>> announcer: right now breaking news. ¥ this morning oakland police have made an arrest in the shooting death of charles butler, jr.. whose family donated his organses in the wake of his tragedy late last year -- good morning i'm kristen sze. cheryl jennings is off. sergio quintana is live at the oakland police department with new information. >> reporter: this story we've been following closely since christmastime in part because of the way charles butler, jr.

was murdered. also because of the fact that he gave the gift of life by donating his organs. police have made an arrest. they are not sharing many details about what the person's role may have been in the murder. police again do tell me they have made an arrest this weekend. charles butler, jr. was murdered just before christmas, shortly after his death, his family told us he had a brief interaction with people he did not know at their neighborhood store they followed and opened fire on him. his vehicle careened into parked cars along the side of his street and burst into flames yards from his home. several of his organs were successfully trance ed to recipients on christmas day. -- butler had just completed a merchant seaman's train program and looking forward to his -- training program and

was looking forward to starting. his family has been trying to keep attention focused on this case get more clues for police officers to work on and make an arrest. to recap, there's been an arrest in this case. not many details. stay tuned to abc7 news throughout the case for the developments on this story. sergio quintana, abc7 news. abc7news.com as well. meantime, a community grieve force the father and his 9-year-old daughter killed by a car that witnesses say was speeding as police checked to see if the teenaged driver may have been using his phone when the tragedy in concord occurred. amy hollyfield is live where a decision has yet to be made on the charges. >> reporter: the police department is just about finished with its investigation. officers will bundle up the evidence and hand it over to the district attorney who will

decide what to charge the driver with and whether to charge him as adult. this accident is having a tremendous impact on the concord community. dave added a couple of miles to hill daily walk to bring flowers to the spot where solaiman nuri and his daughter hadessa were killed. >> i'm an old dad. i've got a 7-year-old son. it made me hug him a little extra at night and kiss him and really reflect on this easter holiday what's important. >> reporter: nuri and his two daughters were on a saturday morning bike ride when they were hit by a cadillac suv. his 11-year-old daughter survived the crash. his wife skipped the bike ride and stayed home to make the family breakfast. solaiman and 9-year-old hadessa were killed. one of the teacher's aide says the school community loves the nuri family.

>> always energetic, happy, smart and beautiful. friendly. my heartbreaks for all the kids because i know this going to be%i a big loss. >> reporter: the 17-year-old driver was speeding when he lost control. police have collected witness statements, physical evidence and cell phone records to give to the district torn's office. prosecutors will -- district attorney's office. prosecutors will then decide to charge him as adult. the driver is booked on two charges of vehicular manslaughter. if that is the only crime he's charged with, it is not eligible for transfer to adult court. >> it has to fall under a list of enumerated crimes. vehicular manslaughter is not one of those. >> reporter: assault with a deadly weapon is on that list. that is a charge that could be an option because the

11-year-old girl was hurt. the district attorney could also ask the judge to decide whether to try him as adult. there are five factors the judge will consider when making that decision. it is complicated. it is going to take time this story is still developing. we will keep a close eye on it. amy hollyfield, abc7 news. we have developing news in the case of the florida teenagerãshot to death by a neighborhood watch captain. the trayvon martin case will not go before a grand jury. special prosecutor made that announcement this morning. she continues to investigate the shooting and will make a determination her there's enough evidence to charge neighborhood watch captain george zimmermann, rather than taking the evidence before a grand jury for a possible indictment. dozens of college students blocked the entrance to the san forever, florida police department this morning. they want zimmermann arrested for mur. >> less than an hour from now bay area musicians are invited

to participate in daily musicals. the noon concerts will be held outside oikos university meant to honor the seven killed in the shooting rampage at the school. anyone is welcome to participate. the concerts are scheduled for everyday except sundays, through april 30th. the day when the accused killer one goh is scheduled to be back in court. he's been charged with seven counts of murder and three attempted murder charges he could face the death penalty if convicted. facebook just announced a one billion dollar deal to buy instagram paid for in cash and stock. the company is a photo sharing app that lets people apply filters to pictures taken on mobile devices. mark zuckerberg made the announcement on his facebook page an hour ago already more

with an 18-year-old student. the story created national outrage. now the student has left the teacher after he was charged with a sexual assault of another girl. >> he was a teacher and i was a student, but i think it is a normal relationship. >> reporter: that was 18-year-old jordan powers last month. today a different outlook on her love affair with the 41-year-old man who used to be her high school teacher. >> i told him that we were over. >> reporter: james hook arrested friday not nor his relationship with jordan. the two say nothing physical happened while she was a minor. but for allegedly sexually assaulting a 17-year-old student more than a decade ago. >> i lost everything, my senior year i gave up my friends because they didn't agree with me. for him not to have enough respect to tell me the truth. >> reporter: in february hooker was adamant he had never been romantically involved with another student.

really come down, breezy winds up to 20 miles an hour. the bulk of the rain will be for that morning commute. then behind the system then by thursday morning here comes system number two that brings lower snow levels. the weekend this time we'll have a good weekend. some kids are off for break, it is a tough one. >> it is, but still you left the weekend clear your timing is impeccable, thank you. uc davis study linking autism with obesity during a woman's pregnancy is raising health concerns. researchers studied 1,000 children two to five in california nearly 700 had autism or other developmental delays. the study found children with obese mothers were 67% more mikely to be at risk for autism. experts say it is a wake-up call for new mothers. >> if you are reaching those childbearing years, obesity is a bad thing. it is not good at any time. but it is something that with a lot of work you can address.
