6:01 on this tuesday morning. rain on the way for most of us. i'm eric thomas. let's check in with meteorologist lisa argen. good morning. pushing east towards the delta you can see in the north bay american canyon highway 101, 880 and 37 pretty wet towards pittsburg in the east bay emeryville, oakland, piedmont wet weather. we are looking at redwood road there you have light rain shower 5802010 -- 580 towards 24, we are keeping the rain chances not only in the forecast today, all weeklong. good morning back to mountain view, last night about 9:00, there was a fatal accident intersection of north shoreline boulevard and wright.

they are getting ready any minute to open up this intersection. we will hopefully have an update on that within a few minutes. elsewhere, earlier accident northbound 101 before broadway burlingame cleared out of lanes you may find slowing as rubberneckers are looking at what is going on. san francisco gang member on trial for the shooting deaths of a father and his two sons goes back on the stand today after dramatic testimony yesterday. terry mcsweeney is live with the latest on the edwin ramos trial. >> reporter: the 25-year-old expected back on the stand here this morning. this is the man accused of killing three members of the bologna family in a case of mistaken identity in san francisco in 2008. today the questions are expected to be tougher when the prosecution takes over. yesterday his attorney guided him through testimony. take a look at the crime scene from 2008.

this is four years ago ramos says he was driving cart with a friend, flacco, he opened fire on the car carrying the bolognas, mistaking one of the boys as a rival gang member. none of the bolognas were in fay gang. ramos testified he had nothing to do with the shooting, didn't know flacco had a gun and only joined a gang because he was pressured to do so he talked about his rough child -- childhood. he said my mom told me i wish you were never born, when i cried she said i was gay, i ran away many times after my mom's boyfriend beat me up. testimony delivered with a smile his attorney asked him about that smile. he said he smiled base he was nervous. prosecution says it -- because he was nervous. prosecution says it doesn't matter what he says it has an airtight case it has a lot of witnesses within a surviving

membership of the bologna who says it was ramos who had the gun and pull the trigger. ramos' attorney says it is a gamble to put him on the stand but a gamble she was willing to take. as for flacco, the man who according to ramos was the one who did the killing that day in 2008, he is long gone, and according to defense witnesses he has fled to south carolina. the testimony resumes this morning. terry mcsweeney, abc7 news. 6:04. a 17-year-old driver could be released from jail as early as today while concord police continue investigating his role in a double fatal accident. the teen was diving an suv when he allegedly ran over and killed a father and his 9-year-old daughter. amy hollyfield is live in concord near the scene of the crash. >> reporter: this community is never going to forget. look at the memorial they've created here at the scene where the family was kill. this is fresh on everyone's minds if the driver is set

free today he will be walking out too a community full of grief. the district attorney says if the driver does go free today it is only because prosecutors need more time to investigate and build a case against him. according to the law, they have to charge the juvenile by 4:30 today or set him free. the d.a. says all of the evidence probably won't be available by then still waiting on details like, cell phone records, so they can find out if the 17-year-old driver was distracted at the time of the accident. >> you can take a look at cell phone records, see if they match the time he was diving. it gives us and case of possibly he was -- either texting or talking which may have helped contributed to the accident. >> reporter: 41-year-old solaiman nuri and his 9-year-old daughter hadessa died while riding on the

sidewalk. an 11-year-old daughter was hit but survived. relatives said they are not focusing on the criminal case they trust the judicial system, they are just dealing with their grief. the teenager is being held on suspicion of vehicular manslaughter. prosecution fors are not sure if he -- prosecutors are not sure if they get formal charges filed today but that doesn't moon he won't be charged later. amy hollyfield, abc7 news. oakland police looking for a suspect who shot at a woman drivering on i-580. the woman managed to stop her car on the edwards avenue off-ramp. you can see the car's rear window was shattered. police say the woman is hospitalized in stable condition. today san francisco police will address neighborhood concerns in the wake of a mass killing of five people in a home in the city's uncleside district last month. the police chief will hold a

-- meeting at 5 p.m. across the street from the scene of the murders. one man has been raysed in connection with the killings. tonight the -- has been realized in connection with the killings. tonight the chief will discuss neighborhood safety. >> the city attorney is offering a scathing response to suspended sheriff mirkarimi's arguments for who he should not lose his job for why he should not lose his job mayor lee ed mirkarimi for official misconduct after the sheriff pleaded guilty to false imprisonment charges. mirkarimi's attorney is asking a judge to overturn the suspension arguing it happened before he was sworn in as sheriff in a court filing city attorney says if that's true then public officials could rob banks or mug ladies before taking office and no one could do anything about it. hours from now san jose state university's president will announce whether he will make key changes to the admission guidelines. university officials are considering an end to guaranteed admission for all

embarcadero that means it is slick out there, be careful, we are tracking both the storm and the traffic. stay tuned. we are following developing news in san lorenzo. it appears a copper theft may to be blame for an early morning fire at a strip mall the fire started before 2:00 this morning. this photo was sent by the alameda county fire department it happened on the roof of this cash for gold business on the 17000 block of hesperian beautiful. investigators say the fire may have started when thiefs were trying to steal copper from the electrical system. the fire was knocked down quickly. crews say the mall will not have electricity until the wiring can be repaired. today brisbane voters go to the polls to decide whether to approve a 156 annual parcel tax to save the jobs of a third of the teachers. the tax requires 2/3 yes vote to pass. the board says it is facing a half million dollar deficit and it is already considering a merger with neighboring bay shore district.

this morning federal officials will outline new rules that will give homeowners new ways to avoid foreclosure. congress ordered changes in the wake of the 2008 financial crisis. the proposal that the consumer financial protection bureau would require morning servicers to give all borrowers standardized monthly statements. they would be required to warn borrowers about interest rate or insurance changes and give them more options to avoid losing their homes. also stipulations providing foreclosure counseling to those who need it. america's teen pregnancy rate has dropped to the lowest level on record. a report from the cdc released hours ago finds from 2007 to 2010, all but three states montana, north dakota and west virginia saw a dramatic drop in the number of teen moms. arizona saw the biggest decline. new hampshire has the lowest overall rate, mississippi has the highest rate. experts say the economy may be a factor in the rate drop

this weekend could walk out of jail this evening. amy hollyfield joins us live from the crash scene at treat boulevard and oak grove road to explain why the driver could be released. >> reporter: prosecutors say they need more evidence like his cell phone records. they don't know whether he was on the phone or texting at the time of the crash. someone here in concord is making that leap. they've placed a sign here at scene where the accident happened saying, please don't facebook, texan twitter and drive. -- text and twitter and drive. 41-year-old solaiman nuri and hadessa were killed riding bikes witnesses say they were hit by a cadillac suv that was speeding and lost control while changing lanes. police say the driver is a 17-year-old boy being held in a juvenile detention center on suspicion of vehicular manslaughter. according to the law they have to charge him formally by 4:30

today or let him go. police say they think it is going to take a couple of weeks to get the evidencing to. he probably will be let go until police and the district attorney can figure out what to charge him with and whether to file the case in juvenile or adult court. because of his age, abc7 has decided not to release his name. a local blog is identifying him and quoting the driver's social media page where he calls himself a "race fox." witnesses say it did appear he was speeding at the time of the accident. abc 7 reached out to the driver's family but the family says they have no comments. amy hollyfield, abc7 news. oikos university in oakland is holding a memorial service at 10:00 this morning dedicated to the victims of last monday's shooting spree. faculty, staff and students are taking part in the service. the consul general of south korea might also attend.

daily noontime concerts are being held at oikos to remember the seven victims kill. their names were red in the state assembly yesterday. today the national transportation safety board will release updated information about last year's deadly crash at the reason know air races. september 16th, a plane went out of control and slammed into the crowd, killing 11 people, including the pilot. updated information about that today and the board will make recommendations on ways to make air shows safer for pilots and spectators. the conference will be held 10:00 in reno. here's something sure to anger thousands of drivers. safeway currently selling some of the cheapest gas in the bay area is being ordered by a judge to increase prices. 20 safeway stores in california sell gas and offer a three cent per gallon discount with a safeway club card and another 10 cents off per gallon for every $100 you

spend on groceries. a group of small gas stations has filed a suit. the suit hasn't been heard yet, now a judge has indicated there's enough evidence to issue a preliminary injunction to force safeway to stop selling gas below cost. >> ouch! that's a disappoint. again, if it is a violation of the law it is appropriate. sky don't care, i want the cheap prices. that's what i care about. >> safeway says the company isn't doing anything wrong. a trial could begin as early as november. new this morning, residents in northwest oklahoma are cleaning up after at least two tornadoes touched down, damaging a county jail along with numerous vehicles. the national weather service says the tornadoes were first spotted around 5:30 yesterday afternoon. in woodward county officials say softball-sized hail knocked out windows of vehicles and caused extensive damage to every skylight at

wells fargo hit with a three million dollar fine for overcharging bankrupt homeowners. a new orleans judge ordered the bank to fork over that money to a bankrupt couple who filed a lawsuit against wells far . the bankruptcy court found the bank overcharged them by $24,000 and violated bankruptcy laws. wells fargo says the ruling ignored changes it has made in servicing practices since the case began six years ago. >> what is the best college for your money? harvey mud in -- after working for 30 years the return on your investment is 1.7 million dollars. runners up for the best california colleges for the money, california institute of technology, stamford and clermont mckenna. that is business, live at the new york stock exchange, i'm jane king, bloomberg news. san francisco giants' fans excited to get their first win of the season yesterday with

this weak cold front is marching to the east you can see from live doppler we have brighter returns heavier rain towards 121, pushing towards vacaville now and fairfield much of the north bay has quieted down and the east bay is look at light rain from the san ramon valley, moraga , alameda, 35th avenue, redwood road and north canyon road, wet weather. -- castro valley and frommont the southern extent of this precip we have some still on the peninsula, redwood city not quite, around woodside, light rain. in the south bay, the santa cruz mountains, still you are in that little dry pocket. light showers in the forecast for the rest of the afternoon. we are looking at this moist unstable air mass to stay with us throughout the next several days. 54 oakland, 55 mountain view. mild start with breezy southwest winds there it is, there's that narrow band of moisture the cold front we are

driving a car with a friend and he was -- and his friend mistook one of the bologna sons as a rifle gang member opening fire and killing the father and two children. ramos talked about a difficult childhood, beaten by his mother's boyfriend. the prosecution has a surviving bologna son identifying ramos as the man who pulled the trigger that day. they have 500 pieces of evidence and 100 witnesses. ramos had to explain why he was testifying with a smile on his face. he says he smiles when he's nervous. this is a case that received national attention because of san francisco's sanctuary law. ramos' visa expired and he shouldn't have been in the united states. he had many brushes with police but never turned over to u.s. immigration because of that policy in san francisco which has since been changed. he will be back on the stand today.
