happened from the police. nunez's neighbors are trying to piece together what happened. oscar perez said he heard something as he was watching tv. >> i've heard gunshots before but it was faint. i did hear one or two shots. >> reporter: a neighbor says he clearly heard a police officer shout three warnings before shooting. >> and then the third one was, "i told you to put your hands on top of your head" or i'm going to shoot you, and not even a second after he said that two bullets rang. >> he said this happened in the driveway. the shooting scene has been cleaned up after investigators collected evidence. police say the man who was shot was stopped by an officer for suspicion of driving under the influence. >> the driver was uncooperative with the officer, which prompted the officer to call for backup. the driver inside the vehicle reached for a weapon, that being the revolver, prompting the officer to respond. >> police say the man died at

the scene before medical teams could arrive. neighbors tell us the man who what shot is 42-year-old jose jesus nunez and lives in an apartment here with two friends. no one was home when we knocked on the door. the neighbor who heard most of the incident, says he was surprised how quickly the officer pulled the trigger after the third warning. >> the thing that concerned me, and i didn't see what transpired, but right after he yelled that third warning, it wasn't even a second. >> reporter: that officer has been placed on paid administrative leave, which i pretty standard in an officer-involved shooting. he has been with the department for two year as for the investigation, it's being carried out by investigators at the santa clara county district attorney's office. reporting live, abc-7 news. >> alan: in the east bay, oakland police are looking for a 14-year-old boy suspected of sexually assaulting two women. the first attack happened on january 6th on market street. the second was on january 12th

january 12th on 11th street. police say the suspect claimed to have a gun, then robbed and assaulted both women. the 14-year-old boy is described as an african-american male, 5'5", and weighing about 110 pounds. the oakland police department is also issuing a warning about a recent string of armed robberies. each victim was using craigslist to sell or buy merchandise. they say the victims were robbed when they arrived to buy or sell an item. >> an italian cruise ship company said today it appears that one of the captains made, quote, air roars in judgment by sailing too close to the coast before the ship ran aground. at least five people died and 15 others are unaccounted for after the costa concordia ran into a reef near an island off tuscany friday night. two americans are mook the -- among the missing. the cruiseline said the captain failed to follow the company's evacuation procedures.

packers and the niners fans are happy this team will have homefield advantage in the championship. we talked to people who went to the game yesterday, and they're eager to experience the playoff energy one more time. >> never been to a 49ers game like yesterday. just intensity. everybody wearing red. the game was the best game i've been to be worth going back to watch one more game. >> i would do it again and i would pay money just to watch the next game coming up. >> how much are you willing to pay? >> i don't know. i don't know. i mean, 300 maybe? >> got lightning in a bottle. san francisco giants a couple years ago, we just got -- just running on all cylinders. i like our chance. >> we did some perusing on craigslist and found tickets for as much as $2,000. it will no doubt by the hottest ticket in town. the nfc championship is

northwest gusts, santa rose sacks 22. 25, novato, sfo, westerlies with gusts to 37. half moon bay, 36. and we're starting to die those winds down a little bit. southwesterly. concord at 8, and a westerly wind component of 7 miles-per-hour in san jose. these winds will slowly begin to decrease this evening. here's a look at current readings. 48, novato. san francisco, 47. most locations, mid-up toker 40s. so, here's a look at the highlights. decreasing wind, colder night with frost, freezing likely north and east bay locations. by early tomorrow morning. get ready for sunshine, breezy dpornzs -- breezy conditions for monday and tuesday, and then rain returns first to the north bay on wednesday, then we all get wet thursday and friday.

you can see from these clouds, denoting the colder air sliding south. all of this will four-the south of us tonight. so i'm anticipating clear sky, and that will translate to cold temperatures below freezing. most definitely in the north bay. santa rosa, 28. livermore valley, below freezing. 30 for livermore. 42 for san francisco. monday, tuesday, high pressure will be with us so look for dry conditions, let's get to the meat of the matter and that is the rain moving in by mid-week. i moved our forecast model ahead. 7:00 a.m. tuesday we're dry, and then as we head into wednesday, this is 7:00 a.m. wednesday morning, already starting to get some rain. mainly north of the golden gate bridge. and then throughout the evening on wednesday, early thursday morning, that rein -- rain will spread south. the heaviest rain along the north coast, and by thursday evening, some of that heavy rain

pushes down into the south bay. so a wet weather pattern anticipated for the entire bay area. the latter part of the work week. here's a look at the highs for tomorrow. still keep it cool. plenty of sunshine, though. 50s uniform across much of the bay area. 53, san francisco. san jose, 55. watsonville, 55. the seven-day forecast, it is active. we'll look for a little change tomorrow. maybe a little breezy. temperatures in the 50s. increasing clouds wednesday, rain beginning in the north bay. spread across the entire bay area. thursday, friday could be heavy at times. some gusty winds as well. maybe some lingering showers saturday throughs. >> alan: could be a wet one when the giants come to town, shu. >> mike: i can't way. the defending super bowl champions green bay packers played their final game of the season on the frozen opportunity -- tundra of lambeau field. the g-men jump out early,
