the slick roads cause major spinnout if you are ahead of yourself on speed that's what usually causes it. issue out of tracy this morning 205 multi-car accident blocking right lane. road sensors still in the green as you head towards altamont pass after the scene you may find slowing at tracy boulevard headed westbound out of the central valley. all mass transit on time so far this morning. 5:02. 17-year-old driver could be released from jail today while concord police continue investigating his proehl in a double fatal the teen was diving an suv when he allegedly ran over and killed a father and his 9-year-old daughter. amy hollyfield is live near the scene at treat and oak grove. >> reporter: there's a lot of pain here in concord. take a look at the memorial that people have created where the man and his daughter were killed.

if the driver is released back into the community today, it could be tough for him to avoid the grief that people are filling. he is accused of it hitting and killing half of this family the father solomon nuri and the youngest daughter -- hadessa. the district attorney needs more time before he can file formal charges. he has to file today by 4:30 or let him go. prosecutors say all the evidence probably won't be in by ther of the -- by the end of the day. one piece of evidence they are waiting on cell phone records. they want to see if if the driver was talking on the phone for texting at the time. witnesses say the cadillac suv was speeding and made an unsafe lane change when the driver lost control and hit the family who were riding bikes on the sidewalk on treat boulevard. the 17-year-old is being held

in the juvenile detention center. because he's a juvenile, abc7 news not releasing his name. another part of the investigation taking a lot of time is deciding whether to charge him as an adult and how to go about doing that it is a complicated process. that's another thing that the district attorney is focused on. while they work out all of the details this juvenile this teenager, looks like may be released from jail. that doesn't mean they won't be arresting him again. amy hollyfield, abc7 news. the san francisco gang member on trial for the shootings deaths of a father and his two sons goes back on the stand today after giving dramatic surprise testimony yesterday. terry mcsweeney is live at the hall of justice with the latest on the edwin ramos trial. >> reporter: he's accused of murdering three members of the bologna family in 2008. today's questioning probably

won't be as friendly as yesterday, prosecution will be taking over today. yesterday it was his attorney asking the questions. the crime stpraepb four years ago. -- the crime scene from four years ago. ramos says he was diving the car while his passenger opened fire, mistaking one of the boys as a rival gang member. none were in a gang. ramos testified he had nothing to do with the shooting didn't know flacco had a gun. take a look at this, he said my mom told me i wish you were never born. whenever i cried she said i was gay. i ran away many times after my mom's boyfriend beat me up. much of the testimony delivered with a smile. his attorney had to ask him about that on the stand, he said he smiled when he gets nervous. he admitted he was not only a gang member, he was also dealing drugs. the prosecution says it doesn't matter what he said they have an ironclad case,

witnesses say ramos had gun in his hand and pulling the trigger it wasn't anybody else. ramos' attorney admits it was a gamble putting him on the stand. as for flacco defense witnesses came to the stand to say last time they heard he fled san francisco for south carolina line that. again the prosecution will take over after his defense attorney finishes up. terry mcsweeney, abc7 news. the san francisco city attorney is offering a scathing response to the arguments of suspended sheriff ross mirkarimi suing to get his job back. mayor lee suspended mere mir mir for official misconduct after he -- suspended mirkarimi for official misconduct. mirkarimi's attorney is asking a judge to overturn the suspension arguing it happened before he was sworn in as

sheriff. the city attorney says if that is true, then public official could rob banks or mug old ladies and no one could do anything about it. the charter prohibits a voter recall within the first six months after elected official's term. san francisco police holding a meeting to talk about the grisly murders of five people. a relative discovered the victims in a home near san francisco city college march 23rd. police will only state three men and two women were killed with some sort of blunt instrument. two days later police arrested a 35-year-old man for the crime. he has pled not guilty. the police chief will address concerns about the murders and answer questions about the case. investigators have not revealed a possible motive for the murders. today a judge is expected to approve a settlement in the battle over the uc davis pepper spraying report. the -- [ inaudible ]

this morning san jose state university's president is expected to make a decision on proposed changes to admission guidelines. university officials are looking to guarantee to end guaranteed admissions for all qualified graduates from santa clara county. those students will get preference. officials say they can't afford the automatic admission after budget cuts this would affect 1400 south bay high school graduates and community college transfers. transfering the rain to the south bay. meteorologist lisa argen looking at who is getting wet. >> now where is it? you are almost right kristen, east bay slowly moving to the peninsula, that's the key slowly edging to concord and alamo. right now the heaviest rain up to the north around sonoma,

crisis. the proposal that the consumer financial protection bureau would require mortgage servicers to give all borrowers standardized monthly statements. they would be required to warn on interest rate or insurance changes and give options to avoid losing homes. there are stipulations for providing foreclosure counseling to those who need it. the internet has become the go-to place for everything why not file taxes by way of the web too. here's t.j. winick. >> reporter: the days of putting pencil to paper are a thing of the past especially for american taxpayers. 8 out of 10 of us around 112 million will file our 2011 returns electronically what the irs calls e-file. working through software with a provided free by the irs or on your own or used by a tax preparer makes timers more accurate if you owe money

muni, caltrain, ace number 1 and 3 out of central valley on time and a good way to go this morning. mountain view problem issue -- don't know if it is weather-related or not we have a closure shoreline boulevard closed between wright and central expressway your alternate would be mountain view avenue or highway 85 to get to 101. today the prosecution may get a crack at the gang member accused of murdering a man and his two sons in san francisco four years ago. edwin ramos took the stand in his own defense yesterday. terry mcsweeney is live at the hall of justice with more on his testimony. >> reporter: might be a little rougher today for 25-year-old edwin ramos on the stand yesterday. today at some point the prosecution is expected to take over the questioning and it might be rougher on the man who prosecutors say shot and killed tony bologna and two of his sons in 2008.

take a look at the crime scene from that day. ramos on the stand testifying he did not shoot anyone he was driving a car with a friend who opened fire. ramos talked about how difficult his childhood was beaten by his mother's boyfriend. the prosecution has a surviving bologna son who says ramos did the shooting and they have much more in the way of evidence. >> we presented nearly 100 witnesses over 500 pieces of evidence. this is a very, very strong case. >> reporter: prosecution says ramos is a member of the 20th street gang. they have an affiliation with the violent latin american gang m-13. the case received national attention because of san francisco's sanctuary policy, ramos' visa expired

despite a slew of contacts with police he was not reported to customs that policy has since been changed. yesterday ramos' attorney had to ask him why he was smiling through much of his testimony? he says he smiles when he's nervous. today he may be smiling again when the prosecution takes over the questioning. they want to put him way for life. terry mcsweeney, abc7 news. oikos university in oakland is holding a memorial service at 10:00 this morning, dedicated to the victims of last monday's shooting spree. faculty, staff and students are taking part in the service. consul general of south korea might also attend. daily noontime concerts are being held to remember the seven victims killed last monday their names were read in the state assembly yesterday in their memory. one way to save on gas spw about to go away. a lawsuit against safeway is sporesing the company to stop offering a special -- is forcing the company to stop

offering a special deal. >> reporter: customers say the price of gas at safeway is a good deal and a better deal if you have a safeway club card. the grocery chain overs -- offers a three cent per gallon dis-- discount. >> it is the cheapest in town that's why you have long lines. >> reporter: a lawsuit may put a stop to that. safeway is accused ever violating the unfair practices act by selling gas below cost, presumably to get people to buy more groceries. the attorney who represents the plaintiffs who owns several small stations in the area. >> if safeway succeeds in running independently owned gas stations out of business there would be no competition at which point sayway could increase prices. >> reporter: the -- trial is set for early november. until then the judge has indicated there is enough evidence to issue a

preliminary injunction later this month that would force safeway to stop selling gas below cost. >> ouch. that's a disappointment. again if it is a violation of the law it is appropriate. >> i don't care i want cheap prices that's why i care about. >> reporter: safeway says the company isn't doing anything wrong. a special person wrote, the court has not made final findings we do not believe there's been a violation of the law preliminary injunction orders safeway to comply with the law, which as we have argued in courts the company is already doing. lilian kim, abc7 news. 5:35. we are following news in san lorenzo it appears a copper theft may to be blame for morning fire at a strip mall the fire started before 2 a.m.. this photo was sent by the alameda county fire department. it happened on the roof of this cash for gold business in the 17000 block of hesperian beautiful. the fire may have started when thieves were trying to steal

copper from the electrical system the fire was knocked down crews say the mall will not have electricity until the wiring can be fixed. we are learning the process of digging through a fourth bore of the caldecott tunnel took longer than planned and costing more than expected. crews drilling for 15 months finally broke through and met in the middle last november. caltrans did not mention the excavation took longer than expected because of tough digging conditions. the transportation commission says caltrans now expects to spend an extra 27 million dollars on the project. officials say that would come from funds set aside for unexpected costs, the tunnel is still set to open in late 2013. this morning the ross valley sanitary district believes it knows why 360 gallons of raw sewage spilled into fairfax creek. a report saying an eight inch suer pipe failed and the spill went undiscovered 12 hours, --

the district declared an emergency so repair work could begin immediately. president obama travels to florida to make another pitch to boost taxes on millionaires outlining support for the so call buffett rule people earning one million dollars a year or more would be required to pay at least 30% of their income in taxes. the rule is named after billionaire investor warren buffett who supports raising taxes on the wealth the senate is set to vote next week. the president will also attend three fundraisers while in florida wfpl at least two tornadoes have touched down in northwest oklahoma injuring two and damaging a county jail along with numerous vehicles. the national weather service says the tornadoes were spotted around 5:30 yesterday afternoon in woodward county officials say hail, the size of softballs, knocked out windows of vehicles and cars, damage to every skylight at the jail a child was injured by shattered glass, jail
