morning. thanks for joining us i'm eric thomas. and i'm katie marzullo in for kristen sze this morning. a new storm has blown into the bay area bringing rain, isolated flooding and fierce winds. before it moves on it will touch just about every community. this is what residents are seeing in san jose. >> the latest on the storm's path now from meteorologist lisa argen. good morning. we are looking at the system exiting the bay area. showers generating behind it. that's why we have the flood advisory until 5:45. hopefully, you slept through you didn't, here's the heavy rain, south of livermore in the hills, mines road, from 101 down to morgan hill, san martine, prunedale and watsonville, heavier rain. highway 121, 37 even the richmond san half yell bridge should be getting rain now as well as the golden gate bridge

lighter, still winds are gusty. we have four injury accidents in the south bay, including two overturned accidents. here's a live shot of northbound 280 near highway 17 south of -- out of the santa cruz mountains bear creek blocked because of a downed tree 17 still open. northbound 280 flooding reported at bird and there's a new injury crash northbound 280 approaching 11th street. let me show you the maps. there's a new injury accident north 280, 11, south 101 alem rock overturned crash. northbound traffic heavy for most commuters, couple injury accidents on 680, overturn truck north 680 capital heavy there, south 680 also another accident not causing too much slowing at this point. 6:02 now. this morning east of the bay area residents are cleaning up after a tornado touched down in san joaquin county. a viewer caught this image and

sent it us to. the twister packing 100 mile an hour winds destroyed a shed, tipped over a 53 foot trailer and buried a pick-up truck six miles south of stockton. it also shot sheet metal, splintered wood and other debris across fields narrowly missing a home. >> it got to the shop, lived the shop up like one piece was like a bomb went off and bursted everywhere. the homeowners, four kids, his wife and parents were all home when the tornado hit, fortunately, none of them were hurt. as we deal with rain and wind the sierra is getting inches of new snow. this is what you can expect heading over i-80 this morning, wind driven snow and slick roads, be careful. chains or snow tires and four wheel drive are required on i-80 and highway 50. stay with abc7 for continuing coverage and check

abc7news.com for street level radar. hours from now, rain or shine, santa clara county will dig in for what they are calling one of the most important transit improvements in south bay history. terry mcsweeney joins us live from san jose to plain -- to explain. there's a hint behind terry, a bart car. >> reporter: that kind of gives it away. take a look at a bart train here in san jose, many said that was never going to happen. and it has happened, it just needs some tracks to run on now. you see the tent behind the train, that is where south bay politicians will be gathering today, to put shovels in the ground and get the party started, as far as getting bart to san jose.r7az take a look at what some say this going to look like when it is said and done the biggest public works project ever in silicon valley kicking off today this is phase one of construction. it is going to be linking fremont to east san jose.

there's a price to pay for this. drivers are going to be inconvenienced. bart tracks going to be put in that means a lot of streets will be dug up, including major ones, mission boulevard, dixon landing road, warren avenue, cato road all impacted. cato road is going to be dug down about 16 feet, it is going to be closed for nine months some inconvenience, yes. but the long term look mayor reed says it will be worth i. >> companies looking at the long term can see they are going to have a way to get their employees to work that is different than they have now. part of the optimism of the valley that he we are investing in this infrastructure and helps people make decisions to keep the jobs here itch >> reporter: already planning phase two of this -- project, bart will tunnel under downtown san jose to the caltrain depot in santa clara. first things first. groundbreaking today for phase one of this project. senator feinstein is going to be congressional

representatives and mayor reed of course. they will be breaking ground on what some said couldn't happen, bart coming to san jose. project is supposed to be done 2015, 2016. terry mcsweeney, abc7 news. this morning the bart board of directors will begin discussing what to do with the projected budget surplus of more than 30 million dollars in the next fiscal year. the agency is thinking about using the money to invest in underfunded areas that would include expanding service on the richmond to daly city line, car replacements and improving train interiors. the board will also consider hiring 56 new employees to help cut down on overtime. fairfield police are looking for suspects in a double shooting that left within dead and another critically injured shortly before 9:00 last night south of -- outside of a bar on the 600 block of park erode near --

parker road near sis air force base. this morning -- san jose police released new picture of a suspect wanted in with bank robberies in the south bay. 25-year-old ryan wells used a note to rob the credit union tuesday morning. they believe wells used the same modus operandi to rob banks last week. wells is described as a transient, 5'10, 180 pounds if you see him, call police. 6:07. i noticed terry reporting from san jose at one point had an umbrella, then he ditched his umbrella which guess to show how this weather is moving around. >> even when it leaves the area we get a break and then another storm system, right lisa? >> right, what month is this? we are stacking 'em up with rainfall totals up wars to a half inch in the north when

release a ruling that could affect millions of workers. the court is set to decide whether state law requires an employer to simply provide meal breaks to employees or whether it must also ensure those breaks are taken at certain times during the workday. the case was filed in 2004 by restaurant workers employed by the company that owns chili's and other entrance. by not ordering breaks employers were taking advantage of employees who don't want to leave during busy times. this morning mayor lee is planning to announce a program that could mean as many as 5,000 summer jobs for city youth, a combination of positions within private businesses and city government. the program is a collaboration with the unitedway of the bay area. 2500 summer jobs will be made available for young people 16 to 24 and private businesses will match that of course lisa argen is the woman of the hour because she has to tell us where the

sonoma moving into american canyon turner parkway and exiting san rafael and highway 101 novato. there's the front, you can see the reds and the yellows and how it moved through within the past two hours or so right now it is in the hills of the livermore valley heading towards i-5 and tracy. in the south bay, 101 still wet from morgan hill, gilroy, hollister, prunedale low 50s now, upper 40s in the north bay, and tomorrow we are going to do this again, same time, same place. we'll be looking at totals anywhere from 3/4 of an inch to an inch and a half from today's system and tomorrow's system. we have a little bit more to go, once again, it will be a quick mover, colder, better chance of thunderstorms tomorrow there's the front, headed into the central valley, the san joaquin valley behind it a little break, partly cloudy skies on tap for today and we'll look at those showers being generated behind the system.

miles per hour. seven miles per hour, traffic on basco road heading into livermore. we've got heavy traffic, also really really slow before you get to the altamont pass even out of tracy, 22 miles an hour. drive time now from 205 to 680 is about 34 minutes this is information you can get by downloading our free traffic app. we have more commuters turn this on, you will be able to see slowing on alternate routes. i want to go to the south bay where we had heavy rain earlier and still quite a few accidents. there are a few injury crashes, including two overturn accidents, north 680 approaching capital heavy with an overturned box truck. north 101 jammed overturned crash in the southbound direction at alem rock injury crash north 280 at mclove lynn causing slowing, you just -- mclove lynn, causing slowing you just need extra time. there is flooding approaching

the toll, and also at the bay bridge toll, metering lights on, back up beyond the end of the parking lot. 6:19. in argentina a newborn nicknamed the miracle baby was found alive in the morgue, 12 hours after doctors declared her dead. the baby girl was born earlier this month, three months premature weighing just 2 1/2 pounds and showed no signs of life from the delivery room she was sent to a refrigerated hospital morgue where she was placed in a coffin that was nailed shut. her parents went to the morgue to say good by and when they opened the box they heard a whimper. mom thought she was hallucinating. then they saw the baby move. experts say the time in the refrigerated container may have helped heard cling to life. >> temperature lowering so quickly acted to protect the baby because the brain doesn't need as much oxygen. >> girl was named spanish for

take a good look at this deadly police chase and shootout shutdown a section of 101 in los angeles, l.a. police rammed the suspect vehicle late last night. moments later the man jumps out and appears to begin shooting at police. you can even faintly hear the helicopter pilot saying no, no, no. police returned fire, killing the man. police are only describing as a 19-year-old male. the freeway is expected to stay closed until at least -- there's the no, no, there's the chase and gunfire. the road is going to be closed until at least 8:00 this morning while detectives investigate this this morning it appears a new lawsuit against apple could mean good things for amazon customers.

amazon cutting prices on e-books for kindle and kindle app. today amazon will slash some popular books to less than $10 a piece. the announcement came after the department of justice said it is suing apple and five major publishers for alleged price fixing. apple is accused of working with the publishers to drive up prices. apple has no comment. charge is murder in the second degree. the latest as a neighborhood watch volunteer accused of shooting an unarmed black teen is hours from a court appearance he believes he shouldn't have to make. volunteers hope they will fan a morgan hill teenaged girl missing for a month. busy, wet morning in the bay area. i'm on storm watch this morning. i'll have a live report coming up, all about weather, up next.

more than 100 volunteers have searched looking for the 15-year-old. she went missing a month ago when she didn't show up for school. the florida neighborhood watch volunteer who shot and killed and you armed$ái! black teenager is set to appear in court on a second degree murder charge. george zimmerman turned himself in to authorities last night in connection with the shooting of trayvon martin. he claims it was self-defense. his attorney says he will plead not guilty. he is also worried about him getting a fair trial. >> -- fair there's been a lot of information flowing a lot premature maybe inappropriate. >> we just want add arrest and we got it. >> trayvon's parents -- expressed relief. zimmerman's attorney says he will push for his client's release on bail. the justice department is still investigating whether to charge zimmerman with a hate crime. suspended sheriff ross mirkarimi is on the offensive

again. his attorney has filed a motion to disqualify the office of city attorney dennis herrera from representing the city in the reinstatement hearing the motion argues that herrera drafted the charges and advices the ethics commission and cannot act independently before the commission. mirkarimi's reinstatement hearing before the ethics commission is set for a week from tomorrow the conflict of interest hearing is the day before. state lawmakers say they intend to make university police departments more accountable in the wake of a report blasting the actions of officers against student protesters. the report says the uc davis police used excessive force when they pepper sprayed students who were protesting with hikes last fall. the report criticizes c administrators for creating the environment that allowed it to happen. the task force is recommending a review of the school's police department. the two officers who sprayed the protesters and the police chief are on paid

thunderstorms comes after this system tomorrow. today there's a slight chance this system has the colder air, another quick-mover, early morning hours, maybe you will sleep through it again. by the afternoon, we are doing it all again. the giants' game of course will go on as planned and probably will not be heavy downpours just hit or miss showers. then it gets chilly. behind the system very cold air changing the rain to snow. right through tomorrow evening one to three feet above 6,000 feet, 6 to 12 inches at lake level. pretty significant. the rest of the day partly cloudy, scattered showers, 40s today, slight chance of thunderstorms north bay into the 50s later. low 60s by the afternoon. it has been like groundhog day this week, don't you think? we'll be looking at fast forwarding into spring over the weekend. at least we are not seeing as many new accidents in the past 10 minutes as we did

>> reporter: i'm stage in a ditch by the side of southbound 101 right now just to give you an idea where a car ended up, upside down about an hour ago, one minute ago they towed it out of here. we have video of what the car looked like when it was in the ditch. talked to the chp they say it happened 5:30. i was here, i can tell you it was pouring rain. chp says probably a combination of rain and speed. bad combination. notice to drive , when it is raining, really back off. they are suggesting perhaps the driver of that car did not back off. the good news is that driver walked away after sliding out of the vehicle, walked an away from that upside down silver hahn they had to first of all right it, they had to close southbound 101, they closed it
