>> terry: in the news this saturday morning, january 7th. police say they have arrested a suspect wanted for three sexual assaults in san francisco. police have just wrapped an investigation of the sheriff elect ross mirkarimi in an investigation of domestic violence. >> good morning a clear sky out there. a beautiful day out ahead. temperatures are freezing right now. >> terry: i'm terry mcsweeney. a 32-year-old man faces charges for violent attacks on women going back to june in the mission district. tomas roman reports the special crimes unit identified the suspect using surveillance video. >> women that live in the fair oaks area that cross through daily are relieved that the man wanted in three brutal sexual assaults in the area has been caught. >> i'm extremely happy that he is caught.

the neighborhood is very quiet, nice street. >> it's quite a sigh of relief because honestly it's pretty unnerving to know there is someone like that out there. fact that he was caught is great. >> reporter: they are happy but still cautious. >> good news. >> reporter: going to change your behavior a bit? >> probably not. because there is always a possibility there could be somebody else. >> reporter: members of the special victims unit announced the arrest of the man in connection with three sexual assaults, robbery and kidnapping. she seen here on the surveillance video. two attacks occurred here on fair oaks. >> he is responsible for three sexual assaults. he will be booked on multiple felony sexual assaults, robbery and kidnapping charges. >> reporter: the victims were all attacked in the early

morning hours. they ranged from age from 20 to 50. it includes officers from eleven different disciplines helped put the case together. dna and a tip helped make the arrest. >> there were characteristics on this case that were a little unusual that narrowed down the suspect pool and made us focus on a certain type of a suspect. we were lucky to have the f.b.i. in on in case. >> reporter: police say the attacks started in june. most recent was december 8th. they say residents have been understandably on edge. people in the neighborhood were extremely concerned and fearful that this rape had happened right on their street, right on the sidewalk. >> reporter: san francisco police say they are not releasing the name or photo of the 32-year-old african-american male they have arrested until they have finished talking to

the witnesses and victims in the case. >> terry: he'll be sworn if in as san francisco sheriff tomorrow but this morning, former supervisor ross mirkarimi is being investigated for an allegation of domestic violence. ama daetz reports. >> reporter: this is photo showed shows what appears to be a loving couple. but a police investigation into mr. mirkarimi suggests otherwise it's now in the hands of the district attorney. we will evaluate the case as we would do with any other case. >> reporter: the domestic violence accusation comes from one of neighbors. she didn't answer the door. a neighbor called police saying she spoke to ross mirkarimi's wife and asked her to videotape a bruise on her arm. she had a text message conversation with the victim about the incident, her injuries

how the injuries were caused and who caused the injuries. but a spokesman for mirkarimi's wife quotes her as saying what is happening here is wrong. i have absolutely no complaint about against my husband. my husband has never been abusive to me. we are committed to our marriage our son and family. >> probably the most frequent problem in domestic violence situations is that the victim doesn't want to testify. >> reporter: dean johnson says these cases can be won without the victim's testimony. >> i have seen cases filed and tried to jury verdicts successfully on weaker evidence. >> reporter: the affidavit they sized the video camera and cellphone. if mirkarimi is charged, he has a lot to lose. >> there are a number of positions that prevent people that have been convicted of felonies from holding public office. it's usually one of the normal

things in a felony. >> one of the most problematic things a district attorney will face if a peace officer is convicted of a felony he can't carry a firearm and they are pretty useless. mary hayashi can't go anywhere neither near a neiman marcus store. she was arrested in october after surveillance cameras showed her walk out of the store with items. she is accused of stealing $25,000. a reducing the charge to a misdemeanor. she was sentenced to three years operation and $180 fine. she wouldn't answer our questions about a motive but her attorney says medical condition may have played a role. >> she has been diagnosed with a brain tumor but fortunately for

her it's benign and it can be taken care of and addressed with medication. >> a spokesman confirmed the brain tumor but had nothing to do with the incident. niles canyon road is reopened tonight after a head-on collision. one driver drifted over the center divider about a mile west of sunol and collided hone with another car. the crash left both directions of the highway blocked until after midnight. hundreds gathered in oakland to remember a five-year-old shot and killed last week. gabriel martinez was killed on international boulevard. yesterday, family and friends and even strangers gathered at st. elizabeth church at the

everything could be cut deeper if voters don't approve the governor's proposed tax increase. that has critics crying foul, capital correspondent nannette miranda has the story. >> reporter: governor brown built another trigger points in the state budget, this time 5.$5 billion if voters don't approve sales tax hike and income tax surcharge. reductions would hit the schools the hardest 4.$8 billion less which is equivalent to shortening the school year we three weeks. >> by the time the student graduates it would be equivalent to one less year to that student. >> u.c. and csu would be slashed $200 million. cal fire would have to cut back 10 percent which means grounding some of the aircraft.

all 600 lifeguards would lose their job and state park rangers would be laid off. they called the proposal extortion. >> it certainly is political extortion. he is basically saying i'm going to really cut essential services unless you pass this tax. >> it really is. >> reporter: park visitor mary johnson feels like coerced. she will vote for it so california's unemployment rate won't be increased. >> we have to pay the taxes rather than see people laid off. >> many people don't look at the cuts as tlts saying the governor doesn't have any choice. >> laying out a clear picture of what those choices are and what the consequences will be if that revenue doesn't come to fruition is what they actually to have know. it's about being honest with voters, really. >> reporter: his campaign

contra costa fire crews were called out to the valley oaks townhomes. they found a two-story townhome fully engulfed in flames. the fire chief says the body of one person was found inside. second resident is okay but at a local hospital. the fire was brought under control by prior to crews from several areas. cause of that fire is under investigation. gop presidential candidate jon huntsman says a new online ad targeting his adopted daughters is out of line. it shows the two girls don't by china and india. it labels him unamerican for speaking mandarin but shows him as a communist leader and asks whether he is manchurian candidate. >> i speak chinese.

wherever you go. shot near the embarcadero, transamerica pyramid, bank of america building and couple clouds up there, but they are not going to make a dent in the beauty of today. it is peak whale watching season and several sightings in pacific. two whales entered honolulu harbor. they have been trailing a fishing boat for days and followed it right into the harbor. the rare move because the mother was following the young whale and the young whale was following the boat. another sighting of a killer whale. a large pod of orcas. you can see a calf among the whales. they say killer whale populations have risen and certainly explain why there have been recent sightings. >> off the coast of san mateo

delta, but our friends in the livermore valley, it has been cold with a windchill factor. later on today. these north-northeast winds will work to warm us up. low to mid 40s and mid 30s elsewhere around the bay and on the coast it's 50. novato, 34 and only place that has a little bit of fog is napa but elsewhere those winds have scoured out the fog, dried out the atmosphere and warmed us up from napa, santa rosa and fairfield this morning while we've cooled down a little bit in san francisco but more significantly in oakland this morning and livermore with 10 degrees of cooling. it all amounts to a sunny and milder afternoon today, tomorrow perhaps the upper 60s in warmest north bay valleys. we will look for the dry weather unfortunately all of next week. it looks like we'll be looking at subtle changes day to day.
