morning, september 4th, deputies are in a standoff with an armed man who barricaded himself in his apartment building last night. and tropical storm lee is now over the southern coast of louisiana. heavy rains could cause extensive flooding. >> good morning. back home, more fog this morning that's traveled across the east bay into some of the east bay valleys. plus, if you wait a little bit longer on the sun today and slightly cooler temperatures. >> thank you, lisa. thanks for joining us. i'm carolyn tyler. a tense standoff continues in el selbrante it morning. a 43-year-old man is surrounded by contra costa sheriff's deputy. the standoff began last night around 7:00 when deputies were

called about a man beating a woman. thirty minutes later the suspect released a woman and three children from the apartment. around 10:30 police say the suspect fired shots. no one outside was injured. a sheriff's negotiator has been talking with the man trying to convince him to surrender peacefully. automated phone calls to neighbors advise them to stay inside, lock the doors and windows until this situation is resolved. we will keep you posted on any developments. >> this morning thousands of people in louisiana and mississippi are without power. he's because of tropical storm lee. the storm has weakened but its winds and rain continue to pelt the coast. and louisiana's governor has already declared a state of emergency in ten parishes. >> tropical storm lee is taking its time moving through the northern gulf coast. the heavy rain bands and strong

winds drenching parts of louisiana and mississippi. >> we are expecting 15 to 20 inches of rain nears rainiers -- in the new orleans region as a result of the tropical storm, and as all of us who have been through this know, it's not how much we get, but it's how much we get in a short period of time. >> it was six years ago almost to the day that hurricane katrina swamped the crescent city when the levies failed. now this is new orleans prime defense. breaks in the rain have allowed the pump stations to keep up with the water. some areas are washed out but flooding has been sporadic. tens of thousands have lost power. all along the coast people are packing up and leaving low-lying areas. residents shoveled and stuffed sandbags. >> i am doing this to prevent it just in case it decides to flood. >> and are hoping their efforts will pay off. lee will slowly make its way across the southeast and head north. chuck severson, abc news. >> for the latest on the path of that storm let's check in with our meteorologist, lisa, with the latest. >> hello. good morning, everyone.

we are looking at winds of 45 miles an hour. the tropical storm lee has been very sluggish and it continues to meander just to the north. this will be impacting with a funnel band to enhance the rainfall from the areas that have seen a lot of rain since irene. we have problems in the north. the tennessee valley already 2 to 6 inches through parts of the south. talking parts of alabama, mississippi, florida and already looking at some flash flatting in parts of louisiana. but we will be looking at the totals of 15 inches throughout the day in in and the actual cer of lee will continue to move up through south central louisiana today. you can see the heavy rain bands moving up through i10, through atlanta and right here the low-lying areas. so some dangerous conditions there. not out of the woods yet. some changes to our local weather forecast for the holidays, those are coming up in a little bit. >> thank you, lisa. here at home we have some powerful surf. although it's diminishing somewhat today. beach goers should be cautious

about dangerous rip tides throughout the holiday weekend. california south-facing beaches have been getting hit by waves coming all the way from the southern hemisphere. the newport beach video that you are seeing here shows a famous body surfing spot known as the wedge. big crowds have been watching expert swimmers take a pounding this weekend. abc7's news looks at conditions here in the bay area. >> reporter: the waves are breaking about big here the mirin county stinson beach. the surfers weren't used to riding waves this big or strong. ben was surprised to see this kind of action. >> i wasn't expecting it to get as big as it is but it is about shoulders. some guys just got tubed a few minutes ago. pretty nice here at stinson. >> long time stinson visitor, steve, is still amazed. >> the biggest waves i've seen and i've been coming out here 15, 25 years maybe. >> the life guard said the waves have come in as high as 10 feet high the last few days.

>> anywhere between three and six feet. the face of the wave can be maybe a little larger, up to seven feet. >> while this is great for many surfers, it can be lethal for swimmers who brave the water. the water is 589 degrees. this is remnants of a storm off new zealand last week. it is arriving at the california coast in time of the big weekend. the waves don't come in consecutively. the danger is there is sometimes a gap of 10 to 20 minutes before another big set comes in. >> if somebody sees it looks reasonably calm they will try to make their way far out beyond the break. if a big set comes in when they are out there they can be in danger because they aren't sure it's coming. >> that can surprise the strongest swimmer. rip tides also can accompany them. >> she said her surfer husband doesn't want to miss this. >> we hear the waves will calm down so we will be out here. there is no longer a high surf

advisory, but people be being cautioned if they are bogey to go into the ocean this labor day weekend, there might be some dangerous rip tides. in pacifica, abc7 news. in oakland police are investigating that city's 80th homicide of the year. it is way ahead of last year's numbers. it happened just after 3:00 yesterday afternoon in east oakland. a man was found shot to death in the 2600 block of 74th avenue. that's just off bancroft avenue. police have not released any information about the victim. last year at this time oakland had 60 homicides. the widow of the man killed in a menlo park lab explosion said he died because, quote, a stupid gas system wouldn't work. the blast happened at the membrane technology and research company in menlo park. the 58-year-old man went into cardiac arrest after he was pulled out of the building. fire officials claim martin was transferring a mixture of gases

from one cylinder to another when the blast occurred. that building is now red tagged. cal osha will ten its investigation on tuesday. thousands of people are expected to turn out for the second day today for the third annual international cannabis and hemp expo, which, for the first time, is being held directly in front of oakland city hall. oakland has a long history of supporting medical mariner, but some residents still object to what they see as the city's endorsement of the drug. >> reporter: since 1999, lynette middleton has been a mlb mariner user. she said it's been instrumental in her therapy. >> i got run over by a car in 1988. it helps with the pain. >> prior to her mariner use, -- prior to her marijuana use, lynette was on prescription painkillers. now she's one of the attendants another this marijuana tent.

as a nurse jackson is an advocate about getting the word out about legal marijuana use. >> especially our elders, retirees, veterans. they are very afraid because their moneys are challenged when they decide this is the mode and method of self medication. >> jackson is also a mlb marijuanalp user. she's one of dozens of exhibitors at the third annual cannabis and hemp expo. it's the first year it's held on the front steps of oakland city hall, and their hope is to make oakland the place to go in the world for pot tourism. >> oakland was the first place of proposition 19. we have a school and a museum and a lot of these different businesses that really do cater to the cannabis industry. but the most important thing they take away, we try to stress how to safely consume the medicine. >> not everybody is happy about it." charles o'neil is with the coalition for a drug free california. he's concerned about people lighting you have in the feet of government and the message it sends to kids. >> in the 50s and 60s we said we don't want this in our

neighborhood because we know the effects of the man bringing it in and dumping it into the community. why aren't we saying this today? >> we will have so much more harmony going on than hate and pull the trigger because we are feeling relaxed and good. we aren't thinking about pulling the trigger. >> as big as this festival is, we have a rule we can't shoot pictures or video of people lighting up with the city hall building in the background. i've been trying to get some details on that rule from anyone at the mayor's office. i likely won't get that until after the holiday weekend is over. at oakland city hall, abc7 news. >> pg&e crews are out working this weekend conducting state mandated pressure tests on its natural gas pipeline system. today they are going to vent

natural gas from a pipeline system in oakland. some residents may smell natural gas odors during the procedure. they have notified affected homes and businesses by telephone today. pg&e said the gas should safely dissipate in the atmosphere. in sunyvale a different gas line section will be filled with water and tested for leaks under higher than normal pressure. >> coming up next, indian gaming centers into urban centers with new new casinos could be located and the last hurdle before we can be built. >> it soon should be easier to catch a cab in san francisco, but

build the casinos. both would be off tribal land and that's causing a difference of opinion. >> this is something that is due to our tribe and is due to the county. >> i thought gambling was supposed to be on tribal land. that's not the case here. >> supporters claim it would bring more than 4,000 permanent jobs to uba county, which has an unemployment rate of nearly 20%. governor brown and lawmakers must still approve the proposals. >> cab fares are about to go up to san francisco starting tomorrow. the flag drop rate, from the moment the meter starts, is going to increase by 45 cents to $3.55. in addition, meter rates will be raised by 50 cents a file and it will cost ten cents more for every minute you are stuck in traffic. it might be easier to hail a cab. 87 new taxis will be on the streets. that's a six percent increase to the city's fleet.

hemisphere swell allowing for the rip currents to be a risk all up and down the coastline, from twin lakes state beach and down around the big sur coast and miran county. be careful if you are headed out today. we have an upper level system today and that's allowing the higher pressure to relax a a little bit and the stronger onshore push. it's allowed the marine layer to deepen from 1500 feet to 1700 feet and just muff to allow for some cooling today. knocking the temperatures out from the 90s and the south bay also coming out of the upper 80s. elsewhere, into the central region of the state we are still warm. 98 fresno. los angeles not too bad at 80. 95 in sacramento with low 90s in yosemite. the fog really going nowhere, staying with us from the north coast into san diego today. back home we will talk about numbers coming down a good five degrees from sunny sale to campbell.

>> welcome back. california could become the first state in the nation to ban styrofoam food containers. there's a proposed bill to put that ban into effect starting in 2016. capital correspondent annette has the story from sacramento. >> the styrofoam con tanners for to-go orders and convenient are convenient.

they are sturdy and keep food warm. but environmentalists say they are a big headache, littering beaches and water ways. they say styrofoam containers have now overtaken cigarette butts as the number one item collected in the california coast community. >> it's not biodegradable, it lasts forever. state senator alyn is on the verge of passing historic legislation that will ban styrofoam food containers in the state. the first in the country to do so. they say communities that recycle at least 60% of the containers are exempt. the long beach democrat said 60 cities and counties already use greener containers and the ban must be implemented statewide for tourism. >> people come to the state because they love the beauty. if we are engaged in a program to pollute the state, we will lose that. >> joe owns the gold rush grill. since 70% of his business is to go, he worries about the expense

of pushing over to more environment tale green containers. he said they cost double at $53 a case. >> what happens to me, you have to lay off a part-time employee or take a full-time employee to part-time. >> his customers are split over the issues. many like the alternatives to styrofoam. >> people don't dispose of them properly. i don't know if you can even recycle them. what do you do with styrofoam when it's gone. >> but if it's going to cost jobs, that's another story. >> i think it's too much. i think it's fine how it is. >> public health groups and the chemical industry are also at odds over the bill. foam containers can release a carcinogen called styrene under certain circumstances, but critics say the risk is low. abc7 news. >> san francisco controversial twitter tax break designed to sure companies to a blighted stretch of market street went into effect in april. the first company to take

advantage of that relief on payroll taxes has moved in. >> one, two, three, there you go. >> most people call it the twitter tax break because they were the ones behind the deal. but zen desk is actually first to take advantage of a city-sponsored money break by setting up shop in the down-and-out mid-market corridor. the high-tech firm has moved it's 100 employees from another san francisco location just a few blocks away. it exchange, the company gets a six-year exemption of the 1 1/2% payroll tax for new employees. >> the payroll tax exclusion for this neighborhood is a great example of why san francisco is such an amazing place to grow a business. >> they plan to hire 70 more employees by the end of the year and expand its space to 35,000 square feet. that's what supporters of the tax break are counting on to help the blighted neighborhood blossom. >> it's a huge contribution to what we are trying to do in central market. >> but some voted against it.

>> it's not fair to all the other businesses, i believe, in san francisco who don't get that. >> he's running for mayor as our current mayor, ed lee, and supervisor, david chu they agree the tax system needs some kind of overhaul. >> the payroll tax system has been a huge drag and it's literally why we've lost tens of thousands of employees in recent years and hundreds of companies in recent years. >> next month some city lawmakers and business leaders are going to start talks about making changes to the city's tax structure. in the meantime zen desk says they are happy to move to mid-market. >> if you are on market street today you know the drill. jacket. you don't need the sunglasses. it's been cool. numbers have reached the mid-60s in the afternoon in the city. but no sun. we are looking at the clouds right now. dense fog at the coast. a cooler couple of days and then a warmer couple of days. we will look at it all coming up. >> thank you, lisa. also ahead, the crime fighting

>> twin peaks boulevard is a thrill ride. people meet each other side by side, taking in the views and taking chances. there are a lot of blind spots along the way. >> if i'm coming down here in a car or on my bike and there's a jogger going up the other direction, i'm not going to be able to see him until the last minute. >> dave walks or bikes here almost every day. he says the overgrown plants along the sharp ends are out of control. >> i don't want anybody getting hurt, especially if its me. >> we drove it ourselves and saw firsthand how the bushes had grown into the streets, blocking lanes, and how easily you can have a near miss and how bikers, like peter, are pushed dangerously into the median. >> one time i was almost sideswiped by one of these beg tour buses that i think wasn't paying attention. >> we stopped to speak with tannen. it was only minutes before we saw another tight squeeze. >> here is one of the tour buses i was talking about. there's a pedestrian, and you can see how close they are going to come. he's going to have to go all the way around.

but if that pedestrian were just on the other side he probably wouldn't have seen him and could have hit him. >> we called the city to see who is responsible. at first they weren't sure but after some digging they found out. it's watershed land that last year was turned over to the public utilities jurisdiction. -- the commission. with jurisdiction established, the puc stepped up. >> i went to see what was up there and you could see it was definitely a hazard to joggers and bicyclists. >> the puc manager, don, said it went to the top of his list. he immediately dispatched a crew. >> they went up there and attacked that with everything from hedge trimmers to backhoe to get the vegetation off the road. even though some got poison oak, they didn't hesitate to go up there and do what needed to be done. >> and we went back too, where we saw one of the near misses. here's the before and the after. now it's cut all the way back and you can see all the way up the street now. before it was completely blocked. this is much safer. >> and the other blind turn also

out by the delta. but the southwest winds are blowing and transporting the cooler air inland. the warmup you had yesterday, the 90s coming down to the 80 eats in the inland valleys. anders where definitely feeling the effect of the stratus, that's put the lid on the atmosphere this morning. 51 napa. take a look at the clock. you will notice still foggy in the east bay. livermore pulling back to 10:00, 11:00. we have a finger of fog that wants to sit over the bay. we should see sunshine about an hour later in the south bay today. look at the fog still hanging tough. so the mist, drizzle and fog this morning, and a little cooler today and tomorrow two to four degrees cooler. then we have a significant warmup coming tuesday and wednesday. a little fog is going to linger at the coast. thursday begins a little bit of cooler weather around the bay. still holding on to some 90s inland. the southerly swell we've been talking about that's unusual this time of year, combined with

a little bit of a northwesterly push, allowing for a good rip current risk from santa cruz, and big sur, stinson beach. a lot of folks out yesterday and today. >> with the holiday. and be careful. things aren't going to change soon with the threat of the big waves there. we are looking at an area of low pressure and relaxing the high a little bit. as it does, that allows for the marine layer to influence its cooler air, the breezier conditions across the bay stretching inland. but that's about it. we will get out war the delta and we will feel the cooling, the inland east bay and tomorrow as well. the rest of the state we are still looking warm, quite warm. 91 yosemite. palm springs no changes there, 112. los angeles comfortable at 80. back home numbers will be cooler today. you will feel it with the sun a little later today. still nice, santa clara 79. 84 here and 80 san jose.

next weekend so keeping it very interesting every couple of days. >> yeah, and i see it's always on the weekend that it gets cool. >> ah-ha. >> all right. well, how do you know that you are getting what you paid for when you buy seafood? a lot of times you don't so the food and drug administration is hoping to use dna technology to identify the species that enter this country. recently some san francisco researchers went on a fishing expedition in the philippines. abc7 news was the only television station to go along. here's dan ashley with this morning's assignment 7 report. kent carpenter and jeff williams are shopping for fish. they aren't looking for a good price or even the best tasting fish. what they want is variety. >> the filipinos eat every species of fish, even small ones. >> this market is in a city in the central philippines. this is where the locals shop. >> it's a lot of fish, a lot of odor. a lot of slime, as well.

>> he is a fellow with the california academy of sciences in san francisco. jeff is with the smithsonian in washington, d.c. these guys know their fish. >> this is a species that i know. >> but even for experts, sometimes it's tough to tell one kind of fish from another, especially if it's cut up. >> 70% of the fish sold in the united states is imported. most of it is labeled correctly, but the food and drug administration has found many cases where it is not. the fda is helping to create a dna data base for fish to identify what's what. >> this is something important for food security both in the united states and the philippines. >> unscrupulous exporters sometimes substitute cheap fish for expensive ones. even worse, poisonous species, like this puffer fish, are

sometimes mislabeled and people who eat it get very sick. >> that did happen within the last few years. a large quantity of puffer fish specimens were sold at monk fish in the u.s. >> jeff and kent spent three weeks searching for fish. >> the fish markets in the philippines has some of the highest diversity in the world. >> this was a good day. >> we collected from 80 to 100 species. >> they take the fish to a make-shift lab to process while it is still fresh. >> a very long day. we've been doing 16, 18 hour days. >> each fish is suspended in a tank and photographed before its original color fades. the fish is preserved and scientists take a tissue sample. those samples are sent to a lab lake this one at the academy of sighens in golden gate park. it takes a couple days to treat them, run them through a genetic analyzer and get a dna sequence. then researchers look at one specific gene, believed to be unique to every species. >> you scroll along and see the sequence. >> this separates the perch from the snapper. they hope to use it in the future to spot check fish coming into the country. on this trip they collected

this frigidaire model. however, there was a little catch. >> the rebate was good for only 30 days. i called and they said don't worry about it. >> she had to mail in the rebate form, complete with serial number within 30 days of her purchase. but as the october 6th deadline approached, homeeverything hadn't delivered the fridge. >> i was getting worried. it's a lot of money. they said send it in without the serial number. >> so she did, but without the number her rebate was rejected and her time ran out. karen didn't receive her refrigerator until november 12th, a whole month after the rebate deadline. not only that, but frigidaire told her the refrigerator she got wasn't even manufactured until october when the rebate was already expired. here the date is printed inside the unit. furious, she called homeeverything. >> if you knew it would expire

october 6th, and my refrigerator wasn't made until the end of october, something is wrong. >> karen demanded her 20% rebate, worth $287. homeeverything offered only a store credit that karen didn't want. >> then my e-mail started being sent back to me undeliverable. >> so karen contacted 7 on your side and we found 243 complaints filed with the better business bureau against homeeverything. many for late deliveries. we contacted the company and it tells us if a late delivery cause as customer to lose a rebate, we will take care of them. we offer a store credit or a refund. and homeeverything agreed to give karen her 20% rebate. $287 in all. >> thank you. i don't know how to thank you enough. >> if you purchased an item based on a rebate offer, make sure you read all the rules and conditions to decide if it's actually worth your time. if you are still frustrated, let me know about it.
