in the news this saturday morning a string of taco truck robberies leaves them scrambling for protection. and four families are evacuated from their home after water gushes from the pipeline system. some. >> we have fog forming in some parts of the valley but plenty of sunshine and a good weekend. >> good morning, everyone. >> good morning, i'm terry mcsweeney. more than 100 area food truck operators plan to hold an emergency meet to go figure out a way to protect themselves from robbers. they say there have been too many stickups in east oakland. we show you surveillance footage of thursday's robbery attempt it's near foothill avenue and moot hill boulevard. that turned into a gun fight. >> this is video from a nearby laundromat camera. in the foreground a 32-year-old is sweeping up the parking lot where the family has done business for twelve years. on the left two men come into

view. according to police, one with the arm extended is a the 19-year-old of oakland accompanied by a 17-year-old who has not been identified. police say morris said be cool and give me what you got. he runs away and is struck twice in the back and once in the leg. he returns fire and shoot morris twice who arrives on the ground before stumbling away. amazingly both men have none threatening wounds. >> we aren't going to take this anymore. we aren't going to be considered atms. >> shelly is with an association of 120 mobile food vendors like this family. she doesn't condone venders shooting back, but they are fed up and terrified of being easy marks for bandits. >> they feel terrorized right now. and they feel terrorized and i'm trying to calm them from feeling that way. >> many vendors fear this kind of confrontation and some are arming themselves to be able to

fight back. >> he stood up. >> others are arming themselves with cameras. they want to be able to identify for police anyone who robs them. this is a food truck on foothill. this man mounted cameras after being robbed at gunpoint three times. he only speaks spanish. one time a man got in the truck, took the money box and pistol whipped my employee. this is a scene the venders say they never want to live out. the association has plans that may help. >> let's work together to get cameras on all of the trucks and the carts. let's work together to possibly get armed security for all of the trucks that work later. >> garza said she's going to be holding an emergency meeting of all 120 mobile food venders next week. they hope to work out some kind of defense plan. abc7 news. more violence in oakland. last night four wounded. that shooting came after a man was shot about 3:30 in the afternoon along international

boulevard near 65th. it appears that victim was hit by several bullets. and someone opened fire on a mini van and wounded two people on mcarthur boulevard and high street after six last night. six bullets went through the van's door. no arrests have been made in any of the three shootings in oakland. four fremont homes remain evacuated after water gushed from the pipeline system after midnight and into a neighborhood by 680. a fireman tells abc a pipe valve was left open or lose, allowing the water to leak out when the water was put back in service. it went across the interstate and went into six properties in the warm springs area. nobody was injured. the water was shut off about 30 minutes after the first fire trucks arrived. the fremont fire tells us the damage is mostly in garages and yards but water may have seeped into some homes. a bay area medical drama is playing out involving an undocumented immigrant who needs a kidney transplant and may have a donor.

he claims a san francisco hospital has refused to perform the life saving operation. abc7 has the story and the hospital's response. >> 35-year-old oakland resident spends 9 hours a day hooked up to his home dial sis machine just so he can feel well enough to care for his family. what he needs is a kidney. >> they didn't, no. >> after being on the transplant list at ucsf for several years he finally reached the top of the list, only to be told by ucsf in may -- >> that he couldn't get a kidney because of his -- because he's illegal. >> they can't comment on his case because of hippa privacy laws but explains in a statement ucsf does not reject transplant patients based on their immigration status. ucsf, like other transplant centers is vigilant about ensuring that the few available organs of transplated into

patients for the best opportunities for long-term care and survival. >> at that time when we went there, he had a job, he had everything. they didn't know if he was going to lose his job. >> navaro just recently lost his job with pacific steel when it was audited by immigration and customs enforcement. he still has insurance for now. it won't last. so an organization called just cause has started a pegs. >> he was covered at the time so they should have done it. there wasn't any reason to do it. and now he is still covered and there have been many individuals that have come out and said they would support him on his aftercare. >> several organizations are also on board. there's many groups, the california nurse's association, physicians for healthcare for all. >> in the meantime he will continue his daily dialysis and hopes ucsf will get them a kidney. abc7 news. a judge has denied an emergency order that would have

allowed san francisco sheriff ross mirkarimi to see his young son. yesterday he asked a judge to grant him visitation rights. he has not been allowed to spend time with his wife or his young son since being charged with misdemeanor domestic violence, battery and endangerment last month. sheriff made this statement as he left court. >> i know what he -- i miss my son terribly and he misses me. i have to go. >> mirkarimi's wife said she's in favor of letting her husband see their son. the pretrial is set for february 22nd. we are getting a look this morning at the occupy protesters. a judge has ordered to stay away from oakland city hall. the stay away orders come after protestors broke into city hall and vandalized the building last saturday.

city leaders requested the order because several protesters keep getting cited over and over and over again while nothing seems to happen to them. here are the people the judge issued the stay away orders to. you can see their names beneath their pictures. all of them have been charged with various crimes after last saturday's protestors. they can be charged again if they violate the order. does it tells them to stay away from city hall unless they have official business there. >> the los angeles dodgers are trying to get a lawsuit filed by brian stow thrown out of court. yesterday attorneys asked a federal judge to reject all of his claims seeking damages. he was a santa cruz paramedic who lapsed into a coma after being beaten opening day in the dodgers parking lot. his attorneys say they cannot prove the beating.

funding to planned parenthood chapters across the country. >> we are thrilled the komen foundation reversed its decision. a key piece of what planned parenthood does is breast health and breast cancer screening. >> we've never been asked to fund planned parenthood. >> she's the executive director of the bay area komen foundation. she says they currently don't have funding for them in the bay area. >> that's the irony. we aren't affected by what the original policy was. >> earlier in the week they created firestorm by announcing it would no longer donate money to planned parenthood because planned parenthood was the object of a congressional investigation. >> it has been a very rough few days. >> bay area komen board vice president said the local chapter rejected the fund to planned parenthood from the beginning. >> i think our reputation has been damaged.

an improvement there and of with six mile visibility, sfo as well as novoto toe. no problems there. cool this morning with some 30s on the peninsula, north and east bay and some fog, but pretty soon we will see another day in the 60s. although yesterday we saw 59. average high should be in the upper 50s. but overall numbers as much as five degrees above where we should be. and cooler conditions by monday with perhaps a little bit of rain coming our way, we hope, coming our way on tuesday. it will only be a one-day event. high pressure to the east and southwest of us, keeping this system from moving into the bay area over the weekend. it will keep us locked in this pattern. in fact, an offshore flow today with the northeastly winds, light east winds tomorrow and then the wind shift with increasing clouds late on sunday. and this forecast model right now is showing midnight on tuesday with rain headed our

way. so this definitely could change. this is a cutoff low. it's pretty hard to predict, and it changes from forecast model to forecast model. we are hoping this verifies but between now and monday, the next three days still dry and mild. certainly above normal in the sierra nevada with 52 in the southern sierra. 43 later on today. right now it's about ten at the tahoe valley airport. 73 in los angeles. and back home we will see more mid-60s with 65 in santa clara and campbell today. 64 in san mateo. on the coast, how about 63 half moon bay. san francisco about five degrees above where you should be, in the low 60s today. in the north bay with the northeast winds climbing to 66 degrees today in santa rosa. low 60s in vallejo but mid-60s as you head toward fremont. and inland another beautiful day. a few clouds in the morning, a

this plan will not help folks who bought a home they couldn't afford and walked away from it. it won't help folks who bought multiple houses just to turn around and sell them in speculation. what this plan will do is help millions of responsible homeowners who make their payments every month, but who until now couldn't refinance because their home values kept dropping or they got wrapped up in too much red tape. >> the president admitted his plan a couple years ago didn't help as many families as he hoped, but he said middle class americans should not have to wait for the mortgage market to recover to get help. and the governor brown released his pension plan a few days ago, he stirred up a hornet's nest. many unions are outraged and want to throw the rest of his plan into chaos. >> governor brown's pension reform package that's finally in bill form is getting

a huge thumbs down from public employee unions. they hoped to negotiate something less severe. it asks current employees to contribute more and calls for a hybrid retirement plan for new hires, essentially including a 401k. >> the things he's proposing is bad for the taxpayers, bad for the government, bad for the employees who are affected and it just takes money that is right now securely invested and turns it over to the wall street profiteers. >> the unions won't publicly bad-mouth a governor they helped get elected. but privately several ever thinking about not supporting his tax initiative because of the drastic pension changes. they will be meet to go discuss the possibility over the next few days and weeks. >> it's kind of like i'm going to take my ball and go home if you don't let me win. >> former governor schwarzenegger's finance director said it's a good start to fixes the state budget. >> if it were enacted exactly as he were proposing, it would be a monumental change and it would in the long-term make pensions much more sustainable.

>> gov. brown has lined up a broad coalition of support for his tax initiative with donations from the healthcare and oil industries and even indian tribes. >> if they take a walk, so what. >> the political watcher tony quinn said the pension changes are a strategic move to win voters over on a small temporary sales tax increase and income tax hike on high wage earners. >> i think he's trying to reach a bargain with the voters by saying, look, i'm asking you to raise taxes on yourself, raise your sales taxes, everyone in the state pays that. and in exchange i will do some cutting of these public employee pensions. >> the unions especially don't like that some of the pension changes will be read into the state constitution, essentially taking away collective bargaining ability. in sacramento, nannette miranda, abc7 news. >> if you drive the bay bridge you need to know about a major disruption happening in two

weeks. caltrans is shutting down the upper deck for the long weekend as part of the construction of the new span. heather ishimaru explains the plan. >> the message seens are on, warning motorists the westbound bay bridge will be closed all of president's day weekend. next week the message will be coming to you inside your home with tv commercials. the westbound closure will be from 8:00 friday night february 17th to 5:00 a.m. tuesday, the 21st. closer is to allow caltrans to build a metering light. this shows the detour until the new span will be open next year. >> this will shift the westbound traffic approaching the bay bridge a little bit to the south just to clear enough room for work to be done on a segment. the new bay bridge known as the oakland touchdown. >> right now there's also a lot of construction activity going on just east of the follow plaza. that work is unrelated to detour or the bridge, rather it's a

very unglamorous parking lot upgrade to go with the new follow administration and maintenance building. like the bridge project, they are replacing the original structures from the 1930s. >> these new buildings are down into terafirma where the old buildings are just not seismically safe and they need to be replaced. >> bart and the ferries will be running extra service during the weekend closure. expect delays on the driving route. >> as we get closer to the evening of february 17th as people are planning their travels, i encourage everyone to go to 511.org and look at alternate routes. there's a realtime traffic map. >> there is one major concern, the weather. the work is contingent on dry weather so if it rains, it will be postponed. obc7 news. we will check with lisa on that. you will be able to get realtime updates on the bridge closing with abc7's waze traffic app. we are inviting you all bay area

50s creeping into the mountains not good. but as we head outside the peak, sunny and nice out there with temperatures this morning cool, in the 30s on the peninsula. a little bit of fog out there. here's the roof camera. isn't that pretty with temperatures today once again nice and mild. 37 in mountain view right now. 38 redwood city with 36 napa. 35 santa rosa. some of the cool spots from north and east bay valley. the fog not much of an issue in the valleys this morning but it could get worse in some spots temporarily. chilly with a little bit of fog and mild afternoon temperatures today, tomorrow, and hopefully some changes monday night into tuesday. in fact, it looks like rain here for the bay area and that could bring some mountain snow right into tuesday evening, wednesday morning in the mountains. right now it's double-barrel high pressure allowing for the offshore flow and the northeasterly winds to push what little fog we have out of the bay and hopefully mix up the

headed out to fan fest, mid-60s here. a mild afternoon. really you should be in the upper 50s in oakland for the early to mid-part of february, but nothing doing. no winter time here for sure. the mild spring-like weather continues in the east bay with pleasanton at 65. pittsburgh 64 and salinas coming in at 70. so not much change from today to tomorrow. kind of hazy out there, mild, mid-and upper 60s. a little cooler monday. hopefully the rain verifies on tuesday and back to dry and mild wednesday, thursday and friday. >> it could be something coming down, three quarter inch max? >> i hope so. >> thanks a lot. we were look agent tahoe a minute ago and now we are talking about it. in nevada wildlife commission votes today on the future of the state's controversial bear hunt. lake tahoe is ground zero in the fight because that's where most of the bears are. the hunt is not likely to end, neither is the debate. but in this morning's assignment 7 report dan ashley shows us a possible compromise. get 'em up, get 'em up.

get 'em up, get 'em up. >> hunting bears was illegal in nevada. the wildlife department video show how they scare bears away from populated areas. but last august nevada had their first-ever hunt and allowed the use of dogs. if allowed shooting up to 20 beers but 14 were killed. we had 14 bears taken, 9 males, 5 females. >> the nevada department of wildlife caught one hunter baiting a bear illegally. >> using apples and bacon grease and used a scented oil that would attract the bear. >> the hunt has created huge public outcry. this man helps residents with problem bears. instead of the usual calls about bears in the garbage, she got calls with hunters with guns. we had people who were frightened, tharpe threatened,

thar were scared on the hiking trail. >> the tahoe horse is between california and nevada. the range is huge so hunters tend to stay out of the tahoe area. the range is huge and hunters tend to stay out of the the navy tahoe area. in nevada, though, most bears live in a small corner of the state, right near tahoe. even though the nevada hunt is tiny compared to california's, it hit a nerve. >> people in tahoe are very wildlife friendly. we live here because we want to live with the wildlife. >> so the nevada wildlife commission is considering a compromise. >> to maybe restrict the hunting in the tahoe basin to basically not have the hunting there. one proposal calls for no hunting inside the tahoe rim trail. that's a trail that roughly follows the crest of the mountains around the lake. a group called no bear hunt nevada welcomes any limits on the hunt but says it should be even fartherrer from the lake. >> i think this is crazy. they are proposing that the rim trail form the boundary. well, 3 million people visit the basin and hike on that rim trail.

the hunters use the trail. the bears use the trail. it's a recipe for disasters. >> the wildlife commission will also consider starting the bear hunt season later in the year on september 15th. >> that will eliminate a lot of the tourist traffic which traditionally kind of culminates with that labor day weekend. >> even with the restrictions critics call the hunt cruel and say there's not enough research on the actual numbers of bear in nevada. researchers say they have solid numbers and science behind them. >> that was dan ashley reporting. the wildlife commission reports on the proposal today but there's no certainty it is going to pass. the two sides can't even agree on whether any bears were actually killed in the tahoe area because they don't agree on what its boundaries are. we have links to the websites of groups on both sides at abc7news.com. just click "see it on tv." don't go away. 7 on your side is next. >> if your personal information is stolen, do you have any rights? i'm michael finney.

several hard drives containing medical records of 2 million customers, including todd. >> they got everything that somebody would need to know to be me. >> since then millions of more americans have received similar scary notices, like those 100 million sony play station customers who found out hackers got into their account. thousands of city college students, just learned their banking information was stolen. >> too many people are getting notice, hi, your banking information was compromised. there's a california law that requires company to notify you if they lose their data. now that law just got stronger. >> we want to know was it my bank account warnings it my credit card. >> until now companies were not required to tell you much about a computer breach, only that it happened and you were involved. now under the new law they must give you more facts like what information was stolen, when it was stolen, and how to contact credit bureaus in case someone is stealing your identity. >> providing more certainty that you will get the information you

need to protect yourself. >> i think notification is a good first step. >> steve of mill valley is still worried. his wife's information was stolen in the big sutter health data breach in november. she was too ill to appear on camera, but he says he wishes the law were even stronger. >> it should require some identity theft protection. >> todd agrees. one year after his information went missing, he is still wondering if some crook is planning to pose as him. >> there's a breach. it's not your doing and you are counting on somebody to protect your stuff and they should have to protect you somehow. >> they said these are common concerns. >> i have got the time, trouble and expense of closing down the account, opening up another one. shouldn't somebody be responsible for that? i think that's a long way off, for better or worse. >> they said it took four years in enact the new protection so its unlikely the law will change anytime soon. however, health net notes it did provide todd and other

customers with two years of free identity theft protection. even though it wasn't required by law. sutter health said it did not offer identity protection because the stolen data did not include any patient financial records or social security numbers. >> so many people are relying on these identity theft monitoring services to protect them from identity theft, and in fact that's not what they do. >> this woman says identity protection services aren't the cure-all anyway. >> they just notify you when certain information is on your credit report. >> she says it's better to monitor your own credit reports, bank accounts and insurance statements and hope no one poses as you when committing a crime. >> it's uncomfortable. you could be the safest person in the world and your information is out there. it's floating around. >> there are several steps you should take if your information is stolen such as file a police report and setting up a fraud alert with the three major credit bureaus. i have all the information and all steps you need. just go to abc7news.com. i'm michael finney, 7 on your side.
