family of jose jesus nunez, the man who was shot last night by the police. they were here at the police department actually still trying to collect his body. they're trying to get some information as to how to go about doing that. we were in his neighborhood earlier today. that is where he was actually shot. this neighborhood is trying to piece together exactly what happened. he says he heard something as he was watching tv. >> i heard gunshots before but it was kind of faint. i did hear like, one or two shots. >> ounce. >> reporter: one of his neighbors said he clearly heard a police officer south three warnings before shooting. >> and then the third one was, i told you to put your hand on top of your head or i'm going to shoot you, and not even a second after he said that two bullets rang out. >> the shooting scene as been cleaned up. police say they man who was shot

was stopped by an officer on suspicion of driving under the influence. >> the driver was uncooperative, and the officer called for backup. the driver inside the vehicle reached for a weapon that being the revolver. >> the police say they map died at the scene before medical teams could rave. neighbors say the man is a 42-year-old jose jesus nunez and lives here with two friends. no one was home when we knocked on the door. the neighbor says he was surprised how quickly the officer pulled the trigger after the third warning. >> the thing that concerned me, and i didn't see what transpired, but right after he yelled the third warning it wasn't even a second. >> the family of mr. nunez says they don't know a lot about what happened. they're trying to get information from the police this afternoon. as for the investigation the police officer involved in this shooting has been put on paid administrative leave, which is standard in an officer-involved

shooting. this is an investigation being looked into by investigators here and the santa clara county district attorney's office. >> alan: in san francisco's richmond district. flints are mopping up after an early morning house fire. it happened at 2:30 this morning. flames were shooting out of a second story window when crews arrived. the fire burned for two and a half hours. there's no word on any injuries, and investigators are still trying to figure out the cause of the fire. >> the red cross is providing emergency shelter for nine people after a house fire in san mateo. it was reported just before 9:00 this morning. everyone was out of the house when firefighters arrived at the scene. investigators believe it was an accidental fire. no one was hurt. >> the death toll is up to five tonight in the cap sizing -- capsizing of a reductionly cruise liner, and italian

authorities are searching the wrefnlgt survivors say the ship's crew responded to the emergency with incompetence. still, there was a joyful moment today. here's the report from italy. >> reporter: the cruise ship lay dead in the water for a second day off the italian coast. and today more survivors. after having been trapped for more than 24 hours a crew member was hoisted to safety bay rescue helicopter. he joins a korean honeymoon couple who were spared death when rescuers heard their cries for help inside the dizzying maize of cabins and corridors. some weren't so lucky. divers found the bodies of two elderly man in the submerged part of the wreck. this home video captures the panic and dismay as passengers swarmed a life boat that wasn't working. are they able to get it down,

says one anxious voice? another says oh, my god now i'm really afraid. >> people started loading into the life boats and there was just panic. >> they had to use hammers to cut the rope and all of a sudden, after five minutes, to the water. >> survivors say the crew was unresponsive. the captain is being detained, facing possible charges of manslaughter and abandoning ship. he told an interviewer, we were the last ones to leave the ship. investigators believe the ship was close to shore when it hit rock that opened a huge gash in the hull and seawater swamped the ship. the ship's black box has been found but it will be months before it is understand what happened. >> alan: in politics, mitt romney is taking the day off, giving his competitors a chance
