in the news this saturday morning, november 12th, eviction notices to occupy protestors camping at the plaza. 12-year-old skateboarder is dead and 8-year-old boy seriously injured after being hit by a garbage truck in vallejo. >> good morning san jose, still waking up to clouds around the bay. sunshine is on tap for everyone today. >> good morning, i'm terry mcsweeney. the city of oakland is once again telling occupy protestors it's time to get out. a fatal shooting near the camp thursday night. the mayor says it's not safe. >> we are asking the campers to leave the plaza now and to leave peacefully. >> police handed out final eviction notices but so far no

one is budging. >> a former marine injured during a previous clash between protestors and police is now out of the hospital. scott olson is still unable to talk but communicates with text and e-mail. other vets have rallied around this man and for the occupy support movement. tomas ramon has more. >> about 30 veterans from iraq, afghanistan and vietnam spoke to the camp. they came to protest the injuries their fellow veterans received from police while trying to protest peacefully last week. >> four veterans have been brutally attacked by police during resent actions related to occupy oakland. >> they led a peaceful but loud march. 114 people chanted end the war

and tax the rich. they said stop beating. they handed out a notice to the protestors in the plaza. they are to take down their tents immediately. occupy residents took the warning in stride. >> they gave us several notices and they gave us a two-hour warning. when the two-hour warning comes. >> along with the local ministers they released a white dove for a solution to removing the camp. the fatal shooting is on another example of violence caused by the occupy camp and another reason why it has to go. >> we are asking the campers to leave the plaza now and to leave peacefully. we are asking the community -- i'm here to ask the community to help me work and talk to the people at the plaza to see if we can do this as a city. >> city pay have to go it alone

as far as help from other agencies. the sergeant says the alameda county sheriff's department will not respond to another call for mutual aid. >> this is no longer an emergency when you have allowed people come in and camp out. >> sheriffs department if they want to hire officers to clear the plaza it will call them $1,000 per officer. a spokesperson says if the plaza is cleared again they will just bring the tents back in. for thursday night's fatal shooting, police have now released descriptions of two suspects. one a man that .a lot of time in the camp. he was known as alex was shot after a confrontation between the two groups he died at the hospital. first suspect african-american, early 20s, 5'9", 150 pounds. witnesses say he was a regular at occupy oakland.

second suspect is also african-american, 20-30, 5'10" with long dreadlocks. he may have a tattoo on the back of his neck. a spokeswoman for u.c. berkeley says the university will investigate the police response to wednesday's occupy cal protests. this shows police hanging a professor by the hair and shoving her toward officers. seven protestors were arrested for resisting and delaying officers. the video is from online newspaper the bay citizen. >> a young skateboard ser dead and another is seriously injured after being hit vallejo. they were sitting on a skateboard. they ended up underneath a garbage truck and was run over. a 12-year-old boy died. 8-year-old boy was airlifted to children's hospital with serious

injuries. two cars went off the road on mount diablo in separate incidents just hours apart. one with deadly results. first incident happened just before noon near the south gate. the driver did not survive. then as report shows, four hours later another car went off the road just a mile away. >> reporter: it looks over the black land rover that plunged and landed in a ravine. >> we found the victim of the crash, probably about 70 yards up from the car. she was pronounced dead on arrival. >> hours later a second crash a mile or two from the zblirs apparently theylost control and went off the road and went off and landed in a tree. >> both areas says the chief says is not typically dangerous.

the speed is only 20 miles an hour. what about the weather. >> first one, we got call before noon. it was pretty clear other than raining. second call, it was pretty foggy. >> the helicopter through the second driver to john muir hospital to be checked out. >> as for the woman who died, chp isn't releasing her name until they notice the family. this morning penn state played the first game without joe paterno in nearly 50 years. a candlelight vigil was held in support of the victims in a child suspects sex abuse scandal. they have forced the out the university's president as well as paterno. it was in stark contrast to the violent demonstration in support of paterno. >> this morning a kidnapped major league baseball player is safe and sound in venezuela. wilson ramos of the washington

nationals, venezuela officials are calling it a kidnapping. first major league player to ever be a victim of that type of violence. three men are in custody in connection with the kidnapping. >> coming up next, a bay area exploding gang problem, even our smaller cities aren't safe but a new way to fight back. pg&e gets ready to retest a segment of pipeline that burst during safety testing last weekend.

the growing gang problem in the bay area is hitting small cities the hardest. one is south san francisco. as vic lee reports the city is now fighting back with a special gang unit. [ siren ] >> it was a friday night on the east side of south san francisco. this is gang turf. the officers had just arrived on a routine patrol when two shots rang out. >> we had a couple shots being fired. >> sergeant danny gill heads the response team. four officers assigned full time to fight an exploding gang problem in this peninsula city. the gunshots tell you just how bold gangs have become.

>> it could have been just letting us know we're here or a warning. >> the shots were fired near a small park where december gang shooting left three people dead and three others wounded. >> this area right here is normally the territory of one group and necessity claim the color red. >> as the violence continues the colors are beginning to blur. >> what we've been seeing last couple years is red on red rivalry where it's not usual. [ siren ] >> officers encounter half a dozen suspected gang members a couple streets down. this man had been arrested before for weapons. he is now on probation with gang enhancement. >> he can't wear gang clothing. >> they make more stops on

suspected gang members. they were arrested after police stopped and searched their car them found drugs and a baseball bat between the front seat of the car and a switchblade. for many of those stops their attire is a giveaway, rad shoes and caps. some are more creative, there is red underwear. this had tiny red stitchings on his shirt. it's almost a mantra. >> when they are looking for trouble they don't ask questions. it's different now, man. >> through routine patrols, they want gang bankers to know they are always. bangers. >> he is now enrolled in a project a gang intervention program. this say they are becoming younger and younger.

>> you want to hang out with the big crew so they have grown drastically. you can't believe it. i saw a little kid 12 years old carrying guns. >> to counter that they have held meetings and parents night and afterschool programs. >> we will assist them with homework. air hockey or fooz e ball. >> since they were formed they made 200 arrests and confiscated some 15 guns. >> pg&e today plans a retest a natural gas pipeline in woodside which burst. when it failed it sent mud and water gushing down a hillside on 280 shutting down northbound lanes. they have cut out the damaged section of pipe. if it does well during testing

today, crews will seal the pipe and fill in the whole. pg&e is testing 150 miles of pipeline in response to last year's fatal explosion in san bruno. >> the one-quarter miles long. >> today is the 75th anniversary of the bay bridge. when it eokd back in 1936 it was the longest bridge in the world. it is still one of the busiest as commuters watching they're saying yes, it is. >> maybe not on the weekend but we do have clouds around the bay area. shaping up to be a nice day. you can see a little sun in santa cruz, we'll see some 60s, but a big about-face from yesterday. i'll have more details and the rest of the weekend, dry week ahead coming up. >> also next, college basketball season here cal bears open at home with expectations this

the world. back when they finished the transamerica building it was one of the five tallest buildings in the world. 850 feet tall. so if you are a window washer that is the job you want. >> if you like dungeness crab, commercial crab season opens officially down to half moon bay. they are trying to negotiate a price with buyers. last year they hit a record 19 million pounds, it's expected to be lighter than this year. sports fishermen say they are getting four crabs per pot compared to ten per pot last year. >> that is good to know. it's going to brighten up around the neighborhood. still a lot of cloud cover in the sierra nevada and heavenly

right now looking at partly cloudy conditions. later on today in the northern various in the 40s. definitely cool, overnight lows below freezing. probably making some snow in some spots. we do have a fog outside and visibility is restricted in ours valleys and to the north in novato. you can see sutro or tam cam looking down through richardson bay. things will improve. visibility will improve in the next couple of hours. right now mainly in the 50s. 51 in mountain view, livermore and fremont with 50 in santa rosa. it is warmer for sure to start out this morning even despite the cloud cover yesterday that keep the temperatures up. that rain did not want to let up. we saw a couple hundredths but now with the left over moisture we're talking about three-mile visibility.

this is visibility in miles. novato only 2 1/2 mile visibility and the coast is five miles. so with it continue to dry out mostly sunny sky. we do have weak system headed our way. sunshine and partly cloudy tomorrow. we're not going to see any rain from that trough. it will bring us a few more clouds. most of the upcoming week will be dry. by thursday night we're talking more rain and much colder weather system. so if you like it dry, most of next week looks dry. but the weekend shaping up to be quite unseasonable. as we take a look. rain in southern california. some snow around mammoth, gusty winds along the grapevine, we are looking a few more clouds, northern california a very lighted north wind right now. that will work to aid in our drying of the atmosphere today.

here is a look at live doppler 7-hd. the rain from los angeles to san diego, all the way you up through vegas. temperatures will be cool there, low to mid-60s. maybe a thunderstorm, back home we're talking low 60s, a little sunshine. san francisco about 61 today as well as millbrae, upper 50s at our coast. sunset upper 50s. cool afternoon but despite the numbers, feel pretty good around 1:00 with numbers climbing up to the 60s. we'll hit about 61 in san leandro, 63 in fremont and some of the warmer numbers around pleasanton, 64. 65 in gilroy today. overnight lows will be in the 40s and 50s with patchy fog, not a lot of change for the rest of the weekend. we warm up a couple degrees from tuesday and wednesday and then by end of the week, we will do

president obama is in hawaii this morning for talks with the leaders of china, russia and japan before who's contingent the asia-pacific cooperation summit. air force one arrived in honolulu overnight. his home state is hosting the summit. eight member countries are involved in a plan to establish a free trade zone in the pacific. before leaving the u.s.s. aircraft he recorded his weekly

address on meeting the economic needs of veterans. >> i called on congress to pass a returning hero's tax credit and a wounded warriors tax credit. i was pleased to see the senate put partisanship aside and came together to pass the tax credits. >> his trip will take him to australia and indonesia before returning to washington. new move to boost the taxes you pay every time you fill up. a new report shows hundreds of billions of dollars short when it comes to fix go roads. nannette miranda reports it's a funding gap that could delay more than 3,000 safety improvements. >> tire damage from it. >> road conditions. >> a few problems on the way. >> and traffic jams. >> it's growing. pretty soon we'll be like l.a. >> it's rough to drive in the state.

a new report by the california transportation commission revealed it will take more than $500 billion through 2020 to help fix crumbling roads and public transit. the problem is we'll barely have half the money. >> we are looking at the money that we don't know where it's coming from to address the zbleedz they say it's time to look at raising the gas tax, it's currently at 18 cents. it's not gone up since 1994. and they say it should increase with inflation. >> when i look at not raising it and the cost of building is more than double since then, the relative value of the gas tax has really declined. >> with high gasoline prices and tough economic times, most voters are reluctant to approve

east bay. yesterday even the east bay valleys picked up over a tenth of an inch of rain. we picked up half an inch in san francisco and nearly an inch in monterey county. with that out of the way we are looking at higher pressure building. 51 in mountain view. good morning napa. 53 degrees, here is a look at visibility in miles with novato, with reduced visibility. five miles along the coast. livermore three-mile visibility. that will be changing as winds are coming out of the north. that is going to dry things out. clouds will evaporate and turn sunny. another weak system brings in a few more cloth. partly cloudy and high pressure, stronger area of high pressure build in for most of next week. thursday night overnight we could see rain. that could set the stage for a pretty wet weekend, maybe beyond that. too soon to tell but satellite

and radar composite shows the front pushing into southern california. it's actually offshore, the area of low pressure, 300 miles west of san diego and snow this morning, rain this afternoon and some very windy conditions. live doppler 7-hd shows the rain in southern california, vegas as well and also along the grapevine, looking at problems. back home we're talking about chilly weather in the sierra nevada. couple inches of snow and overnight lows will continue to be cool. highs in the 60s for the most part in the next several days. in fact today, 64 in campbell. 63 in sunnyvale. seasonal for this time of the year. half moon bay, 59. low 60s downtown today. big improvement from yesterday. it was awfully dreary and rain didn't go away in the north bay.

nice improvement today, 63 in napa. east bay, cool and gray, dry now with warmer temperatures by a couple degrees in oakland. by late afternoon, 60s in danville. 64 in pleasanton. plenty of clouds hanging around the monterey coast with increasing sunshine should be a nice afternoon. it will take several days to dry out. very little temperature change in the upcoming days ahead, but into the middle of next week, we get a little bit of warming as the ridge strengthens before a stronger trough heads our way perhaps next weekend. >> any thoughts on the thanksgiving forecast. >> i hope it's nice. >> thanks very much. >> something that is a nuisance in california is a killer in much of africa.

malaria in sierra leone. research that begin right here in the bay area is offering new hope to the west african nation. here is carolyn johnson with this morning's report. >> the bush country of sierra leone is beautiful with majestic rivers. hovering in the background is a silent killer. mosquitoes that carry a deadly form of malaria in the surrounding villages. it hits the young children especially hard. >> do you worry about malaria and illness? >> yes. >> the concern for their son. >> he hasn't had it yet?

>> we'll get it. >> with the help of a flashlight sam any mi and his family showed us the mosquito net they all sleep under at night. a net that offers little protection because of the hole. if a child develops malaria, immediate treatment can mean the difference between life and death. >> it's the number one killer disease. >> a surgeon trained at san francisco general hospital is learning the techniques for healing fractures but most of the children are suffering from extreme complications from malaria. families don't reach the emergency hospital until the symptoms are already severe. >> they are rushed in gasping. requiring urgent blood transfusion. >> but help could soon be on the way from the bay area. berkeley researcher has developed a synthetic form of the most common drug for

malaria. in partnership with one world health, scientists used biology they produced it from e. coli in huge tanks. >> to increase the increase it and lower the price substantially. >> the price could drop down to 25 cents and could be widely available as early as next year. back here, clinics scramble to treat the children that are diagnosed and aid groups work to educate families on prevention. >> while the efforts may take years to pay off, people are hoping that sierra leone will join the list of countries that havequad rated malaria. >> abc news is partnering with

if you or a loved one wants to be prepared for the senior years you may be considering long-term health insurance. one couple had trouble getting benefits they turned to michael finney not once but twice. >> the last time we saw beverly jo she was fighting to get long term insurance company to pay for his long term care. now she is fighting again. >> they started to give me all this trouble. >> beverly says when jack suffered a stroke it left him disabled but they purchased a long term care policy back in 1996. it was expensive. up to $534 per month.

now beverly figured it would bay off. however, when she filed a claim for home nursing she found benefits did not come easy. >> they kept writing me, no, we pay that much they declined to pay the full benefits. "7 on your side" contacted the carrier senior health care of pennsylvania. the company reviewed the claim again and in the end it did pay her an additional 4,092 in benefits but months later she found herself fighting the company again. >> they try to put obstacles in the zblath jack wound up in a nursing home. she filed another claim. >> they sent all these papers, i filled them all out. >> but they said it was not enough information. the insurance company said still not enough. >> they said you only send six

pages, actually want 35 pages. >> beverly says she and the nursing home never received a clear idea of what information the company wanted, just this letter saying their time was running out. >> we can't hold this claim forever. so the deadline is october 28th. >> letter said without that extra data we will be unable to pay your claim. one day before the deadline, beverly contacted "7 on your side" again and again we contacted the company. soon beverly got the good news. >> the senior health care called and they received all the information. >> they agreed to process her claim and soon after sent a check for $7,000. the company is saying the requested information was finally received on october 27th 2011. they never denied the eligibility but a built was denied because we couldn't read
