to a save our schools rally. occupy oakland also plans to set up camp on a vacant lot on the corner of 19th and telegraph but many neighbors say they want protestors to occupy someplace else. abc7's rick smith has more on that. >> i don't want it in my front yard or backyard or side yard. junior if the participants of occupy oakland movement were expecting a warm reception from the folks who live in oakland's uptown find, they are in for a rude awakening. >> but this is not the way to do it. this is the not the way to do it at all. >> there was a rally where they pledged to march down telegraph avenue. >> we are going to march, we're going to shut down some banks. >> but it's what they say they will do after that have many concerned. they are worried, reoccupation. the "r" word, reoccupation. >> people who want to go do that can do that and people would don't will go home. >> signs like these line the plaza warning that the overnight lodging and the assembly of

tents will not be allowed. so plan is to move here, this empty the city lot at 19th and telegraph, right in the midst of the oakland's uptown district and in the shadow of the oakland school for the arts. >> not near any school, it's not okay. >> her daughter is a student there and she supports the movement but she says the idea of a possible tent city next to her daughter's school gets a failing grade. >> i see what people are doing and there are things kids don't need to see. >> at a rally held earlier, demonstrators were confronted by some uptown shop owners. they made it clear they do not want patrons to avoid the area because of the protestors. and it also prompted a new response to the man tasked to bringing new business to the city. >> it is disturbing. whoever is leading the group obviously doesn't care about anybody else but their own personal gain in this. >> in oakland, nick smith, abc7 news. there's a new video clip showing the confrontation between an iraq war vet and

police in oakland. for the first time we are seeing a man challenge officers and then one officer breaks ranks and strikes him with a baton. we have the video and reaction. [yelling] >> the man you see facing off with oakland police is a local war veteran who said opd ruptured his spleen when they repeatedly hit him with a baton on the night of november 2nd. this new video was recorded by neil, a bay area photographer. >> when he was getting beat, i mean, i definitely wasn't happy. i was pretty upset. i was mainly focusing on just keeping it as steady as i could. >> wayne freedman asked the veteran for a reaction. >> do you mind talking to us? >> no, i don't want to be on tv. >> however, another had something to say after seeing

the video on the internet. she's with iraq veterans against the war and didn't like what she saw. >> it was pretty damning. it was hard to believe that, like he said, he was being peaceful and wasn't provoking anyone, and he just was beaten. it was terrible. >> rick smith doesn't see excessive force. >> what i saw was a police officer was ordering him to get down, to stop, and the demonstrator failed to do so so he took whatever action necessary to force him to do so. >> smith is a former fbi agent and president of cannon street, inc, a private investigation form. >> i think society is tired of this. you have the right to free speech and you have the right to assemble, but at a certain point law and order has to be restored and that's not happening here. >> he says he doesn't have any plans to that his video to the police. abc7 sent a link to the video to

the oakland police and we have yet to get a call back. they said the case is under investigation. city leaders haven't returned our calls either. in the newsroom, abc7 news. >> in san francisco union members say they will stand shoulder to shoulder to occupy members should the police raid the encampment. they tell abc7 as many as 500 members are on standby in the event of the raid. they said labor grease with the call for economic justice. >> police arrested ten occupy protesters and dismantelled their camp at uc davis yesterday. [yelling] >> uc davis police used pepper spray at close range to disburse students who were trying to occupy the uc davis camp. 11 people were treated for exposure to pepper spray and two more went to the hospital for treatment.

berkeley investigators are looking into the cause of a fire that gut add century-old five story apartment building last night. the residents of 39 sequoia apartments are looking for emergency shelter. the fire on the corner of telegraph avenue and hay street broke out about 9:00. firefighters battled the blames for about six hours. it was contained about 3:30 this morning. they tell abc7 news, it appears the fire started between the walls and spread quickly to the roof. >> the fire is spreading throughout the floor. we have no firefighter injuries at this time. there's flames and fire on the third through the rooftop, as you can see. >> 100 firefighters from at least four agencies were on the scene. firefighters believe everyone got out okay. the red cross is helping find temporary shelter for the displaced residents. they also have ground floor shops and restaurants. >> the city of vallejo plans to hold a vigil tomorrow night at

city hall in honor of slain police officer. henry albert smith of fairfield is being held on murder charges. this morning a flower memorial continues to grow at police headquarters. they have created fund to help out the officer's wife and their three daughters. you can find more on that at abc7news.com. >> 25 homes were destroyed near reno, the southwestern edge of reno. a wildfire forced nearly 10,000 people from their homes. the mayor said they will start returning home today about noon. firefighters believe the flames may have been sparked by a downed power line. winds gusting up to 60 miles an hour fanned the flames yesterday. a 64-year-old man suffered a heart attack and died. >> coming up next. >> it does not require one in most situations.

>> how many people know where you are at this moment? probably more than you think. the supreme court is considering who should be allowed to track your information electronically and whether they need permission to do it. here's jonathan bloom junior long before we used gps to find our way around town, rick smith was using it to keep an eye on suspects. >> it was used when i was in the fbi 15 years ago but the technology has improved so the device is much smaller. ten years ago i would say this was state of the art. >> jason, who owns the international spy shop, shows us this elaborate kit that once cost thousands of dollars and took hours to install. >> today's trackers are smaller. this is one here. a mini tracker. >> they are small, easy to hide and cost a few hundred dollars. >> on a vehicle this side, the spare roof tire has a lot of metal on it. you can reach in and it's there. >> for private citizens it's illegal to track a car without the owner's permission but it's not for the government. >> it does not require a warrant in most situation. >> that's where the american

civil liberties union comes in. >> if the government wants to be able to access and track our location through gps devices, they need to go to a judge and get a warrant. >> the u.s. supreme court is considering requiring a warrant for gps tracking. the aclu said it would be a critical step to protect privacy. >> many people might be thinking this supreme court case has nothing to do with me. the government would never be installing a gps device on my car. but the reality is that the government doesn't need to install a gps device in your car to track you. >> the fact is most of us already have a gps device tracking our every move. they are made by companies like apple and motorola and report our location. companies like verizon and at&t. >> is my location of really private. >> no. >> antwan said phone companies have plenty of legitimate and legal reasons for collecting us. >> they collect data for finding outages in your cellular coverage. you don't have to report these things, the phone is doing it for you. >> but a justice department

document say companies store that information sometimes for years. >> do you remember everywhere you have gone since july, 2008? i don't remember this, but at&t knows because i'm an at&t customer. >> i can assure you that the industry goes to extraordinary measures to keep that information safe. >> speaking via skype, wireless spokesman john wall acknowledged one reason for keeping the data is in case it is requested by police. >> they have to show just cause for the location information to be shared. they have to go through the legal system, go to a judge, provide the proof and get a warrant. >> we know that sprint received over 8 million demands for location information in just a 13-month period. and privacy advocates say while it's one thing to know somebody's location, knowing everywhere they have been for the past few years can tell you their whole life story. >> it can reveal where you live, what your child's school is, what doctors you visit, whether you go to a political protest or

you go to a religion service. >> but former fbi agent rick smith insists most people have no need to worry. >> if you are not transporting a thousand pounds of coke, you shouldn't have a concern. >> in san francisco, jonathan bloom, abc7 news. >> if you are hoping for some fresh crab on your thanksgiving table, it might not happen. local crabbers have yet to agree on a price with seafood distributors for this year's catch and no new talks are scheduled. it typically gets resolved at the last minute before crab season opens but four days into the season, crab fishermen refusing to go set traps until they are guaranteed $2.50 a pound. they have offered two dollars , up 25 cents a pound. but crabbers say they can't make a living less than $2.50. last season they settled on $1.07 a but the harvest was

it looks nice out there, you feel how cold it is. we are looking at a bit of a break until the next system moves in. in heavenly, some clouds around and chilly numbers, in the 20s. we're not talking about any new snow here a new leftover snow showers perhaps this morning but we are looking at calmer winds and a day of res pit before the next system heads our way. and this from mount tam, partly cloudy conditions. we are talking about another area of low pressure, a cold front sliding down the coast tonight and bringing heavy rain to southern california. what about the bay area? well we will see rain as well but we have a dry day first and a cold start. good morning, napa, 34. san raw fell, 343. in pocket here we are talking visibility less than a quarter mile. notice it is warmer, of course, as you head south. san francisco 46. 39, though, in fremont with 38 in mountain view, 39 half moon

bay. how much colder? wow, anywhere from 5 to 18 degrees colder this morning than yesterday morning. all week long it wasn't such a cold start heading out in the morning hours, but today big change as yesterday's system moved through. the cold air is in place. we are talking about a weak high pressure bringing us partly cloudy skies today. enjoy it. we will look for good visibility as the fog lifts. and then the rain returns early evening hours in the north bay. later on today the rest of the bay area pushing on through overnight. we will dry out tomorrow. partly cloudy the first couple of days of next week. then we are talking more rain, and snow for the sierra nevada thanksgiving. here we are right now with our satellite and radar composite and notice a little bit of moisture heading through the sierra nevada and most of the activity and cold air continues to stay bottled up to the north and west of us. we are talking another area of low pressure that will sink south, move over the bay area

tomorrow and we are talking rain throughout the entire state for the most part. today enjoy that break throughout the afternoon, the he will evening hours. we are talking about dry weather right on through the early evening hours and then things do begin to change. maybe three quarters of an inch to an inch of rain with this next system as it drops down from the south. here's a look at what you can expect. by 7:00 tonight, santa rosa, napa, some light showers. we do have the main frontal band still to the north of us. so we are dry for the big game on the peninsula tonight. but by nine, ten o'clock, could be looking at light showers here. the rest of the bay area getting wet as the cold front pushes through by the overnight hours. heavier rain here and by 6:00 tomorrow morning we are talking scattered showers and we will continue to dry out to the late morning hours. by the afternoon we are talking more sunshine, a cool day today, though, with 55 san francisco,

you. >> thank you. >> well, in sports tonight cal and ninth ranked stanford square off down on the farm in the 114th big game. larry beil tells us why it may be a bigger game for stanford in this morning's sports. >> good morning. the national championship dream is gone but stanford still has a lot on the line tonight against cal. beyond the bay area bragging rights and the coveted axe. there's still a possibility of a bcs bowl berth for stanford. and luck looks to revive after struggling against oregon last week. stanford hosting cal on espn. the cardinals just had a 17-game winning streak end. before the loss to the ducks the cardinals had not dropped a home game since 2009 when cal went down to the farm and left town with the axe. >> we got to get up for this game and we have all the motivation we need. last time we played this team at home they beat us and we -- they celebrated on our field. that's why i remember.

>> president obama returns to washington tomorrow following a nine-day economic tour of the asia pacific region. last night in indonesia president obama held an unscheduled meeting with china's prime minister. the white house said a territorial dispute in the south

pacific sea was briefly discussed, but also steps they could take to foster global recovery. the president said u.s. global growth in asia is key to building jobs. >> building an economy to last isn't just about making things, it's about opening new markets for people to buy them. after all, 95% of the world's consumers live outside our borders, and as the fastest growing region in the world no market is more important to our future than the asia pacific region. a region where exports already support 5 million jobs. , american jobs. >> the administration's new focus on asia has unnerved china somewhat. china state-run media accuses the u.s. of trying to impose dominance over asia as the u.s. winds down wars in afghanistan and iraq. the war in afghanistan has taken the lives of two more bay area men. san ramon valley high school is mourning the death of joshua, who just graduated last year and joined the marine corps. he died fighting in afghanistan.

defense department has not posted the announcement. they do report the death of 21-year-old national guards man from san jose. shawn walsh from san jose. he was assigned to the 185th military police battalion based in pittsburgh. his unit, seen here, deployed for afghanistan last december on a one-year tour. >> in other news, social media sites like facebook around -- are not just popular with consumers. they have also become a new avenue for advertisers. you have probably noticed. business and technology reporter david loui shows us the novel ways they are using social media and why some consumers are pushing back. >> facebook allows people to share their lives, photos and likes with friends w800000000 and with eight hundred million users on facebook it's a place advertisers and marketers go to reach consumers. it's hard to escape the ads and

campaigns and the proliferation is starting to cause irritation among users. >> would that eventually chase you away from facebook? >> if it gets more intrusive, yes. it's barely okay now. >> social media advertising is still in its infancy, representing just under $1 billion a year in spending. but experts forecast it will explode to $20 billion within three to five years. >> it's all focused on engaging the consumer in a one-on-one interaction. therefore, it's not about direct advertising spend anymore, it's about how you create engagement with consumers. >> for decades we've gotten use to mass media advertising such as tv commercials but social media advertising is different. look at had campaign for philadelphia cream cheese called the real women of philadelphia. it has a presence on facebook and it pushes consumers to check out videos on youtube for recipes. and there's a website where consumers have submitted over 36 hundred dread of their own recipes. all of this engagement was designed to boost sales, which has been flat. and what was the result of this campaign? sales of philadelphia cream cheese went up 8%.

bridge obviously, and it is -- boy, that's a beautiful shot. something different about the bridge today. the walkway and the bike way on the bridge returning to normal configuration today. for the first time since mid-september. this morning the east side walkway fully opens, allowing visitors to walk across the entire span. the west side returns to bicycles only on weekends and weekday averages when there is no seismic retrofit work being done. bicycle lifts say they would like to see the return of the 24 hour access on the west side and the bridge people said they would think about that. they put up a beautiful shot of the bridge. it's hard to tell, is it clear out there? was that a blue sky? >> yeah, we are looking at some clear skies. in fact, frost in the sheltered area of the north bay. we are talking mid-and low 30s. patchy fog from napa, santa regulationa and much warmer conditions closer to home or in the city where numbers are in

the mid-40s. we have the clear conditions, and the sun officially up in another ten, fifteen minutes or so. we are going to be talking about a cool, dry day today. in fact, another twelve to thirteen hours of dry weather. the bulk of the day dry today and the bulk of the day tomorrow dry. so where is the rain going to fit in? well, it's going to fit in through the overnight hours. right now we are talking 30 santa rosa, 34 napa, 40 redwood city. look at the upper 30s from fremont. mountain view, los gatos and livermore. well below where we were yesterday morning. anywhere from 5 to 18 degrees colder. we are talking a very cold start out there, one of the coldest starts we've seen all week long. but we will look for a moderate warmup as we see some sunshine today. a weak high pressure builds back in. the rain returns by the early

evening hours in the north bay, overnight hours from the south bay along the monterey coast. it will push in through southern california, and then as it exits we are talking about a dry latter half of the weekend leading up to the early part of next week. so here's a look at our satellite radar composite. we are talking about no problems this morning if you are headed on out for an early morning run or bike ride. it's chilly out there but you won't run into any rain. that's to the east of us ( also a few leftover snowflakes in the sierra nevada. but the next system is on its heels and this will continue to drop to the south and east of us. we will get everybody wet, anywhere from three quarters inch to an inch of rain by probably about noontime tomorrow from about 7:00, 8:00 tonight through noontime tomorrow. in between talking partly cloudy skies, a cool afternoon today. so if you like some sunshine and dry days, the weekend not too bad. but here comes the next system and it will likely arrive in the

north bay by about 7:00, 8:00. here's what i'm talking about. you see the bulk of the activity offshore. from about napa to santa rosa we've got some wet weather. it will take until about 9:00, 10:00 for this system to reach the peninsula and the south bay. the big gain today at stanford looks dry, maybe leaving you will notice a few light rain showers. but the rain will be getting going along san francisco and in the north bay and really all throughout the evening hours, pushing all into the east bay and down the coast. so we are talking about a wet start sunday morning. then by about 10:00, 11:00 things really begin to dry out and we are talking about a decent sunday. 57 today san jose. palo alto and san mateo with dry conditions. the rain moves in about 7:00, 8:00 north bay. another four hours until the peninsula and south bay and then we are talking not a bad sunday. warmer monday, tuesday. wednesday some rain arrives with

thanksgiving looking somewhat wet. maybe an inch of rain and then a slight chance on friday. so we are about 77% of normal in san francisco. doing all right rain-wise. >> we will be jumping up-closer to 100 by the end of the week? >> maybe. >> thanks, lisa. thanks a lot. abc7 cheryl jennings paid a visit to south korea recently and took a ride on the high-speed rail system. it took decades to get done, faced a great deal of opposition, but it has for ever changed travel and business in south korea. >> you are looking at the ktx train express in south korea with two rail lines that connect to the entire country from the biggest city seoul to the second biggest city, busan. >> from seole to busan it takes 5 1/2 hours by car but less than 3 hours with the train.

>> i started at the station, one of the busiest transit stations in the world. it's a place where america hopes to sell koreans on chevys and where korea it wants to sell to america, the ktx. tech savvy travelers can pay for tickets with a cellphone with an application called glory. >> you can choose your destination and type of train and starting time and departure. >> i check out first class, complete with food and beverage service to arrive from soule to the headquarters of where they make this. >> we are on the high-speed trail in seole, korea and leaving to go to another town. i have to say it's quiet, very comfortable, and it's going to be going very fast. the train is designed to go 220 miles an hour, but the maximum speed they run it at is 190. even at 190 you see the landscape is flying by. ridership was only 72,000 passengers when the ktx started running in 2004. that's according to the director of the department of international affairs for co-rail.

story. >> walk into any downtown san francisco high rise and you might have to sign in, show an i.d., maybe wear a name tag. but what about letting them scan your driver's license? that's what you have to do if you want to get in here, the pacific gas and electric company in san francisco. >> we have some extremely sensitive assets in here. >> i asked pg&e to explain what they are doing scanning the information off of our license? >> all the high rises around here, when i walk in they may ask me for my name, but nobody else is swiping my i.d. what's up with that? do i look shady? we have our employees, gas and electric operations for northern california and we have a child care center. we owe them a strict security system. >> they have captured the names and photos and license numbers off the licenses of thousands each year, showing the date and time of each visit and where they went each time.

isn't driver's license information supposed to be private? >> there's a section of the civil code that makes it very clear that a driver's license can be swiped only in certain very narrowly defined circumstances, and as a condition for entering a building is not one of those circumstances. >> abc7 legal analyst dean johnson said california law makes it a crime for businesses to swipe your license, then retain your personal information, except for specific purposes, such as bank money transfers, but building security is not one of the exceptions. >> it's pretty clear that just swiping everyone's driver's license and then using that information to track the comings and goings of the driver's license holder is not legal under the statute. and anyone who is doing that is almost certainly committing a

misdemeanor. >> we do not believe that this was a violation because folks are handing their information voluntarily. >> however, you cannot get in the building without agreeing to the license scan. pg&e claims the practice is widespread, though we could find no other building in the bay area that swipes your license as a condition of entering. here at the transamerica pyramid security doesn't require a license, but it does snap a photo of each visitor to create a badge and, yes, they keep the picture. at the federal reserve bank visitors need only to have an appointment with somebody inside. all of that is within california law. pg&e would not let me see how their system works. it wouldn't even let me go inside for the interview so we are standing outside. >> do you see how this is going to look to some as if you are hiding something, you are building and not letting me see the system? >> michael, we can certainly let you in the building but we are asking you to keep a distance. >> it was different here at the plug and play center in sunyvale, a complex of 300 high-tech start-ups from around the world and a high-tech

security system for entering. >> we just need to make sure we know who is accessing the building. >> folks there show us how it works. visitors provide their name and e-mail address. the system snaps their photo and creates a badge for access. at the end of the day, however, all those pictures are deleted. >> we didn't want to have the server have a bunch of pictures on it and, frankly, there's no reason to keep it other than to have it on the badge when the person is in the building. >> there's no law that would stop them from taking your photo when you came into the budding. -- the building. >> this person of the electronic frontier organization said the law only lets you capture the official government id, not another photo. she said pg&e's system is more worry some because the license is your official id >> people who want to operate in society occasionally do need to visit buildings and have meetings with other people. pg&e is responsible for your electricity. you shouldn't be forbidden from entering just because don't want to hand over a personal document.

>> so how does pg&e react to all of this? two days after we brought this matter to its attention, pg&e did an about-face and changed its security system. >> really? >> yeah. >> so our inquiries made you look at the law and look at what is going on? >> well, we never had a complaint in the over five years that we've used this system until your producer complained about this. >> pg&e said it will still require you to scan your license in order to enter the building, and it will keep your name in its computer system. however, from now on the company will not retain your driver's license photo in its data base without getting your permission first. already the utility has deleted tens of thousands of photos that were collected in its data base over the past five years. generally it's okay to swipe a license to verify age or identity for transactions like buying alcohol. however, it is rarely legal to store the information. abc7 legal analyst dean johnson says so far no one has sued a
