morning, december 10, an east bay middle schoolteacher is in jail. police say he confessed to having sex with a minor. and doctors at children's hospital oakland remove a toddler from life support that was shot last week during a gun battle. good morning, here it is. total eclipse of the moon for the next hour. clear skies, freezing temperatures in the north bay. >> good morning, i'm terry mcsweeney. a middle schoolteacher has confessed to having sex with a former student. math and science teacher andrew bruce cottrell was arrested yesterday following a week long investigation. the victim's parents found out about the relationship and went to police. >> at about noon walnut creek police officers came here to dab

-- diablo middle school. they took math teacher bruce cottrell out of class. they brought him in another room away from students and arrested him. >> he confessed to the several allegations, and at that time he was then taken to the contra cost county detention facility. >> he faces multiple counts of sexual abuse with a student. a young woman she's within -- been having relations with for the past three years. >> we have lewd acts with a child between the ages of 15 and 14, and then we also have oral copulation with the juvenile. >> police say the child's parents found out about the relationship with cottrell, couldn't fronted the child and then called police. steven lawrence quickly alerted parents. arrest through the school's phone tree. >> sadly, i am sharing some serious and troubling information but. today andrew bruce cottrell, one of our diablo middle school

teachers was arrested for having inappropriate relations with a former student. children's safety is a paramount concern to our district. accordingly, we are actively cooperating with both police departments to mack sure they have all the support they need to investigate this matter. >> police served a search warrant on his walnut creek home where they say he brought the young woman and discovered more evidence of the relationship. neighbor janet abrams stood stunned and speechless when she found out about the arrest. >> i am shocked. i know him and kelly lived here before she was even married to him. and they have two little boys. i am shocked. >> a teacher here at the middle school who wouldn't go on camera told us how angry she was at cottrell, not just for the sexual abuse, but also for the trust of the parents and students that he violated. now police say all the charges against cottrell are felonies and they are also asking that if anyone has information about any other victims, that they give him a call. in clayton, abc7 news.

a one-year-old oakland boy shot in the head in a gun battle last week has died. doctors at children's hospital removed life support from hiram lawrence. the parents spent several days pleading to give him time to recover, but after no activity, and a series of tests, they reluctantly agreed. hiram's mother spoke to us outside the hospital. >> i have a remember my baby because somebody wanted to start shooting. >> community organizers came together in oakland last night in the little boy's honor to

march for peace and push for a community free from gun violence but place say they can't do it alone. sergio reports. >> about 50 people marched up and down national boulevard. along this stretch is where the three-year-old was gunned down his summer, his death, and now the death of 21-month-old hiram lawrence is becoming the major focus for organizers. >> we are seeing babies being shot. it's something imperative we move on very quickly and very seriously. >> following the march, mayor jean quan and police chief listened to testimonials from people who have been affected by gun violence. >> derick williams was shot when he was 15 years old. >> i was a good person going to school, good athlete. and this is the way it left me. >> at this forum organizers pressed the mayor and police chief to do something about the gun violence. mayor quan touted her 100 block plan, the specifics of which have been delayed because of the need to handle occupy oakland. >> we've been meeting with the principals within the 100 black. -- block. it's something we are inventing as we go along.

it's the first time we've had a strategic tactical plan on violence in the city. >> this comes at a time when police are still seeking information in what is now a murder information of a 23-month-old child. community organizers encouraged people to contact police when they had information about a crime, and with the death of hiram lawrence the police chief asked for information now to track down his killers. >> they know who they are, they know who did it and what gang they belong to. we are asking them to come forward and provide us with information so we can remove the people responsible from the streets. >> in oakland, abc7 news. >> about 50 people marched up and down international boulevard along a stretch where -- excuse me, we will move on to the next story. oakland mayor jean quan is making a pitch to keep all three professional sports teams in her city as the warriors entertain an offer from san francisco. kwan said she has private funding ready to go to create coliseum city, a retail complex

on thursday. the thieves ran right over to the ipad display. >> they knew where they were stored. quickly got to them, removed them and left the store. >> these are at least two to three or more people that are very well-trained and knew what they were doing. >> they dragged a large, locked display rack filled with ipads through a fire exit into a waiting vehicle. the store alarm alerted dispatchers and police arrived a minute later but saw no sign of the crooks. >> a goal some prison guard will be arain monday morning on allegations that she fake her own rape in an attempt to get her husband to move them to a better neighborhood. she cut her lip, had a friend punch her in the face, scraped her face and all of that to make the appearance she had been raped at home by an intruder. she confessed after co-workers told police it was all a fraud. she and her husband are in the process of divorcing.

reeseing in novato. and on the coast 40 degrees. things are changing because we will see an on shore flow. a few more clouds later on today and that will bring the numbers up tomorrow and we could see maybe a tenth of an inch of rain, perhaps oakland, the peninsula. the lunar eclipse is going until right before 7:00. the sun coming up 7:19. after our chance of showers come sunday into monday, it looks like, once again, back to high pressure and dry weather. so with this high pressure overhead, the pollutants send some of the soot from the fireplaces and wood being burned pressing down toward the surface. we are looking at inland east bay quality taking a hit, as well as the north bay. keep that in mind and try not to burn the next 24 hours. it is illegal to do so. high pressure, it is heading toward the east it is allowing for the weak trough. and an area of low pressure to slide down the coast. that will bring increasing clouds, slightly cooler temperatures and we will see a switch to an on shore flow.

as the republican presidential contenders square off in a debate. >> mitt romney has lost his position at the top of the republican field and now he has shown signs he's ready to release attacks on newt gingrich. romney stopped short of criticizing gingrich directly but opened the door to doing just that. >> we have differing views on some issues and we will be talking about those differences. that's, after all, the nature of a debate. >> earlier today romney was much more blunt. he lavished praise on the medicare plan offered earlier this year by congressman paul ryan, a plan that conservatives liked, but gingrich criticized. >> he called this right wing social engineering. i believe it's a very important

weekly' address to lobby congress to approve his consumer watch dog nominee and to extend the payroll tax cut before it expires. on thursday house republicans blocked the nomination of ohio attorney general richard cordray to head a watch dog agency that oversees big banks. the president calls it a make-or-break moment for middle class people to be taken advantage of. >> it's time consumers had someone on their sides and while they are at it republicans in congress should stop the games and extend the payroll tax cuts for working americans because if they don't, nearly 160 million americans will see their tax go up at the end of this month. congress cannot end the year by taking money out of the pockets of working americans. now is not the time for playing politics. now is the time to do what is right for the american people >> in the republican response house speaker john boehner said the house will act on a payroll

tax extension next week, one that provides relief for working class americans but does not raise taxes on wealthier job creators. union nurses at six bay area hospitals have announced plans to hold a one-day strike next thursday. december 22nd walkout follows a similar strike the california nurses association and national nurses united held back in september. the hospitals locked out the nurses for five days in that one. the hospitals targeted by the strike include oakland, antioch, burlingame and vallejo. the napa river is getting a new look in the name of flood and erosion control. napa county announced it's getting millions of dollars for month projects that have local vineyards cooperating by giving up valuable land. >> the napa river is barely flowing now but during the rainy season it can be a raging torrent and that's the problem.

rushing water eats away at the riverbank making it impossible for fish to spawn and it can sometimes flood nearby vineyards, causing expensive damage. >> a lot of debris was clogging the river so we had to give up space to widen the river and bring it back to a sustainable being. >> this berm used to be covered in grapevines, about two dozen vineyards let the government use their land to carve out large wide spots in the napa river in order to slow down the flow of water and to reduce the risk of flooding for local growers. >> the berms will be all exactly at the same height so everybody will get a little water and not one vineyard get all the water. it will significantly reduced by the damage. >> federal officials announced napa valley would be getting more than $3 million to widen additional portions of the river. half the money would come from the federal government, the rest from a half cent local sales tax increase. the idea is to slow down the

flow by building alcoves. the fast pace of the river has chewed away at the riverbank, causing sediments to build up. >> the sediment has lots of different problems. one is the salmon can't spawn, the fish eggs are unable to attach to the gravel underneath because there's no such sediment on the top. >> the walls of the riverbank are about 30 feet high. in a wet winter i would be under water in a place where fish could escape from the swift current of the river rather than being swept into the bay. and they hope to do it in time for this rainy season. >> it's good for wildlife and fisheries, it's the right thing to do. >> this covers about 4 1/2 miles of the river. crews hope to be at the halfway point next year. the ultimate goal is to restore 15 miles of the river, using this as a prototype for other erosion control projects.

developing news story. looking out from our camera atop sutro. straining to see the moon, and if you look carefully at your screen you can see why it's straining to see the moon. the eclipse well underway. also we have some little bit of fog up there or something going on up there that is preventing us from getting a really clear picture of a dark object, which kind of only makes sense. >> yeah. we saw a better shot a little while ago. we have high cirrus clouds drifting buy. fog in the north bay and patches around the bay. pretty good viewing and the total eclipse of the moon lasting until 6:57. another 15 minutes or so. sun officially up at 7:19. we are looking at a beautiful start to the day. a little more sunshine today,

although clouds will begin to invade the area in the afternoon and that will lead to perhaps some showers headed our way in parts of the bay area by tomorrow afternoon. it's 41 in oakland. good morning. san francisco, 46 for you. look at the numbers in the north bay, below freezing, some fog there. 36 fremont. definitely a chilly start out there. mountain view at 44. 40 on the coast. we will look for those numbers in the morning to moderate in the next couple of days. then we will be back to the clear sky by the middle of next week. so chilly once again this morning, and the lunar eclipse lasting until just before 7:00. we will have a chance of showers. i think we can see them in the east bay, the penins lay, parts of the north bay. not talking about a lot of rain, but in the meantime before that we are still looking at a spare the air day today. moderate air quality from the south bay, and the worst air quality from the north bay and

inlet east bay. please refrain from using the fireplaces and burning wood. we are looking at high pressure. it's been in control for the past several weeks now. it begins to slide to the east of us into the mountains. you can see the clouds here along the coastline. as it does, we will look for a trough. the weak weather system it slide down the california coast. this system will end up to be a cutoff low so that will allow for some showers to drift south of the bay beginning tomorrow afternoon. you notice the green on the map painting the chance of precipitation from the offshore waters right into the bay area. then it sinks south and we will have some leftover showers it looks like for the south bay, the monterey bay, into monday morning. then after that we are back to our dry weather pattern. 59 santa clara today. look pour 60 in saratoga. temperatures a little cooler today. we see the increasing clouds and increasing on shore push. instead of the 64 today, yesterday at half moon bay only

squid a couple years ago. the squid got their name because they live in the hum built current off south america but they have expanded their range north. some have even been spotted in alaska. scientists speculate that's because of warm water created by el nino conditions. but they are doing more than just moving. >> the more we look the more we are astounded the way they find a new way to adapt. >> the squid have less to eat. to compensate it appears some squid have stopped growing and they are having babies a lot younger. >> they start reproducing when they might be 8 inches long instead of 2 1/2 feet long so it's a huge difference in body mass, a difference in egg production of a few million versus a few tens of millions. >> these two squid are the same species and at the same stage of sexual maturity but you see one is dramatically smaller than the other.

scientists aren't sure how long the humboldt squid live. they look for a tiny crystal of bone in the head which is about the size of a grain of sand. >> you can take those little bones and cut them and polish them on sandpaper and then down rings like rings in a tree. >> in computer image shows one of those bones magnified. you see the rings that indicate the skid's age. jumbo squid probably lives a year or two but the smaller squid have shorter lives so they have to make babies quickly. researchers think that's nature's way of keeping the species from going extinct. dan ashley, a. bc7 news. >> interesting. they have an outreach program called squid for kids which provides frozen skid to teachers in the classroom. we have a link at abc7 news.com under see it on tv. still ahead, 7 on your side's michael finney has a checklist to help you decide if it's worth

the rising sun. we will talk to lisa about that and exactly how warm the sun is going to make it today coming up in a few minutes. decorating for the holidays can be joyous, but when you are on ladders stringing lights, it can be dangerous. is it worth the risk for should you hire a professional. 7 on your side's michael finney has tips to help you make that decision. >> the consumer product safety commission says 13,000 people fell off a ladder while decorating for the holidays last year, ending up in the e.r. professional holiday lighting installer jay nelson is often called for just that reason. >> i've gone to a lot of clients' houses and the wife will say the husbands are not allowed on the roof or has fallen off the roof for the last time. >> he sets up an elaborate display each year at his house in fairfax and said he never even knew there are professional installers. >> i have no fear of a ladder, and actually i look forward, the higher you go, the better you are.

>> many electricians and contractors have added this as a side business during the winter's inevitably slow season. after the holidays jay returns to his mainstay, garden lighting, gutter cleaning and window washing. >> we've seen a lot of increase the last couple years. we've been pretty steady at a 20% growth every year for the last three years. >> contractors generally charge between $200 and $500 for stringing basic lights. they will set up the lights and return after the new year to take them back down. jay's company brings the works, lights, timers, extension cords and more. angie hicks from angie's list has some tips about choosing the right installer. first, she says, make sure the company is qualified. check that the decorator is insured to protect against any falls or accidents or otherwise it falls back on the homeowner. ask about costs. do the installers charge by the square foot or by the hour? are you required to purchase the

carle is a ten-time bell ringing champ. he showed his holiday spirit by raising money for the salvation army. yesterday was the organization's 31st annual celebrity bell ringing event at union square. all the money collected will be used for the assistance program for the salvation army. festivities included musical performances and a visit from the man himself, santa claus. rolling stone is the magazine that changed the music industry. it was launched in san francisco in the '60s and it's first photographer has just released a book of some of his memorable photos. abc7's arts and entertainment reporter don sanchez opens the book. >> the rolling stone years is a big book loaded with pictures that document an era in music. >> you don't know until afterwards the role it will play in history. >> and 1960 rolling stone was launched and they asked him to be the photographer.

>> no one heard of the magazine. i was shooting for free, working for nothing, so i did have to have a day job and work for paying clients. >> he was uncertain there would be a second issue. this is a famous san francisco landmark. it's where the grateful dead used to live on ashbury street, and it's where he showed up for his first assignment for "rolling stone." the rest is history. they held a news conference after a drug bust. see the bowl? it's filled with whip cream. they threatened to throw it on any reporter who asked embarrassing questions. >> they were wired for the press conference and i con get them to relax and settle down. i said i need a group shot of you, and they said who are you? i said, i'm from "rolling stone," and they said what's rolling stone? because we hadn't even done the first issue so i had no credibility and they had guns. >> he got the shot and rolling stone became "the chronicle" of a culture. people come to check it out. this couple from barcelona.
