good morning, thanks for joining us, i'm carolyn tyler. about one in every eight women in the united states will develop breast cancer in her lifetime. so finding a cure is key. this morning thousands of survivors and others touched by the disease are racing or walking in the 21st annual race

for the cure. nick smith joins us live across from the ferry building. nick, this is part of a global fund-raising effort. >> reporter: absolute. it started with 800 people participating in the race but thousands are gathering this morning. they are lining up around the ferry building because the race kicks off in a few minutes. thousands of people are participating, most are running to support a loved one, someone they know, someone with the disease or someone who has survived treatment. take a look at video we shot earlier of people who have gathered here today. today's race celebrates 21st annual race and coleman race for the cure. it's the longest race in the world and it raises awareness for the fight against breast cancer. it honors those who have lost their fight with the disease but

also sell briath friends and family who are here to support survivors. greg robinson and his mother have decided to make it a family affair. >> i've got friends who had cancer, survivors. i got a cousin that is a breast cancer survivor. i wanted to do something special this year. so they asked me about running, my daughter-in-law and my son is coming. >> reporter: since the inception it has grown from one local race with 800 to a global series of more than 120 races. at 10:30 there will be a ceremony and 10:35 and award ceremony to recognize race winners. we are minutes from the race starting across the street. 5-k run. i have to tell you people have been super excited. i have met families that span

four and five generations. that is wonderful thing. i like the pink tie there. >> we may learn more tomorrow about the death of a patient caused by a nurse at an oakland hospital. federal investigators are now involved. our media partner mercury news a replacement news at al did a baits medical center made a medical error while giving medication. the out of state nurse admitted making the mistake. they are now trying to determine whether it was an accident. the nurse was filling in the one-day strike by the regular nurses. an autopsy is scheduled for tomorrow. here is a statement to "abc 7 news," chief nursing executive says, we have met and spoken with the family of the patient and let them know our

players are with them. the death of a well known disabled man in richmond has community members grieving this morning. david cox was riding his wheelchair when he was hit by a car. richmond police are still looking for that driving. tomas ramon spokes with friends and family. >> reporter: 52-year-old david cox had been confined to wheelchair for most of his life. >> he would always smile and say hello. he had a flag on the back of his chair. >> either this car caught on a traffic camera on san pablo avenue or a car just like it hit cox as he wheeled along on 34th street. >> he was struck from behind by a two car lexus black in color, tinted windows with a rear spoiler. he was ejected from his wheelchair, thrown onto the roadway. >> a witness said that the wheelchair got trapped on the front end of car near memorial.

then i took off down 34th street. >> i know accidents happen, but to just leave him in the middle of the street. i see people hit dogs and stuff -- to hit a human and keep going is unimaginable. >> he died of his injuries on the way to the hospital. the family made the first visit to the memorial. >> we need to know the truth. >> david was the youngest of six children. the first to die. his brother held back tears. >> i just wish the opportunity to tell him how much i loved him >> richmond police officers say they want the public's help to find the black lexus with front end damage. the family wants answers. >> i would hope we hear the side of the story from the person

responsible. >> the car is black lexus with tinted windows that has front end damage. the driver is wanted for felony hit-and-run. anyone with information is asked to call police. sunnyvale police have arrested the mother of an 8-month-old boy that was found dead friday afternoon. they discovered the baby inside an apartment. around the same time his mother tried to jump from an overpass a few blocks away. police and firefighters grabbed her. she has been booked into the santa clara county jail on suspicion of murder. medical examiner will conduct an autopsy tomorrow to find out how her baby died. >> this morning an alaska airlines flight had to make an emergency landing after striking a bird during takeoff. flight 881 carrying 155

passengers departed oakland this morning, but after ingesting a canadian goose it returned to the airport. the fire department responded as a precaution but the flight landed without incident. investigators say heavy fog may have played to be for in the death of a cyclist in the oakland hills yesterday. it happened on grizzly peak boulevard near the intersection of claremont avenue around 11:30 in the morning. police say the man was traveling downhill on those winding curves overlooking the bay when he lost control, swerved into the oncoming lane and collided with a car. police do not plan to cite the driver. >> parents in oakland now know which schools or the chopping block next year. the district released this weekend their plan. sergio reports on the schools

slated to close and those that dodged the bullet. >> reporter: kaiser elementary school are breathing a sigh of relief. >> the families are really relieved. >> they lost an organized effort to keep the schools open. it's an effort that has paid off. it might be expanded. right now kaiser is hundred students short of the district average of 380 per school. so with potential expansion it leafs questions by parents. >> we understand this is an old building and not a big building. there is a lot to consider. >> kaiser and berkholzer are recommended for quality expansion. >> i believe they are about at capacity, in order to accommodate more students you have to do construction or relocate. >> five oakland schools did not escape the axe.

they are all recommended for closure by district staff. they are on the list for various reasons, low enrollment and low test scores. mohammad is a teacher at la zeer he says they have been working hard to improve test scores. >> we were close to our goals, i don't see the reason why they want to close it. >> he says there had been talk to converting it into a charter school but he is skeptical of those plans. >> as a member and the union, we really want our members to work in good conditions. so charter schools, i personally i'm not far charter schools. >> this list will be presented to the oakland school board during tuesday's board meeting but the final decision on school closures and expansions won't be

[ male announcer ] the epa-estimated 42 mpg highway chevy cruze eco. perfect for finding your way home. a plane has crashed killing all 19 people on board including two americans. rescue workers and civilians have gathered around the wreckage today. small plane went down a few miles south of the capitol. a witness reports seeing the plane hit the roof of a house and then break into several pieces. it was foggy and visibility was very low in that mountainous area. >> and the gop presidential race this morning, some political analysts say we may be seeing the beginning of the implosion of rick perry's presidential candidacy, this after a shocking loss yesterday in florida. john hendron reports from washington. >> reporter: the big winner

right now at 68 and 67 in mountain view. we're 62 at the coast and a little bit of fog there. so we are running the gamut of some numbers warmer, some numbers cooler and some numbers looking at rain and everyone looking at sunshine. drizzle, showers and definitely cooler. 60s and 70s and partial clearing setting the stage for a northerly winds and offshore we could see 70s at our coast throughout the middle of the week. right now we've got rain out there. live doppler 7-hd the bulk of the activity, this line right here it's going to swing on through. it's very weak returns. nonetheless, it will dampen your walk and ride this morning. everybody else just enough to get your car wet and it pushes on out of here. there is the other wave i was

talking about pushing down to the south of us. these are moving from west to east. they'll be out of here and we will look at much different conditions for this last week of september. the low pressure is to the north front pushes through and falls apart and we will look for a little bit, in fact i think folks in the east bay and south bay won't be seeing anything at all. 9:00 to 11:00, you've got the moister and by the lunch hour, breezy. clouds will part and we'll look for a pretty nice afternoon but much cooler. yesterday we dropped 20 degrees. today dropping further, 5-6 degrees, with highs in the mid-70s in the south bay. not a bad afternoon but throughout the morning hours, plenty of clouds, mist and drizzle on the peninsula and 70s in san mateo to 60 degrees in san francisco. you should see a few peeks of sun. in the north bay, you are getting moisture from sonoma and

napa. upper 60s in oakland with more clouds around favoring the early part of the day. you could see a sprinkle here. the higher elevations for sure, otherwise look for breezy conditions, low to mid-70s in the warmest neighborhoods. down by the monterey bay, clouds in the afternoon but everyone gets into the warming trend tomorrow. so between tomorrow and wednesday we have b an about-face with really typical typical san francisco september weather and then we've got another system next weekend. >> but it drops the fire danger which was high last week. thank you. >> let's check out sports. 49ers are in cincinnati trying to bounce back from a loss to dallas. this afternoon raiders are playing against the jets in front of a sellout crowd. yesterday the cal bears were in washington hoping to stay

welcome back. experts say more than 200,000 women will be diagnosed with breast cancer this year and while they battle the disease, there are other warriors including the thousands taking part in the bay area's 21st susan g.coleman race for a cure. nick smith joins us live. how is it looking right now? >> some of the racers, some of the runners in the race have already started to come back. the race is more about those that actually run but those that are fighting about the disease and encouraging friends and

family. lisa lee you are a survivor. what do you think is most important? >> i would like to share with people basically, since i was diagnosed with breast cancer, there are over a triple negative. my rate of survival is less than all the other cancers. it's underfunded will so i'm looking for answers. >> we are looking to video of race. so many people participate that may not be directly affected but it's important for people to participate? >> i think they are all helping. cancer affects everybody's life you either have it in a mother, sister, cousin or aunt or co-worker. >> when you found out the diagnosis, what was it about you said i need to share this story and need to let people know

focusing on time with their families beginning to heal the deep wounds of imprisonment. the city of sparks, nevada has declared a state of emergency and cancelled a motorcycle event. that is after the president of hells angels chapter was killed. he was shot and killed outside or inside a casino late friday night. they say a fight erupted hells angels and members of another motorcycle gang stepped on to the casino floor. >> we are currently reviewing surveillance tapes and interviewing responding officers to develop additional suspect information. >> that street vibrations event had attracted thousands of bikers to the reno area this weekend. >> the san jose sharks have ban

add local bails bonds man from wearing a t-shirt. jeff stanley owns bad boys bailbonds and has season tickets. he and his family and friends wear shirts with the company's logo to the games. last year they sponsored the home bench and visiting penalty box but the company did not renew the $70,000 sponsorship. now, the sharks say they are enforcing the fine print on the back of their tickets that restricted you on businesses can promote themselves inside the arena. >> they stated we're the only ones that received a notice. we've seen many companies out there with their logos whether it's yahoo or google. >> they have not singled him out because the company cancelled his advertising deal. you can see he wore his shirt to

emeryville looking gloomy and overcast. a few raindrops. you are staying inside this morning, we certainly appreciate your viewership. lisa will be here with the full forecast. hindered by painful stings and strong currents, diana nyad that is ended her latest attempt to swim to cuba to florida. he was pulled out of the water about an hour ago. she made it halfway through but face and body became swollen after painful stings from jellyfish. she tried last month but had to quit then, as well. lisa argen is here, as promised with the full forecast. it's kind of odd to see rain falling in september. >> we won't see it for too long. it's a quick mover. a little warm week ahead.

to lake tahoe you can see the partly cloudy conditions. numbers are near 60 going to a high of 73 in the northern sierra around tahoe. elsewhere around the bay, yeah, you called it, really cloudy, damp in the north bay so far we haven't seen any rain in san francisco. look how mild the numbers are. everyone has been in the 60s overnight. it's 67 in mountain view. we are looking at the numbers, we're warmer than they were 24 hours ago but overall, its cooldown, another one today as we lose another of the cloud cover. this morning, drizzle, light showers, cooler afternoon with partial clearing. then warming begins tomorrow with a north wind and offshore flow takes over. we'll see a return to 90s in inland valleys. near 70 at our coast. it looks like wednesday we'll be the warmest day of the week. here is a live doppler, weak

cold front suddenly march across the bay area. the north bay has been favored with the cloud cover and the moisture from san anselmo and point reyes and inverness and further up to novato, santa rosa rohnert park, light showers. off the coast of the san mateo peninsula here we are looking at a couple of bands that could move into half moon bay. this is a stronger cell that i have been watching for the past half-hour possibly moving into santa cruz until it falls apart. we'll be left with a pretty brisk wind. that will bring us the clearing and big change starting the workweek. between now and about 11:00 is the best chance of showers. then by the afternoon hours, you can see what moisture is left. well, it begins to fall apart

and then the clouds begin to dissipate and we will look for the sunshine to bring us up to the mid-70s in some of the warmest locations. 75 in san jose. 74 santa clara. partly cloudy and 71 in redwood city, san francisco could get a little wet but by the afternoon things will brighten up but still be cool, upper 60s in snom today. dealing with the wet pavement here and in the east bay you can see a little bit of light rain but cool afternoon in berkeley. 70 in castro valley. mount diablo could be getting wet and 78 in danville today with 77 in morgan hill. doesn't look like you see any moisture here but a lot of cloud cover throughout much of the day. accu-weather seven-day forecast, becoming a reality for the

raindrops and warmer tomorrow. 90s tuesday and wednesday, cool around thursday. and another rainmaker may be coming in next weekend. >> such a swing there in temperatures this week. >> that is what autumn is all about, too. bring it on and we'll have some changes. >> thank you, lisa. >> people that love off road vehicles are fighting to get one of their favorite parks reopened. clare creek management area is around fresno. it was closed because high levels of asbestos but some say robbed by enjoying public land by an overblown risk. dan ashley reports. >> reporter: this is how ken likes to spend his spare time. riding the trails of the hollister hills state recreation area with his 12-year-old daughter. he wishes he could take her 50 miles away where he spent his

child hood learning to drive. >> clear creek area covers 48 square miles of mining roads and trails. it's like any other in california. >> the mileage you could ride in a day was incredible. you can ride 60 miles and come back and have lunch and ride 50 miles and not cover the same terrain twice. >> they closed the area. they ordered all off road vehicles out after the environmental protection agency found potentially dangerous levels of naturally occurring asbestos in the soil. >> it indicated the recreation activities that we were authorizing on public lands were ex possible go to public to levels of asbestos that was going to increase their lifetime risk of cancer. >> we are concerned about what

the public health impact and frankly we were surprised how high the levels were. >> the epa study concluded five visits a year could lead to lung cancer and other diseases. the effects often take decades to appear. >> it's not safe for children to be participating in these activities. it's not safe for adults to participate on a frequent basis. >> reporter: but off roaders are skeptical of the epa findings. he's been coming here most of his life. >> for many years, it was about just every weekend. >> he says the tests were done in dry conditions, not the weather conditions that off roaders like. he started reaching out to others that spent time here. there was no single case of cancer or asbestos related illness. >> but in 2005 u.c. davis study

people living near the area have a significant higher rate than those that are not exposed. but he is not the only one about closing the parks. >> the state agency that oversees off road vehicles has worked in partnership with the bureau of land management for decades. california has spent millions to maintain roads and trails. so the state commissioned a scientist to investigate whether the risk is lower when the ground is wet. >> they found that the risk to human health was below the danger level. it was an acceptably low level of risk. >> the state is hoping to work out an agreement with the bureau to allow limited use of clear creek. phil says all extreme sports come with risk, whether mountain climbing or off road vehicles. >> as long as we're informing

the public of what you are going to be exposed to, theoretically it should be left up to individuals to make their own decisions. there are an estimated had million off-road vehicle users in california. whether to clear creek the bureau of land management will decide. >> this is hispanic heritage month. they find more 50 million latinos live in united states. lyanne melendez moderates a round table discussion about the opportunities and challenges facing the hispanic community. >> if they keep growing, california 2050, it's going to be half the population will be latent. we're not being represented as the latino population. >> that is a special edition of "beyond the headlines" at 10:00 right after our newscast.

on the contracts they get back 70 cents in benefits. gene 07 kneel puts it a different way. >> if you are buying a service contract and got to get into the contract and see what it covers because there are a lot of exclusions. there is a lot of hoops you may have to jump through. >> a survey found nearly 400,000 dollars claims were denied and $27,000 paid out. the they call it questionable and on top of that there can be high deductibles. >> you could have deductibles that kick in on multiple levels, paying the duct i believe or taking the vehicle. >> under california law you are entitled to a refund if you cancel within 30 days of purchasing the contract. after 30 days you are entitled to a prorated refund.

you can put in the request with the seller or administrator. if that fails contact the insurance company directly. >> if the insurance company fails to resolve the matter then you should contact the california department of insurance which would regulate the insurer. >> he purchased the car and the service contract from auto west honda in roseville. he had concerns and cancelled in less than 30 days. when he didn't receive his refund he called "7 on your side" and we were able to get him the last $1300 of his $4300 refund. >> they declined to comment on the story and the credit union said they had nothing to do with the service contract. one added note, consumer action says instead of buying a service contract but put the money in account for emergency repairs. i'm michael finney, "7 on your side." >> coming up, brad pitt leads the oakland a's in money ball.
