california. according to lawsuit all of them are operating illegally. customers say the price of gas at safeway is a good deal. even better deal if you have a safeway club card. grocery chain offers 3 cent per gallon discount and even more savings if you buy grocery. 10 cents off gallon for 100 dollars spent inside the store. >> cheapest in town. that's why you have all the long line lines. >>reporter: but lawsuit may put a stop to. that safeway is accused of violating the state unfair practices act by selling gas below cost presumably to get people to buy more grocer groceries. attorney james represents the plaintiff who own several small gas stations in the bay area. >> if safeway succeeds in running independently owned gas stations out of business, there will be no competition at which point safeway could increase its prices because there's no competition. >>reporter: trial is set to begin as early as november. but until then judge has

were unable to substantiate increase in shootings but the resident are adamant about it. >> sfi security gates around the river stob apartment ins antioch have kept the criminal element out. but resident here say it's a false sense of security from the gun fire that surrounds them. >> the if you are in the wrong place at the wrong time, you know, just walking by or if even goes through the wall of your apartment. >>reporter: resident say the shootings along this part of sycamore drive are becoming more and more frequent. >> it's been just in the last year that it has gotten to the point where it's daily. today like 8 different gunshots. and then week ago it was like 4 and girl got shot. it's just getting scary. >>reporter: this past friday police say one person was shot just outside the apartment complex. they say they are well aware of the problems and

colonel. we would be pleased to hear from you. >> in a san francisco courtroom today dramatic testimony from an accused killer. he's charged with murdering man and to sons as part of mistaken gang hit. abc vick lee reports the defendant told the court about a hard childhood. >> prosecution is accused ramos of shooting to death tony and his 2 sons in the contradict june 22, 2008. they say ramos was a member of a group that is affiliated with a violent latin american gang ms 13. that he mistook one of the sons for a rival gang member as he drove by the car. another son not injured and testified as prosecution star witness. he identified ramos as the shoote shooter. ramos claims another gang member in the car fired the gun and he never knew there would be a shooting. today in court ramos said he was abused by his mother. until he financially run away. about joined the 20 street gang at the age of 16. my mom told me

i wish were you never born. whenever i cried she said i was gay. i ran away many times after my mom's boyfriend beat me up. ramos claims he got out of the gang before the shooting and that he was only giving the shooter nickname flacco a ride this day. as they were leaving flacco saw that car and shouting they were rival gang members. ramos says flacco began firing as they drove by. ramos says it wasn't until to difficulties later that he learned people had died. i was scared. someone shot out of my car. now i read that some people died. now i'm 10 times more scared. district attorney george says it doesn't matter what ramos says. >> he believes he has an iron tight case. >> we presented nearly 100 witnesses. we have presented over 500 pieces of evidence. this is a very, very strong case. >>reporter: she believes in her client innocence but still knows how risky it is putting
