>> the chancellor of uc davis demands action after campus police pepper spray students during a peaceful protest. >> and also, residents search for a new place to live after flames gut an apartment building in berkeley. >> good afternoon. >> right now protesters are marching in the streets of oakland. live from sky 6hd, a few hundred people are marching on grand avenue near euclid. they plan on stopping at banks along the route to protest. their final destination is lake view elementary for a save our schools rally. abc 7 is live from the ground at grand and mcarthur where the march is passing and john is live near 19th and pellgraph with the latest spot where they plan to set up another encampment. john? >> reporter: police and neighbors are here waiting, wondering what is going to happen here and what could be the next hot spot in the occupy oakland protest.

behind me you can see several dozen police gathered inside the park. there are also people, police gathered at areas on the corner around 19th and telephone, at strategic locations awaiting protesters to show up and possibly keep their promise to start an encampment near the fox theater. all afternoon the police presence was growing next to the fox theater. last night no trespassing signs went up around the property as some neighbors put on their own demonstration against an occupy encampment setting up here. >> i think if they try to occupy this area, the police are going to prevent them from doing it. however, if they were successful in occupying this area, i believe you would have a dirty, disgusting, filthy tent if i filled with drug dealing and rats and disease like oakland. >> reporter: earlier, police handed out notices to protesters camping in snow park, warning they are in violation of the law and they need to pack up and get out immediately. it was the second notice from

police in three days. mayor says the encampment will close tomorrow. >> are you going to stay? >> i'm going to head to l.a. >> reporter: now empty of stents, a few protesters returned and planted a garden in a corner near city hall. city officials were having talks about whether they would allow the garden to stay. >> start providing a beautiful face for people to convene and organize and educate and feed each other. i think it's really representative of a lot of things we have. >> reporter: at the same time, other demonstrators showed up protesting crime and violence in oakland. some were not happy to see the occupy people back. >> 99%. and i feel like their efforts should be directed against the 1%. not the other 99%. we have to pay taxes. >> reporter: again, live here at 19th and telegraph where police are waiting for the protesters to arrive. the residents do not want them to come. a number representing union interests and other citizen

groups protesting banks and also school closures, but also people here who may end up starting another encampment here and police are bracing for that if and when it happens. live in oakland, john allston, abc 7 news. >> thank you. before the march, a dance revolution broke out in the plaza. a flash mob of 100 people filled the plaza with a dance intend to do disrupt downtown oakland. spectators did flood into broadway and 14th during that dance. organizers said the oragree was meant to evoke a dying system and the awakening of a new society. a similar flash mob was supposed to take place in san francisco's justin herman plaza. >> speaking of occupy san francisco, the protesters there got a surprise visit from police and the department of public works. abc 7's lisa joins us live to tell us what happened. >> reporter: about 25 tents lined this grassy area behind me earlier this afternoon. but that's also when protesters voluntarily moved the tents to

the concrete area behind me. it's all part of a compliance measure instilled by the public works department. but the move is actually reinvigorating protesters. about 30 minutes ago, hundreds of occupy protesters marched up market street. they're going to 7th and market. it's a solidarity march to let the public know they're not going anywhere. there is also a very large police contingency escorting the protesters. all this comes after the department of public works ordered campers to remove their tents. in front of the federal building on market street, public works employees dressed in blue sanitation suits as protesters to take down their tents. campers locked arms in protests. dpw left after a few tents voluntarily came down. but a short time ago, it at least one tent went back up. supply tents office stayed up. at the main camp, protesters complied with the order to move

off the lawn. a dpw spokesperson told me they have no plans to return today. that progress was made. still protesters are not in full compliance. the mayor called occupiers an unsanitary environment and it was deemed a, quote, nuisance. protesters, meantime, refuse to leave. >> we linked arms. >> now what? >> now we're going to wait and see if the cops decide to show up. what they've been trying to do for the last three or four days we're going to raid you. >> we're unstoppable and as many times as they take down our stuff, they can't take our heart nor message. we are the 99%. >> reporter: are you worried? >> yeah. it's very stressful to be out here. there is always the threat of a raid. >> reporter: again, a very large police presence escorting protesters as they march up market street. otherwise, not a lot of officers

are staged at the camp. dpw would not say if there are pending orders for police to move in. back here live, i am told that tonight at 9:30, protesters will march from here in the main camp all the way to union square and then back again and then they'll hold a candlelight vigil. live in san francisco, abc 7 news. >> thank you. the chancellor of uc-davis is calling for the creation of a task force to investigate the police response to an occupy protest yesterday on campus. a school spokesperson defends officers' use of pepper spray, telling them that students were repeatedly told if they didn't move, police would use force. the school says officers used the pepper spray when students surrounded them while trying to protect an encampment on campus. police arrested ten protesters and dismantled that encampment. >> berkeley investigators are looking for the cause of a fire that nearly destroyed a five

story apartment building. the fire consumed a apartment building on the corner of telegraph and hay street. flames shot out of the building shortly before 9:00 o'clock last night and it took six hours to control. 60 residents were displaced and they lost valuable stuff. >> my passport, social security card. i just got a job yesterday. now i need to get a new social security card, new passport for work. i don't know how i can do those things again. i have nothing. i really don't mind all my belongings being gone. those can be restored. it's just things like my hard drive. i've had almost ten-plus years of my hard work in there. projects i started and i can't complete them anymore. >> no one was injured in the fire. authorities are now keeping people out of the building for fear that structure could collapse. san jose police are

searching for a driver who struck and killed a pedestrian. happened at the intersection of story road and bedford street at 6:40 last night. police say a man in his 60s died at the scene. the victim is the fifth person to die after being hit by a vehicle in san jose in the last two weeks. the city of vallejo will be hold ago vigil tomorrow night at city hall for slain police officer jim kapu. the 19-year-old veteran of the department was shot and killed thursday while chasing a suspected bank robber. henry albert smith of fairfield is being held on murder charges. a memorial for kapu continues to grow at police headquarters and a fund has been set up to help his wife and three daughters. you can find out more on how to donate at abc 7-point com. >> tonight is the big game. if you're heading to the game, most people are probably there. but if you're heading out, pack your rain gear. lee glasser let's us how how soon we'll need the umbrellas. >> probably as you head into the second quarter, how about that?

you can see a live doppler 7hd picking up good returns. lightning strikes right there. just off the coast. this is a pretty good looking cold front that will bring us rain off and on throughout the evening. some of the yellows denoting some of the higher tops of those cloud bases which means that's where some of the moderate rain is coming down. we'll take you to the north bay. you can see from santa rosa, a little bit of moisture. down toward the golden gate bridge. even ocean beach right now, some of this moisture filtering in and it will continue to sweep in from north to south throughout the course of the evening. you can see some of the cells right there starting to pick up in intensity. this is the culprit. a fast-moving cold front. look at the intensity right there. the enhancement on the tail end of this front. all of this moves in. get ready. it's going to be a big game, but a wet big game most definitely. be prepared for that. we'll look at my accuweather 7-day forecast coming up. >> thanks a lot.

>> in the last month, st. anthony is in san francisco said it had a 15% increase in the number of people coming to its dining room. that's why they're counting its 24th annual curb side donation program that started today. it gets two-thirds of its annual donations during the holiday season. currently it's serving 3,000 meals a day. one man from san bruno stopped by to donate 20 turkeys and ten hams. >> we're very blessed. we got no complaints. god has been good to us. we like to share. >> here you feed thousands of people a year. so this is the place we're bringing them. >> they know we're here to serve people in need and we're blessed to have people. we need 100 turkeys a day to make it. >> the november curb side donation drive runs through thanksgiving. donations are accepted weekends from 9 to 3:00 o'clock and during the week from 8:00 o'clock to 6:00 o'clock. food and clothing is accepted and it will be distributed to san francisco's most needy

it was october 1964. those are uc berkeley students surrounding a police car containing a student under arrest. his name was jack wineberg. they blocked that car for 36 hours. the start of a movement that made today possible. >> it took about three days for the free speech movement to go from a few hundred people to an incident where there were several thousand people surrounding a police car. >> reporter: at uc berkeley, fighting against the establishment is an attitude as unchanging as the architecture of this hall. by december, students occupied the building. they sat in eating food passed through a second floor window. professor richard muller took these pictures back then when he was one of those students. that's him on the left. here is another picture he took of the congressional cafeteria before he spoke to us on his computer. >> you've got to be arrested. we expected to be arrested.

is coming down. fairfax picking up light rain. starting to move close to mill valley, golden gate bridge reporting rain. berkeley and all of this is sweeping from the north all the way to the south, southeast. so yes, it does look like this is going to be on the menu for the big game tonight. prepare for wet conditions. rain and wind will be increasing overnight as that frontal boundary makes its way across the bay area. from rain to scattered showers. maybe an isolated thunderstorm in our forecast for sunday and then we'll dry things up for us monday and tuesday. temperature wise, mid- to upper 50s. this is a look at the storm system, pretty impresssive cold front. enhancing quite nicely right here toward the base. look at that, cloud build-up. the front will move through tonight. it will be the low that will bring us the scattered showers and the possibility of an isolated thunderstorm and some of that colder air wraps in

we have developing news for you at 4:30. demonstrators from across the spectrum are gathering in assume of the grand lake theater. take a look at the live picture. shows you the size of the crowd there. so far this has been a peaceful march. police have blocked off both the lake park avenue exit and the grand avenue exit off of 580 so cars cannot get into the demonstration. union members, teachers and occupiers are listening to speeches delivered from the top of a large truck. that's what you're seeing and live pictures from the ground. a short time from now, they plan to move to the corner of 19th and telegraph, the planned new home for occupy oakland.

for the second time this week a bay area soldier has been killed in afghanistan. 19-year-old joshua graduated from san ramon valley high last year. he was killed yesterday. he played freshman football at san ramon. his death was announced to the crowd attending friday's home game. on wednesday, sean walsh of san jose was also killed in afghanistan during combat operations. 21-year-old national guardsman unit was based out of pittsburgh. today in connecticut, the big game between harvard and yale took a back seat to tragedy. a massachusetts woman was killed when struck by a u haul truck carrying kegs of beer to a tailgating area. the driver of the u haul suddenly accelerated for unknown reasons. two other women were injured in this accident. one suffered minor injuries. the other is in critical but stable condition. yale says it plans to review its policies on tailgating. a college football legend's reputation has been shattered as joe paterno was fired last week in the wake of the sex scandal involving former defensive

coordinator jerry sandusky. joe paterno's name has been removed from the big ten title trophy. t.j. winnic has more on this fallout. >> as the penn state community comes to grips with its sexual abuse scandal, it was revealed friday that recently fired legendary football coach joe paterno is dealing with his own crisis. lung cancer. >> it's very treatable and he's going to be -- if there is one guy to beat it, it's him. >> reporter: his son told espn that doctors are optimistic his father will make a full recovery. he also discussed the difficulty of the ongoing abuse investigation. >> i don't want to get into too many specifics because i think one of the most important things we have to realize is it's a tough tight rope we walk right now because there are things that you don't want to get into because there is an ongoing legal process. >> reporter: still, it has been a devastating two weeks here in happy valley. friday the ncaa announced it's launching an investigation into

how penn state monitoring its sports programs. and the second mile charity founded by jerry sandusky, the one he allegedly used to fund his -- find his victims, may have to shut down. it's the financial support they heavily count on is no longer there. the victims and their families will remain foremost in our thoughts and prayers, a statement from the acting ceo said. ultimately it is the children who matter. the man at the center of this scandal, sandusky, has been mostly holed up in his state college home. hit by another brick thursday, breaking a window. >> do you have anything to say? >> reporter: the note read, i have nothing to say. contact my lawyer if you wish. that attorney told abc news he believes sandusky is innocent. he also revealed the defense's strategy. attack the credibility of two alleged victims and key witness mike mcqueary who again friday refused to speak about the case. >> i don't have anything to say. okay? i'm sorry. please leave. okay?

>> that was t.j. winnic reporting. there were rumors this week that this statue of joe paterno put up ten years ago would soon be taken down. the university maintains that is not the case, that they have much bigger issues to deal with. in nevada, fire investigators say arcing power lines likely cause add wild fire in reno that destroyed 15 homes and damaged at least 40 more. the start -- it started thursday night and being blamed for the death of a 74-year-old man who had aheart attack while trying to flee. 16 people were injured, including a firefighter who suffered serious burns. the 2,000-acre fire is now 65% contained and tonight the nearly 10,000 people who were evacuated yesterday are starting to return to their homes. officials say police and the national guard are on patrol to protect vacant homes from vandals. in 2007, san francisco became the first city in the country to ban plastic bags from grocery stores and pharmacies. now there is a proposal to extend that ban and even go a step further. now this story.

>> reporter: if you're shopping in san francisco, there could soon be a now mantra, bring your own bag. plastic bags are already banned from groceries and pharmacies. that could now be expanded to all retail stores and restaurants in the city. the proposal comes from supervisor who pushed the first ban back in 2007. >> it's common sense, it's measured. it's time we take it to the next level. >> reporter: a key component of that next step would hit you in the checkout line. under the proposal, bags that are allowed, including paper and com postible, will cost you ten cents starting in july of next year. climb to go a quarter per bag by 2014. >> it's not a big deal. i can bring my own bag. >> reporter: the supervisor says when washington, d.c. started charging a fee, customers usage dropped by 81%. it's not just grocery stores that would be required to charge

for bags. it's all retailers. the owner of clothing store has concerns. >> it becomes another impedement to making the process an easier one. it makes it less friendly. >> reporter: the businesses will get to keep the fee, which is one reason the california grocers association and san francisco chamber of commerce spoke in favor of the proposal at a city hall hearing today. but an attorney representing the plastics industry has sued other cities and is threatening to do so now unless there is a state environmental impact review. >> san francisco is basing this ordinance on misinformation, exaggerations and false statistics. >> reporter: the legislation is scheduled to go to the full board for a vote next week. in san francisco, carolyn tyler, abc 7 news. if you think you're smart, you may be in good company. >> the most educated city in california is right here in the bay area. what residents think about the distinction coming up.

out of five have a bachelor degree. more now from abc 7's david louis. >> reporter: it's a city known for expensive homes, a wide selection of shops and restaurants. and now the census says it's 63,000 residents are the most educated in california. gary is one of them. he retired from hp. his father was principal at palo alto high school. there are two sides, he says, to a community with smart people. >> the positive is there are all these great ideas flowing. the negative is, especially in palo alto, everybody thinks they're right because they have all these great ideas and they're so educated. >> reporter: apparently they don't have to impress people with intelligent conversation. >> what do they talk about when they sit in your chair? >> people talking about sports. >> reporter: it seems it's a smart place to live before it became a place with smart residents. mary murphy moved here in 1958. >> we didn't know it was a smart city at that time. we just came over because we

can see as we head toward the 6:00 o'clock, 7:00 o'clock, 9:00 o'clock hour, that front spreads the rain from north to south. moderate cells north of the golden gate bridge overnight tonight and then 11:00 o'clock, 12, 1, 3:00 o'clock, that passes toward the east. even tomorrow evening we'll have to count on showers. could be heavy at times. rotating in across the bay area. if you're heading to the niner game tomorrow, this is 1:00 o'clock. so even be dealing with showers for that time frame as well. if you're heading to the sierra, a winter weather advisory in place through tomorrow afternoon. ten inches of snow possible with 7,000-foot levels. three it six above 5,000 feet. carry the chains and heavenly is open. so head up there. i'm sure after this system moves through, more of the resorts will start to open up this holiday week. lows tonight in the 40s. a little warmer as the cloud cover will be with us tomorrow. rain in the morning.
