did not hear the alarm until it was almost too late. >> on the fifth floor leon patiently waits as fire crews line up their ladder to his window. he's one of at least three residents rescued by ladder. he said he did not hear fire alarms on his floor and only heard fire crews when they arrived. >> i heard nothing, just fire and smoke. >> no fire alarm is what we heard from several residents. >> we didn't hear no alarm go off on our floor. i looked out the window and there was a big fire and i looked in the back and flames were coming out the window. >> some said they didn't hear an alarm >> no. there's no sprinkler systems. our smoke detector hangs and beeps. >> his wife jasmine is one of eight residents rush to local hospitals. >> i don't know what the extent of the injuries are. some look bad. >> like smoke inhalation?

>> there was one guys with burns, pretty significant burns. >> the chief said damage from the fire remained mostly in one unit. as crews attack the blaze. some people remained in their units. many residents are elderly or disabled and the san francisco housing authority is trying to figure out how many of 1902 -- 1902 residents will need to be relocated. >> until we know the full extent of the damage and we can determine how many people could stay in place, there's definitely going to be some temporary displacements. >> now i also did and the folks from the san francisco housing authority about reports from residents that there were no alarms in this particular fire. she tells me that they are waiting for investigators with the fire department to give them any reports of possible problems with the alarm system. in san francisco, abc7 news. investigators are also looking into the cause of a fire

that burned a victorian home near san francisco general hospital. firefighters battled flames for two hours last night, starting around 9:00, trying to keep the fire from spreading. no one was injured, but the victorian at utah and 25th street was severely damaged. a neighboring home had minor damage. firefighters were quite concerned about the homes being so close together as they often are in san francisco. they feared the whole block might burn. >> the company made a quick, very aggressive interior attack. they have contained the fire at this point. we have no injuries that have been reported to civilians or firefighters. we have about 20 companies on the scene and approximately 100 firefighters that are involved in this firefight. >> anyone displaced? >> yeah, there's going to be some number unknown. >> traffic on highway 101 was affected for a while when thick smoke started drifting across the highway.

>> developing news to san francisco's financial district where police right now in riot gear are conducting a sweep of occupy protestors in front of the federal reserve bank. an estimated 100 officers showed up several hours ago and began moving people out of the area at market and drum street. they closed down market street and brought in public works crews to clean out the belongings of the protestors. there have been some minor clashes with protestors and we are checking reports that arrests have been made. protestors wearing handcuffs were seen being loaded into police advance, as you can see there. occupy san francisco posted on twitter an hour ago that, quote, police are arresting everybody. as you know, then camp men at justin herman laza was cleared out last week. there's growing opposition this morning among labor groups to plans by occupy oakland to

shut down 11 west coast ports tomorrow, even some occupy demonstrators are opposed. labor groups that supported the november general strike tell the san francisco chronicle they are not on board with tomorrow's planned action. the primary concern is that shutting down the port of oakland hurts workers, who are part of the working class. the so-called 99%. some union leaders say they weren't even consulted and can't support a job action without input from their members. even some bay area occupy group said the port blockade is too extreme and too confrontational. crews are cleaning up downtown redwood city where a suspected drunk driver created a 40-foot water mountain last night. look at some of this, quite a spectacle at broadway just before midnight when fire crews were first called out. the driver of a jeep cherokee took out a fire hydrant causing the gusher. he also mowed down a light pole

and parking meter before his s.u.v. came to a stop. the condition of the unidentified driver is not known but he was taken to a local hospital. >> oakland police determined a drive by shooting that killed a father of four yesterday was not a random shooting. the 46-year-old was shot while sleeping in his house early yesterday morning. he was killed by a bullet that went through a wall. his daughter says it's the third time their house has been targeted. >> it was all in one like one year. it happened in one year. with randomly happened. >> what happened? >> like just drive businesses. people stop their cars and shoot at my house and leaves. >> violence comes close to home it reminds you that there are people who insist on getting through life that way. >> this is the 105th homicide of the year in oakland. 10 more than last year.

bullying can have lasting, sometimes deadly effects. in campbell last night a vigil was held for a young woman who tried to kill herself three years ago. abc7s toms ramone was there and he spoke to a teenager and her brother who have both been victims of bullying. >> 19-year-old ashley said she thought death was better than living with being bullied by so-call friends. so she attempted suicide. >> gossip, rumors, girls, boy drama. >> she had to drop out of school because of it. she's now studying to be a paramedic so she can save life. her twelve-year-old brother jacob is now a target at his school. >> the kids bully me once a week. >> both attend a candlelight vigil for 19-year-old amanda. she's confined to a wheelchair. she cannot see, walk, talk or eat on her own, all due to an attempted suicide in the school cafeteria bathroom when she was 16. >> if i would have known, yeah, i could have done something. something different. >> amanda was in san jose's dell

mar high school marching band. her mother said amanda received from 3500 harassing and spiteful texts in a one month period. >> they were saying she was a lesbian, bisexual, that she was pregnant, and that she had a.i.d.s. and was spreading it. >> since her attempted suicide in november, 2008, her mother has been loading an educational campaign called amanda network to prevent teen suicide and bullying. >> for every one suicide that a kid dies, there's 100 kids that attempt it. >> about 100 parents and children attended the candlelight vigil for amanda at the campbell united methodist church. they received scarves and wrist bands in her favorite color, purpose he will. -- purple.

isn't that a gorgeous shot of the moon with clouds around there. back home we are talking mostly cloudy conditions. our roof camera where numbers are in the upper 40s in san francisco, and one of the warmer locations. oakland we are talking about 47. so pretty mild in and around the bay. but in the north bay we do have fog and temperatures have dropped into the 30s. so we are looking at just a little bit of mixing out will. the weather system is going to stay offshore, not bring in a great chance of showers odd. plenty of cloud cover out there. 45 in fremont, 43 livermore and reduced visibility up to the north in novato. down to two miles visibility. across the bay in oakland, 4 miles visibility. elsewhere haze around concord and hayward this morning. temperatures are my, much warmer, as much as ten degrees warmer in the valley of livermore this morning. ten degrees warmer in concord with santa rosa, boy, yesterday they were in the upper 20s and today sitting much more

comfortably seven degrees warmer in redwood city. high fog and clouds this morning. haze out there. cloudy and cool today. chance of showers? well, maybe. looks like san jose and points south later on in the afternoon. we are talking just a passing shower. if you see anything at all. dry weather returns tomorrow. it will last through the middle of the week and then perhaps more rain. just light showers on thursday with windy conditions after that. here's a look at the cloud cover that has invaded the bay area. you will notice that we are looking at more cloud cover across the state. but the system that was going to provide us a the bit of rain is bogey to stay too far offshore to bring any rain to san francisco. so mainly south of the bay we do have a chance of showers later on in the afternoon, but really it's southern california that will see the rain and the mountains of southern california will see some snow as this area of low pressure continues to track to the south throughout

>> welcome back, everyone. nation's biggest union organization has issued a new report warning that hundreds of thousands of californians will lose their unemployment benefits right of a christmas if congress doesn't act. abc7s capitol correspondent nannette miranda has the story from sacramento. >> the great recession hit the construction industry hard. millions lost their jobs like jeff davis. he recently became a 99er, someone who has exhausted all 99 weeks of unemployment benefits.

that's 26 weeks of normal benefits, plus five extensions. >> i'm not quite sure what is going to happen to me. i spent 20 years basically getting to where i was and i was happy hanging sheet metal ductwork all day. now that's gone. >> the afl-cio estimates more than 300,000 californians will be joining davis if congress doesn't act to extend benefits by the end of the year. washington is hung up on its usual fights. but mckinney saw the same stalemate last year. he was at 97 weeks when he decided to retire rather than risk no money coming in at all. >> i could see my benefits were running out. i didn't see that congress was acting to extend anything. i didn't know if they could extend anything. and i was one of the lucky ones. i had a way out. i had my retirement. >> mckinney's decision turn out to be the right one. congress barely approved extensions last year, but not beyond 99 weeks. but extending jobless benefits is costly. because the state's unemployment

trust fund is broke, california has been borrowing money from the federal government for two years to keep the checks going. taxpayers forked over $300 million in interest to the feds this fall. another $400 million is due in nine months. >> that continues to be costly to the state the longest we go without a solvency solution. >> labor unions say the economy cannot afford to let the benefits expire. they are ready to picket congressional offices across the country thursday urging lawmakers to set aside partisanship. >> now is not the time to be playing a political game with unemployment benefits that are keeping people alive. >> and it's not just the 99'ers on the line. if you, for instance, are on your third extension you cannot get the fourth without congressional approval. the average extension is about $300 a week. in sacramento, abc7 news. >> two of pg&e's high pressure gas distribution lines were declared safe even though the

company does not know what grade of pipe was used in the lines. today san francisco chronicle has details in the late nest a series of reports since the san bruno pipeline explosion in september, 2010. one of the pipelines that was improperly declared safe runs through discovery bay in brentwood in certain contra costa county. the second runs from kettleman city in kings county to the central coast. >> if you owe money for any overdue books at a library in alameda county, here's a good deal for you. they will for gift fine if you don't nate food. we have the story. >> overdue library fines can quickly add up. >> over the summer, $50 actually with videos. they are a dollar a day, and lost items. >> the library can help get the balance down to zero thanks to the new food for fines program.

for every food item you put in the collection barrel, you get one dollar off your bill, up to a maximum of $10.00. >> if you want to bring five nonperishable items, you can do that. bring them into the library and have the items checked in and the $5.00 would be taken off of your account. >> the alameda county board of supervisors approved the two week program. >> i think that's really a good idea because you feel like you are helping someone at the same time as repaying your obligation. >> and the alameda county community food bank said the timing couldn't be better. they referred 8500 people to emergency food sites in november alone. that's 15% more than last year. >> that was a record number for us. again, part of it was the holidays. people wanting a holiday bag during that time or needing one. but again, it's another indicator that more people are needing assistance this holiday season. >> this is not the first time

the food bank and the alameda county library have joined forces to help the community. over the summer the food bank helped deliver lunches to needy children at some libraries. helping feed the mind and the body. >> now other counties like san mateo, for example, have had similar programs where they forgive fines for food. another way to give is through their virtual food drive, which is on the alameda county library website. there you can make donations directly to the food bank. in the news, abc7 news. >> i thought i heard we were going to get a little rain here or there, did i miss or. >> you heard right. a cutoff low that will travel a little too far west to give us any rain here. i think more likely the south bay or monterey, and even still it's just a passing shower. a live look outside, you see the gorgeous moon out there.

to you? day after day the weather pretty much the same with just a few blips? >> there's some subtle nuances. the short answer is no because yesterday we were forecasting rain and things change. especially forecasting a cutoff low that is cutoff from the main branch of a jet stream and that allows for it to sort of wobble and do its own thing. we are showing the moon. sun will be up in a half-hour or more. temperatures there in the teens. back home, knob hill, upper 40s with a little bit of cloud cover. we will see more of an on shore push. we are looking at points south picking up snow in the higher elevations of southern california. but right now a couple 30s out there. certainly not as chilly as it has been. 36 in napa, 39 fairfield, 36novato and we have fog and a little bit of haze around the

bay. 45 fremont. upper 40s san francisco and the fog sits in novato around napa and hayward. along the coast looking pretty good. no problems there but we will look for more cloud cover today. and a slight chance of showers. but you will notice the warmer starts with 10 degrees warmer this morning in concord, and livermore 13 degrees warmer. we had plenty of 20s here yesterday and this morning 20 degrees warmer for redwood city and hayward. it is cooler in los gatos. high clouds and fog keeping the numbers up. this afternoon a system will travel to the south of us and bring it offshore. a light chance of showers from the south bay to monterey and into southern california. we are looking at dry weather to return to start the work week, but by thursday perhaps a few more showers. we're we are so far with santa rosa just four inches of rain for the season. 48% of normal. san francisco a little over

three inches of rain, a 55% of normal. oakland almost three inches of rain with 60% of normal. and we are talking about only 43% of normal here. this time last year the numbers were doubled and then some. so definitely really some paltry rain chances coming our way today and then this area of low pressure tense to drop south. very limited moisture. with the moisture offshore, the best chance remains from around monterey all the way down into southern california. once this pushes through we will see partly cloudy skies return and dry conditions for the beginning of the week. in fact, a little bit warmer. so we are looking at numbers today really held down, only in the upper 50s from los angeles, mid-50s sacramento, and today back home only in the low to mid-50s.

why would you want to do this? >> they were recruiters for the miss california pageant and why we will get to in a minute. first we will get to where denise has been where no other contestant has ever been, to war in iraq. >> i was there for 400 days and i was a medic and worked in three different prisons. we saw more gunshot wounds, and amputations, that sort of thing that are more prone to being in war versus the emergency room situation here in the states. >> denise spent for yours on active duty in the army and is now a sergeant in the army reserve. the pageant said she's the first iraq war veteran to compete. here is why she wins. -- here is why she entered. >> if you win you get to do humanitarian work for a year and you get to be the face of a lot of sponsors and helping children in school and just putting your voice out there and speaking into people's lives that are

young. >> miss sausalito competed in the miss california last year. she believes denise's military background may be a big plus. >> someone coming from her background who has seen what she's seen, i think she will be able to really excel in her interview, being able to tell stories no one else can tell. >> i chose to join the military. made me nor stronger physically and mental by and made me a better candidate for miss california. what if she doesn't win? that's where her faith comes in. >> even if your friends or family fail you, there is something bigger and better that you could hope for in the future, especially when you are going through trials and tribulationings of the moment. you know there will be a brighter day to come. >> she expects that brighter day whether or not she becomes miss california. but winning couldn't hurt. eric thomas, abc7 news. >> don't go away, 7 on your side is up next. >> when is a refundable ticket

return flight and received confirmation from the airline that she had done so. three weeks later the couple was married in san mateo county. >> there was no need to have more time. we were sure what we were doing. >> when things settled down she inquired with the airline about the expected refund. >> all i receive was the automatic notification saying it was refunded. he never heard back anything from anybody. >> over the next year she filed several online complaints but there was no response beyond the automated e-mail. he is a nationally known travel attorney. >> months and months, that isn't reasonable. but there's no consumer rights law that says it must be this long. >> more than a year after her cancelled trip she contacted 7 on your side and we contacted lufthansa. >> i'm thinking halleluiah. there was absolutely no communication from the airline.

i had completely written it off. >> they blame the delay on a computer glitch but said they responded to her once it became aware of the situation. we do need to mention the refund was only about half as much as she expected. it seemed she unknowingly purchased what is known as a restricted refundable ticket which entitles her only to a partial refund. >> i'm happy because i at least got something back which was not even -- which wouldn't happen without awc7s help. >> she felt the terms of her ticket were not fully disclosed. we looked online and could not find it disclosed either so we asked the airline whether the terms were posted and have not yet heard back. when we do, we will let you know. if we don't, we will let you know that, too. i'm michael finney, 7 on your side. >> coming up next, charlize theron stars in what don calls an almost comic version of the fatal attraction.
