. good tuesday morning. thanks for waking up with us i'm kristen sze. i'm eric thomas. oakland police investigating a shooting that left three wounded as the department considers another major change to policing strategy. katie marzullo is live at the oakland police department. >> reporter: no matter where you put the police officers somebody is going to be upset about it. one man who lives near where last night's shooting happened wishes they had more police in that neighborhood. take a look at the scene about 11:00 last night corner of 98th and holly, three people shot, one drove himself home. his roommate says he was only caught in the crossfire sounds like he's going to be okay. the chronicle is reporting this shooting comes the night before the mayor might change

her strategy on policing. she had wanted to inundate the violent blocks with officers, the 100-block plan. people in the other neighborhoods did not like that plan no within in any neighborhood is satisfied -- no one in any neighborhood is satisfied at in point. one witness talks about how he feels. >> with them laying off police officers, them not putting focus on these neighborhoods, you know, you know it is going to happen. summer is coming around, more and more young people are getting antsy. with resources cut, there's not much that we can do. >> reporter: as you can see in this video at least two were taken into custody last night. we don't know anything about the motive or anything confirmed on injuries. police thought maybe one was shot in the chest another in the leg. as i said the roommate of the third victim says he thinks his roommate is going to be

okay. that crime -- crime is up in oakland, violent crime like homicide, burglary and robbery up 21% from the same time last year. crews on standby to see what will become of the sailboat that crashed during a race, killing five. it was airlifted off farallon islands last night. amy hollyfield is live in the newsroom. >> reporter: and quick, and something to see. check out this video, 15,000 pound yacht was flying through the air last night this was before 7:00 it was being hauled by a special helicopter to the half moon bay airport. dozens of locals gathered at the airport to watch the[w' helicopter bring the boat to land. five people who were onboard that sailboat died about a week and a half ago when a couple big waves over took the ship. as people watched the recovery of the boat yesterday they had the victims on their minds.

>> sad for the people that were lost and the families that were lost. >> you are thinking of the people caught in that. we have a lot of friends who are sailors. it is like a ghost boat in a sense. >> reporter: a dive crew had to go to the farallon islands to prepare the boat for the trip. they were up against bad weather, rocky terrain. they are calling the mission a success. the boat called the low speed chase is now fenced off and covered with a tarp. no word on how long it will stay there. the job is expected to take two days and cost $200,000. amy hollyfield, abc7 news. meanwhile, the san francisco police department has finished its investigation into that yacht racing accident. police found no criminal and have handed over the investigation to the d.a.'s office. the police report did uncover

that the captain of the yacht was among the five killed, survivor was originally thought to be at the helm. the san francisco ethics commission has decided on a framework in the proceedings against suspended sheriff ross mirkarimi during last evening's hearing the commission decided attorneys for the city and mirkarimi will file briefs and provide witness lists before it meets again on may 29th, when the commission is expected to decide whether live testimony will be heard. >> it hasn't happened before. it is unchartered, unprecedented. so i expect people to be careful. i want them to be careful with the proceedings. the it reflects not just on the integrity of the process but on san francisco. >> it was also revealed the city attorney's office has not obtained a copy of the video showing mirkarimi's wife in it she reportedly tells a neighbor that mirkarimi grabbed and bruised her arm

during a new year's eve argument. mirkarimi pleaded guilty last month to a misdemeanor related to that incident which lead to his suspension by the mayor and the hearing. apple set to release another record quarterly earnings report, expected to be huge for apple which is the most valuable company in the world it includes the first international iphone sales and january 13th, launch of the iphone 4s in china. street is estimating that apple sold between 31 and 32 million. phones in that quarter. today an estimated 90,000 californians will be told they are about to lose unemployment benefits in weeks. as of this week california no longer qualifies for a federal program known as fed ed that provides up to 20 extra weeks of jobless benefits to the long term unemployed.

sense. >> the yacht is now sitting near the runway awaiting transport by a big rig. no word on where it will be taken next. disappearance of morgan hill teenager sierra lamar is sparking chains in the way the district will report student absences. the district which includes sobrato high has begun notifying parents in the morning when students done show up. sierra's parents were not notified their daughter never made it to school until after 6 p.m., march 16th, nearly 12 hours after she disapartment. san bruno city council meets tonight to discussion what to do with 8,000 feet of gas pipeline out of service since the explosion. residents have been pushing for the pipeline's removal since the explosion and fire killed eight and destroyed 38 homes. pg&e planned to fill the pipeline with concrete so would it never carry natural gas again.

the council may decide on a third option. workers rebel men removing nearly 900 feet of the pipeline and plugging the rest to avoid the long process of tearing it all out. 5:36. in san jose today, city councilmembers are expected to pass a ban on styrofoam containers at city facilities and programs and events in city venues going into effect may 1st. the mayor says the city plans to do a study to see how a ban would affect the cost of doing business and the amount of litter it would reduce. businesses are opposed to a broader measure. the use of styrofoam containers is already banned in many other bay area cities. you have to love this week's weather, drizzle, thunderstorms, warm weather, cool weather. >> that's a recipe for a happy meteorologist, mike. >> at least -- [ unintelligible ] hopefully, the thunderstorms
