in the news this saturday morning, bay area police say they are stepping up d.u.i. patrols even though arrests and fatalities are down this year. and a rare saturday vote on extending payroll tax cut. while they'll have to debate it all again in a few weeks. >> good morning. a few high clouds, another mild afternoon. >> i'm terry mcsweeney. holiday celebrations kick into high gear but the d.u.i. patrols have already started. bay area law enforcement agencies are out in force as penalties are about to triple for chronic drunk drivers. >> reporter: in marin county

they set up a checkpoint early. drivers are being asked if they had anything to drink. in marin county, it's called avoid the 13, 13 cities that will have expanded patrol, 791 people lost their lives in california in 2010. last year for which numbers are available. >> in san mateo county, assemblyman jerry hill is kicking off avoid the 23. with 300,000 californians having more than three d.u.i.s. >> january 1st, if you are convicted with third or more d.u.i. a judge could take a license away for ten years. >> the prior penalty was two for three years. the sergeant believes this new law could be a lifesaver. >> the safer the streets, the better. to save a life on the street it's worth it. >> this could take 10,000

fatal shooting by a san jose police officer last night. a man identified as manuel fuentes, was drinking in public. he ran into a home and tossed a gun into another bedroom. another man picked it up and refused orders to drop it. >> he picked up the weapon and the officer gave him command to drop the gun and the suspect pointed it at the officer and the officer shot one round. >> funentes was booked for arrest. this is the eighth officer-involved shooting this year. >> concord police have made ran arrest for the killing of ducks and geese in city parks. a teenager is being held at juvenile hall. they have been looking into the

death of water fowl. they believe he used a small caliber gun. his name is not being released because of his age. >> the u.s. senate has just passed a one trillion year end budget deal earlier this morning. senate voted to voted to extend social security. democrats and republicans could not agree on spending cuts large enough to cover a full year. the house passed the one trillion dollar spending plan. it trims most domestic agencies and awards the pentagon the smallest budget hike in recent memory. >> a big improvement in california's job market. it fell to 11.3% in november. that is the lowest since may of 2009. down from 11.7% since october. the employment development department says they added

another 6800 jobs last month. still two million people remain out of work in the state. a south bay couple is in police custody accused of rent fraud. an unusual story here. timothy august and monica peretta is charged with several counts. they say they swindled landlords out of income. they rented the homes with no intention of paying rent. >> they misrepresented themselves from head to foe. they said they were married, they weren't. that wasn't important but they said many other things, like they had good credit. showed me two falsified credit checks. >> the couple is expected of carrying this fraud out on six occasions that was a windfall of $30,000 in unpaid rent. barry bonds is avoiding

prison time after a federal judge sentenced him for obstruction of justice. he is placed on 30 days house arrest and two years probation. he is also ordered to do 250 hours of community service and pay a $4,000 fine. all of which was suspended while his lawyers appeal his felony conviction. more now in vic lee. >> he living in a wonderful mill at this million dollar mansion in beverly hills. many people would be happy to serve detention there. >> lance williams who wrote a book on the scandal is referring to this mansion, barry bonds' $9 million estate in beverly hills where he may be under house arrest for 30 days. >> how do you feel right now? >> pretty good. >> federal prosecutors believe it's not much of a punishment for the superstar who was also put on probation for two years and ordered to perform 250 hours of community service. but the judge said she was moved

by bonds' charity work, almost all of it out of public eye. >> one says he has been generous to bryan stow. >> he donated and for the kids for college. >> the judge was also influenced by the homeland king's clean record. she believes his behavior was an aberration. bonds' attorneys agree. they are appealing his conviction on obstruction of justice. >> at the moment he is brand add felon, we think unjustly. just as we aggressively put a the case at trial we intend to fight it on appeal and overcome that judgment. >> victor conti got four months prison time after pleading guilty to drug related charges. he believes prosecutors unfairly

looking at the golden gate bridge, richmond district, the presidio, what a day. gorgeous shot of one of the most famous landmarks in all the world, golden gate bridge. a crisis in the philippines this morning, more than 400 people have been killed overnight by raging floodwaters. a tropical storm pounded the southern philippines for rain for 12 hours. it caused rivers to overflow last night and sent walls of water through several cities. at least 436 people are reported dead, many were in their beds as floodwaters hit. hundreds of still missing. you have to say something about the technology and communications that we have in this country, we don't have rains like that, but we do get heads up just about everything coming our way. >> not only the bay area behind precip but much of the nation, unusual weather, mild in the

east. there is really not any snow in the eastern part of the country. hoping for snow and rain here. we have cold conditions. 17 degrees in tahoe valley airport. heavenly, lots of sunshine. numbers in the mid 40s today not northern sierra. back home, we're talking numbers really cold in the north bay, this is mount tam where you are looking at all the hills there with freezing temperatures, santa rosa, but you go over to napa and with an east wind that is draw dra understanding a lot of fog into fairfield and concord. the numbers are up in napa but look at redwood city, 33. mountain view, 33. 39 in san jose. fog for the next couple of hours less than a quarter mile visibility. right here where we've got the tule fog, even novato, mile and

a half visibility. elsewhere more sunshine and a cold start this morning, but overall, we're talking about these east winds that will kind of wreak havoc if you are over in the delta and concord this morning. other areas on the peninsula have bottomed out. cool start with the frost around and some fog. sunny and mild today. a little cooler, north winds will back up. sonoma, napa, parts of marin county will be in the upper 60 today. very seasonal and no rain for the next seven days. here is why. huge ridge of high pressure, you can see all the way up into canada. our low that brought us rain on thursday, quarter of an inch in santa rosa, still lingering in southern california. but that slide to the east and we'll see more quiet weather. here is the setup.

begin collecting signatures for new initiative to repeal the ban on same-sex marriage. secretary of state signed off on the petition yesterday. los angeles based group has until may to get 800,000 signatures to qualify for the ballot. california voters passed prop 8 with 52% of the vote that bans same-sex marriage t currently under appeal in the 9th circuit court of appeals. >> a federal judge in san francisco is now considering a case involving the federal defense of marriage act known as dolma. according to that act, same sex on couples in seven states are not entitled to a number of federal benefits that other married couples are allowed. obama administration says it will not defend doma but a constitutional group says it will. lyanne melendez reports. >> reporter: she works for the federal government. she was denied health benefits

was speaking to a district attorney. jerry sandusky faces 52 counts of child abuse against ten boys. he says he will plead not guilty and has a new lawyer. >> showering like that may sound strange but people that are dependent have to be taught basic skills. >> the judge ruled there is enough evidence to put them on trial. jerry sandusky will head to trial separately in about six months. stanford is announcing it is dropping plans for an engineering campus in new york city. silicon valley 2 would have cost up to $2 billion. university said it could not get guarantees to get the permits for the kind of building it envisioned. engineers says we're not going to build the school because you won't let us do the engineering

if you want to see a true appreciation of snow head to china. two pandas couldn't be happier with the recent heavy snowfall. i believe they are pronounced walau and hosang. they are used to this kind of thing and they really like it and they have plenty of fur to keep them warm. a couple of them did a quick thing on skis. but that is pretty darn good. very cute. >> and what is going on? >> we do have some changes around the bay. it choose with our winds. flight, lots of sunshine in

santa cruz where temperatures later on today once again will be in the 60s from mount tam, notice the winds here. blowing pretty strong out of the east and that is why we have some fog from the central valley that is visiting concord and fairfield this morning bringing the temperatures up in napa and elsewhere. there is frost from the peninsula, redwood city, mountain view and these winds actually not work on our favor to warm us up today. yesterday it was 70 in santa rosa. how about 30 right now. we've got 30 in fairfield with 42 in oakland. here is a look at the visibility in miles. talk about the fog by the delta, also in concord, less than a quarter of mile. even some of that fog has settled into novato. definitely some problems out there. >> livermore valley, five-mile visibility. with the wind, temperatures that have come up into the low 40s in napa. so the east wind will bring in the fog and allow for some of

filed an appeal to block the plan for the america's cup yacht race the city wants to move forward with sweeping changes to the waterfront. here is jonathan bloom. >> reporter: some consider it one of the most iconic views of san francisco bay, the unobstructed panorama visible from the embarcadero. but preparations for the 2013 america's cup threatens to change the view. >> the original city has contemplated a new marina. >> the new marina slated to go in south of ferry building would have visiting yachts too big to city in other harbors, it would let visiting millionaires block the view from a popular walking trail with their huge boats. >> it calls for the marina to stay here a lot longer of after america's cup. the mayor said this won't work.
