brandy martel was shot to death at franklin and 13th streets. her friends believe the killing was a hate crime. abc 7 news joins us live from hayward. laura? >> well, this is where the 37-year-old grew up, and where she lived until she was shot and killed yesterday morning in downtown oakland. and martel was sitting behind the wheel of the car, one, or two men began a conversation. a witness told abc 7 it was cord yil but minutes later one of the men became angry, firing into the car where she was sitting. and until last year she worked as an outreach worker that serves the transgender communities. >> when you don't provide a space in society for people

who are other and different, if you don't provide places for them, whether it's socializing or services, this is what happens. >> now, last night people gathered at the scene to remember martel. her murder is one one of three over the weekend. investigators are trying to figure out what led up to this shooting. it could be considered a hate crime if they find out the shooter was motivate bid a perception of the victim's sexual identity. now, i'll have more on what led up to this shooting from a witness who was inside of the car tonight on abc 7 news at 6:00. >> thank you, laura. from a former oikos university student one goh pleaded not guilty that he shot and killed victims.

the sheriff of course goh has been moved from the infirmary in santa rita jail when he began eating on his own over the weekend. he refused to eat for the first few weeks after his arrest. >> a marin businessman has been jentsed to 22 years in prison for defrauding dozens of investors. and he was convicted of stealing tens of millions to pay for a lavish style life including a private jet. he was convicted of fraud, money laundering and tax evasion, a judge ordered him to pay back $31 mill dwroin victims. investors are doubtful they'll see the money again. >> this i think he spent it all. would it be nice to get something back but i'm not hopeful. >> among victims was van gaurd public foundation, a civil

checking healthy living news findings show america's obesity epidemic is weighing heavier on medical costs than anyone realized. research at university of chicago shows additional spending because of obesity is double estimates skpechleeds those of smoking. those costs include obvious, such as higher health insurance premiums as well as more hidden expenses like hospitals ripping out

wall-mounted toilets and replacing them with floor models. and there is a suspect that it it will lead to introduction of policies to fight obesity. >> thinking of sending a text is enough to increase the likelihood of getting into aan accident. there is a modest 1% increase among those who spent a lot of time thinking about texting or talking on the phone. a separate study shows those who texted as they drove were up to eight times more likely to drift between lane autos if you take diet sup plems you may be wasting your money. research published online finds there is no such thing as a vitamin providing insurance against cancer. claiming supplements including beta-carotene may increase the

risk among some high risk patients. >> the e reader marketplace is getting fierce. barns and noble has a strong ally to revitalize its nook unit. >> barns and mobile goes on the offensive against amazon today, teeming up with microsoft, microsoft is investing $300 million in a new subsidiary including the nook e-reader unit. microsoft will own 18% of the venture, barns and mobile will own the rest. the new partners will develop an app for windows 8 bringing digital bookstores to millions of new customers. and it gives a foot in the tab blet business without having a tab blet. shares of barns and noble jumped more than 80 at one point in today's trading that. is the biggest trade since the book seller went public almost 20 years ago.

it's been struggling to win the share with less than a third of the market today compared to 60% and it's an important market to win. this is thanks to oil e reader owners. in 2013, 3% owned one. by 2015 estimated nearly one in four will own an e reader. and according to research amazon is the number one e book seller followed by barns and noble second, and apple, third. so in teeming up with barns and noble, microsoft also shared its own outlook on sales saying they'll soon makeup a third of the market. but this is not so good news for publickers losing out on profit. recently the pricing structure attract attention in washington after the justice department sued apple over claims it kol you'ded with publishers to fix the prices.

and there is today's closing bell stocks closed lower today after news came out spain's economy is in another recession. the second since 2009. your bloomberg silicon valley index down with shares of apple losing 3%. and it's not just you. everyone is suffering from spam texts. an anna lift says number of u.s. spam text messages rose 45%. and that is costing carriers as they deal with a number of complaints and frustrating user who's face fraudulent messages. some have to pay to open those texts. in san francisco, i'm emily chang with bloomberg west.
