5:01. thanks for joining us i'm eric thomas. and i'm kristen sze. developing news in the oikos university shooting investigation. new name has surfaced as the intended target. terry mcsweeney is live at the school where students returned for the first time since monday's massacre. >> reporter: they returned last night to get some belongings. also coming out people from the community who obviously heard about what is going on. they are dropping off flowers, candles. and the poster on the left saying among other things it says, stop the violence, stop the violence. take a look at those relatives of the victims. they were led into the school chapel at oikos university where belongings of the victims had been placed. some drove away cars that had been here since monday. teachers returned.

buried a.m. the oakland coliseum a wake con -- [ unintelligible ] it is a say this needs someone to look out for it. terry mcsweeney, abc7 news. the man accused of killing five people in san francisco has pleaded not guilty to murder charges. yesterday 35-year-old binh thai luc appeared in superior court and entered the pleas this is a special circumstances case. meaning, luc is eligible to receive the death penalty if guilty. the district attorney's office has not decided what path to take. police say he knew the two men and three women and targeted them. they've not released a possible motive. bail has been set at 25 million dollars. suspended san francisco sheriff ross mirkarimi will be making a court appearance today. related to his domestic violence classes. his wife is speaking out,

blasting key players in the drama from top to bottom. >> reporter: this hearing later this morning is going to be a review of a report by ross mirkarimi's probation officer. never going over the number of domestic violence classes that he has completed so far. it is his wife eliana lopez who is making headlines. she is blasting this whole process in a scathing opinion piece in the san francisco chronicle. lopez is out of the country visiting family in venezuela with their son theo. she writes about being back home and the stature she has as an actress. in the piece she criticizes mayor ed lee for removing her husband from office. she attacks the media in general. makes a special mention of her neighbor, ivory madison. in the chronicle she writes, i

sought legal advice from ivory madison about custody issues, i did not seek her help as a friend. madison promised me that our conversation was confidential and the video she advised know make would be secret. madison is a trained attorney but not licensed, nor does she practice. in pretrial hearings in the domestic violence case leading up to mirkarimi's guilty plea of one count of false imprisonment, a judge determined that the video of lopez's bruised arm would have been admissible in court. apparently, one of the main issues that sparked the physical confrontation between lopez and mirkarimi was lopez's hopes to take thoe to venezuela to visit with -- theo to venezuela to visit with her family. mirkarimi did not want that to happen. mirkarimi is scheduled to face at things hearing at city hall later this month. later this morning he will face a judge before 9:00.

i'm sergio quintana, abc7 news. we are coming up on 5:07. jury deliberations begin later today in the ongoing racial bias trial against richmond's police chief. seven high ranking officers accuse chief magnus and his former second in command of racial harassment and discrimination in 2007. all filed a civil lawsuit against the two and the city of richmond. they claim magnus retaliated against them after they complained. the chief and city officials claim the suit was an effort to oust a progressive chief who wanted to change the status quo. the faa investigating the death of a skydiver in lodi. he took off yesterday from the airport. the pilot said the man's parachute opened prematurely, sending him into a spin. he told police the emergency chute never opened.

the victim was experienced and well-known at the parachute center. >> he has had issues in the past not a history, but in the sport you have what we refer to as malfunctions. for whatever reason he didn't deal. >> that expert says the victim may have lost consciousness. his body was found in a nearby vineyard. a surfer is expected to be okay after a difficult rescue off of ocean beach yesterday. rough waters and rising tide trapped the teen on rocks and interfeared with the initial rescue. crews tried to pull the surfer off rocks two swimmers with the fire department tried but were unable to get him back to the beach. a coast guard boat and additional rescue swimmers used long boards to get him to safety. protesters against the california vote area proved ban on affirmative action planning a rally today at noon and sit-in on the uc berkeley campus. several groups, including

black, latino and native american students are calling for the university to double under represented minority student enrollment. their enrollment has fallen steadily since affirmative action ended. a court rejected the lastest challenge to prop 209. the 16 year voter approved ban on using race and ethnicity in admissions. san francisco given preliminary approval to major hospital construction project on van ness avenue. california medical center wants to build a 555 bed hospital. officials say the nearly two billion dollar development would create 1500 new construction jobs. the san francisco chronicle reports commissioners expect the hospital's final plan to address issues from funding to traffic before a final vote. whether you are getting

the has sunk a ghost ship that had been drifting across the pacific since last year's tsunami in japan. yesterday a coast guard cutter fired several salvos at the crawler it took four hours to sink in waters 1,000 feet deep in the gulf of alaska. nobody is sure how much fuel was still aboard. the epa decided in any case, sinking it was the best option. in santa clara county fish and game agents found a hawk shot to death by a pellet gun in san martine another was wounded by the same type of weapon last month. there is now a $5,000 reward for information leading to the shooter. fish and game says the dead bird may have been the parent of a younger red shouldered hawk found with pellet gun injuries march 11th, it is in
