in the news this saturday morning, november 19. occupy fans have sent set up on a vacant lot. but many say they want the protestors to go someplace else. and firefighters battle a fire for more than six hours. >> good morning, lots of sunshine but is it cold. below freezing. less fog in the north bay valleys. rain is coming back this weekend. occupy oakland plans a rally and march to deliver bills to big banks downtown. it begins at 2:00 at 14th and broadway. demonstrators will march to lake view elementary school for save our school rally. occupy oakland plans to set up a

camp on a vacant lot on telegraph but many neighbors say occupy elsewhere. >> i don't want it in my front yard, my back, nor my side yard. >> if they were expecting a warm reception in the folks that live in the uptown neighborhood this are in for a rude awakening. >> this is not the way to do it at all. >> they pledged to march down telegraph avenue. >> we're going to march. >> but it what they say they are going to do -- re-occupation. >> signs like these lined the plaza warning the overnight lodging and assembly of tents will not be allowed. so the plan is to move here. this empty city lot right in the midst of the vibrant uptown district of diners and

restaurants and in the shadow of the oakland school for the arts. >> it's not okay. >> joe's daughter is a student there. she supports the movement but says the idea of a possible tent city right next to her daughter's school gets a failing grade. >> it means that kids are not safe. >> at a rally held earlier, demonstrators were confronted by some shop owners. they made it clear they don't want patrons to avoid the area because of the protestors. plans prompted a strong response with the task of bringing new business to the city. >> it's very disturbing. whoever is leading the group doesn't care about anybody else but their own personal gain in this. a new video clip showing the confrontation between an iraq war veteran and police in oakland. for the first time we are seeing him challenge officers and one officer strikes him with a

baton. here is the video and reaction. the man you see facing off with oakland police is sabeghi a veteran that says police ruptured his spleen when they hit him with a baton. this was recorded by a bay area photographer. >> i was pretty upset. i was mainly focusing and being as steady as i could. >> wayne freedman asked him for reaction. >> would you mind talking to us for a couple of minutes? >> no, not on tv. >> but they had something to say after seeing it on the internet. he didn't like what he saw? >> it was pretty damning. it was hard to believe.

like you said, he was being peaceful and wasn't pro vocal go anyone. it was terrible. >> rick smith doesn't see excessive force. >> what i saw was a police officer ordering him to get down stop and the demonstrators failed to do so. so he took whatever action necessary to force him to do so. >> smith is a former f.b.i. agent and president of cannon free ink a private investigation firm. >> i think society is tired of this. you have a right to free speech and right to assemble but at a certain point law and order has to be restored. >> he says he doesn't have any plans to take his video to the police. abc7 did send a link to the police but we have yet to get a call back. the case is under investigation. city leaders haven't returned our calls either.

in san francisco union members say they will stand shoulder to shoulder with occupy members should police raid the encampment. as many as 500 members are standby in the event of a raid. a tense confrontation at u.c. davis when police arrested ten occupy protestors and dismantled their camp. >> u.c. davis police used pepper spray to disperse students that were trying to occupy the camp. students sat on the ground and did not try to resist. 11 people were treated to the scene and two more went to the hospital for treatment. berkeley investigators are looking into the cause of a fire that gutted a century old five story apartment building last night. dozens of residents are in place

of a need to stay. it broke out about 9:00. firefighters battled the flames for six hours, finally had it contained about 3:30 this morning. berkeley fire chief tells us it appears the fire spread quickly to the roof and started in the walls. >> the fire is spreading throughout the floor. we have no injuries at the time. >> 100 firefighters from at least four agencies were on the scene. firefighters believe everyone got out okay. the red cross is helping find temporary shelter for displaced residents. san jose police are searching for a driver who struck and killed a pedestrian last night. it happened at the intersection of story road and bedford street around 6:30. a man was pronounced dead at the scene. the victim is the fifth person to die after being hit by a vehicle in san jose in just the

past two weeks. all the accidents have happened since daylight savings ended about 6:00 p.m. in the darkening rush hour. >> they are holding a memorial in honor of jim capoot. he was chasing a suspected bank robber. this morning a flower memorial continues to grow at vallejo police headquarters. vallejo police have created a fund to help out his wife and three daughters. you can find information on how to donate at abc7news.com. >> wind have calmed down and snow is spreading in reno this morning is good news for firefighters battling a wildfire. it broke out yesterday possibly sparked by a downed power line. it was fanned by 60 mile-per-hour winds. 25 homes are damaged or destroyed and 10,000 people remain evacuated. cecilia vega shows us they had little time to get out.

>> ferocious winds ripped this fire out of control putting the flames in the upscale neighborhoods. in all, 2,000 acres torched more than 20 homes and structures damaged and nearly 10,000 people forced to flee their homes in search of safer ground. >> very scary. this morning about 2:00 i smelled smoke but i thought it was one of our neighbor's fireplaces. then it was about 6:00 this morning lot of different people were asking me if we were okay. i didn't know what they were talking about. we're kind of in shock right now. >> reporter: a firefighter is in the hospital after suffering serious burns. a 47-year-old man suffered a heart attack while trying to flee. >> we have all our assets deployed. national guard is on standby. >> it was a dangerous kings of

dry land and brutal winds that pushed it to 400 acres to three scare miles. >> the wind is unbelievable. it's blowing it all out of proportion. >> reporter: once the winds died down, firefighters said they managed to spare 4,000 homes. still, thousands more were forced to evacuate and many spent the night in neighborhood shelters. >> on the front lines, the worst may be over but for residents returning home today, the cleanup is just beginning. >> thousands of people are out of homes overnight. >> our goal is by 12:00 today. >> she says police and national guard units have been patrolling the neighborhood to make sure the evacuated homes don't get burglarized. >> coming up next.... >> it does not require one in most situations. >> your cellphone and gps every step is being recorded and stored. people are asking who should have access to that information.

since yesterday morning, that cold air moves on in after the weak system and we are anywhere from four to 19 degrees colder this morning. we'll recover somewhat today with numbers in the mid-50s under partly cloudy conditions. clouds will increase especially in the north bay. rain is holding off in the north bay and then tonight it moves on in san francisco and peninsula. looking for partly cloudy skies by midday tomorrow. a little rain tonight. the bulk of it will be overnight. we'll start out on the damp side tomorrow. satellite and radar composite, half a foot of snow around reno and points eastward. that is still winding down while the next weather system coming down from the gulf of alaska. it will be sliding down the coast. so we are looking at a partly cloudy day to squeeze on in before this system brings the rain.

three-quarters of an inch of rain. it will make it all the way down to southern california bringing mountain snow into southern california. i don't think we'll see much out of it in the northern sierra. with the track we've got rain for part of the game today but depending on where the low sets up, it could be rather soggy. forecast is going back and forth. this the latest forecast that says 5:00 rain in santa rosa. look what happens by 7:00. we've got moderate rain, san francisco into oakland and then a chance of rain in palo alto and south bay. by 9:00 or 10:00, looks like moderate rain pushes through the overnight hours. morning hours, leftover showers, 5:00 a few damp spots and then by 11:00 tomorrow morning we're looking at mixture of clouds, sun and few light sprinkles. 54 in richmond under dry

talking about below freezing in parts of the bay area, right now. >> right, in napa and santa rosa in the low 30s. lots of sunshine and enjoy it because we'll see an end to that and a wet weathermaker headed our way into the evening hours. here is a look at tahoe where numbers are in the 20s. numbers will stay rather cool, numbers below average in the mid-50s. it looks nice out there. still 30s around the bay with 38 in mountain view, 39 in redwood city and the numbers slowly coming up along the coast in the 40s. livermore, 41. a little bit of fog and numbers will respond to the sun but the clouds will quickly moving in today. coldest numbers head down into napa and santa rosa this morning.

have been everyone is feeling the chill for sure. another area of low pressure that will slide down the coast overnight. it will bring rain for the evening thundershowers. -- evening hours. >> rain moves in and stays with us overnight. early morning hours. early riser it will be wet out there and drying out about noon. that will take hold. weak high pressure, looks like more rain headed our way wednesday and thursday. this system is not going to bring -- won't bring us any snow because it's close to the coast. but a weak ridge ahead of it should bring us a nice dry afternoon. increasing clouds around 2:00 in the north bay. this low will slide down the coast with it bringing the cooler air. it's already chilly out there. look for another cool afternoon tomorrow. we'll look for the rain, all over the bay tonight.

heaviest rain should set up along the shoreline. 5:00 tonight, santa rosa and points north, some rain but still southern marin county dry. as we go through 7:00, 8:00, it enters the south bay, and likely around concord and san francisco. middle of the game looks weather possibility along the peninsula, south bay and then the system pushes on through while you are sleeping. in the morning hours, it will be chilly out there. lake county looking at snowflakes and talking about still scattered showers early morning. by about 10:00 or 11:00, partly cloudy, once again, 50s for high temperatures. today 57 in oakland and palo alto and san jose with mid-50s to the north. only 46 in clearlake. definitely feeling holiday like the next couple of days with cold night and rainy night tonight. big warmup come monday and tuesday, low to mid-60s should feel pretty good out there.

embarcadero. what a beautiful day. certainly cooler, we've been hearing about that. a lot of people all over the world would be right where the camera is right now. >> more and more businesses are striping your driver's license like when you buy alcohol. california law puts restrictions on information. when we pointed out that to one of the biggest corporations they changed their policy. >> walk into any downtown san francisco high-rise, you might have to sign in, show an i.d., maybe wear a name tag. but what about them letting you scan your driver's license. that is what you have to do if you want to get in the pg&e headquarters in san francisco. >> we have some extremely sensitive information here. >> and explain what they are doing, scanning our information off of our licenses. >> all of the high-rises they

may ask me for my name but no one is slicing my. did. >> we have customer information and we have a child care center. we owe them a strict security system. >> they capture names and photos off the licenses of thousands and thousands of visitors over the past five years, storing it all in a database along with the date and time of each visit and where each person went each time. so, isn't driver's license information suppose to be private? >> there is a section of the civil code that makes it clear that a driver's license can be swiped only in certain very narrowly defined circumstances. as a condition for entering a building, it's not one of those circumstances. >> legal analyst dean johnson says california law makes it a crime for businesses to swipe your driver's license and

retaining personal information except for specific purposes, such as bank money transfers, building security isn't one of the exceptions. >> it's pretty clear that just swiping everyone's driver's license and using that information to track the comings and goings of the driver's license holder is not legal under the statute. anyway who is doing that is committing a misdemeanor. >> we do not believe this is a violation because folks are handing their information voluntarily. >> but you can't get in the building without a driver's license scan. pg&e says it's widespread but we continue find another building that swipes the licenses. here at transamerica, it does snap a photo of each visitor to create a badge. and yes, they keep the picture. at federal reserve bank, you need to have an appointment with
