>> richmond less are looking for a driver that killed a disabled man in a hit-and-run accident. >> good morning, plenty of clouds. it's mild this morning but we will have a cooler afternoon and maybe a few showers sod. >> thank, you lisa. good morning. thanks for joining us. i'm carolyn taylor. parents know which schools are on the chopping block this year. sergio reports on the schools slated to close and those that dodged a bullet. >> reporter: parents at kaiser elementary school in oakland hills are breathing a sigh of relief. >> the list is out and the families at kaiser are really relieved. >> they launched an organized effort to keep their school open, and it has paid off. not only is the elementary not closing, it might be expanded. right now kaiser is about 100

students short of the district average of 380 per school. so a potential expansion does raise a few questions by parents. >> we understand this is an old building and it's not a big building and there's lots of things to consider. >> kaiser and burkhalter elementary are the only schools recommended for district staff calls quality expansion. >> they are not at capacity so to expand you would have to do construction or relocate. >> foe oakland element trace did not escape. lakeview, marshall, maxwell park, santa fe and lazear are all recommended for closer by district staff. they are on the list for various reasons, including low enrollment and low test schools. mohamed is a teacher at lazear. they say they have been working hard at improving student test scores. >> we not really far from our goals. actually we are within our goals over the years. then i don't see the reason why

they want to just close it. >> he said there has been talk of converting lazear into a charter school but he's skeptical of those plans. >> as member of the the union, we really want our members to work in good condition. so charter school i personally, i'm not -- i'm not for charter school. >> now this list will be presented to the oakland school board during tuesday's board meeting, but the final decision on school closers and expansions won't be made until october 26th. district administrator's say shutting schools could save $450,000 for each campus. abc7 news. the death of a well-known disabled man in richmond has community members grieving this morning. david cox was riding his -- in his wheelchair when he was hit by a car.

richmond police are still looking for the driver. abc7's reporter spoke with his friends and family. >> 52-year-old david cox has been confined to a wheelchair most of his life. neighbors said that didn't dampen his spirit. >> he would always wave and say hello and he had a flag on the pack of his chair. they say this car, caught on camera, or a car like it, hit cox as we wheeled on on 34th street. >> he was struck from behind on a two door lexus, black in color, continued windows with a -- continued windows with a wheel spoiler. he was ejected from his wheelchair, thrown on the roadway. >> a witness who did not want to appear on camera said the whole wheelchair got trapped under the front end offer of memorial. the car backed up to dislodge the chair and took off under 34th street. >> i know accidents happen but to just leave him in the middle of the street. i see people hit dogs and stop. to hit a human and keep going, it's unimaginable.

>> cox died from his injuries on the way to the hospital. the cox family made their first visit to the memorial. >> we need to know the truth. that's what we need to know. >> david was the youngest of six children, the first to die. his brother, tom, held back tears. >> i just wish i had the opportunity to tell him how much i loved him. and just kind of reach some sort of closer. >> richmond police officer told us they want the public's help to find the older model black lexus with front end damage. the family wants answers. >> i would hope they didn't see him and it was a total accident, but, you know, until we hear the story from the person responsible, we around going to know. >> the car is older two door black lexus with tinted windows and a spoiler. it now has front end democrat. -- front end damage. the driver is now wanted for felony hit-and-run. people with information are asked to call police.

abc7 news. >> in reno the local officials have declared a state of emergency and cancelled this weekend's streets vibrations motorcycle event. this after gang members killed the president of san jose's hell's angels chapter. jeffrey was shot and killed inside the nugget casino late friday night. witnesses say a fight erupted and minute's after hell's angels and the other gang members stepped on to the floor. >> we are reviewing take place -- tapes and interviewing responding officers to develop additional suspect information. >> street vibrations had attracted thousands of bikers to the reno area this weekend. >> we may learn more tomorrow about the death of a patient

death caused by a nurse at an oakland hospital. federal investigators are involved. our media partner, the san jose mercury news, reports a replacement nurse at the medical center committed a medical error while administering medication to a cancer patient. it led to her death. investigators say the out-of-state nurse admitted making that mistake. they are now trying to determine whether it was an accident. nurse was filling in during the recent one-day nurses strike. an autopsy is scheduled for tomorrow. sunyvale police arrested the mother of an 8-month-old boy who was found dead on friday afternoon. officers discovered the dead baby inside an apartment. around the same time his mother tried to jump from the matilda avenue overpass above highway 101 a few blocks away. police grabbed 27-year-old let leticia serna before she could jump. sheehan booked into the santa clara county jail on suspicion of murder. the medical examiner will conduct an autopsy tomorrow to determine how her baby died.

a witness saw it hit and then break into several pieces. it was foggy and visibility was very low in the mountainous area. concerns over the california international airshow in salinas this weekend has organizers stressing the difference between an airshow and an air race. the airshow comes just one week after 11 people were killed at the reno air races. officials with the international council of air shows say planes at air shows must any parallel to or away from the audience. federal aviation administration officials are in salinas this weekend, as they are at every airshow and air race. >> this morning thousands of people are beginning to arrive in san francisco. they are taking part in one of the nation's biggest efforts to fight breast cancer. it is the 21st annual susan gkomen race for the cure. abc7s nick smith joins us live from justin herman plaza.

how is it look out there so far? >> it's looking great. the volunteers have already started to show up. a race a that started in 1983 with only 800 participants has grown into a global event. joining me is the executive director of the -- >> san francisco bay area affiliate of susan g komen organization. >> that is a long title. >> it is. but we are creating a goal without breast cancer. >> talk to me about it. i want to show people video from ways rays in the past. the idea is to do what. >> to provide money for women who don't have insurance right now and to fund the research so their daughters won't need the help in the future. >> maybe a hot of people haven't heard about this until now s it too late to come down? >> it is not too late. we can register runners at the market street. >> we are talk about any skill

this afternoon, especially in the east bay and the south bay as the cold front pushes out of the day area. we are talking very mild numbers. how about 66 degrees this morning in oakland, 62 in hayward and livermore and concord? a little breezy in fairfield with 60 in half moon bay with some fog along the coast. now this morning the numbers are much warmer along the shoreline. our protected valleys, because of the cloud cover. inland, where you experienced the cool down yesterday, the cool numbers are with you this morning. we around going to recover all that much. we will see mainly 60s and some 70s today. chance of showers mainly in the morning, mainly in the north bay but we will look for a little afternoon clearing. partly sunny this afternoon, but still numbers continue to come down. we will see warmer weather, especially tuesday and wednesday of next week when we get an offshore flow. live doppler hd shows a little moisture offshore. this is a cold front that's continuing to gather some moisture. it's going to sweep on through the bay area. but as it does, it will fall

apart. i think the best dimics and the moisture available will be in the north bay. we are talking marin county, sonoma county, also up toward napa. even san francisco could see a few raindrops. area of low pressure pushes to the north. as it does, it drags the cold front over the bay. so we are talking about a few light scattered showers this morning perhaps, and then by the afternoon we are behind it, and then tomorrow yet another weather maker comes our way, a fair weather maker. by 6:00 we are dry. take a look what happens towards the 8:00, 9:00 hour. more moisture heading into sonoma and marijuana county. the best chance of rain will be from the 8 to 11:00 hour from san francisco into the east bay. just a chance. then we are looking at the cloud cover to really fall apart. so by the afternoon partly sunny conditions and that should allow for some mid-70s in the warmest locations. back home we are talking cool weather. the sacramento valley just low 70s.

only 71 in loston. very windy condition necessary reason owe. and we are talking mid-70s by the afternoon. san jose, low 70s. it will stay gray in san francisco, just 60. maybe a few rain drops. and into the north you will notice that the numbers will try to recover by the afternoon. up he were 60s, 73 pet -- and holding on to the cloud cover throughout the afternoon. but the best chance of showers would be from 11:00, 12:00 here but with a little sun we should see highs in the mid-and upper 70s, especially down around the monterey bay. we are talking about a warmup tomorrow but the real warmup comes tuesday and wednesday. maybe 80s around the bay, upper 60s coast. it doesn't last long because this is the season of change and we will look at perhaps another system by next weekend. >> you know what i always say, it's beginning to look a lot like -- >> no, don't say it. >> thank you, lisa. well, coming up at 7:00 is good

candidate herman cain is celebrating a surprise victory this morning. he's won an early test vote in florida that left most of the leading gop candidates. cain captured 31.7 percent of the vote in yesterday's straw poll in orlando. texas governor rick perry in second with 15.4%. mitt romney came in third with 14%, followed by rick santorum with 10.88%. it seems politics is more contentious than ever and it's not limited to capitol hill. sarah palin's daughter recently went head-to-head at a heckler at a los angeles bar. she was taping her reality show. here's ron claiborne with a look at the decline in etiquette. >> reporter: from bull to bully. sarah palin's oldest daughter was confronted at a west hollywood bar thursday night. he has season tickets behind the sharks bench. he and his family often wear shirts with the company's logos to the game. last year bad boys bail bonds sponsored the home bench and the visiting penalty box. this year the company did not renew it's $70,000 sponsorship. now the sharks say they are enforcing the fine print on the back of their tickets, restricting how businesses can promote themselves inside the arena. >> they have stated we are the only ones that actually received notice. we see men of them out there with their logos, who it's google or yahoo. >> the sharks tell us they are not singling out stanley because its company cancelled their advertising deal. stanley wore his t-shirt to last night's preseason game and no one asked him to take it off or to leave the building. >> in about an hour thousands of runners and walkers will begin arriving to do their part in

[yelling] >> we worked on that. emily, you and i were talking about why you had the young women volunteer. why is it important to have the young girls volunteer? >> breast cancer affects way too many women. we are here to help with the outreach. our troop has been involved with it for the past twelve years and these are our newest volunteers.

>> you have to pay close attention to the the forecast all week long because every day there's something different. lisa is here to tell you about that. >> maybe raindrops today and the hot weather returns as soon as tuesday. as we head outside, we have it all. you see the hint of sun there but the clouds overtaking the landscape with the sun coming up in another 20 minutes. the early part of the morning will favor the clouds. maybe a few showers north of the golden gate. the latter part of the afternoon, some sunshine. really yesterday wasn't too bad when we did break out into some sun. temperatures were much more mild than we had all last week. but once again, we are going above normal in the next 48 hours. 62 in hay war, 64 mountain view. with all the cloud cover, boy, a warm start in oakland at 66.

60 half moon bay. we have fog on the coast. certainly not as much as yesterday because today we do have a cold front on the way so the clouds are higher. we have mid-level clouds and high clouds. so the low clouds not so much favoring the coast. but the uniform cloud layer keeping it warmer in san francisco, oakland. but cooler out in the valleys. so overall we have a mixed bag out there as we head out into your sunday. sunday morning favoring a chance of showers and the afternoon will be cooler, as much as five degrees cooler than yesterday. we dropped about 20 degrees yesterday. looking at a little sunshine later on this afternoon. and then things begin to change as soon as tomorrow. numbers coming back up into the 80s in our inland valleys. 90s will return tuesday and wednesday. by the end of the week we could see another weather system maybe bringing us a little more of this. live doppler 7 hd shows the rain up in redding and eureka, wed wood city.

but some returns being picked up offshore here. probably two hours or so and we will see sonoma county perhaps looking at a few showers. here's the water vapor imagery. an area of low pressure heading up into canada. as it does it will sweep the cold front over the bay area and it will fall apark. it's relatively weak, but strong enough to gather some moisture and perhaps see some raindrops in your neighborhood in the east bay and oakland. then by the afternoon we are behind it. so let's take it hour by hour, as we head in toward the rest of the morning hours. look at 8:00. notice santa rosa, san rafael, looking more and more likely you could see some rain shower activity. then 10:00, 11:00 into the east bay, into san francisco. but as you head toward the 11:00 hour on the peninsula, it really begins to fall apart. then by 1:00, 2:00, it looks like we will see partly cloudy skies, a little breezy out there. not a bad late sunday afternoon.

but in terms of temperatures, boy, in the valley with all the cloud cover, numbers held down into the low 70s. los angeles only 71. 75 cupertino. low 70s redwood city. a lot of cloud cover. san francisco 60. chance of showers right on through about 11:00. near east bay you hold on to the clouds and a chance of showers through the noon hour. then low 70s as you head out toward concord 75 in brentwood and maybe a few trips here but not likely. tomorrow we are looking as much as five to 8 degrees warmer. wednesday getting warm inland and then the cool down comes next week. you know, you have to check the calendar. wait a minute, yeah, it is late september. it's, you know, probable that we are seeing this kind of strange weather. >> you called it right. you said mixed bag. >> yeah. >> thank you, lisa.

the department of education is hoping to improve schools in low income neighborhoods. one way is to help veterans transition from the battlefield into a new field, teaching. abc7's education reporter, leeann, looks at a program in the bay area. >> j, joke. good job. k, keys. >> he says education was not his first career choice. before landing a job as a kindergarten teacher, he spent 20 years in the air force. o, octopus. >> but when he and his wife started a family, he wanted nothing more than to be at home with his children. >> i saw the effect of me being gone on them. i thought, well, they didn't enlist in the air force so why should they have to deal with this? >> his wife had also been in the air force, but retired to become a special education teacher. his life changed when he visited her classroom. >> my heart kind of went out to

the terrifying scream of a ten-month-old baby in san francisco got his parents out of a deep sleep and sent them into a panic. they are calling for a recall of a popular baby sleep sack. here's michael finney with the details. >> did you have a good sleepy? >> the mom wakes up her son, julian, from a nap. the circumstances were quite different from that frightful night back in october last year when her husband ran into his room to see what was wrong. >> as a parent, you hear the >> as a parent, you hear the typical crying and moaning, but this was a panicked scream. >> that night julian was wearing the sleep sack from halo. it can be zipped up for added comfort and protection. it promotes its products as a safer way to sleep. his parents then the then

ten-month-old julian had curled himself into the fetal position while sleeping. the eyelid from the zipper somehow hooked onto his tooth. >> the tooth was stuck on his zipper. it was literally stuck on his tooth. his feet were up here and he was panicked trying to get it lose. >> he kicked so hard he yanked his own tooth out. blood was everiy. halo declined an on-camera interview, but they said this type of incident occurring was extremely remote, less than one in a million. yet it redesigned the zipper to eliminate the eyelid. but it continues to sell the sleep sack with the old zipper, as well. john fox of cal perk said he doesn't see the logic in that. >> clearly if there was a risk enough for them to redesign the product, then they should have removed the previous product from the shelves to prevent any risk for future kids using older versions of that product. >> we wanted to know if this type of incident had ever happened before so we filed a

freedom of information act request with the consumer product safety commission and we learned the exact same thing had happened to taylor stern eight months earlier. like julian, then 15-month-old taylor was wearing a halo sleep sack and the zipper hooked onto her tooth. taylor, who is now almost three and she describes what happened next. >> then i kicked up, and then i had blood by my mouth. >> what happened to your tooth? >> it kick, kick, kicked out. >> federal regulators investigated the incident involving taylor and concluded there was no product defect. 7 on your side has also learned there had been six other zipper-related complaints to regulators involving halo sleep sacks. five involved the zipper either crumbling into pieces or being bit off by a child. >> obviously that's a very dangerous and faulty product
