. good tuesday morning. it is 6 a.m.. i'm eric thomas. i'm kristen sze. warmer morning out there. meteorologist mike nicco coming to talk about what is causing those conditions. a lot of cloud cover hot spot is santa rosa, light rain for the better part of overnight 12/100 of an inch over the last 24 hours. the other story is warmer from one to about six degrees across most of our neighborhoods because of the cloud cover. when you step out 60 in oakland, mountain view and san jose mid to upper 50s for the rest of us. here's the first look at traffic. reports of an accident in the silicon valley. good morning. this accident happened on the key road on that ramp leading towards northbound 101 and so far traffic on 101 okay

sensors picking up light traffic for the stphoeurt bay as we check in on the rest of the commute, westbound traffic at the bay bridge toll, beginning to slow expect delays now. 6:02 now. new this morning, developing news from oakland. police are investigating a shooting that left three wounded it comes as the department prepares to consider another major change to their policing strategy. katie marzullo is at the police department to explain. >> reporter: it seems no matter where you put the police officers they aren't enough to go around. one man who lives near where last night's shooting happened wishes he had more police officers in his neighborhood this is last night 98th and holly three people shot, authorities found two at scene the third drove himself home he told his roommate and the

roommate told us he was in the wrong place at the wrong time. he's going to be okay. the shooting comes the night before the chronicle is reporting the mayor might be changing her strategy on policing. she wanted to inundate the most violent blocks with the most officers. people living in other communities like oakland hills didn't like that. now it seems nobody is satisfied that one witness to last night's shooting has this reaction to the police situation. >> with them laying off police officers, them not putting focus on these neighborhoods, you know, it is going to happen. summer is coming around. more and more young people are getting antsy. with the resources cut from the city, not much that we can do. >> reporter: video taken at the scene shows two men put into handcuffs we don't have

confirmation from police as far as humidity rests were made and we don't know anything about the -- as far as how many arrests were made and we don't know anything about motives. 21% more homicides and -- katie marzullo. the san francisco ethics commission has decided on a framework in the proceedings against suspended ross mirkarimi. the commission decided attorneys for the city and for mirkarimi will file briefs and provide witness lists before it meets on may 29th, when the commission is expected to decide whether live testimony will be heard. >> it hasn't happened before, it is unchartered, unprecedented. i expect people to be careful. i want them to be careful with the proceedingings it reflects not just on the integrity of the process but it reflects on san francisco. >> it was also revealed last evening's hearing the city

attorney's office still has not obtained a copy of the video showing mirkarimi's wife. in it she reportedly tells a neighbor that mirkarimi grabbed and bruised her arm during a new year's eve argument. mirkarimi pleaded guilty last month to a misdemeanor charge related to that incident which lead to his suspension by the mayor and the ethics commission hearing. surprise move in the case of an unarmed teen shot to death by a neighborhood watch volunteer in florida. last night the sanford, florida city commission would not accept the resignation of the police chief who many have harshly criticized for his handling of the trayvon martin case. they say they want to wait for the results of the full investigation. there were protests nationwide after police refused to immediately arrest george zimmerman for the shooting of the unarmed teen. zimmerman has been charged with second degree mur. police chief lee previously stepped down temporarily in late march after the council gave him a no-confidence vote.

proposition abolishing the death penalty in california has qualified for the november ballot. it would make life without parole the harshest sentence. converting the sentences of 725 death row inmates to life. estimated 100 million dollars it would save over the next three years would be sourced to police departments for murder and rape investigations. yacht that crashed on to rocks at the far:islands this month is in half moon bay this morning -- at the farallon islands this month is in half moon bay this morning. crews lifted the boat in a delicate operation and flew it 28 miles yesterday. there were a number of obstacles facing the crew. in a few days protected birds will begin nesting. the company was paid $200,000 to do the job. people showed up to watch the operation. >> sad for the people that

the district waited five days to notify the state and county health officials about the spill. the settlement includes $800,000 in fines related to the lack of notification. hours from now, cupertino-based apple set to release another record huge for apple, already the most valued company in the world. it includes the first results since january 13th, launch of iphone 4s in china, wall street estimating that apple sold between 31 and 32 million iphones in the quarter. the sales streak is -- is hurting at&t the company says it is losing money and iphone sales and not making it back via service plan charges. at&t stock down 25% since it became an iphone carrier in 2007. apple's stock up 415%. today estimated 90,000 californians will be told they are about to lose benefits in

example as to why. last night around 11:0098th avenue and holly street, three people were shot, two at the scene, the third drove himself home with a bullet in his collarbone apparently he's going to be okay. the roommate says he was in the wrong place at the wrong time. mayor quan might move extra police officers out of the 100 blocks, a plan of hers temporary one, to help reduce crime in the most violent areas of oakland. some are saying it did not work. off camera, a witness at last night's violence describes what he heard. >> it sounded like an assault rifle. whatever it was, it was pretty big, because i live six block with them laying off police officers, them not putting focus on these neighborhoods, you know, it is going to happen.

>> reporter: you can see from this video police took at least two away in handcuffs. as of this hour they have not confirmed any arrests or possible motive. katie marzullo, abc7 news. 6:34. a fair field police officer is on administrative leave this morning, -- while detectives investigate his involvement in the shooting death of a suspect. authorities say the officer went to a home in the 700 block of gold coast drive to follow up on an investigation. the 16 year veteran and the suspect began fighting in the doorway when the officer pulled his gun and shot the 51-year-old man. the suspect died at the hospital. the names of the officer and dead man have not been released. this morning more students will return to classes at oikos university, more than three weeks after seven were shot to death by a former student. one class was held yesterday.

17 of the 22 students enrolled showed up to finish an english course. most of them didn't want to talk about the shooting. one teacher we did talk to says, he is still shaken but feels it is important to get back-to-school and finish what they started. >> i'm still dealing with the emotion. it is tough. i thought it was important i come back and show that everything is fine with me. >> students who don't want to return to oikos have been invited to attend unitech college in fremont where efforts are underway to accommodate them. the sheriff's office says at accused shooter, goh has not eaten since was arrested almost three weeks ago. remains of a yacht is now in half moon bay. sky 7 got these pictures as the salvage crew prepared the

low speed chase for a helicopter journey back to the mainland. just days to spare before sea birds starting nesting. this morning it is fenced in at the half moon bay airport. in a few hours the occupy movement plans what they call a major disruption at the wells fargo shareholders meeting downtown san francisco. they want top banking executives to pay their fair share of taxes. two years ago there were only a few demonstrators when shareholders met in january protesters chained themselves to the front doors of the bank. about a dozen were arrested when they refused to move. what started as an earth day event has become the latest confrontation between uc berkeley and the occupy movement. a group of occupiers is camping out at a uc-owned field in albany. they want to turn it into a

southbound 880 approaching 237 in milpitas got an accident delaying traffic. a couple of accidents all in that same area expect big delays for southbound 880 leaving fremont into milpitas. 580 commute also tough because of an accident still in the clearing stages westbound 580 approaching pore low -- portola, slow from the altamont pass approaching the dublin interchange. because of head-on accident this morning highway 120 within still shutdown approaching highway 12, take napa instead. bay bridge metering lights on traffic backed up from the 880 overcrossing. bart reporting all trains on time. no delays for caltrain. of 6:52. the san bruno council meets tonight to consider what to do with 8,000 feet of gas pipeline out of service since

the 2010 explosion and fire. residents have been pushing for the underground pipeline's removal since the explosion that killed eight and destroyed 38 homes. pg&e had planned to fill the pipeline with concrete. the mercury news reports the city council may decide on a third option. city workers recommend removing nearly 900 feet of pipeline then plugging the rest that would avoid the long and messy process of tearing it all out. in san jose, the city is expected to vote to ban all styrofoam containers at all events and city venues. the mayor says the city plans a study on how a city wide ban would affect cost of doing business and amount of litter would it reduce. businesses are opposed to a recapping: shooting has left three wounded in oakland, including an innocent bystander.

>> katie marzullo in oakland with details. >> reporter: of the three wounded, police believe one was hit in the chest, the other in the leg. the third who his roommate says was an innocent bystander someone who happened to be driving in the wrong place at the wrong time was hit in the collarbone he's expected to be okay. -- he drove himself home before going to the hospital this happened last night a neighbor and witness says he heard at least 30 shots fired from two different what sounded like to him, assault rifles. the mayor's plan was to move extra officers into the most violent neighborhoods in oakland. people in other neighborhoods didn't like that plan some say it is not working anywhere way. the mayor might announce she is moving those officers out of those neighborhoods and back to their original
