change in the forecast. we may shave a few temperatures or a few degrees off tomorrow as we get into a stronger onshore wind component. a cooler sea breeze for us. and then we will start to warm things up as we head into the middle of next week. highs for your sunday. 80 for san hoe sais. cupertino 79 degrees.

we will look for morning overcast, 60 pacifica and palo alto, afternoon sunshine. san francisco is 66 tomorrow afternoon, and in the north bay, we will look for 80s there. 82 for santa rosa. we will get warm to hot toward ukiah. 80 for sonoma and napa 78. look for the morning overcast on the east bay with oakland warming up to 73 degrees tomorrow afternoon. you will see some afternoon sunshine there. 77 for castro valley. interior east bay, upper 80s to low 90s with 90 from brentwood and antioch. 70 tomorrow for santa cruz and the further east you go, things will warm up to 90 degrees for gill roi. here is looking ahead. the accu-weather seven-day forecast, right on in through labor day, monday, the temperatures are inland. the upper 80s around the bay and in the 70s. 60s at the coast and then we will have a brief warm up on tuesday and wednesday. back into the 90s inland and then cool things back down for next weekend.

evacuated. the center of the storm is about 55 miles south of lafayette, louisiana. lee has one city in particular on edge. abc's yunji de nies is in new orleans. >> churning surf, whipping winds and drenching rain announces that lee had arrived. >> it looked like it is gonna be rough. >> tropical storm lee is unloading on louisiana, bringing new orleans just what it fears most, water. it was six years ago almost to the day that hurricane katrina swamped this city. now this is new orleans' prime line of defense. dozens of pumping stations that can drain 19 million gallons of water a minute, fast enough to empty an olympic-sized swimming pool in one second. that's not a second too soon. new orleans is perched precariously between lake pontchartrain and the mississippi river. the pumps could be hard-pressed to bail out the big easy. >> this storm is moving

painfully slow. the greatest risk for us is to get a lot of rain in a short period of time. >> all along the gulf coast, people are packing up and getting out of lee's way. residents picked up shovels and turned the sandbags from their doors. they stoakd up on bread, water and eggs, everyday staples that could turn into emergency provisions. for those in low-lying areas, safety means finding the higher and dryer. >> katrina was real bad. i don't want to be another victim of that. >> in addition to the constant rain, we have been experiencing heavy winds with gusts up to 60 miles an hour. these severe conditions are expected to last through sunday. abc news, new orleans. let's get the latest on the storm's slow march northward from leigh glaser. leigh? >> overnight tropical storm lee just really exploded. a lot of moisture associated

with this. it is just at a snail's pace moving to the north at four miles per hour. wind gusts to 60 miles an hour. let's step out a little and you can see on live doppler 7hd all of the wrap around bands, the feeder bands moving in toward new orleans and now moving to montgomery, alabama, and jackson, mississippi and shreveport, and all of this will continue to move slowly to the north and to the east overnight. rainfall potential, we are talking quite a bit over the next couple days as lee moves very slowly to the north, 10 to 15 inches of rainfall expected from this tropical feature as it continues to of move on through the gulf. no rain in the local forecast, but mild temperatures when we come up. >> all evacuation orders are now lifted in southern california where residents of homes threatened by a wildfire are now moving back. the fire broke out yesterday

afternoon on the main artery between los angeles and vegas in the cajon pass. the flames quickly chewed up about two square miles of brush forcing a labor day weekend packed interstate 15 to close for hours. about 1500 homes were evacuated. the fire is now 60% contain -- contained. full containment is scheduled for tomorrow night ?ie. california could be home to two new indian casinos, but some tribes are not happy. the north fork rancheria is proposing a new casino north of fresno, while the enterprise ranceria wants to build one 40 miles north of sack safnlght both would be located off reservation land. we go to sacramento for more on the debate. >> this land is where the federal government just gave the enterprise ranche ry a permission to build a casino. >> this is something due to our tribe and yuba county.

>> but some call it reservation shopping. it would be built on 40 acres in yuba county, closer to the busy metro area. >> we were supposed to be on the charter land. that's not the case here. >> thunder valley casino doesn't like it either. the feds' decision will open the door for tribes to build casinos wherever they want. the yuba county board of supervisors are on board supporting the casino, even though in 2005 the yuba county voters said no to it. >> honestly the voters and the constituents in my district are clearly not in favor of the caw seen foe either. >> unemployment in the county is running close to 20%. the casino could bring in more than 4,000 permanent and temporary jobs. it would pump $200 million a year into the local economy and $5 million a year to marysville to pay for safety, education and other public

programs. >> we plan to be a great neighbor. >> that was dale shornack reporting. they now need approval from the governor and lawmakers. the governor will review the plans in the months ahead, and he has one year to decide. san francisco police are now looking for a hit-and-run driver who injured a pedestrian last night in the south of market area. the police say the pedestrian was struck by a car at harris and hawthorne streets around 10:30. but the driver sped away. the car likely has front end damage and the victim was rushed to a local hospital with serious injuries. accused cereal killer joseph naso has given up the right to defend himself. he will now get a public defender's help. he faces charges in the murders of four northern california women from 1977 to 1994. he represented himself until yesterday when the judge ruled a defense attorney is required by law because he faces a

possible death sentence if convicted it. the judge also pushed back next tuesday's evidence hearing until october to give the public defender time to prepare. if he can afford it, he will also pay the cost of his defense. in libya, the rebel fighters have started closing in on one of qaddafi's last strongholds without encountering resistance. as the rebel officials advance on the town, they said they are still trying to persuade tribal elders there to surrender without a fight. the rebel commander says the town has been given until sunday to surrender. he remains on the run and some officials think he may be in that town. a representative arrived for talks at the national transitional council on that country's future. the u.n special representative says he will report back to the organization on libya's expectations for the future assistance. >> i am here now to discuss with the national transition

council how the united nations can be most helpful in the future. we have had that discussion already. >> the world leaders have vowed to free up billions of dollars in frozen assets and we have offered to help libya rebuild while stressing it is the libyan people themselves who must take the lead as they establish a new government. good for the environment and bad for the economy. up next, historic legislation would virtually ban styrofoam food containers in the state. some employers say it could lead to layoffs. that story when a good night's sleep.

textbooks across the nation. the cupertino-based apple official say they know more than 600 districts that have launched one to one programs in which at least one classroom of students are getting ipads for each student to use during the school day. two-thirds of these one to one programs have begun since july. it cost districts between $500 and $600 each. they estimate they spend at least that much each year on textbooks and other tools for students. but some experts watching the trend warn that the districts need to ensure they can support the wireless infrastructure. california could become the first state in the nation to ban styrofoam food containers. there is a proposed bill to put the ban in affect starting in 2016. our capital correspondent has this story from sacramento. >> the styrofoam containers from to go orders and leftovers are convenient.

they are sturdy and keep food warm. but environmental lists say it is a big headache littering beaches and waterways. they say the styrofoam containers have overtaken the cigarette butts as the number one item collected at trash pick up events in california's coastal communities. >> it never breaks down. it is not compostable. it is not biodegradable. it lasts forever. >> they want to pass legislation that would ban styrofoam food containers in the state, the first to do so. they say 50 cities and counties already use greener containers and the ban must be implemented statewide for the sake of tourism. >> people come to the state because they love the beauty. if we are now engaged in a program to pollute this thing, they are going to lose that. >> joe thompson owns the gold rush grill and says 70% is to go. he worries about them pushing

over to more environmentally friendly containers. it costs double at $53 a case. >> what happens to me is i have to layoff a part-time employee or i have to take a full time employee to part-time. >> the customers are split over the issue. many like the alternative to styrofoam. >> i don't know if you can even recycle these. what do you do with styrofoam after it is gone? >> but if it is going to cost jobs, that's another story. >> the public health groups and the chemical industry are also at odds over this bill. foam containers can release a carcinogen that under certain circumstances. but critics say the risk is low. in sacramento, nannette miranda, abc7 news. unsports man like conduct caught on tape. a referee is attacked during a youth football game. what he is saying about that violent confrontation.

the federal agency that oversees mortgage giants fannie mae and freddy mac filed a lawsuit against bank of america. the bank is one of the several agencies accused of misrepresenting the quality of mortgage securities and inflating borrowers' incomes. lyndsay sheldon reports from north carolina where the bank is based. >> there is a lot of uncertainty as to how bad off b of a is at the end of the day. >> this economist says there is no doubt bank of america is facing more tough times. some experts say a lawsuit could hurt people needing loans to run small businesses. >> they have concerns about capital requirements. >> they say the lawsuit which targets more than a dozen banks could also hurt the already fragile economy. >> when they can't win economic activity contracts. >> the lawsuit says the banks misrepresented the value of mortgage securities. they sold to fannie mae and freddy mac. both mortgage giants lost

billions. they defaulted on their mortgages and they were picked up by taxpayers. still he says he believes b of a will find a way to weather this storm the way it has dealt with other lawsuits and concerns in the past year. >> b of a is not going to go away. it is not going to get taken over by somebody else. >> that was lyndsay sheldon reporting from charlotte. just last month billionaire warren buffet single handedly bailed out bank of america taking out a $5 billion stake in that company. a new twist in the saga of the lost iphone 5 prototype. they first reported that the phone went missing at this mission district bar. a source says the phone's signal was traced to a san francisco home. after initially denying the officers were involved, the sfpd says four plain clothed officers did accompany apple security to a home on anderson street. according to police, two apple security officers went inside the house, and did not find the phone. apple would not comment on all

of this. feel free to do a little fishing in california, even though you don't have a driver's it is the second dwai of the two free fishing days of the year, july 2nd was the first free day. today people can try their hand at fishing without having to buy a sport fishing license. all other days it will be in affect and wardens will enforce them. it will provide people a low cost way of giving fishing a try. >> that's fun. >> head out to your local fishing hole. nice day for it. >> yes. let's go out and look at the high definition camera, and you can see from this vantage point that the low clouds and the fog are moving back inland right now. and it will spread inland and over the bay overnight tonight. it has been a nice day, hasn't it? 90s inland and 92 right now in antioch. we have 74 in napa and 62 right now in san francisco.

half moon bay has the stubborn fog and the low clouds much of the day. 60 degrees now and 76 in san jose. here are our weather highlights. you can expect the fog to venture back inland tonight. gradually cooler as we head to the rest of the holiday weekend, and then we will bump up temperature as we head into the middle of next week. here is a look at our fog cast for this evening. it banked upright near the cost, and throughout the course of tonight it will just spread inland. mainly the cost and the bay. out toward the delta you will be clear overnight tonight. and of course that will translate to some mild temperatures. antioch 61. 53 for vallejo. 54 and 52 for half moon bay. the higher appreciate cert set up for the next couple days. as the high does build in over the bay area, it will bring us a stronger onshore wind flow. there are westerly winds that

will pick up tomorrow anywhere from 10 to 20 miles per hour, especially near the coast. a cooler air mass will venture over the bay area. the temperatures will come down slightly tomorrow, but still it will be a really pleasant, pleasant day. here is a look at your highs. 79 for santa clara and 80 for san hoe sai. at our beaches you start off overcast and a little mist and drizzle tomorrow morning. and then some of that fog will start to burn back. a little off the coast in some locations. half moon bay 62 and we are looking for sunshine tomorrow afternoon and palo alto 75. san francisco 66 degrees tomorrow. in the north bay -- really in the north bay, extreme northern locations ukiah and clear lake will make it into the 90s. 75 and comfortable for napa. oakland is 73 and 73 for hayward. 78 for fremont and the interior east bay a bit on the warm side. 87 for concord and danville and 90 for brentwood and antioch. very comfortable numbers. watsonville at 72.
