>> in the news, october 23rd an apparent case of road rage turns deadly on 580 in san leandro. a biker was killed and a transit van driver is under arrest. and an early morning apartment fire in san jose has left dozens displaced. >> good morning, temperatures rank from the 40s in the north bay, 60s elsewhere. but it's clear across the bay area. another warm day today but fog returns tonight. >> thank you, lisa. >> good morning. thank you for joining us. i'm carolyn tyler. interstate 580 is open again in san leandro after being closed for ten hours during a police

investigation. officers have arrested a para transit driver on a pair of felony hit-and-run and murder. police are investigating whether 31-year-old eddie hall of oakland deliberately ran down a motorcyclist with his para transit van during a freeway confrontation. it happened on 580 in san leandro. we have more from the scene. >> the twisted metal jammed under the front of this para transit bus used to be a motorcycle. police say this marks the end of what used to be a crime scene. >> the para transit bus involved actually dragged the motorcycle for about a mile and came to rest after the 150th avenue on-ramp. >> the motorcyclist died in this collision, and because of initial reports by witnesses police are handling this as a homicide. >> i don't know if there was any communication between the two. that's unknown at this point. and suddenly the van turned and hit the motorcycle. >> investigators are interviewing the driver of the

para transit van to figure out if he expended to hit the cyclist. witnesses tell police the biker was traveling with a pack of other riders. >> there was a group of motorcycles that was reported, anywhere from six to eight people on the motorcycles. some had insignias which showed affiliations to the hell's angels. whether or not the victim did here, i do not know that. >> these are pictures sent to us by a driver on 580. the initial crash brought traffic to a standstill and got some drivers snagged in a circus street snag trying to get home. four hours after the crash nina smith was still trying to get home to modesto. >> they said when they took us off at keller in oakland they said it's blocked all way down to san leandro, and i got into san leandro and every entrance i got to was blocked. >> i talked with it two employees of first transit which is the organization is that runs

the para transit van. they tell me there were no clients aboard the bus at the time of the incident. they also tell me for some reason the driver of the van stopped communicating with dispatch so they decided to try to locate it through gps and that's when they figured out it was one of their buses involved in the incident. in san leandro, abc news. >> this morning an apartment building fire in san jose has left between 30 and 50 residents without a place to live. the fire broke out in a 20-unit complex just after 1:00 this morning. firefighters had to perform six rescues using a ladder truck to get those victims to safety. the fire itself, king road and bowling green drive, was raging when firefighters arrived. they managed to get it mostly under control within 45 minutes. they are still busy putting out hotspots. investigators are trying to determine how it started. no serious injuries are reported. police in stockton are still searching this morning for a

hell's angel they believe killed another member of the club this san jose last weekend. yesterday they surrounded a house where they thought he might be hiding. officers believe steve ruiz was inside the house perhaps with his girlfriend, christel trujillo. ruiz is suspected of killing a member last weekend at the funeral of another hell's angels member. heavy armed san jose police and armed vehicles began gathering at the house in stockton yesterday afternoon but by last night officers left the scene after determining ruiz was not there. trauma surgeons say a sacramento area police officer will recover after being shot several times during a traffic stop. the shooting happened yesterday afternoon near grant high school in twin rivers. the officer tried to pull over a suspect, who then fled on foot. during the chase the officer was shot numerous times. the suspect is still at large.

a stockton area marine corps man died after a hunter mistook him for a bear. it happened in western oregon. christopher ochowa and a friend were hiking friday evening. sheriff's deputies say a 67-year-old oregon man was hunt ing for bear with his 12-year-old grandson. he saw he saw something move and fired one shot, striking him. the hunter has not been charged and it has been turnover to the local d. a.'s office. gun right supporters made a dramatic statement in the east bay to protest a new state law. yesterday more than two dozen people went to a shopping mall with rifles and shotguns strapped to their shoulders. abc7's john alston explains why. >> reporter: they came with plenty of firepower to make their point. handguns, rifles, shotguns and other weapons. the guns were unloaded, making it legal. >> i'm trying to protect my family and the second amendment

says i can do that. >> for about an hour more than two dozen gun rights advocates gathered in front of the mall in san leandro. they heard and supporters who honked their horn and others who didn't like their car. >> i got my kids in the car, i don't need them to see arms like that. >> we have the right to bear arms. >> the group protest add new law signed by governor brown. beginning january 1st it will no longer be legal to openly carry an unloaded handgun. but it will still be legal to openly carry unloaded long guns like shotguns and rifles. >> this is a direct reaction to what our government officials in sacramento have done to us. we aren't out here trying to intimidate anybody or anything like that. we are just saying our government is making life difficult for us. we are willing to stay within the law. >> as of january 1st i will not be carrying but i have a long gun at home, a smith wesson that i might be carrying because

we are allowed to do that. >> a few spectators didn't like the idea of seeing civilians carrying so many weapons. >> i think it's a little scary because when you go out in public, going into public places like starbucks, even to a 24 here, don't want anybody carrying a gun, whether you think it's loaded or not. >> anytime you see people, you know, in a suburban environment with a bunch of guns, you know it's kind of scary. >> after it was over demonstrators walked across the boulevard and piled into a kfc restaurant where they grabbed a bite to eat with weapons exposed for everyone to see. >> police in san leandro quietly watched the event from a distance. when the new law goes into effect, openly carrying a handgun would be a maryland -- a misdemeanor offense. in the newsroom, abc7 news. >> turning to the occupy movements all over the area. in san francisco they are calling it a day of learning where according to overnight twitter posts they plan to hold talks to build consensus on

their next nonviolent direct action. you are looking at what they were doing yesterday marching up market street in what they call a solidarity march for national anti-police brutality day. members of occupy oakland continue to camp at the plaza despite warnings from police that the plaza is close product ten at night to six in the morning. yesterday demonstrators marched down broadway but quickly made their way back to the plaza. police began issuing parking citations along 14th street where demonstrators have been collecting donations from drivers. and in san jose there's no sign of any new arrests for illegal camping since early friday morning. ten people have been arrested, two others cited and released. pg&e reportedly knew about more than two dozen in explained gas leaks along the pipeline

that exploded in san bruno last september, killing 8 people and destroying homes. yesterday the out utility certified that the pipeline was clear of seam well leaks less than year before the explosion. federal investigators discovered only after the blast that the pipeline had faulty wells. the san francisco chronicle reports at least 26 leaks were documented on the line from milpitas to san francisco between 1951 and 2009. the paper said the company listed the cause of those leaks as unknown. it then relied on computerized records to show the pipeline was seamless and therefore in compliance with federal safety rules. coming up next, liberating libya. a historic new era will officially begin in just a few hours. and u.s. troops will soon head home from iraq. what one local lawmaker is saying about president obama's decision.

ya officially enters a new era this morning. at 8:00 our time rebel leaders plan to hold a formal ceremony declaring the libyan people liberated from muammar gaddafi. street celebrations are taking place in the capital of tripoli as the libyan medical examiner confirms this morning that gaddafi died of a gunshot wound to the head. his 42 year rule ended last thursday when he was killed near his hometown of sirte. transitional leaders plan to form a new government within a month and hold elections for a constitutional assembly within 8 months. politicians and veterans say the draw down from the u.s.

troops from iraq may have ugly consequences following president obama's announcement that the war there is nearly at an end. senator feinstein was in san francisco to speak for the human rights campaign. she has her doubts about iraq. >> i'm worried about whether the iraqi army really is trained up to a standard that enables it to protect the country. i don't really know that yet. the experts say it takes seven to ten years of training really to assume that standard. so we will see. one iraq war veteran says the country is still dangerous. he recently spoke with a friend serving in iraq who said things are as bad as of. >> he showed me a lincoln to the casualty reports that happened and seriously, almost every day someone is either getting killed or at a checkpoint or on the street, and it's still not safe. it's still iraq.

>> president obama has promised all american troops in iraq, except for a contingent at the u.s. embassy, will be home for the holidays. this morning a $5,000 reward is being offered for information leading to the arrest of whoever who shot and apparently ran over a deer. it happened last week in the north oakland hills. the animal was shot in the shoulder and had three broken legs. according to the oakland tribune, the same person may have tried to stab that deer, as well. the animal had to be euthanized. an injured red tail hawk has finally been rescued. the hawk was spotted in golden gate park with a nail through its head. it appeared to have been shot with a nail gun. rescuers tried for several days to capture the bird but it had eluded them until yesterday evening. it was finally trapped by the group wild rescue.

62 degrees. we have the cool upper 40s napa and by fairfield. mid-50s mountain view and san jose. really running the gamut this morning. and this afternoon quite a spread as well because we will see a return to our sea breeze along some of our coastal locations. clear skies this morning. sunny and mild along the coast. warm inland and increased fire danger next week as the offshore flow really brings some gusty winds tuesday and wednesday. right now the fog is still offshore. it will stay that way throughout most of the day. it will be coming up from the south late day. that will give us a return to our sea breeze, allowing temperatures to drop in the 60s around half moon day and pacifica. but still 70s will prevail from the san mateo coast, san francisco, and the setup remains almost the same, although our double barrel high pressure beginning to weaken a bit as the high drifts to the east and that will allow for a return flow of that fog to move up from the south today and bring us back to seasonable numbers tomorrow. so enjoy the warm day today

inland, if you like that kind of thing. a cool-down tomorrow and that begins the changes for the week ahead. we will see another wind shift by wednesday. back home we are still looking at more 80s san way queen, sacramento valley. and 69 in the northern sierra. upper 20s this morning with clear sky. the numbers will be coming down today. southern california as much as three or four degrees cooler. they have seen the return to the fog. with the clear start, we will warm up again rather quickly. south bay looking at 81 in campbell. but more likely lower 80s around santa clara. 83 san jose. peninsula. upper 60s here. half moon bay will see a high early of 70. then the temperature drops. 82 in in redwood city. palo alto. nice afternoon the breeze picks up midday. 65 daly city. in the north bay the

down-sloping winds and light offshore flow keeping it very, very mild to warm as you head up towards santa rosa. 85 there. and 67 for stinson, 78 in oakland. so a cooler afternoon breeze but still 80 in hayward. in union city and inland it will still be in the mid-80s. changes come tomorrow for you. 86 danville and pleasanton. monterey bay 70s santa cruz. but upper 60s. 72 monterey. the accuweather seven-day forecast. so today, the last day of the 80s. notice the cool down tomorrow. then with the offshore flow tuesday and wednesday gusty winds but certainly not as warm. numbers in the mid-70s. still high fire danger. increasing clouds and now it looks like maybe no rain next weekend. but then halloween is a different story. that's not yet on that seven-day outlook. >> okay. but it's not that far off. >> no, it's no. but with the fall things change. if we did see any rain, it will probably be a little light rain. >> thanks lisa.

let's look at sports. at 1:00 p.m. the raiders will battle the kansas city chiefs at the oakland coliseum. still no official word on whether the newly acquired carson palmer is going to be the starting quarterback. tonight the st. louis cardinals will try to take a stranglehold of the world series after beating the rangers in last night's pivotal game three. here's larry beil with the highlights in this morning's sports. good morning, everybody. game three of the world series turned into the albert pujols show. not one or two, but three home runs for the cardinals slugger. dallas mavericks have dirk novitzki throwing out the first pitch. get ready for offense from albert. that ball is destroyed! way out. three-run bomb. it was off alexi ogando. albert getting warmed up in the center. dead center off mike gonzalez. a two-run shot. makes it 14-6. big mac loving it to the ninth and albert caps it off other another.

china town. it shows workers wearing ed lee for mayor shirts manning an area set up on ironing boards. it shows workers filling in ballots for residents and telling them for whom to vote. he spoke to us via skype from sacramento. >> i had a canvasser is telling us they saw the workers fill out the ballots themselves. what i saw was the workers using a stencil, holding the stencil over the ballot and having the voter fill in the stencil. >> this activity has enraged ed lee campaign manager, tony winniger. >> that group and people doing it have nothing to do with the mayor lee's campaign. they don't represent mayo lee's campaign or anything to do with his campaign. we want that group to cease and desist from anything they are doing from anything under mining the process immediately. >> the group that set it up is the neighborhood alliance. the same group that ran the run, ed, run campaign. we attempted to speak to the manager, but he was not available.

other candidates weighed in on what they said could be voter fraud perpetrated by the lee campaign. mayor candidate chiu's campaign was concerned. >> i think the videos speak for themselves. there are folks wearing shirts that are identifying who they are with and they were engaged in what happened to be potential voter fraud. >> anthony thomas with yee's believes the lee campaign is indeed tied to the event. he said there are no coincidence necessary politics. >> there's also been rumors of other things that lead us to believe there is coercion going on not allows citizens to vote free and legally. >> he wants to stop them from campaigning for lee. >> if the allegations are true then there were illegal activities. we urge an investigation and i understand the elections department has forwarded that to the district attorney's office. >> now city attorney would normally investigate this case

but he's recused himself because of his mayoral campaign. abc7 news. this week the oakland school district is expected to decide whether to close five elementary schools to save money, and consolidate for declining school-age population. our media partner, the oakland tribune, said the closer list includes lakeview, and marshall in the east oakland hills, and lavere. maxwell park near mills college, and santa fe in north oakland. the district operates nearly 100 schools, but now has 5,000 fewer students and $62 million less in its general fund than it had just three years ago. school officials in san francisco are trying a new approach to truancy. kids who miss more than ten days of school are considered habitual offenders. education reporter lyanne melendez explains the new plan to try to keep them in class. >> san francisco's burton academic high school is focusing on ninth graders, identified as habitual truants.

this is why. stanford university analyzed the school direct's student data and found those with a grade point average of less than 2.0 who showed up for class only 85% of the time were very likely to drop out of high school. >> in fact, students at both of these early indicator warning indicators had only a graduation rate of 15%. so it's something that glares out at you and we have to do something about it. >> so instead of being taken to the truancy assessment and resource center, counselors from that center come to the school once a week. it's a pilot program being tested only at burton. >> and that case manager is obligated to work with that young person to get them reengaged back with school. >> since the program started in august, those once identified as truants have added 25% more school days. >> graduating from high school means you can go to a college and a college degree will make

your life easier. >> the money to fund the program, $30,000, is coming from the district attorney's office. the pilot program will run for at least one year. if the results are good, the district will implement it at other san francisco high schools. >> the goal here is to create the blueprint that we can take to other schools because that's the only way we will be successful. >> in san francisco, lyanne melendez, abc7 news. >> tomorrow bay area music icon carlos santana will have a treat for the students at the san francisco high school he attended. he will perform at mission high to celebrate the school's impressive accomplishments. 85% of its seniors were accepted into college last year. santana and the high school principal talked with our cheryl jennings about how education can change people's attitudes. >> the more you educate people the less people have tendency to be brutal with violence.

today. 88 yesterday in santa cruz. so those numbers will be gone, but we still will be looking at mid-80s around the bay. but our strong ridge of high pressure begins to drift to the east and that will allow for a southerly surge of fog to move up and that's going to influence our afternoon highs. in fact, it's already foggy in los angeles so the fog near santa barbara bra continues to pull up and we will begin to see that westerly wind. but temperatures maybe five degrees to 8 degrees above normal today. with the fog big sir 78. we are talking upper 70s los angeles with 69 in the northern sierra. later on today we are talking about more 80s in the south bay. it was a nice day yesterday in san jose. almost as nice today. here's where you are notice the changes with temperatures coming down twelve degrees half moon bay. 70 today. 82 in redwood city.

milbrae, and san mateo, you begin to feel the breeze in the afternoon with mid-and upper 70s. san francisco, 74 degrees. mostly sunny skies. breezy winds by the afternoon. daly city 65. and in the north bay you will see the 60s at our beaches. so starting out warmer this morning. then the temperatures will come down with the sea breeze kicking in. low to mid-60s here for santa rosa and sonoma. yesterday 84 degrees in oakland. today we will top out at 78. still a nice afternoon, but with the afternoon sea breeze it will be 75 berkeley and the 80s reserved for union city. fremont 82. -8g 1 newark. as you head inland still quite warm. 86 danville and pleasanton. no changes there. monterey you are clear now but that will change by the afternoon. the 60s will return to the beaches there. seasonable weather returns on monday meaning this is where we should be this time of year. mid-and upper 70s with the morning fog and then the winds get a little gusty come tuesday and wednesday with an offshore

they have a little light-producing photo cords, light organs. >> this scorpion fish has poisonous spines and color that creates camouflage. >> under water this fish is not red because red light is absorbed in shallow surface water. in the depth this fish is gray. >> the specimens are carefully handed down the hatch and whisked off to a maze of laboratories below deck. around every corner a scientist has something new. this thin, orange worm was found inside another worm, a big fat one with spikes. gary is a coral expert, getting a rare chance to see deep water coral alive. >> like this. i've never seen this one. >> it's called black coral. but it's the skeleton inside that is actually black. a lot of these huge crustations came up in the traps. they are related to the pill bugs that you find in your garden. >> this is an eel.

>> when your insurance company pays for damage to your home you may think it is all over but it might be tricky to collect the money. we show you why. >> patricia is showing us her new dishwasher, the one she bought after the old one caused a big problem. >> the neighbor below said, do you have water in your kitchen? i said no. she found the dishwasher water pouring in water and not draining out, even though it was drained out. it had seeped out her washer and through the floor and into the apartment downstairs. it didn't appear wet, but it felt squishy when i stepped on it. >> she had to rip out her floor in all five rooms since she has one continuous floor. thankfully the insurance company agreed to replace it, but the only problem was getting the money. >> very, very, very frustrating. >> here's why.

her insurance company made out the check to patricia and her mortgage lender, chase bank. chases released two checks as the work was done, but it would not release the final payment until after an inspection. >> she took pictures, went through and said the job is 100% done, it's beautiful. >> the inspector came and filed this report, saying the work was 100% complete. chase only requires 90% completion. however, the bank did not send patricia her money. instead, it sent her this baffling notice. >> they said, well, they needed to have proof that the job was complete. i said, well, you have it. it was faxed to you and you should have it. no, no, they didn't have it. >> so she faxed the bank another copy of the inspection report, but that didn't help. a month later chase sent another notice saying we need an inspection. so patricia faxed the report a third time. and for the third time chase sent a notice asking for the inspection. >> i faxed it to you three times

already. well, we don't have it. this went on and on. >> patricia said she called the bank 34 times and got nowhere. so she contacted 7 on your side. then told the bank we were on the case. right away she got action. >> they said we will get the check and it was all fed ex'd overnight. >> chase bank tell us the insurance check had been mailed to the wrong bank office which caused a delay in processing her claim. chase did not explain why it kept asking for an inspection report. however, patricia did promptly receive her final payment of $1,950. >> i appreciate the help, and i am a fan of 7 on your side now and i will keep watching. >> the bank says the mix-up started when the insurance check was linked to her home equity line of credit instead of her mortgage account. we are glad it was all straightened out. if you have a consumer problem

>> what is he doing? i think he's eating grass. >> reporter: the oakland zoo's new tigers are making themselves right at home. >> i think he likes them. i they he thinks they are big kitty cats. >> but it was a long journey for the sisters from texas. each about 600 pounds and about four years old. >> these tigers were originally owned by a couple that used them in what was deemed a freak show, if you will. it is a traveling animal show. >> owning pet tigers is illegal in california, but not in texas. >> i think people are really surprised to know that it's okay with some states to own pet tigers. >> the couple charged people money to pose for pictures with the cats until the tigers got too big and they got a divorce. a zoo in texas came to the rescue, but didn't have enough room to keep the tigers, so oakland offered them a free ticket to the bay. wide awake and roomy straw-filled crates, the big cats boarded a truck to fort worth and flew to oakland in
