yesterday that didn't seem to match the fuel range for his plane. we have incredible video of the landing and rescue. >> it was a good landing. >> he did it picture perfect. it was a textbook landing, if there is such a thing in the water for an airplane like that. but he came in, wings level, and just brought in as slow as he could and touched down. >> we were able to see him come out of the airplane moving so we were overjoyed. he's good, airplane was intact when it landed. >> the 65-year-old man was plying in a t-310 r twin-engine cessna. he notified the faa to tell them he was slow on fuel and he would run out. >> maybe the head winds slowed him down eventually didn't make it. >> according to its flight specifications, the plane has a maximum range up to 2300 miles. distance from monterey to the pilot was heading, hilo, was 2315 miles.

he was able to ditch just 13 miles short of his destination. >> he was very professional throughout the whole scenario. i know i probably would have been a little more freaked out. >> it was kind of surreal seeing it firsthand. it's not the kind of thing you think you would ever see. >> abc7 news. details are coming out about a desperate life or death struggle between a san jose police officer and a 27-year-old transient. it happened yesterday morning as the officer was investigating a suspicious activity. the officer got into the patrol car and drove after him, knocking the gun out his hand. shots were fire. nobody was hit. >> i heard one and maybe two or lee seconds after that i heard three just like successively. >> what we have determined since then that officer was attacked

by one of the suspects. the suspect engaged in a struggle over the officer's pistol. during the struggles the officer's pistol discharged several times. we don't know if it was the officer or the citizen but the officer has powder burns to his hands as a result of the gun discharging. >> two officers arrived to assist and fired at the suspect but missed. evans was taken into custody and is in the hospital with numerous broken bones. he's been booked for attempted murder. now a chilling story how one man survived the shooting in typier tino. shareef allman targeted perceived enemies at work. days later the union said they would no longer defend him for unsafe driving. the shop person mike ambrosio described how he played dead to keep alive. >> it was quick, just bam, bam bam. >> him and his co-workers were stunned and froze as he shot them one at a time, from one end

of the table to the other. allman was shooting a handgun. >> he started from the end of the table and started shooting down. i was the last one on the table so i was watching everything he was doing. i don't know when i got shot. i had to be facing him. the bullet came in and came out through the back. >> he was shot through the upper right arm. he put his wounded arm over his head and played dead as he fell to the floor. he believe that saved his life because he looked under the table to see if he was dead. >> he walked over to the end of the table, and i closed my eyes and stopped breathing and kept on praying inside, please. and i just saw him walk over. i closed my eyes and the next thing i heard was that him running out. >> ambrosio was then able to call for help from an adjacent room telling 911 dispatchers what happened. he said allman seemed to pick his target, yelling at each one as he shot them.

the employees are being offered grief counsell tolling deal with the situation. these left employees declined to speak to us. mike calls it the beginning of his second life. bullet missed bone and he hasn't suffered any loss of movement or feeling. abc7 news. friends and family came together came together last night to remember three people killed after a party in san leandro. the shots were fired in the parking lot. at least three people died killed leneasha northington, joshua alford and shan niece kei. officers say witnesses have stopped coming forward with information. they believe party-goers know who the shooters are and won't identify them. the police have released this sketch of a man they are calling a person of interest. a federal crackdown on california's medical marijuana industry is infuriating some

california lawmakers. an assemblyman issued a statement calling president obama's policies on medical mariano worse than president bush and clinton. that comes in response to what us attorney started earlier this week, they are taking steps to shut down large medical marijuana operations. >> reporter: the state's u.s. attorneys say they will not use their limited resources to prosecute seriously ill people and the people who care for them. rather those people who use the state's compassion national use act with only themselves in mind. >> the california act was intended to help seriously ill people but the law has been hijacked by profit ears who are motivated not by compassion but by money. >> steve is cofounder of one of the largest dispen starries. he said they may not be target ill people but it will hurt them nonetheless.

automatic remote control shut off valves throughout their system. we will have more on the bills he's signed so far coming up in about half-hour. apple cofounder steve jobs was laid to rest with a small, private funeral yesterday. the current apple ceo said the company is planning what he calls a celebration of steve's extraordinary life that will take place soon. jobs passed away wednesday at age 56. the family has not released a cause of death but he was diagnosed with pancreatic cancer seven years ago and had a liver transplant in 2009. he leaves behind a wife and four children. his last project was an anniversary present for her. >> made her a special handmade box and wrote a note, a love note, and talked about how we've had good times and hard times but we've never had bad times. and the love between them was so palpable and so beautiful. >> sony pictures has purchased the movie rights of the life of steve jobs.

>> we've got a really nice shot of a spot of blue whales to show you. they are swimming off the coast of san diego. experts say it's rare to see them so far south this late in the season but cold currents from the north and warmer waters from the south have come together and created an environment rich in nutrients drawing the whales in. i went to the national geographic website this morning and they say blue whales are the largest mammals to ever live on

moon bay. clear and cool this morning. a sunny weekend for the blue angels. not much change from today to tomorrow. a few subtle changes. we will look for the warm pattern to remain next week despite a weak system coming our way on monday. so clouds just around pacifica half moon bay. the usual places. but we will look for it mid-60s, even with the cloud cover kind of mild there and 70s elsewhere around the bay. keeping our numbers right where they should be for early october. high pressure maintaining its grip in the eastern pacific. in fact, after this weak little system on monday, it will build back in. that will allow for a string of sunny days with sunny and mild conditions throughout the work week. but this system will drop down come monday afternoon, monday night, and with it we will see extra clouds. maybe even a little mist and drizzle in the north bay. but still the numbers will remain on the warm side. today, though, kind of cool with that foot plus snowpack in the

america began the war in afghanistan.

with only today and tomorrow to act on a pile of legislation, governor brown has signed or vetoed scores of bills, several which have a big impact on the bay area. we report from sacramento. >> in light of last year's gas

pipeline explosion in san bruno that killed 8 people and destroyed dozens of homes, of nor brown took steps to make california neighborhoods safer. he signed a number of bills to prevent such tragedies from happening again. including the requirement that all out utility company have an automatic or remote control shut off valve. >> had pg&e or other utilities gone ahead and put the valves in in these high concentrated area, the san bruno fire probably would not have been as bad of destruction and lives lost. >> the governor also sided with public employee unions, moving all ballot initiatives to november elections only. while he said it's consistent with the constitution, critics slammed the last minute bill because an initiative slated for the june ballot limits the use of union dues on political activity. now it will go on the november ballot where there's a greater chance to defeat it with a bigger turnout. finally the governor weighed in on the controversy shark fin ban. probably one of the most

heaviest lobbied bills this year. celebrities wrote the governor urging him to sign it. and the head of virgin airlines felt compelled to give the governor a ring. >> the phone is off the hook and i say i want to talk about this one, i want to talk about that one. had a call from richard branson yesterday on the phone australia. he's worried about shark fins. >> in the end the governor wanted to protect the shark population which researchers say has declined by more than 90%. he signed a law banning the possession and sale of shark fins, mostly used for sharp fin soup. >> 85% of the trade is moving through california ports. this will stop that in its track. >> some of the chinese community felt the ban picked on their culture. >> the governor also signed a companion bill allowing existing stocks of shark fin to be sold in california until july 2013. in sacramento, abc7 news. >> another bill signed by the

governor this weekend, one raising the age when the children are allowed to ride in the car without a booster seat. they will need to be 8 years old before they stop using a booster seat. it makes an exception for kids younger than 8 that are at least 4 feet, 9 inches tall. >> we know the proper use for child safety seats booster seats for the older kids, can increase their survive ability by up to 50%. >> under current law kids can abandon their booster seats once 6 years old or 60 pounds. the new law takes effect january 1st. fines start at $469 and that is for the first violation. a california university has been named the best in the world, even beating out harvard. the british magazine "times higher education" gives its top honor to the california institute of technology down in pasadena. cal tech put harvard in second place where it's tied with stanford. the editor said the quality differences between the top

universities are miniscule but coral won because -- cal tech wins because of the money given to research. u.c. berkeley came in tenth. a group of two dozen california chancelers have proposed a drastic tuition increase. according to the daily cal, system president convened the group over the summer and they are suggesting that tuition should be raised to $24,000 a year for in state students. out-of-state tuition would be even higher. a uc spokesman was quick to point out the group's ideas are advisory only, not binding. the state desperately needs the economy to improve before it can dig out of its financial crisis. the new unemployment numbers for september are not offering much in the way of job creation. the nation added 103,000 new jobs, technically enough to keep us out of a double-dip recession. we have more on the jobs outlook. >> the september unemployment numbers were better than in the previous month. the main reason?

nearly half of all new jobs came from verizon. the company rehired 45,000 workers after going on strike. analysts say it still counts as new jobs. >> i guess the best thing that can be said about it that it wasn't a terrible report. it didn't give any credibility to the argument that we are sliding closer to a recession. >> former labor secretary, robert rice, said the slow job growth has an impact on consumer confidence. consumers spending represents 70% of our economy. >> americans cannot buy because they are so economically stretched. they have got to save if they have any money at all. but at the same time, unless they buy, businesses are not going to create new jobs. >> rice, a u.c. berkeley professor, said the only saving grace now is for the government to step in to boost the economy. >> rebuilding roads and bridges and schools and ports and providing people the safety nets they need so they can turnaround

and in turn buy things so that businesses will create jobs. >> right now congress is battling over president obama's $447 billion jobs package. many americans are frustrated with lawmakers and their inability to agree on anything. van nostrom is one of them. she came town to the financial district to support the occupy wall street movement. van nostran is a graduate of the university. she majored in environmental health and can't get a job in her field. >> i'm entry level at this point and i have a very expensive college education that's not doing me any good because nine dollars an hour doesn't cut it. >> some analysts are optimistic because the holidays are coming and more hiring will occur. we may see better numbers in the upcoming month. abc7 news. >> a new batch e-mails turned over to congress yesterday

reveals a potential conflict of interest in the solyndra investigation. a person was hired to oversee the program under which solyndra got the half billion dollars loan guarantee. his wife is an attorney who represented solyndra at the time. they are a solar panel manufacturer and ended up getting a loan guarantee of $5.5 million and went bankrupt a year later. there was correspondence within weeks after signing a pledge not to get involved in anything his wife's firm had an interest in. the law firm gat $2.5 million in legal fees paid for with government stimulus money. hundreds of protesters marched through downtown in san francisco last night blocking streets and traffic for more than two hours. the protest was organized by the answer coalition to mark the tenth anniversary of the war in afghanistan. several groups, including anti-war act tests, educators and students were protesting

funding of the war. >> for one thing i hate war. another thing i have loved all my teachers and i love art, and i'm afraid of that being cut away from my school. >> the coalition wants the money used for the occupation of afghanistan and other wars to be spent on education, housing and, most of all, jobs. the protest stopped more than half a dozen muni lines that service market street. the war in afghanistan is >> some are want to pray during the job. they say they need to pray twice and said the company suspend them for doing that. >> when i prayed, they send me home. when i asked my managers why they do this, they said we send you because you pray. >> hurt said this has nothing to do with religious persecution it has to do with clocking out, something the suspended workers did not do.
