good morning, thanks for joining us. i'm carolyn tyler. >> interstate 580 is open after being closed for ten hours during a police investigation. officers have arrested a transit driver on suspicion of murder and felony hit-and-run. they are investigating whether eddie hall of oakland deliberate rally ran down a motorcyclist with his van during a confrontation. it ended in 150th avenue in san leandro. now more from the scene. >> reporter: the twisted metal jammed in the front of this paratransit bus used to be a mc. this marks the end of a very long crime scene. >> the bus that was involved dragged the motorcycle for about a mile and came to rest after 160th on-ramp. >> the motorcyclist died in the

collision and because of initial reports by witnesses, police are handling it as a homicide. >> i don't know if there was any communication between the two. it's unknown and suddenly the van turned and hit the motorcycle. >> investigators are interviewing the driver of the van to figure out if he intended to hit the cyclist. he was traveling with other pack of riders. >> there was a group of motorcycles, anywhere from six to eight. some had signs they were hells angels. >> these are pictures sent by a driver on 580. initial crash and following investigation brought traffic to a standstill and got some drivers mad trying to get home on surface streets. >> four hours after the crash, nina was still trying to get home to modesto.

>> they took us off in oakland, it's blocked all the way down to san leandro. i got into san leandro and every entrance i got to has been blocked. >> i did talk with two employees of first transit which is the organization that runs this paratransit van. they say there were no clients aboard the bus at the time of the incident. they also tell me for some reason, the driver of the van stopped communicating with dispatch and so they decided to locate it through gps and that is when they figured out it was one of their buses involved in this incident. red cross workers are expecting to help victims of a fire of an apartment building in san jose. it damaged a 20 unit complex just after 1:00. the fire was raging when the firefighters arrived. a chief describes a chaotic scene. >> there was so much smoke and

flame they could barely get in, they had people running in and out and they were trying to get rescue up on the balcony and within the apartment complex. >> six people were rescued. no serious injuries reported. that fire was brought under control in about 35 minutes. so far no word on how it began. >> developing news, san jose police say officers shot a man just before 8:00 this morning during a confrontation at motel on east brokaw road. police were called to the extended stay motel about a suspicious person with a weapon. police found the man and they say he displayed threatening behavior. one officer fired at the man wounding him once saying it was self-defense. the unidentified suspect is being treated for his injuries. we'll have more information on this tonight on our news at 5:00. >> police in spock ton are

searching this morning for a hells angel they believe killed another member of the club in san jose last weekend. yesterday they surrounded a house where they thought he might be hiding. officers believe that steve ruiz was inside the house, crystal truijillo. he is suspected of killing another member at a funeral. they gathered at the house but last night officers left the scene after determining that ruiz was not there. trauma surgeons say a sacramento area police officer will recover after being shot several times during a traffic stop. that shooting happened yesterday afternoon near grant high school in twiv rivers. officer tried to pull over a suspect who then fled on foot. during the chase, the officer was shot numerous times. suspect is still at large. gun right supporters made a

dramatic show in san jose. two dozen people went to rifles and shotguns strapped to their shoulders. john alston explains why. >> reporter: they came with plenty of firepower to make their known, handguns, shotguns and other weapons. demonstrators say the guns were unloaded making it all perfectly legal. >> i'm trying to protect my family. >> for about an hour, they gathered in front of the bay fair shopping mall in san leandro. they heard from supporters who honked their horns and others who didn't like what necessity saw. >> the group calling responsible citizens of california protested a new law being signed by governor brown. it will no longer be legal to

openly carry a handgun but it will be still be legal to carry shotguns or long guns. >> we're not trying to i am date anybody. our government is we're going to stay within the law. >> i do have a long gun at home. a smith wesson .45 car bean because we are allowed to do that. >> a few spectators didn't like the idea of civilians carrying so many weapons. >> it's discretionary, when you go into public places like starbucks or even to a 24 here, you don't want anybody carrying a gun, whether you think it's load ordinary not. >> any time you see people in a suburban environment with guns, it's kind of scary. >> they walked across the boulevard and piled into a

restaurant where they grabbed a drink and bite to eat with weapons exposed for everyone to see. >> they quietly watched the event from a distance. when the new law goes into effect, openly carrying a handgun would be a misdemeanor. turning now to the latest on the occupy movement around the bay area. in san francisco, driarms are calling this a day of learning where according to overnight twitter post they plan to hold talks to build consensus on their next nonviolent direct action. yesterday they marched up market street in what they called a solidarity march anti-police brutality day. >> members of occupy oakland continue to gather at the plaza despite warnings from police that the plaza is closed from 10:00 at night until 6:00 in the morning. demonstrators marched down broadway but quickly made their way back to the plaza, police issued parking citations along

14th streets where they have been collecting donations from drivers. >> in san jose, no sign of any new arrests for illegal camping. ten people have been arrested and two other cited and released. >> pg&e reportedly knew about more than two dozen unexplained gas leaks along the pipeline that exploded in san bruno last september. as you know it killed 8 people. the utility certifies that the pipeline was free of weld leaks less than a year before the explosion. federal investigators discovered only after the blast that the pipeline did have faulty welds. today san francisco chronicle reports 26 leaks were documented on the line from milpitas to san francisco between 1951 and 2009. they say the company listed the cause of the leaks as unknown. they relied on computerized record that the pipeline was

collapsed 45 buildings in turkey. they are trying to dig out victims in the hardest hit areas. there are many reports of fatalities. scientists say there will be a few thousand deaths with a powerful quick that size. it struck just before 2:00 in the afternoon turkish time. >> libyan people are celebrating their liberation this morning with a ceremony following thursday's death of dictator moammar khadafy. as they celebrate a medical examiner confirmed that khadafy died of a gunshot wound to the head. with his death, new claims are surfacing of torture and other atrocities at the hands of his regime. what happens next in libya is, of course, of great concern around the globe. secretary of state hillary clinton appeared on "this week." >> the new libya needs to start with accountability, rule of law a sense of unity and

reconciliation in order to build an inclusive democracy so people that supported the former regime unless they do have blood on their hands, should be safe and feel included in this new country. >> tunisia is holding an election of the arab spring. they were the first african country to revolt. today's election involves 11,000 candidates and 80 political parties with the winners to be announced tomorrow. back here at home, an injured red tailed hawk has been rescued. he was spotted in golden gate park with a nail through its head. it appears to have been shot with a nail gun. rescuers tried for several days to capture the bird. it was trapped yesterday evening by wildlife rescue. bird has been taken to the wildlife center of silicon valley where it's being treated.

scientists say it might take several days where the latest pieces of space junk returned to earth or whether they burned up. a german satellite entered the atmosphere last night and they have not received any reports that it has hit any populated areas. most of satellite was about the size of a minivan was expected to burn up but 30 pieces may have crashed to earth. last month a nasa satellite reperiod the atmosphere. >> so if you see something raining down, duck. >> fog is far away from today. 63 degrees in san francisco. 68 across the bay. 50s in the north bay. and change headed our way

of a sea breeze. we have 60s here. changes from yesterday, half moon bay and pacifica, pleasant and sunny not as warm. how about 82 yesterday. we've got high pressure still in command of our weather. it's beginning to shift to the east and with that fog tonight we've got the onshore push tomorrow bringing numbers down, another 5-8 degrees to seasonal norms and then winds will pick up on tuesday and wednesday. things have dried out considerably yesterday and they will continue on to do that today. despite the longer nights, you have to watch the possibility of fire danger next week. 87 in fresno. 82 in sacramento and 77 in yosemite. back home, more 80s, summer like afternoon, 82 in saratoga, 83 in sunnyvale. couple changes, breeze picks up. 78 in san mateo.

76 in millbrae with 80s hanging on. palo alto, redwood city, inand around san francisco, 74 today with 67 in the sunset. winds late in the afternoon will bring a cooler feel to the atmosphere but i don't think you'll see that fog. that should hold off until later tonight. it will be lurking offshore. 83 in sonoma and 84 in napa. as you head out to the east bay, 75 in berkeley. 80 for union city. 82 again in fremont. numbers here remain quite warm, 86 in pleasanton. 85 in walnut creek, sunshine all along the central coast. the fog is down past san luis obispo so enjoy a nice day in monterey. a little cooler but the warmest day out of next seven, more fog tomorrow morning but that gives way to sunshine and gusty winds

>> this is video taken by adam during the mayoral campaign in chinatown. it shows workers showing wearing ed lee shirts. it shows workers filling in ballots for residents and telling them who to vote. >> i had a canvasser of senator yee's telling them workers fill out the ballots themselves. what i saw was the workers using a stencil holding it over the ballot and having the voter fill in the stencil. >> it has enraged the campaign manager. >> that group and people have, they don't represent mayor lee's campaign. we want to cease and desist immediately. >> the group that set up tables is neighborhood alliance, same group that run ed run campaign.

we attempted to speak to the manager but that person was unavailable. they weighed in what could be voter fraud perpetrated by the lee campaign. they were concerned. >> i think the video speak for themselves. those folks are wearing shirts that are identifying who they were with and engaged in what appeared to be potential voter fraud. >> anthony thomas with leland yee's campaign believe lee's campaign is tied to the event. he says there is no coins dejsz in politics. >> it leads us to believe there is coercion going on. >> they want to stop the alliance from campaigning for lee. >> if some of the allegations are true, there were illegal activities and we urge an investigation. the elections department has forwarded some of that to the district attorney's office. >> city attorney says they would

normally investigated the case but he has recused himself because of his mayor campaign. >> and the next mayor will be elected in november they will use rank choice voting system that will allow to pick the top three choices for the job. it eliminates the need for a runoff election but it's not without controversy. >> 16 people want to occupy room 200 at city hall, most crowded field in memory. almost all considered viable contenders. in alphabetical order, jeff adachi, aliota, john avilos. david chu. former supervisor tony hall. city attorney, dennis herrarra, ed lee. phil king and state senator leland yee. >> the mayor will be chosen

through the rank choice voting system approved by voters back in 2002. it's been used in other city elections like last year's supervises' races but this is the first time it will be used for a competitive mayor's race. >> this method allows them to mark their ballot in order of preference. on election night it begins with all first choice slx selections. if there is a front run they're captures more than 50% of the vote the race is over. if nobody gets that majority the candidate with a fewest first choice rankings is eliminated. then you get another chance because your vote is now transferred to your second choice. all the votes are recounted. this process of eliminating last place candidates continues until someone has a winning majority and becomes the new mayor. >> i think it's a good thing because it saves money, it

allows the election to determine the outcome. >> folks on the right, left and middle, if they are th are confused or scared about it. >> some research has been done in previous elections, by usf political science professor. >> more than half of the voters only list one person. question becomes do they really understand the system. >> 80% of the voters in last year's mayor's race marked all three choices. it was the first rank choice was used there. don perata was 11 points ahead but jean quan captured more second and third place ro votes leading to her surprising win. >> i know people today, people say what happened? >> perata accepted his defeat

but some voters are confused about the system. >> if you can't explain how in the ninth count you lose, if i can't understand it, how can a voter understand it? >> they believe it worked in oakland. san francisco is now a crucial test. >> san francisco election will be a test because people are aware of rank choice voting. >> a supervisor has his way, voters won't become too familiar with it. on election day he plans to submit a proposal for the june ballot to repeal rank choice voting. >> whoever is the next mayor will be elected with the majority of votes. >> but there are many supporters. >> i love it, we'll see what the voters think. >> the elections department hopes to have most of the ballots counted by the friday after the tuesday election. this week the oakland school district is expected to decide whether to close five elementary schools to save money and

consolidate for a declining school age population. our media partner oakland tribune says the closure list includes lake view, laveer in the fruitvale neighborhood, marshal, maxwell park they are mills kron and sante fe. the district operates 500 schools but has 5,000 fewer students and $62 million less in the general fund than it had just three years ago. >> tomorrow bay area music icon car loss santana will have a treated for students at san francisco high school he attended. he'll be performing at mission high, celebrating the school's impressive accomplishment. 85% of seniors were accepted into college last year. santana and the principal talked with cheryl jennings in about how education be change people's attitudes. >> the more you educate people, the less people have tendency to

turtle neck, steve jobs recounts details about his life, feelings about success, politics and his fiercest competitor. >> today apple is going to reinvent the phone. >> the tech giant was livid over android software and he committed to spending the last dying breath, adding that he was going to destroy android because its stolen product. a the meeting between jobs and president obama, almost didn't happen. at first, the he balked and sitting down the president unless the president personally invited him. obama did not. jobs ended up meeting him at a san francisco hotel in the fall of 2010. it was there that the blunt speaking jobs, obama you are headed for a one-term president si. why? according to the biography he says the obama administration was not business friendly.
