good thursday morning. 5:01. i'm eric thomas. and i'm kristen sze. breaking news in richmond. police searching for a us is expect after an early morning shooting near south 7th and virginia streets overnight. the victim was found inside a car and ultimately rushed to the hospital by helicopter. police are saying his injuries are very serious. his exact condition is not known no word on any suspect description. >> hours from now the 49ers will take their biggest step towards moving to santa clara. the team will break ground this afternoon for its new stadium. terry mcsweeney is live in santa clara with the preview. i guess we can say they are in the red zone now. >> reporter: you can say that. they will tell you they are in the end zone. they are going to be breaking ground today at 5:00 this afternoon. after all the talk over all

the years, today's the day they are going to be breaking ground for the new stadium for the san francisco 49ers. it is good-bye to san francisco. look at the animation we have of what the finished stadium is going to look like from the 50 yard line or so supposed to be opening in the 2014 season, just two years from now. hello to a 68,500 seat state-of-the-art stadium with a price tag of 1.2 billion dollars. right next to great america. amazing. not exactly good news for some of the season ticket holders who have been watching the 49ers some are upset the tickets they've held for so long are going up in price. doubling in price per seat. plus, tens of thousands for a seat license. a spokesman says hold on just a second we've only put a price tag on 13% of the seats

that we have at this new stadium. the final pricing in june. the stadium is two years away. there are still some who want to stop this stadium. they are thinking about another round in court. all that is going to take a back burner today. team officials and city officials are going to be out here for the groundbreaking as they break ground on this magnificent stadium. it is not going to be just for pro football, college football, other events, concerts and it is expand so it could accommodate some -- it is expandable, so it could ay, a super bowl. suspended sheriff ross mirkarimi goes back to court this morning to fight for his job. he speak in detail on the argument that led him to bruise his wife's arm. amy hollyfield is live at superior court. >> reporter: ross mirkarimi says he wishes now that he had spoken out sooner so he would

have better control over the story. he is getting his story out now. yesterday he appeared on the news program, radio show forum and explained how he bruised his wife's arm. he said they had been fighting on the way to lunch. he said she was screaming and trying to get their son out of the car seat, who was very upset by it all. mirkarimi says, he reached over, put his hand underneath her arm to tried to guide her back to her seat and escalate things, that's when the bruise happen. >> i parked our car. i had already vented what i had to say. so it was off my chest. i acted inappropriately. i swore at my wife, in front of my son. >> reporter: he's fight get the story out to the public. he's also going to be fighting in court. he has two tactics. today he goes after the city attorney he found a

technically to fight over whether the city attorney can stay on the case. tomorrow, he will ask the judge to overturn his suspension. he was suspended as sheriff last month when he pleaded guilty to a domestic violence-related charge. if he loses these two cases, then the case will go before the ethics commission on monday amy hollyfield, abc7 news. 50 students at berkeley high put their computer skills to use and they are paying for it accused of hacking into the school's system change attendance records. katie marzullo is live with details. this sounds like something out of ferris bueller. >> reporter: right but more high-tech these days. berkeley high school officials say they've changed passwords and closed loopholes in their attendance system, but not before the dozens of students hacked into that system. administrators say students were changing attendance records dating back to

december using home and school computers sometimes even during class. in some days they were deleting absences and tardies interest their own records in other scenarios making money off fellow students. >> they were selling access passwords to students. >> i've heard that someone has hacked into the system and changed attendance. >> if you have enough absences it will drop your grid, three unexcused absences or something like that will cause your grade to drop. >> reporter: that last student is speaking to motive, other reasons besides grades that are being kicked around campus is athletes wanted to stay eligible to play and students in general not wanting parents to find out they were skipping school. suspensions for the 50 students will last one to five days, expulsion can last up to one year. katie marzullo, abc7 news. 5:06. oakland police investigating the fatal shooting of a 24-year-old man

while he was pushing his 1-year-old son in a toy car yesterday afternoon at 3:15 in east oakland at fenham and 66th avenue not far from the coliseum. police say tyrell smith had been walking down the street when the suspect got out of a car and shot him before driving off. a neighbor quickly scooped up his infant son kyrell and carried him to safety. for the first time since a deadly shooting spree three weeks ago, classes at oikos university will resume monday most classes will be held in the same building where police say former nursing student one goh who was 43, killed six former classmates and a receptionist april 2nd. several students have said they would not return to the campus and only willing to complete their degrees if classes are held at another location. the director of the school raised concerns about whether the university can survive long term. this morning two dozen

face charges following a rowdy labor protest in san francisco. ♪ ♪ ♪ >> yesterday several hundred gathered at city hall to protest pending pay hikes for some top city officials. the rally lead to a march down market street that blocked traffic at the start of the evening commute. 23 were cited and released after refusing to stop walking a crosswalk. the union that represents 13,000 city workers organized the protest. union workers want the mayor, d.a., city attorney and public defender to forego pay hikes scheduled for july. marijuana legalization supporters planning major demonstration tomorrow. protesting the recent federal raid on oakland's oaksterdam university.

two-tiered college pricing plan. san mateo in los angeles proposed high demand classes worth three times the normal price trying to make the classes more available the plan was cancelled after student protesters were pepper sprayed at a board meeting. a spokesperson for the attorney general's office says the pricing plan is illegal under the state's education code. this morning mixed reaction to a minimum wage proposal considered by the california assembly. it would require the state to adjust the minimum wage every year, based on inflation and once increased cannot be decreased. the labor committee approved the bill yesterday. supports say it woulda.3ñ addrs the widening income gap which analysts say is the highest the state has seen in 30 years. opponents say it is a job killer. >> we are talking about tax breaks and helping out businesses let's balance that out thinking about what plan do we have for working families? >> labor is the biggest expense we have. if you don't have predictability in that, you

billion dollar price tag. not good news for season ticket holders most of them are upset that the tickets they've held for all that time now going to be jumping up and doubling in price. if you want a club seat, it is going to cost you tens of thousands for a seat -- [ inaudible ] only 13% of the seats in the new stadium have a price on them. they will figure the rest of it out in june. some are thinking about taking a shot in court to try to stop this project. today the 49ers aren't talking about court or anything else except groundbreaking on this stadium which again is expected to open in 2014, more than just a 49er stadium,

dollars a day until all the records were found. pg&e alerting neighbors in san mateo county about a natural gas pipeline test today. it is taking place near i-280 and highway 92. crews have to vent the pipeline to con the test so pg&e is warning you may -- to conduct the test. so pg&e is warning you may get a whiff of the gas in the area. if you have questions call pg&e at the number on your screen. sacramento working on a new bill to prevent the cell phone service shutdown like we saw on bart that triggered outrage. the bill bars bart and other agencies from turning off the cell phone network without a court order. bart officials angered civil liberties groups when it temporarily shut off service to squash a protest. new policy allows them to turn off cell service only in emergencies that threaten passengers.
