in the news this saturday morning, december 3rd, the family of a toddler critically injured in a west oakland shooting rampage has hired an attorney in a dispute with the hospital. labor unions team up with occupied san francisco protestors today and plans for morals and a march. good morning. i'm terry mcsweeney. we begin with the wind returning to many parts of the bay area. here is lisa argen. >> you can see the camera shaking behind me. look at the delta, winds of 43 miles an hour. wind advisory is really for elevations above thousand feet but even at the surface, gusty winds, 31 mile-an-hour winds at the airport. look at livermore valley, those have increased in the past couple of hours, we see windy conditions the next couple of hours, after 10:00 across the

bay things will die down. wind advisory for the places everywhere and the low pressure will slide south and once it does the winds will relax this afternoon and sunny and mild day not as warm as yesterday. rain in the outlook, i'll have more coming up. door-to-door campaign is under way in west oakland to get to the bottom of monday's shooting rampage that wounded seven people including a toddler. family members say hiram lawrence remains in critical condition at children's hospital. the family is consulting an attorney in a dispute over the child's care. >> hiram lawrence will be two in a couple of weeks but he is clinging to life at oakland children's hospital. the mother and the hospital are disagreeing on hiram's continued

care. >> we are unable to agree on a continual care for baby hiram. as a result we are hiring an attorney. >> houston says she wants every opportunity to save the child. the child's uncle is asking for restraint from family and friends. >> pray, pray, no violence, pray. >> the little boy was wounded in the head in a volley of 50 shots that was fired on monday evening. six other people were also hit. the mayor and several leaders went door to door in the neighborhood. they asked for help to catch the shooter. they handed out leaflets with an anonymous tip line. >> we know there are people out there that saw what happened or know the people that did it. we want them to encourage to come out and come forward.

>> just a little information and let people know that we care. >> they say the neighborhood has been forgotten by the city and police. they said the side show meant for cameras and reporters. >> this is all for you guys. this is wild, wild west. >> they have questioned five people of interest but so far have not made an arrest. children's hospital said they would not comment on his condition nor would they comment family is seeking a patients rights attorney. they say hiram is in critical condition and clinging to life. oakland police are asking for your help in that case. if you have any information on the shooting, call the anonymous tip line at 510-773-2805. we posted the number on our

website. oakland police department will soon be hiring more officers thanks to the federal government. 25 positions will be created. four will be re-hired by officers laid off last year. occupy san francisco demonstrators plan to rally and march today. the rally against bank foreclosures and evictions, it will be the second day of protest. >> reporter: san francisco's labor unions converged on the hyatt regency carrying signs public interest and not private gain and citing their opposition to state and federal budget cuts. they didn't actually shut the hyatt down. people were free to come and go. this was one of many stops while

walking the financial district. >> we were at the federal building, to protect social security and medicare, medicaid, we have ma marched on the banks that are sitting on tons of money and not helping us creating jobs. >> the executive director of the labor council. labor unions joined the occupy movement for a concert. >> construction workers that are out here, the teachers are here, postal workers, hotel workers are here. public sector workers. it's the whole span of the 99% that are out here to get the message out. >> fred tucker is a longshoreman with local union 6. >> the corporations say have shown us they are irresponsible and it's time to take care of what people need, housing, education and jobs. >> mary goes works at san

francisco state. >> we are so under paid and overworked. it's so unfair to our students that the tuition was raised again by 9%. a lot of my students are working two jobs and they can't afford it. >> overall it was a peaceful day no major incidents to report. san francisco's police chief says his patience is wearing thin after one of his officers was injured in a scuffle with an occupy protestor. it happened thursday night. this video shows police setting up barricades outside the encampment when a protestor punches the officer in the face. the chief says it's unprovoked attack that testified over lighten. >> there is no place for violence and frankly the officers deserve better. especially with the amount of professionalism and restraint they have demonstrated over the last two months. >> police arrested the man. chief suhr says there will come

a time when police have to clear out the camp but he is hoping they will leave voluntarily. >> we are learning of a death from the wind storm. a biologist died when a tree fell on him. he worked in a condor recovery program. santa cruz county is still dealing with the aftermath of intense winds. crews are removing dozens of fallen trees and repair downed lines, more than 14,000 customers remain without power. >> san francisco fire officials say they will appeal cal osha citations that fault the department for a deadly house fire. two firefighters died at diamond heights fire in june. cal osha issued four citations citing lack of communication and having enough personnel available. >> it created an environment where all involved what was

going on at any given time and could have resulted in a different response. >> we have things that prove that. those citations are not based on what we think happened. >> those citations could cost the department $21,000 in fines. >> 49ers and the city of santa clara announced they have the money to build a new stadium. the proposed stadium would be built on the parking lot next to great america theme park. they have agreed to loan the city and the team $850 million. construction could start as soon as next year. city will hold public hearings next week to discuss the agreement. >> opponents of a san jose plan to build a proposed ballpark for the a's have filed a lawsuit to block it. the suit filed says the city council had no right to sell a's public land for half the value. the group includes giants minor league team who has exclusive

territorial rights to san jose. suit contends the action was done without a state required environmental review and without san jose voter approval. >> coming up next, the return of northern california national guardsmen. and a christmas tradition that has more than 340,000 lights.

there will be a public funeral service for a california national guard soldier to san jose, sean walsh was killed while serving with the military police company. his unit deployed last december. the body will be returned to moffett field on wednesday.

the. this morning the last california national guard unit that served in iraq is back home. it was an emotional welcome in san mateo yesterday when they were reunited with family and friends. >> we have been showing you scenes like this, people who have missed people. >> he has been gone since february. >> today, national guard said it would be the last homecoming, 15,000 californians that went to iraq, 60 members of the 297th on this approaching bus would be the last group to come home. >> do you think it will be the same girl that comes back or they changed? >> they probably changed.

his aides says they are not encouraged for him as a nominee. >> display on the east bay. livermore tradition for 29 years now, last night several hundred visitors for the holiday lighting ceremony on hillcrest avenue. more than 340,000 lights make up the display. deacon says high winds destroyed thousands of lights. >> the wind came in was a cross wind and actually ripped some of the lights apart. we had to rally the troops here so we have the light display that you see here. >> the wind storm, 350,000 they would have had. this year's themes on you believe? you can believe in a good forecast from lisa argen. >> when those winds get funneled throughout the higher elevations they are even gustier.

bay area this morning. wind advisory was forecasted for the higher elevations but we're looking at very gusty winds at the surface, as well. gusts up to 50 miles an hour for the diablo range, santa cruz mountains and north bay mountains and possibility of some downed trees and branches could bring power lines down. here is what happened while you were sleeping. high pressure building build in quickly behind a departing low. that brought windy conditions. they will begin to subside. mild afternoon and continue to see the winds coming back to around 20 mile-an-hour category. it will be a breezy afternoon but take a look right now. by the delta, north wind gusting to 41 miles an hour. offshore winds keeping the numbers mild. northwesterly winds in san jose, 23 mile-an-hour gusts.

back and forth in the north bay. as you look at the temperatures you can tell where we had the wind and where the wind has been light. 39 in mountain view while the coast in san francisco in the mid-50s. santa rosa calm right now but you had gusty winds last hour, as well. we are looking for things to settle down the next couple of hours into the afternoon. things get back to near normal in terms of our breeze but we're talking about still numbers above normal throughout the day today. then we'll be dropping to very chilly conditions tonight with calm conditions and dry conditions through next week. setup remains the same with double barrel high pressure. that is keeping the storm track, jetstream, river of air will to the north up into canada. we're not looking at any change here. numbers are coming down to seasonalable norms and by tomorrow, highs will be around

where we should be. 49 in the southern sierra. the snow may still be around but some resorts open and mother nature not helping too much in the week ahead. 33 today for the high. very gusty conditions in the sierra nevada. still breezy in southern california. back home, mid and upper 60s common today with less wind. 66 in fremont, oakland and san francisco looking nice in the afternoon for oakland, 65. chilly night with clear conditions. numbers where they should be upper 50s to low 60s, dry, not any rain in sight. beginning to worry about that. >> we'll get plenty in january, that is my forecast, based on nothing but opinion. >> in sports, san jose sharks host panthers at the tank,

raiders are in miami where it's unclear whether mcclain will play following his arrest early in the week. >> linebacker mcclain was not in practice but he has joined the team in miami. it's unclear if he will play against miami. he was arrested on assault charges after allegedly firings a gun near a man's head. his attorney says he denies being involved in any altercation. he is out on bail. n.f.l. says they will follow the lol legal process before deciding on any discipline for the linebacker. hugh jackson expressed his dissatisfaction. >> there is a right way to do things and wrong way to do things. obviously there was something wrong, so we will deal with it accordingly from there. at this time for our organization is we focus on this

recovering welfare debts. they have been targeting children and forcing them to pay back money their parents owe. nannette miranda reports from sacramento. >> it needs to stop. >> reporter: 75-year-old clarence ayers received a letter from welfare office earlier this year saying his 14-year-old great-granddaughter irene owed $3,000 for benefits that her mother should not have gotten while pregnant with irene. now her $334 aid is being cut until the debt is paid. >> i didn't know they would do that. people that don't pay child support but not children. >> jamie is now a college student and she got a demand letter that her family received when she was 15 years old. the tax refund are now being

garnished, money she needs for school. >> the state has gone out of bounds on this. >> they have filed a lawsuit on behalf of the two girls. it wants the state to stop this practice that has been going on for years. >> you are allowed to recover from the parents and grandparent if they are part of the assistance unit but nothing in state law you can take money back from a child. >> the california department of social services says it's sensitive to the issue but state law first go after the adults that are associated with the case. quote, when those efforts are fully exhausted they county is required to get money. >> why would the state do that and they are not protecting the child? they are victimize that go child. >> they want the state to refund

the money from children. oftentimes was due to clerical error. >> and out of all this, president of the state senate says he is appalled by the state welfare policies. darrell steinberg has sent a letter to the governor calling for an immediate halt to such practices. it was in reaction to a lawsuit filed in alameda county. for the sake of this young woman and others, i strongly urge you to put an end to these practices as quickly as possible. >> president obama bank accounts to renew a middle-class tax cut that is about to expire. 21 consecutive months of job growth is not enough to fuel the recovery. they have added a calculator how much their payroll taxes would go up if the cuts passed last year by both parties are allowed to expire at the end of this month. >> they shouldn't go home for the holidays until they get this

done. tell them not to vote to raise taxes to working americans. put money back in the pockets of working americans. >> republicans are asking americans to tell congress something, too. support a balanced budget constitutional amendment. that is headed for a senate voted after failing in the house last month. >> many people looking for work have had to shift their thinking to just finding a job. >> president greeted the lower employment number as a positive sign. >> the american economy has created in the private sector jobs for the past 21 months in a row. >> reporter: but speaker of the house john boehner says the only reason why it's down is because people have given up. >> more than 300,000 americans have left the labor force, that

means they stopped looking for work. >> there are 13 million americans looking for jobs. last april we went mark ivy as he handed his resume in a job fair. >> i have a mba and five to seven years of marketing. >> despite of his efforts, a manager for sony in san diego, stayed unemployed until this past september. >> you have no idea. >> he landed in silicon valley as a marketing manager. >> i took a pay cut. >> he took the job for $40,000 a year less. >> therefore, i have to get in somewhere and slowly work your way back up. >> a survey of unemployed americans by rutgers show that ivy represents the vast majority of those that found jobs after being laid off.

>> the winds are going to die down later this morning. we are talking about much calmer conditions. we've had the dry weather, low relative humidity and gusty winds. wind advisory, all that wind and nice and sunny down in santa cruz. today, 65 degrees there. further north we go, you'll notice the skies are clear but not only higher elevation wind but lower elevations have been quite breezy. we're talking about great visibility but notice the camera shaking there. the wind advisory next hour and a half, upper elevations, diablo range, we have been looking at gusts over 45 miles an hour out by the delta. santa cruz has been okay. you know it has been the second system that took pretty much the same track as the first system. weak system moved through, low pressure to the south of us had

and high pressure builds behind it. that creates the wind, as the low continues to fade to the itself south and east, mild numbers will result in the afternoon. breezy to windy start to your day. winds out of the northwest gusting 23 miles an hour in san jose. fairfield, gusts up to 40 miles an hour. things have calmed down a bit but in mountain view, temperatures have dropped in the upper 30s where we haven't seen any wind at all. wide ranging temperatures depending how windy you are. 55 in san francisco, 56 in half moon bay. we'll be looking at pretty nice afternoon. give a couple hours for those winds to dial back. through some of the gaps and passes it will be quite breezy for that. temperatures will be above normal. we're not talking about upper 70s like yesterday but calm and dry weather continues through

next week. extremely dry weather with a low relative humidity today due to the strong offshore winds. in the days ahead, we have just got a quiet weather pattern, hoping for some rain to mix things up a little bit. maybe you are enjoying this weather and if you are, we don't have any rain in the forecast. we do have cold temperatures and windy conditions in the sierra nevada. freeze warning for the san joaquin valley tonight. our temperatures will be dropping significantly, as well. 58 in fresno. 65 in big sur. afternoon highs, comfortable with less wind out there. a lot less wind. we'll call it breezy from time to time. 67, oakland, palo alto, san francisco. we have a ways to go because it's still quite windy, about 10:00, 11:00, you'll definitely see the winds decrease. in the days ahead, temperatures will come down a little today and tomorrow, we'll stay that way right through next week.

looks like next weekend will be dry, too. >> good shopping weather. a shelter that has provided emergency housing to hundreds of women and children for more than five decades is in danger of closing due to lack of funding. in this morning's reported, laura anthony credit the haven of peace with turning their lives around. >> this place has been a important place. >> they are in a good place. five months ago, state aid was cut in half and no longer pay her rent by attending community college. she brought her kids to the haven of peace. >> i have never been homeless before, it was one of the most scariest moments in my life. suddenly the haven is like a breath of fresh air for us. it has given the chance to rest

and rebuild and reassure ourselves so when we're ready to go back out into the world, we'll be stronger, most definitely. >> you don't have to worry about things. it's a nice place to rest. >> reporter: about half of irt is children and mothers, many from the bay area. the rest of single women that need emergency services. the shelter director. >> they are coming in from domestic violence situations, they are coming from substance abuse programs. we get first time homeless ladies, people who have lost their jobs and have no place to live, home foreclosures. >> it's a clean, safe place, one that may not be here much longer. the shelter itself is having financial difficulties.

there have been cuts but private donations have dropped way off and thrift shoe store that provided most of the budget went out of business. now, the they may have to close its doors, too. yolanda has two girls who was taken by child protective services because of substance abuse. she is clean now and has her kids back. >> you feel like you are clean now and keep your kids? >> yeah. >> 23-year-old denise moreno came here one month ago with her young son and daughter. >> i just moved from idaho. i needed someplace to take my kids. i heard about this place and i called and they had room for us. >> the haven has enough money to get through the holidays.
