closed captioning by closed captioning services,inc . right now major police indent in san jose that is just now ending this very minute a man barricaded himself in a home following a stabbing this morning. good morning i'm kristen sze. and i'm cheryl jennings. the s.w.a.t. team surrounded the house. let's if get to katie marzullo with the latest. >> reporter: nine hours later

it appears this standoff has come to an end many behind us you can see police very much still on the scene roads still blocked. they have taken one person into custody there were others in the home. officers going through that home making sure they have everybody and everything out. this whole time since almost 2:00 this morning police have had no contact with anybody inside that home. it has been a long morning. it began with a 911 call shortly before 2 a.m.. someone inside a home on the 200 block of cleveland avenue called and said a man had been stabbed. police found a 51-year-old man stabbed. they took him to the hospital, where he died that was just the beginning. >> established the relationship between the victim and the resident. >> reporter: when officers tried to talk with the man in the house about the stabbing door, locked himself in, not before officers deduced he might be dangerous. >> they believed there might

be firearms they've developed information to suggest there may be firearms in the house. >> reporter: the s.w.a.t. team was called. three homes and apartment buildings evacuated three schools placed on modified shelter in place, meaning -- >> we don't think anything will happen on campus. we need our kids to be safe. better say than sorry. >> reporter: neighbors didn't want to go on camera but say the man who live in the house runs a plumbing business out of the home he has several security cameras on his property as well as barbed wire along his back fence. we are still waiting to hear what the relationship might be between the people inside and the stabbing victim if there was one at all. also, we are waiting to hear how this come to a conclusion, if police went in or if the people came out voluntarily. katrina rusk will bring updates later. as far as the schools go, the

district spokesperson still on scene and says they are going to leave the schools in modernized -- modified lock down for now until it is safe. katie marzullo, abc7 news. developing news within the past hour police found the tax that i was commandeered by robbers last night. they put the cabbie through a long life-threatening ordeal from bay point, antioch to oakland. amy hollyfield is live in antioch with new information. >> reporter: we are just now getting pictures in from sky 7. take a look, this is the yellow cab that was stolen last night. this is where the cab driver was held for a torturous ride for merely an hour in his own trunk. the car was found in morning in oakland around 83 avenue in good condition. they haven't found the men who stole that car the cab will be on its way back to antioch

where police are looking forward to processing it. this cab driver was forced to ride in the trunk of his own cab while listening to his captors argue over what to do with him. a police officer says the three kidnappers couldn't decide whether to beat him up or kill him. they decided to let him go high up in the oakland hills. >> obviously, you would be traumatized under those circumstances, but i think he's doing well as far as i know he has no physical injuries. >> reporter: the driver's ordeal started at the bay point bart station where he picked up three men in their 20s they wanted him to take them to antioch. when they got there, they pulled out a gun. >> they robbed him of the cash that he had on his person. he's brought to the back of the vehicle and told town lock the trunk he's told to get in he comply. >> reporter: one of his fellow cab drivers told us the driver has only been with the company for a few minutes.

>> he was a nice guy. he's okay. he's new. he wasn't looking over his shoulder too >> reporter: he says the kidnapping has had an impact on drivers. >> we all lined up here in the morning yellow, green, whatever, but i'm the only cab that has been out here so far. [ unintelligible ] >> reporter: why? >> scared. usually they beat me out here >> reporter: it has even upset people working at the coffee inside the bart station. >> co-workers are like i don't want to take the garbage out. kind of crazy. >> reporter: police say the men got the driver's cash, jewelry and cell phone. now that they've ditched the cab investigators say they could be on foot or home maybe they live in oakland where they got rid of the cab. police are following up on all

of their leads. amy hollyfield, abc7 news. the brother of 49er football player vernon davis is being charged in connection with an attack that may be linked to the death of a tourist in denver last night. police say there were to similar assaults in the area where the killing took place. michael davis is accused of one of those attacks. investigators say none of the victims knew each other all suffered head wounds and attacked suddenly with no provocation. the victim was a 66-year-old man. this morning davis tweeted just got a disturbing call from back home good day gone bad hopefully, he wasn't involved. oakland firefighters trying to figure out what lead to an early morning car fire. the fire started 4 a.m. on the 800 block of 36th treat. the flames spread to a utility pole. investigators not sure how the fire started no one was at the scene when they got there an air bag exploded while

firefighters were trying to put out the fire fortunately, no one was hurt. early morning highrise apartment fire in is sent one person to the hospital and forced dozens to shelter in place it started in an apartment complex on woodside avenue. several tenants were ordered to shelter in place because firefighters felt that[%zd was safer than evacuation given the building's configuration. investigators are trying to determine if the fire was intentionally set. at least two apartments on the 8th floor were damaged. several more have water damage. the house has just approve a bill that keeps interests on millions of federal loans if doubling this summer. republicans ignored the white house veto threat and disagreement within their own party. democrats opposed that 5.9 billion dollar bill because of the way it covered costs eliminates preventive health care fund in president obama's health care law the measure is expected to die in a

democratically controlled senate. the former aide for john edwards says he feared for his life during a meeting with the former senator. young testified for the fifth time he said he met edwards on a rural road in 2008 and demanded that edwards tell the truth about an extramarital an air he was having with a campaign worker. young says edwards drove them through a remote rural area at one point he worried he was going to be killed. edwards' lawyers say young is a pathological liar. >> sometimes we say as a prosecutor you don't find swans in the sewer. this guy is a swan, no question. >> edwards is facing federal charges of misusing campaign donations to hide at fair with rielle hunter and the fact they had a baby together. coming up, the doyle drive demolition is hours away we'll take you there. historic ride for one of the space shuttle's, why it
