11:36 pm
where she went and what she did in the company of a man she met online, a man who is now behind bars. here's abc's matt gutman for our series "crime and punishment." >> reporter: nearly seven weeks since robyn gardner disappeared from this idyllic beach, investigators work to re-create the nightmare step by step from the moment gardner and her companion, gary giordano, arrive to his shirtless dash for help as seen in this surveillance video. through this evening's reconstruction of gardner's august 2nd disappearance, police hoped to piece together the jigsaw of evidence they have into a picture that could do two things. reveal what happened to gardner, missing but not ruled dead, and determine whether a crime was committed on this beach. they can now identify less than a two-hour period and try to re-create exactly where they were at about 4:12 p.m. and then
11:37 pm
put him back at about 6:00 p.m. and say, is everything that he said happened possible? >> reporter: with tight security, the reconstruction included painstaking attention to detail. police officers acted the role of gardner and giordano going on what they saw in these surveillance videos and bearing a remarkable resemblance to the real couple. the one that arrived on this resort island on july 31st, more sex partners than lovers according to multiple sources. and the night they arrived they partied taking these photos obtained exclusively by abc news. two days later giordano and gardner went to the rum reef restaurant a stone's throw from the water. a server snapped these pictures of the couple leaving the restaurant. it was the last time gardner was photographed. giordano would later tell police his partner drowned while snorkeling but he was arrested three days later as he tried to
11:38 pm
leave the island. and so far he has not been charged with any crime. this evening about 30 police officers and detectives set up barricades and walked through a version of the events on august 2nd. the gardner character wearing nearly the same ankle-length sundress robyn gardner wore the day she disappeared and giordano's character wearing nearly the same outfit he wore that day. they asked gary giordano to participant but he has declined. the re-enactment begins with the couple parking the rented rav4 outside the rum reef restaurant. they get out. and an eyewitness points to where they might have been seen. then gardner and giordano drive around back to the jetty and it's here giordano and gardner allegedly went snorkeling. at first he claims she cut her foot on one of these rocks. they both go back out and then finally head back into the water. the current becomes too strong. he says he taps her foot to tell her to come in. he never sees her again. and then the re-enactment has
11:39 pm
giordano jogging back to the restaurant. so according to giordano's version of the tale, he comes rushing down this pathway, robyn having just disappeared in the water a few minutes later, tries to bang on the shutters and doors of the restaurant. someone answers him. they call the police, 20 minutes later the police arrive but it's that surveillance video that leaves so much room for interpretation. as opposed to the re-enactment this surveillance video obtained by abc news shows giordano walking, not running, something investigators have deemed suspicious for a man who just lost his companion. >> the fundamental question is going to be even though they have a lot of reasons to suspect him, are they going to have enough to actually take him to trial? >> reporter: but after the fallout following natalee holloway's disappearance in 2005 which crippled tourism here, aruban authorities are under tremendous pressure to press charges in this case.
11:40 pm
jose baez led the defense team that saw casey anthony acquitted in the murder trial of her daughter, and defended his new client on "the view" today. >> the basis of it all is just mere suspicion. he -- i also believe that the natalee holloway is playing a political aspect in this investigation. >> reporter: but ultimately investigators tell abc news it was impossible to fully re-create the conditions of august 2nd. investigators have been bedeviled by a lack of hard evidence and sluggish pace of forensic work. abc news has learned that due to budget cuts, critical forensic evidence like robyn gardner's ipad and blood found at the beach were only sent for analysis a full month after gardner disappeared. >> if they can show that according to their re-enactment there's no way all these things could have happened, it's at the very least a good argument to make to a court. >> reporter: there's a chance giordano will never have to
11:41 pm
answer those tough questions in a courtroom. for "nightline," i'm matt gutman, in aruba. >> gary giordano maintains his innocence in the case, one we will of course continue to follow. just ahead, he is the most talked about contestant on "dancing with the stars." chaz bono talks to me fresh from the dance floor tonight.
