>> in the news this morning, the saturday, february 25th,, sheriff ross mirkarimi's trial begins with an uproar over the pictures allegedly documenting the abuse. we will show you. and a special team of oakland police officers are patrolling the streets this weekend after an especially violent week. >> good morning. clear and breezy, feeling much more like the season, though, this week. >> good morning. i'm terry mcsweeney. outrage in the trial of san francisco sheriff ross mirkarimi. we are now seeing pictures of his bruised wife. prosecutors say they prove domestic violence, but they say they become public before a jury is even seated for a trial. >> these are from film taken by a neighbor, ivory madison. the prosecution is asking the

judge if it's okay to show them during the trial. video also contains audio n the district attorney's affidavit, the neighbor who reported the domestic violence, madison, stated her lopez's son tried daddy make boo boo on moment's arm and also she completely burst into tears and was trying. the release of the pictures stunned mirkarimi's attorney, lidia stiglich. >> i don't know it's prop practices to put out the photos knowing we are litigating a motion to whether or not the video is even admissible in the case. >> staying rich said the statement and video is hear say, made in some 20 hours after the incident allegedly took place. legal analyst dean johnson said california has an exemption to the hear say rule. >> that particular exception,

the physical abuse exception to the hear say rule was designed precisely for situations like domestic violence and child abuse where the victim may not be willing, able or present to testify. >> for prosecutors the video is a crucial piece of evidence needed to show injury. sheriff mirkarimi was in court and spoke after a judge delayed a ruling on the admissibility of the video until monday. the shear i have says he's been seeing his son regularly. >> he's the apple of my eye? how is he doing? >> he's great. he's very united with me. >> stiglich said the photos could affect choosing a jury. >> he isn't surprised prosecutors released these films when they really didn't have to. he said more and more lawyers are trying their high-profile cases within the media. >> we have to pick a jury in a couple days and throwing those photos out there without context under the guys of attacking it to a motion, it's unfortunate. >> abc7 news. this morning five teenagers are under arrest accused of hurling rocks into homes and

cars in a vandalism spree in livermore. they said they spread through the town early last saturday morning, throwing rock from a moving car. nobody was hurt but one rock moved through a window and ended up embedded in a wall in a child's crib. >> any type of injury as a result of their action would have changed the dynamics, fortunately for them and for us that, you know, no persons were injured and no one was home at the time the rock actually went into the house. >> detectives credit this surveillance tape, as well as tips from neighbors for helping them make the arrest. they said the boys expressed regret for their action. oakland police are taking a close look at video aired on abc7. you see a man stepping out of a car and firing a gun. a special team of officers is sweeping the streets this weekend. so far they made three arrests in a week with shootings left

two people dead and 15 others injured. >> he pulled out a firearm and shot it in the air and then down the street. >> this was caught on surveillance video. it happened wednesday morning on 53rd street. the cameras belong to a resident who doesn't want his identify no known. he was home when it happened. . when he realized his camera caught the shooting, he called the police. >> i heard several loud reports that sounded like gunshots. >> i offered them the video and told them how to get in touch with me and they took that information down. i didn't hear anything from them. >> i got in touch with the oakland police and a few hours later detectives came for the video. >> i just want them to make them stop shooting. >> oakland police have been working nonstop responding to at least nine shooting in the last three days. there was another daytime shooting near 99th avenue. >> through the couch. it went all the way through the screen door. it hit the bottle that was on the countner the kitchen. >> bullet went through the screen door where two young children often stand during the day.

>> both babies have been at the screen door. they like to watch people walk. i had to still put her socks on so i said come away from the door, come down and at this time down put the socks on. the socks saved them because there are two bullet holes through the screen right at head level. >> there were ten casings in front of the home, each bullet add together anger of oakland residents. >> you can't have keep running around shooting guns in the street. >> as for the violence that's been happening the last couple days, police believe that some of it is due in part to a gang turf war in east oakland. abc7 news. operations are back to normal at san francisco international airport after a bomb scare interrupted airline flights yesterday afternoon. >> terminal 1 was evacuated. but an elderly woman in a wheelchair could not identify a canister that showed up in the

scan of her own carry-on bag. a robot checked things out and it turned out to be an oxygen bottle. >> everything was shut down very quickly. >> people were sent out the door very quickly. >> terminal one was closed about two hours with airline delays rippling nationwide. >> muni is reviewing procedures after a bus sent pieces of equipment flying through an office building. it went through a window nearly hitting someone sitting at their desk. the projectile is a piece that connects the bus to overhead wires. it got caught in the wire and it was sent flying right through the window. speaking of muni, its most popular train is shut down at two locations this is weekend and for the next six weekends. shuttle bus servicing is

setting academic standards for those classes, including supervision. >> faculty has to be in communication with the students >> faculty has to be in communication with the students in order for the model to work and there has to be effective tutorings available for the students. >> more students are taking courses online because of class shortages on campuses, because they save the expense of student fees and there is the convenience factor. on monday as many as 1400 college bound students living near the campus of san jose state find out if they will qualify to attend the university. late yesterday officials decided to wait for the university president to return from an overseas trip to even consider raising the academic bar for local students. university has always given admissions preference to the santa clara county residents make easier for them to qualify. all the campuses are slashing enrollment and for a first time ever they could decide to eliminate the preferences they give to local applicants.

next week they are a step closer to breaking ground on the new 49er stadium. on tuesday they are expecting to approve a lease contract that is expected to get construction going within 120 days. our partner, the mercury news, reports this generates $200 million to the city in two ways over 40 years. rent would provide the city about $41 million and the city would share income from other events like concerts to bring in $125 million. -- $155 million. but inflation would seriously discount the actual value of that deal. tomorrow night hollywood's biggest stars and producers hold their breath as the envelopes get opened. for the rest of us plenty of drama and surprises watching the it on abc7. diana has a sneak preview from hollywood. >> from hollywood. >> when it comes to this year's academy awards, silence may indeed be golden.

likely. that's good news. as we head outside, it's pretty breezy locally. heavenly the winds are calm and temperatures in tahoe are in the upper 30s. pretty quiet there. another sunny afternoon but a chance of showers comes in, snow showers late sunday and into monday and perhaps a couple inches of snow by the middle of the week. back home our roof camera nice and clear. 6:47 is our official sunrise and temperatures right now right around 50 in oakland. but the wind is quite gusty. everyone else in the low to mid-40s. we have 4-9d in san francisco, livermore, good morning, 45 degrees with san jose coming in at 45. so those northerly winds keeping the fog and the clouds at bay so we are talking about the gusts over 20 miles an hour at oakland. northwesterly winds at 12. hayward, you were calm last hour. and novato still gusty. the coast has calmed down a little bit. we will see the winds ease off a little bit and then they will be

pretty breezy throughout the rest of the afternoon. so we will look for a cooler day today. not only for the beginning of the weekend, but the coolest day of the weekend comes in tomorrow with increasing clouds in the afternoon. highs tomorrow will be knocked down another five to seven degrees. today 10 to 15 degrees cooling from yesterday's mid-and upper 70s. and then perhaps a few sprinkles, make more like higher elevation. the best chance of showers coming in sunday night into monday in the santa cruz mountains. yesterday you remember mid-and upper 70s for the most part. we had 72 in san francisco. today how about 13 degrees cooler, only 59 is expected on northwesterly winds. we are looking at low 60s throughout much of the bay area today. saysay good-bye to the upper 10s at santa cruz. 63 today in watsonville. the culprit is an area of low pressure, a trough, a dry cold

front that finishes to push through. with it it brings the cooler conditions today. the breezy northwesterly winds are here, and more cool air arriving tomorrow. in fact it's not going to stop tomorrow, we are going to bottom out it looks like on monday with temperatures continuing to come down. here's a look at our cloud cover. for tomorrow afternoon you notice we become mostly cloudy at 5:00 tomorrow and then a few areas of green begin to show up with low snow levels around the santa cruz mountains. other than that it doesn't look like we will pick up much in the way of rain. looks like our better chance coming in tuesday night to wednesday. 65 fresno. breezy winds los angeles. back home average highs in the low and mid-60s. and 60 richmond, san raw fell 60. it will feel a little cooler, 62 in salinas. hollister 64 today and the accuweather seven-day forecast shows today, the warmer day compared to tomorrow. but compared to yesterday it will feel cooler on

>> good morning, i'm terry mcsweeney. today president obama did what many americans are doing, talking about the sudden surge in gas prices and how that's affecting the entire economy. being an election year the president is predicting you will hear the same old strategy to -- from the republicans to solve the problem from politicians, drill, baby, drill. the president said it's just not that simple. >> the american people aren't stupid. you know that's not a plan, especially since we are already drilling. it's a bumper sticker. we need a sustained, all-of-the-above strategy. that develops every available source of american energy, oil, gas, wind, solar, nuclear, biofuels and more. >> in the republican response, texas senator kay bailey hutchinson put the blame squarely on the president saying he has blocked potential new sources of oil and gas. gas prices are rising almost

as fast as tempers across then nation. this is the 30th straight day gas prices have gone up. this morning it is it's up a nickel at $4.25. yesterday it was $4.20. a week ago it was $3.99 according to triple a. why is this happening? here is abc's dan harris. >> when it comes in to breathing in the noxious fumes of overpriced gas, we are not living in the united states. california is the red zone. a big angry blotch of high prices, over four dollars a gallon pretty much throughout the state tonight. >> one of the most expensive gas stations in america right now, the mobile station on south hacienda blvd. in l. a.. today at $5.21 a gallon. on the east, prizes between $3.60 and $3.93.

the vast underbelly of the country in yellow between $3.38 and $3.71 but look at the big pasture of green in the middle where prices are all the way down to $3.16 and lower. home of the cheapest gas in america? u pump it in for the collins, colorado, just $2.92 a gallon. prices already vary from state to state but this is unusual. >> no, this is not normal. >> why? because the refineries on the coast are buying more expensive crude from places like saudi arabia and nigeria and inland states are getting cheaper stuff from canada and north dakota. these wild prices around happening just on a national level. at this gas station in new york city they are charging $4.39 a gallon. but check this out. here we are a mere 20 blocks north, and it's 50 cents cheaper. >> look at the variability in the dallas area where the average price is $3.59 a gallon. the most expensive is at this

>> this morning fire crews expected to fully contain a brush fire that raced through a napa valley canyon. they spent yesterday putting out hotspots on atlas peak. it started as a controlled burn thursday but with wind, the embers and dry brush, the fire quickly spread. they haven't decided if charges are going to be filed for the folks who had the controlled burn. >> you were just checking out high temperatures on a sheet of paper? >> the average should be low to mid-60 utah. oakland 66, san jose -- >> that's what it should be? >> that's what it should be this

conditions out there and the cooler temperatures usually provide the increased relative humidity. for the most part it's a dry wind out of the north, gusting to 23 miles an hour at oakland, 29 miles an hour wind gusts in novato and winds easing up along the coastline. sfo west wind at 8 and winds at livermore. we look for the clear and breezy conditions to continue throughout this morning and the afternoon. winds will pick up and we look for a chance of showers mainly in the higher elevations sunday night into monday. basically we will see more clouds insulating us tomorrow night. tonight will be a cool night if you have some plans. yesterday's highs, yeah, remember? mid-and up he were 70s. it was cool at half moon bay but the winds did kick up throughout the afternoon. today forecasted highs ranging from the upper 50s to the low and mid-60s which would bring us as much as 14 degrees cooling today. say good-bye to the 70s.

they aren't in the forecast for the weekend and not for the next seven days. livermore was 77 yesterday. we have a cold front that continues to march to the south and east of us. that is bringing the cooler air to the north. fortunately it is moisture-starved so it's a relatively dry front. we are talking about temperatures coming down significantly today, tomorrow. monday should be the coolest day. increasing clouds for your sunday afternoon. and then the best chance of showers here, the santa cruz mountains, with snow levels down to 2500 feet. maybe a few snowflakes in the sierra nevada, but we will look for a better chance come wednesday. 51 in yosemite with breezy conditions along the coast. 61 sacramento. vallejo coming in at 61. fremont 63. down by the monterey bay it will be breezy with 63 in watsonville. 59 at monterey. so today the warmer day out of the weekend, but it will be

>> we are looking to add them into our penguin exhibit. >> did she say they are putting sharks in here? yes, she did. they will share the 2500-gallon exhibit tank. >> they are docile and approached by divers in the wild. they aren't a threat to the penguins we don't suspect. >> they may not be a threat, but biologists want to make sure they don't end up in a food fight. the penguins are fed twice a day by hand b the sharks move in they have to learn to eat in a different part of the exhibit at a different time. >> that transfer will be a delicate process. >> biologist nancy is in charge of training the pajama sharks. she puts it near the target and then rings a bell. >> we are trying to teach them that bells and vibration in the water means there's food in the water so they can start looking for it and know it's feeding time. >> their eyesight is not very good but they have a great sense of smell. >> they use all the senses available to them in order to survive in the wild. >> sharks do not naturally eat on command so it takes weeks of work and experimentation to

figure out the best way to let them know it's time to eat and where to find the food. >> in the end this is going to be great for them because we can keep track of how much each shark is eating and we can get a good visual on each individual if they come to us to feed. >> biologists are putting the sharks and penguins together because in the wild they are actually part of the same ecosystem, a temperate water environment in southern after africa. african penguins are an endangered species and the sharks habitat is under serious threat. penguins may be a little cuter but the biologists hope visitors will also learn to love these sharks who live life in their pjs. >> they are reporting the sharks will go to about three feet and the penguins are actually a bigger threat to the sharks than the other way around. if the training goes as planned, the sharks should be in the penguin tank by april. a record number of sea otters are being attacked by

wind blowing everything out of the way. and changes on the way forecast-wise. nice day forsythe seeing if you are into that kind of thing. we will get back to lisa in a little bit. speaking of the golden gate bridge, it is about to turn 75 and the vees tore area is expanding. but that means tearing out some commemorative bricks and the owners of those bricks are upset they lost their piece of a famous landmark. here's michael finney with their story. >> they thought their bricks would lie forever at the foot of the golden gate bridge. instead bulldozers are ripping them out. >> it wasn't even anger at first, it was absolute shock. >> donna evenson and her family bought two of the 7500 bricks sold to the public 25 years ago when the famous bridge was celebrating its 50th birthday. buyers inscribed their names and messages to loved ones. here you see how they laid back in 1988. >> your names are now part of where everybody goes on the

golden gate bridge. >> it had special meaning for donna. as the bridge was celebrating its 50th anniversary, so were her parents. two bricks were the perfect gift. >> dad didn't stop talking about it for years. >> her parents, who watched the bridge being built, in our relished their small place at the celebrated landmark. >> everybody looked forward to going out and seeing those bricks. >> they never expected this. bulldozers tore out the bricks this year as part of a project to rebuild the visitor garden in honor of the upcoming 75th anniversary. >> we probably heard from about two dozen folks who are very upset. >> the spokesperson said the bridge district had no choice but to rip out the walkway because it did not meet standards for americans with disabilities. >> two feet. two feet. you can't see it from here but it goes downhill. >> she said workers tried to save the bricks, but they crumbled as they were pulled out. still, the demolition came

without warning. by the time donna arrived to the site, her bricks were gone, leaving only dusty remnants behind a chain-link fence. >> i wish they could have given us some time to maybe go out there one last time. >> i want people to know that it was not an uncaring gesture on our part. we recognized people would be upset. >> she acknowledged brick owners thought they had a permanent place at the legendary bridge. forever. even when i'm gone, my kids, they would be able to show their offspring this is your missy and papa, those were your great, great-grandparents. >> the certificate that came with the bricks says it too, congratulations your name is permanently placed at the golden gate bridge. >> all i can say is i'm sorry for folks who thought that. >> curry points to the tiny print on the original sales brochure.
