in oakland nearly three weeks after the deadly shooting spree there. volunteers will be back out at 8:00 this morning searching for missing morgan hills teenager, sierra lamar, after yesterday's searching that didn't bring in any new leads. good morning. i'm terry mccsweeney in for carolyn tyler. let's start out with a look at the forecast. here's meteorologist lisa argen. >> good morning, everyone. this is it. marine layer is shallow right now at about 500 feet. combination of marine layer and increased onshore flow, bringing the cool down today and a significant cool down tomorrow. right now half moon bay in the 40s. visibility less than a quarter mile. elsewhere still mild in the east bay. it will take a little time over around hayward and livermore but already feeling the effects of the cooler air from the city into the north bay. so today we will see 60s, 70s, a couple of 80s instead

of the 60 eats and 90s. the real cool down for the entire bay area, another day coming but we also have increased moisture that means rain midweek. terry. >> thanks very much. >> for the first time since april 2nd class reese tomb tomorrow at oykas university. six students were killed and a receptionist. the suspect said he was angered when he said administration refused to refund his tuition. the classes will be held in the same building the shootings took place but several students said they will not return to the campus on edge water drive. they are only willing to complete their degrees if classes are held at another location. this week they will attempt to recover a yacht wreckage from the faralon islands. sergio shows us that tribute yesterday. >> all vessels proceed behind the coast guard vessel engine

over marine area they choreographed the nearly 100 boats that came to the cove from around the bay. for those who knew the crew of the low speed chase, this flotilla was a fitting tribute. >> i think it's really amazing. i like how many team turned out. >> emma watched from the shore along with dozens of others. she knew alexis bush, one. five lost at sea when a wave washed her and three of her fellow crew off the deck of the low speed chase. as part of the ceremony on the record, nick, one of the survivors of the accident, and the boyfriend of alexis, tossed a wreath in the water along with others. onshore a few people also brought flower, some who are friends and some who only knew them from around town. >> there's five perfect roses, one for each sailor that lost their life doing what they loved. >> her roses also made it into the water. her personal tribute in this grand show of respect for those who are now gone. as the ceremony wound to a close, an arc of water shot into

the air from the fire department rescue boat and another cascade came from the san francisco fire department boat. finally, the horns. [horns honking] each veeset then slowly made it back to port with only a ding i carrying wreath and staying in the water until sunset. it was a week ago this weekend that a large wave washed four crewmembers of the low speed chase overboard during the race around the islands and a second wave washed the boat on to the rocks. that's where the boat remains. it is expected to be retrieved by a salvage crew later this week. abc7 news. on tuesday, the alameda county board of supervisors will vote on accepting the resignation of fellow supervisor nadia lockyor. for the first time she's speaking on camera about why she submitted her resignation. we show you what she has to say.

>> she struggles to maintain her composure during this interview. during this four minute interview with the san jose mercury news reporter, she spoke about why she resigned as an alameda supervisor. >> i am resigning today. as a mother and as -- i don't like to say the word victim, but it's somebody that didn't realize how difficult it would be to heel from what i went through the last year. >> lockyer reignited a relationship with an ex-boyfriend last summer. the ex-boyfriend has a history of methamphetamine abuse. and met lockyer in a rehab program in 2010.

the renewed relationship cause friction with her husband, 70-year-old state treasure, bill lockyer. then in february she accused him of assaulting her, causing head and neck injuries. then she entered into rehab. >> i did need to resign because i need to really, really focus on my recovery from both the assault that abusive relationships, you know, in my heart and my psyche. >> in her letter of resignation she wrote she also wants to concentrate on raising her child. her fellow supervisors say all the constant media attention caused too many distractions. they say they support her and her decision to resign. >> i loved being supervisor, and i think i did a hell of a job. i do. i think i accomplished a lot in that short year. >> the board will have 60 days in which to select a replacement to serve out her term. if they can't find one in 60 days, governor jerry brown will appoint a successor. abc news. suspended sheriff ross mirkarimi heads into tomorrow's

ethics commission hearing having lost another battle to get his job back. on friday a judge rejected hissy -- his request to overturn his suspension on misconduct charges. he said it was unconstitutionally vague since it was not related to his duties at sheriff. but the judge said those issues should be raised before the ethics commission. he was suspended after pleading guilty last month to a maryland charge in a domestic charge involving his wife. mirkarimi anded mayor are expected to of it tomorrow. in the county volunteers will be out to search for missing morgan hill teenager sierra lamar. the 15-year-old girl vanished more than five weeks ago to -- on her way to catch a school bus. yesterday trained canines participated in the search. >> we want to check here. come on. out! >> specialized search and rescue teams focused on remote areas between morgan hill and gilroy.

the santa clara county sheriff's department said they have looked in these areas before but the goal of yesterday's search was to be more thorough. this morning crews are working to fix a water main break that shut down vineyard avenue. no word when it might reopen. drivers ever asked to use caution but no traffic related delays are expected. coming up next, voters in france head to the policy as president nicholas sarkozy's uncertain bid for re-election hangs in the balance. and new developments in the sex scandal involving the secret service. a

>> right now in france voters are deciding who the two finalists will be in next month's election. president nicholas sarkozy is believed to be one of them. turnout is solid today with one in four casting ballots in the first round of voting. it will narrow down a list of ten candidates to two. the run-off is may 6th. polls show president sarkozy and a socialist candidate are likely to make the cut. >> this mornings and photographers and photographsers are surrounding the jail where george zimmerman is waiting to be released. it could be a couple days before he's released because his family needs to come up with the $150,000 bail. he's facing second degree murder charge in the death of an unarmed unarmed teenager, trayvon martin. the sex scandal is still churning up this morning. six secret service agents have been ousted and more could be following them out the door. as david curley reports, they had some explaining to do. >> the secret service director was summoned to the white house

for a face-to-face meeting. a source says it was an opportunity for the president to get an update on the investigation rather than an evaluation ever the director. but the president was not happy, he made that clear when the scandal broke. >> if it turns out some of the allegations made in the press of confirmed, then of course i'll be angry. >> the confirmation to the allegations of heavy drinking and an argument with the prostitute over payment came with the dismissal of six agents. it cleared one agent of the most serious allegations. >> the rest of the crew, they totally went over the line in terms of secret service conduct. >> and the military is still investigating 11 of its own, as well. this scandal went from bad to worse when one of the dismissed supervisors was identified.

and it was discovered that david chaney posted a picture ever himself behind then vice president candidate sarah palin and said i was really checking her out, if you know what i mean. should the secret service have known? >> i bothers me it was posted. i don't know if you can expect him to post it on every web page orfacebook page. >> there is a sense. urgency here at the white house for the secret service to complete its investigation without cutting any corners. as of now the president supports the director of the secret service. david curley, abc news, the white house. san francisco congresswoman nancy pelosi weighed in on the scandal yesterday while at an event at golden gate park. >> i think it's disgusting. i think it's disgusting. the secret service provides a great service for protecting our president and those people are willing to pay any price to protect the president, the vice

president, et cetera and that some of them would tarnish the image is disgusting. i don't understand. but i'm sure there will be a full investigation. >> she was at the park to accept an award for helping make the grove a reality back in 1996. >> that was one of the earth day weekend events. today is actually earth day. a ton of events going on. everywhere you go there's going to be a nice day. >> it will be a very nice day. not as hot, taking the edge of off of that heat yesterday. i heard a few complaints. >> not from me. >> no, not from you. from our sutro camera you see the fog drifting into the bay. it is still is a shallow at about 500, 600 feet but we have the onshore flow and we will combine the two for the cool down. i'll explain. >> also next the sharks disappointing season comes to a frustrating end.

city and the north bay . >> if you want it hot you can go get it. >> that's right. you can see the fog behind us. >> look at that. >> yeah, look at that. so it is beginning to flow right on over the hills there. and in fact it will still pretty shallow, 500, 600 feet deep. we are looking at it moving in across the bay tonight. not today. so that onshore flow will be with us, allowing for some cooling around the bay. we are going to be knocked out of the 90s, out of the upper 80s, so the warmest inland spots above normal in the 80s. mont, 63, san jose 48. a quarter mile visibility at the coast. this morning it's cooler in the city. over in the east bay. right now it's a little warmer in san rafael. but that southerly surge will influence your weather in the north bay. it will be cooler there. cooler everywhere but not by as much here as it will be there, or opposite. because we are only going to

look at about five degrees of cooling in the east bay. 10 to 15 degrees cooling in the north bay near san francisco. sunny and cooler today. chances of rain come in midweek, more like wednesday, thursday. maybe a thunderstorm tomorrow. higher he elevations. here's what happened overnight. the low fog, the marine layer surging north, very shallow. the john show winds keeping it right at bay today, and then overnight tonight as it moves on in we will look for the cooler numbers tomorrow with barely an 80-degree temperature for monday. 58 livermore, down from 91. 70 in san francisco, down from 79. take a look at watsonville. 69 today. 20 degrees cooler than your 89 yesterday and even santa cruz, still a nice day, but not mid-80s. we are talking about temperatures very comfortable today. it's all due to still this ridge ever high pressure continues to weaken and it's in response to this area of low pressure. we are looking at a couple

pieces of energy visiting us throughout the week. the weather will be changing day-to-day. today the ridge begins to weaken, to slide off to the south and east. and the low, the first piece of energy comes ashore tomorrow with the possibility of a thunderstorm in the higher elevations. but it's not until wednesday and thursday that the temperature significantly drops. today not a lot of change from the sacramento, the san joaquin valley. how about 87 in yosemite. it was a record yesterday in reno with temperatures well into the 70s there. we are looking at numbers today still quite pleasant. low 70s in oakland instead of the low 80s. so it just takes the edge off. palo alto about 15 degrees cooler there. 74 fremont with 77 in san rosa. so at times it will be a also bit breezy along the coast. we will still see the fog from half moon bay, pacifica, and 69 in watsonville and ocean beach back into the 60s. the accuweather seven day

>> bradley said he's been waiting more than three decades for closer. his sister, terry, was brutally murdered and raped in 1981 in a vineyard. her killer, michael morales, sits on death row and is one of 14 inmates who have exhausted all their appeals. just as he was about to be executed in 2006, a judge granted a reprieve, allowing his lawsuit to move forward after he claimed the three-drug lethal injection method was cruel and unusual punishment. winshell filed a lawsuit of his own saying he has waited long enough. he wants the state to move to executions by moving to a one-drug process currently used in other states. >> i consider 31 years excessive delay, injury to myself and my family. >> the death penalty has been criticized for many years. delays often result in decades passing before an inmate's execution is carried out. >> it's a sad state of affairs when those officials with the

duty to execute the law care so little about the rights of victims of crime. >> opponents of the death penalty have been trying to get rid of it for years, citing a report found it cost taxpayers $184 million a year to operate. they say if he wants to change it, they need to formally ask corrections. >> they need to put it into procedure, submit it for public comment, they need to have a hearing and do exactly what they did when they set up the three drugs. >> corrections can't comment because it hasn't been served with a lawsuit. but the man's attorneys say they have been unsucessful in getting them to use the one drug effort. he said the courts it's the only way to let his sister rest in peace. >> it will add closer if we get it back. >> next week opponents of the death penalty are expected to announce they have qualified an initiative to do the same to let california voters decide on the issue in november.

in sacramento, nan knelt miranda, abc7 news. >> in santa cruz police are using math to solve crime. they are using a oormula to predict crime before is happens. it lets them no when is where a crime is likely to occur. >> people tend to burglarize the same area more than once, even the same times of day or the same times of the week. if the system works, and so far it looks promising, i see it as the future of law enforcement. santa cruz pd considers it a good tool to fight crime in the face of budget cuts and it seems to be working so far. they say burglar raise are down 27%. there is a report this morning that pg&e new in 989 about a leak on the same pipeline that caused the deadly san bruno gas explosion. the memo industries the leak

caused by a faulty weld about 9 miles south of where the disaster occurred. "the chronicle" also reports the document was turned in just last month, well after the conclusion of state and federal investigations. the company denies the 1929 leak -- the 1989 leak occurred along a seam. that would have required an inspection of all 51 miles of that pipeline. a scorched neighborhood is getting new trees thanks to the effort of a 13-year-old boy. his learning project collected $4,000 in grants and added some donations. he came up with 20 to 30 citrus trees to be planted today, earth day. the work will be done by volunteers. he recruited the volunteers. >> and we now go to the gardens of lake mary. >> it's been there all along. >> a lot of people don't even know it's here. >> we always hear that and we've

been working for years trying to overcome that. >> a quiet jewell beneath the tall buildings and busy streets that surround it. the gardens at lake meredith homes is one of the rarest clerk -- hort cultural clerk necessary north america. it's also one of the most peaceful and beautiful places in the city. >> this is a rose garden. >> victoria manages the garden for the city of oakland. her budget has been cut year after year but thanks to generous donations and thousands of volunteer hours, the guard -- garden is thriving. >> i think what makes it thrive is that we build a sense of community about this garden. this garden of lakes and parks belongs to the people. and we express that. ♪ >> here there is collection of 150 rare bonsais one. including this one, it's been growing for 450 years. >> and the largest collection of outdoor cool weather pawns in the entire western united states. >> there are 65 varieties in all.

national park. as it does every year, the national park service a offering free admission to all its park all week long. the deal started yesterday and goes until next sunday, april 29th. san francisco and other bay area cities have started a campaign to help keep kids physically and mentally active over the summer. brain drain is a problem during those fun, but lazy days of summer. abc7 news education reporter leeann tells us all sorts of programs are offered. >> there's a wide variety of summer camps for kid. there is a list of camps he wants his son to attend. >> we try to vary the camp between mentally stimulating and physically stimulating. >> but california superintendent of schools say low income families can't afford many of those quality summer learning programs. >> during the summer the middle income kids keep going with their learning and stimulation in the home environment in their own neighborhood, but low income kids lose, they go down.

that widens the achievement gap year after year. >> facing another budget deficit, the state and most cities don't have the money to fund programs, but foundations and corporations do. jennifer is with partnership for children and youth. the organization behind the campaign to prevent summer learning loss. >> we are also working with private foundations to talk to them about why it's important that they invest in summer learning. >> here's an example. 75 corporations in the silicon valley are helping to fund programs like stepping up to algebra. for one month in the summer 1,000 underserved kids at 30 schools in the silicon valley and south bay will get help with their math skills. these have the silicon valley ed foundation. >> it's you're future workforce. math is important to us. >> and the department of rec and park is expanding his summer programs for kids ages 8 to 17. -- 3 to 17. this mother has relied on them

camera. you will notice treasure island there. look how shallow that fog is. with that onshore flow combined later on this afternoon, then we will begin to feel the cooler sea breeze. but it will take a while. it is going to be tomorrow where the east bay really drops in temperature. but today out of the 90s for everyone. 57 redwood city and dense fog around hatch moon bay. also the oakland bridge it is dense so be careful out there. still mild in san jose. 24 hours ago we were definitely warmer in oakland and san francisco. we will continue to feel that cooling trend up to the north bay and in the city. but elsewhere still quite mild. a lot of sunshine in our east bay valleys this morning, and we will be looking at the sunny day today with more comfortable temperatures. if you thought it was a little bit hot yesterday, and if you enjoyed, it unfortunately nothing like that in the next seven days. in fact, not only temperatures trending downward, but we are talking about a couple

opportunities of rain. so overnight the fog slowly began to pull up from the south. and now it is hugging the shoreline, trying to push into the bay a little bit. it's not going to make it very far inland, but the sea breeze, the westerly wind will keep san francisco and marin more tempered today. half moon bay will stay in the 60s. santa cruz 17-degree drop while we cool down 9 degrees in san francisco. look at napa. it was 90 yesterday. how about 78 today? so, yeah, not a dramatic cool down, but that's kind of the way we like it, right? a little more subtle. here's the big ridge of high pressure that is continuing to dominate our weather for the most part today. but we do have a cut off area of low pressure. these things have a mine of their own a piece of energy from that is going to drift into tomorrow. so the higher elevations could see a slight chance of a form. the ridge continues to weaken and then the tulo will encompass much of the west coast.

registering your car is usually simple but not for a marin county woman. the dmv wouldn't give her her new tags and for a whole year police kept pulling her over. 7 on your side's michael finney stepped in to help. >> elizabeth sweeney felt downright fearful every time she

got behind the wheel. not for her safety but because of this. the expired registration tag on her car. >> the tag says 2011 and we are in 2012 so the officers will stop me. >> she's been driving around for nearly a year with expired tags, never knowing when she would get pulled over. however, she says, it's not her fault. she paid her car registration but the dmv wouldn't give her the new tags. >> i said is there a problem? they said, yes, you have a citation and it's not been paid. and i said no, i paid that citation. >> it all began two years ago when elizabeth admits she did let her registration lapse. she was cited and she paid the fine. however, when she tried to register the car last may, the citation still showed up on her dmv record. elizabeth had to go back to the courthouse to prove she was cleared. >> and i did speak to a

gentleman there, and he tells me, no, it's paid, liz, it should be fine. just wait a couple of days and it should be in the system. >> but it wasn't. so elizabeth got a copy of her court record and a letter saying she had paid the fine and took it right down to the dmv. >> and they said, no. this doesn't suffice. >> elizabeth went ahead and paid her registration but the dmv said no tags. elizabeth said she had no choice but to drive without them. >> i was very tense. i was very tense every time i got behind the wheel. i was always, always looking in the rear view, watching. >> and every so often she would hear the siren behind her. >> oh, and i'm late for work and i have to pull over. >> elizabeth kept this envelope in her glove compartment with the court papers and her registration receipt. the cops were sympathetic, but still she was getting stopped. she also received this $279 parking ticket for expired tags. and months later her dmv record

still showed that citation. >> so i was very frustrated at that point and called channel 7. >> we contacted the dnv and it looked into the case. within hours elizabeth got a call to come on down with her paperwork and after a test, she was handed the coveted orange sticker. >> i'm so incredibly relieved. >> the dmv said we are unsure why ms. sweeney's issue took so long to be handled. there may have been an issue with communication between the field office and sacramento headquarters. we apologize to ms. sweeney for any inconvenience this may have caused. now she carefully applies that precious tag. >> i'm done. i'm so done. >> and drives off feeling free. >> and thank you so much for that. being there and helping me. >> so if you get a citation and pay it, make sure you get a receipt from the court saying the matter is cleared up. i'm michael finney, 7 on your
