charges in connection with an alleged domestic violence incident against his wife. and police arrest a union city high school teach are for having sex with a student. >> good morning. in the 60s, sunny sky. >> good morning. ross mirkarimi is vowing to stay on his new job as he fights misdemeanor domestic violence charges filed against him. he could face charges of domestic violence, battery, child endangerment and dissuading a witness. yesterday he surrendered at the very jail he oversees. he was booked, of photographed and fingerprinted. he is now free on $35,000 bail. domestic violence groups are calling for his resignation. he and his wife call the charges unbelievable. >> sheriff mirkarimi walked out

of his office looking tired. accompanied by his wife he stated he had just received confirmation by the district attorney's office. >> three misdemeanor charges have been assigned to me. >> he quickly stated that he will be vindicated of all wrongdoing. >> we believe that these charges are very unfounded and we will fight these charges. and i'm confident that in the end that we will succeed. >> district attorney george gascon believes the charges are supported by photographic evidence, text messages and the neighbor's testimony and proved beyond a reasonable doubt. >> our decision here just like in all domestic violence cases was based on the availability of sufficient evidence to prove the

case. >> gascon said the case is going forward even without the help of mirkarimi and his wife. >> the case is always stronger if the victim is willing to testify. however, it is very common for victims to be uncooperative in domestic violence cases. gascon said lopez has not spoken to investigators, but she spoke to reporters. >> this is unbelievable. i don't have any complaint against my husband. we are together and we are fighting. we are going to fight this. my family, my husband and my son. this is unbelievable. >> ross mirkarimi's attorney said his client is now prohibited from seeing his wife and child through an emergency protective order. >> he's quite upset that this process does not allow him to be with the wife, his wife and child, who he wants to be with. and they want to be with him. >> kathy black is the executive director of a group that counsels and houses domestic violence victims. she says the emergency protective order gives lopez some time alone to make a decision. >> to convert that into a restraining order, and there's different kinds of restraining

orders, and that restraining order covers visitation. it helps define where that child needs to be. >> the emergency protective order lasts for seven days and is included in the charge of domestic violence. district attorney could have made the charges felonies instead of misdemeanors and the charge of child endangerment alone carries is one year jail sentence. despite of all this. mirkarimi told us he will show up to work as the sheriff on tuesday morning. >> after the district attorney announced charges, mayor ed lee issued this statement. saying, "as mayor i must now review the facts and options available to me under the city charter, but i must also ensure that we do not take steps that undermine the criminal justice proceedings underway.

" and brown told us the sheriff should step aside at least for now. >> i'm of the opinion that any elected official finds himself in a position of domestic violence has to remove himself of any responsibilities until the matter is cleared up. >> the sheriff is expected to be in court for his arraignment on tuesday. >> in fairfield investigators are trying to determine the cause of a huge fire last night. flames shot out of the roof of a commercial building on empire street. eventually the fire engulfed the structure. a fire official says arson is not suspected. at least 50 firefighters were called in to put out the fire. no one was injured. also authorities are trying to determine what caused a natural gas pipeline to rupture and explode last night in rio vista. it happened about 6:00 p.m. in a distribution field. it took crews about half an hour to cap the fire. no injuries there. the line was going to be decommissioned on tuesday. it's owned by a company called vintage natural gas, not owned by pg&e.

>> three young children killed recently in separate street shootings will behind in order today. they will hold concurrent save our babies block parties. the churches will offer music and refreshments. doves will be released in the name of each child. a three-year-old was shot august 8th as his mother pushed him. and a 23-month-old child was shot in a parking lot during the tape of a music video, and a 5-year-old was shot while standing outside his father's taco truck on december 30th. neighbors say an elderly woman badly beaten during a home invasion robbery in the sunset district was known to carry large amounts of cash. the police task force is searching for leads in thursday night's assault. it left a 76-year-old victim and restaurant delivery woman who

jumped the robbery in critical condition. both women were beaten with a hammer and stabbed. >> the victim is a very active community member. she's a business owner here. we would hate to think that she was targeted specifically but she does have, we believe, a pattern that she does every day. >> the 76-year-old woman owned several restaurants and a bakery near her sunset district home and is politically active in the community. the attacker is described only as a young cantonese speaking male. in union city a high school teacher is under arrest accused of having sex with a student. the 33-year-old man teaches at james logan high. he's facing charges of statutory rape. they say he was on the way to meet with a girl on thursday when he was taken into custody. according to the girl, the relationship began when she was 16 and it lasted for about nine months. police say they are now look for other possible victims. another east bay teacher

reporting to have sex with a student admitted to the crime. 40-year-old mary johnson was charged yesterday with 24 counts of sexual assault. investigators with livermore police say johnson's relationship with a 14-year-old granada high student began with text messages and facebook postings. court documents reveal she told police she had sex with the boy to dozens of times over a six-month period. >> police may have finally break in a case. and the 49ers are set to host the first playoff game at candlestick park in nine years. the hunt for tickets and a the hunt for tickets and a warning from police.

police in orange county are investigating a suspect in the stabbing of a homeless man, the fourth homeless victim in the month. it was in anaheim. police aren't sure whether they captured the serial killer believed to be responsible for three other murders. bystanders chased the suspect and police detained a man about a quarter mile away. there's been an intense manhunt for a similar looking man who appears in surveillance video taken near the first murder seen. this morning gene hackman is recovering after being hit by a car. the 81-year-old actor was riding his bike in the florida keys yesterday when he was hit. he was thrown from his bike when a pickup struck his rear tire. the state highway patrol said he was not wearing a helmet. his publicist says he has some bumps and bruises but is going to be just fine. it sounds like something right out of a movie, but a retired bay area truck driver believes his dog may have discovered a meteorite in his

at 8:30 the tailgate parties begin at candlestick park. the fans are? a frenzy. it's been nearly a decade since the niners were in a playoff game. and police are warning fans willing to pay thousands of dollars for a seat to be aware of scalpers who may be selling fake tickets. >> all the way to the super bowl. >> he and his pals often worship the 49ers at this park at candlestick. they are filled with hope and a little inspiration. >> 49 hours to wait. the saints, they come here, look like they come visit. just come visit and 49ers take it all the way. >> they won't be going to the game because they don't have what every niner fan dreams of, these, tickets to the game against the saints. these belong to ryan, who bought them for $150 a piece a week before christmas. now he has to give them to a friend because he has to work. >> so i give them away to my friend. >> how painful was that? >> you don't even know. you really don't know. i don't want to talk about it.

look at all these numbers. we're at 29 in santa rosa, 33 livermore, 30 by the delta. it's calm winds and definitely another frosty start out there. but for a change we will be looking at warmer nights, some cloudier days, the cooler averages, and a little bit of rain coming our way. a series of systems that will spread some snow by the end of the work week. we aren't talking anything huge but at least it's the beginning of some changes. mostly clear and chilly this morning. spare the air. sharply cooler tomorrow. no rain out of this system, just very gusty winds and it will add to the dry atmosphere that we've had the past month or so. but it will also mix things out so the air quality will be better. right now the setup remains the same. dry across the eastern pacific and there is a cold front to the north and west of us. this will bring a carolina air mass our way. but out ahead of it we will look for the on shore flow and that will bring clouds. in fact, a 1500-foot deck of clouds overnight tonight and that will allow for a cloudier start.

then with this air mass spreading overhead, breezy winds. in fact gusty winds into the sierra nevada. but it's not going to bring rain. the rain will be confined in oregon, but definitely with the chilly air in place it will feel much, much cooler. in fact, as much as 10 degrees colder tomorrow afternoon. so a lake tahoe has wind gusts up to 50 miles an hour tomorrow. we know we need snow there. it will take at least four days or so until we see some precip in the mountains. at home, upper 50s to low 60s. game time, 1:30, should be a beautiful afternoon here at candlestick and elsewhere around the bay. once again, mid-60s so above normal for january. 64 san mateo. on the coast we will see numbers in the low 60s. quite mild n the north bay, a little bit of a north wind here so we are talking about mid-60s again for santa rosa. near east bay, 62 berkeley, 64

fremont and heading out over the hills enjoy it, this will be the last day that you will see numbers in the mid-60s for our inland valleys. upper 60s for salinas. 65 monterey. spare the air today with another mild afternoon. a frosty start tomorrow waking up to low fog and clouds. cooler, breezier, and partly sunny condition for our holiday, monday. and a chilly afternoon on tuesday. it's wednesday the north bay could see rain. thursday and friday, some showers and looks like the mountain snow could get going by the end of the week. it's not going to be huge but it's a start. >> lisa, thanks very much. dan harris joins us from new york to tell us what is coming up at seven on "good morning america." good morning, dan. >> good morning. breaking news overnight. this is really like a scene out of titanic. a luxury screws ship running aground off the coast of italy, flooding with water, forcing more than 4,000 people to evacuate. at least three people are dead. rescue crews are look for

survivors after some people jumps into the water in a panic. the question is how did this happen and why couldn't they use the life boats? that's coming up. and also, it's finally starting to feel like winter in much of this country, especially the midwest and northeast. they got a huge hit of snow overnight. now the temperature is plummeting. we've been tracking the whole thing and we have the forecast this morning. and plus an incredible scene caught on tape near you guys. a mother and her two young children trapped in this mangled car as it teters over the side of a bridge outside of santa barbara. it's hard to believe that what you are looking at here ended in a miracle and we are going to show you that coming up. also we are just hours away from an epic football showdown. i know the 49ers are playing today but there's also this. tim tebow going head-to-head against three time super bowl champ tom brady. one is an open evangelical, a self-described virgin, the other is married to a supermodel.

in st. louis, rams tire fisher as new head coach. he was weighing offers against two teams. fisher coached the titans for 17 years. he led his teams to four division titles as well as a super bowl appearance back in 2000. and baseball news. unable to come to a contract, tim lincecum and the giants head to arbitration. this could be record setting. he's one of 142 players filing for arbitration yesterday. timmy is expected to ask for the highest award ever. it would eclipse the 22 million that roger clemens requested in '05 from houston. lincicum made $13 million last year. he had a losing record of 13-14 but you can't really blame him because the giants' offense was so bad they failed to score for him when he was on the mound in seven of his starts. two years ago the giants and timmy went through this before they agreed to a deal just before the arbitration hearing was about to commence, and that could very well happen again. that's a rap on morning sports. mike shumann will have

>> governor jerry brown said he's to not giving up on his high-speed rail dream for california even though two key leaders of that program resigned. abc7's capital correspondent nannette miranda reports from sacramento. >> the governor reiterated his commitment to the high-speed rail project one day after the resignations of k ceo roloff and another. the jolt at the top brings a lot of cries to scrap the plan, but the governor said he's not backing down. >> we are going to build, but we won't be stupid. we will listen to the critics and we will fix things and we will do the right thing and we aren't going to go overboard. we are going to be very careful

and build incrementally as we go. >> brown immediately elevated one of his appointees, dan richard, as chairman of the high-speed rail authority while the search for a new ceo takes place. questions swirled over the van ark's departure. she's seen here on the left. and while some think he was forced out over bad publicity over the project the $100 billion price tag, he sees it as opportunity. >> i'm putting my stamp on it slowly, but surely. >> and others found california's political climate tough to maneuver, despite having international high-speed rail experience. >> unfortunately he's not from california and a lot of things that us californians take for granted he had to learn. when the titanic hit the iceberg, the smart and lucky ones got off.

today he's asking all u.s. business leaders to think about doing that. >> and yourself what you can do to bring more jobs back to the country that made your success possible. and i'll make sure that you've got a government that does everything in its power to help you succeed. in the coming week he will outline his plan to offer new tax breaks for companies that import jobs and owe eliminate incentives for companies that move jobs oversees. in the race to make all things digital, smaller and faster, there could be a game changer out of ibm san jose's research center. they are reporter a major breakthrough. here's business and technology reporter, david loui. >> this small lab makes for cramped working conditions but these men are working on a tiny scale. while it takes around 1 million atoms to store digital data today, they have found it can be done with only 12 atoms. >> why do we do this? because, of course, if we can make something that really works, it's a revolutionary

monarch butterflies flock to the the coastline each winter, and right now they are here in record numbers. abc7's jonathan bloom explains the big surge and why monarchs are one of nature's great mysteries. >> it's really an amazing thing to see. >> at first glance they look like clumps of trees in this grove of eucalyptus trees. >> there's one right above us right there. >> look closely and you will see what may be the biggest population of monarch butterflies that the farm has ever seen. >> we had 4,188 butterflies. >> 4,188, that's about ten times the year before? >> right. and more than the last ten years. >> they say it's possible last year's rainfall caused a spike in the growth of the milk weed plant where they lay their eggs. this pinprick will hatch into a caterpillarar that will eat the milk weed nonstop for 15 days before starting its transformation. >> imagine a whole putter fly in that tiny space. >> most live only a few weeks but each year one generation will live for six months migrate across the country to where the climate is just right. these have come from as far east

switch that trend by really as soon as tomorrow where we get a milder start and much cooler air in the afternoon. so say good-bye to the 60s and upper 630s. 35 in napa. good morning, livermore. 33 for you. it's 38 in san jose with 34 on the peninsula. low 40s half moon bay. 32 novato. the calm winds, radiational cooling, a stable air mass in place so a spare the air day throughout the afternoon. we are talking about more wind, in fact a lot of wind coming in tomorrow so that will increase the fire dangner the sierra nevada. relative humidity sharply decreases but that's all going to change the middle to the end of the week when we see some moisture head our way. the short term is the weekend, with today being the warmest day out of the next three. of course, that includes the holiday where we are going to see a significant change. and here's why. we've got high pressure holding on right now. here's the cold air bottled up into canada. you can see it here with the

speckling of the clouds. one more day will bring us temperatures above seasonal norms for mid-january. then finally we are looking at some changes. not in the form of rain, but in the form of a much colder air mass. and with this cold air mass we will see the winds shift out ahead of it. we are going to weak up to low clouds, the fog tomorrow. in fact, the marine layer will be pretty deep, about 1500 feet deep. this swings on through bringing the gusty winds in the mountain. yosemite 53. 73 los angeles. then by tomorrow with the wind gusts up to 55 miles an hour, it's going to be kind of dicey if you are headed up to the sierra or back home for the holiday keep that in mind. of course, if you are trying to ski, boy, lots of brown in the sierra nevada with only 11% of normal state-wide. last year doing much, much better, but at least we can see some changes in the future. back home we will be looking at a lot of sunshine today.

upper 50s to low 60s. at candlestick, 1:30 for the niners. and all around the bay numbers will be very pleasant today with more mid-6 tos. 65 concord, as well as san jose. subtle changes today but we are back to the poor air quality. keep that in mind. >> 68 in watsonville and down by the monterey bay it will be a very pleasant. tomorrow much cooler, low clouds and fog to start. we are talking about a cool holiday monday but that's really typical for january. tuesday about the same. we've been spoiled. we are looking at some rain coming our way and then hopefully snow. right now it looks like rain in the mountains by the end of the week. >> great, lisa. thanks very much. well, if you man to attend the 49ers game this afternoon against the saints, you can talk trash but leave your trash at the stadium, not in the neighborhood. that's the plea from people who live near candlestick park, a place most of us never visit unless it's football season.

at bc7 news i-team dan noyes took a look around for this morning's report. >> exiting off highway 101 on the way to candlestick park there are some beautiful bay views, wildlife and a lot of trash. >> welcome to the stick, as i like to call it. >> gilbert lives out here. he's trying to get something done about the constant barrage of garbage tossed, dumped and blown on the bay shore. >> we've got budweiser. i don't know if this is insulation or what this is. one shoe. >> on our tour we saw every kind of trash. thousands of tiny pieces of plastic instead of sand. we even found medical waste. >> there is a syringe. that's a syringe. >> so where is it all coming from? >> one of our biggest offenders, 49ers fans who need parking passes and tickets. >> besides some bad fans, he also suspects people use the

desolate areas to dump garbage from home and construction projects. he also says the passing trucks from the recycling plant nearby have something to do with it. we asked recology spokesman about that. he said the recycling trucks are sealed tight. he took us on a forensic tour of his own. >> this is intact. it was never in a garbage can. that was just -- someone just threw that out the window of their car. >> reed said recology is just as upset about the dumping as the neighbors. >> this should have gone into a recycling bin. this is fiber that can be made into new paper products. >> the sources for this trash are many. >> save the bay policy associate alison said the stress on wildlife here can't be underestimated. >> especially plastic bags and styrofoam. when they break down into small pieces they look like food to wildlife and that will eventually suffocate wildlife that try to ingest it.

>> so what can be done? there is so much trash tossed here that caltran said they can't keep up. they clean the area every other week. >> but there is just so much litter it always looks as if we haven't done anything because we will take care of it and a couple days later it's there again. >> and changing the mindset of dumpers is an up-hill battle and each person we talked to has a different approach. law that is get rid of plastic bags instead of going after people is a big step. >> we are encouraging every bay area city to stop the polluting area at the source by banning their use. >> after we called a caltran crew to cleanup and they plan to put in extra hours picking up trash by hand. a labor-intensive process. they are asking the fans this weekend and anyone that drives out there to think about the costs. >> all the other things that we should be spending our time and resources on, highway maintenance, we have to devote a lot of that just to picking up other people's litter. >> and from recology we got an offer and a card.
