5 a.m. on this friday morning. thank you for joining us i'm eric thomas. and i'm kristen sze. hours from now ross mirkarimi will make a critical court appearance as he battles to get his job back. amy hollyfield is live at san francisco's superior court. >> reporter: good morning. not looking good for ross mirkarimi victory in court today. the judge issued a temporary opinion yesterday stating he -- doesn't look like he's going to be mirkarimi his job back. they will be in court to fight and argue this in court. mirkarimi is asking the judge to toss out his suspension. the city suspended him last month when he pleaded guilty to a domestic violence-related charge. today is his second attempt to get this worked out in court rather than a long battle before the ethics commission and the board of supervisors. city attorneys say they aren't

surprised by all of this court activity. >> i think he is in danger in serious jeopardy of removal. of course it serves him to try and short-circuit that process. >> reporter: mirkarimi lost in court yesterday. it looks like he will again today if he does, he will take this before the ethics commission. that hearing is scheduled to start monday ultimately, the board of supervisors will decide whether he can remain the city's sheriff. he is currently suspended, without pay. amy hollyfield, abc7 news. just hours from now, sheriff's deputies and volunteer searches will comb a sonoma county park for signs of a missing teenager she left her home saturday and hasn't been seen since. katie marzullo is live in santa rosa with more on this developing story. >> reporter: the search is going to resume today.

the santa rosa police department with the help of the sonoma county sheriff's department, will do that. we are waiting on details where and when they will do some the sheriff's department launched its helicopter yesterday to search in the area of spring creek the girl's last known destination. we want to show you her picture. she is 15-years-old her name is charlotte molinari, 5'9, weighs 150 pounds and has brown curly hair and brown eyes last seen on a green mountain bike you had a ukulele and her backpack with her. her dad has created this facebook page he's hoping it will lead to more answers in the search for his daughter. he said last saturday morning she left for a bike ride to spring creek. she never came back. he called police 9:00 that night and did report her missing. she attends sonoma academy. the school is distributing

fliers hoping to find the girl to find charlotte. police say they do not suspect foul play that is why they will in any case they would continue to search for her and they are going to do that again this morning. katie marzullo, abc7 news. new this morning, oakland officials will go to court hours from now to try to shutdown what the city calls a hub of prostitution and child trafficking. attorneys are asking an alameda county judge to shutdown the economy inn motel on east 12th near lake merritt for one year. last fall a court order required the owner and the national lodge motel to install cameras to allow police monitoring. the city argued the cameras -- they say they helped a little not enough both hotels need to be closed. student out on bail as he with -- as he awaits a court

the fines were proposed by the puc staff last year the commission finalized those fines yesterday after denying appeals from pg&e. construction has officially started on the new 49er stadium. the team held an elaborate groundbreaking ceremony last night. 49er ceo york was joined by city leaders, his parents and several players. on the location of the future 50 yard line. the 1.2 billion dollar state-of-the-art stadium is expected to be finished in august of 2014. 1,000 construction jobs will be created by the project and it will be a technological powerhouse, a far from candlestick, the oldest unrenovated stadium in the nfl, york insists the location is changing but the san francisco name for the team will not. >> i realize that this is a bittersweet day for a lot of people. i want to thank mayor lee for making sure that the 49ers and the city of san francisco have a great relationship and we are going be the san francisco 49ers forever.

had a scholarship to the school because of her interest in math, science and engineering she was also active in sports and music. they are distributing missing person fliers at sonoma academy. authorities do not suspect foul play. but they as well as her family are desperate to find her. katie marzullo, abc7 news. happening right now police in santa rosa are on the hunt for a suspect after an armed robbery in marin county. it started when four people were spotted driving way from a scene on san pedro road deputies chased them into san rafael the suspected bailed out of their car, two were hiding in nearby yards, a third caught a few hours later the final suspect still on the loose should be considered arm and dangerous. suspended san francisco sheriff ross mirkarimi has one more chance in court this morning to try to get his job back before facing the ethics
