>> san francisco police will hold a news conference to explain the circumstances surrounding their shooting of a barricaded suspect by the s.w.a.t. team. terry? >> reporter: the crime scene tape came down. the shooting took place on third floor post street near hyde. it was absolutely wild. shortly after police from rohnert park in sonoma county arrived at the three-story apartment building they wanted to talk to a man about a homicide in their area. san francisco police say the man's girlfriend answered the door. the man opened fire. rohnert park police backed off. they called in san francisco police to help them out. the man not only fired a shots he set fire inside the apartment building and police decided to make a move. >> incident commander made the decision that there was

immediate danger to life or serious injuries to other tenants in the building. gave the green light to do it safely and that opportunity presented itself. >> reporter: san francisco police shot and killed the gunman. san francisco police doing the shooting. not releasing the man who was shot and killed he was wanted in the killing of a 66-year-old woman up in rohnert park. her body was found tuesday morning. she died of blunt force trauma. rohnert park pd tried to contact him tuesday night but came back last night and apparently found their man. police will be releasing more information possibly giving the name of the person who was shot and killed at the hall of justice. terry mcsweeney, "abc 7 news."

>> battle at bart. protestors promised to show up at force at a meeting where the board will decide who gets to build the next generation train cars. abc learned being able to withstand a terrorist attack could be a new criterion. >> reporter: high level source is telling "abc 7 news" there is a new question on the table. would you like to wait five or more years for new trains that could possibly contain a blast that goes off inside the train? or would you want to order the new trains right now? the debate has been, whether to choose a company that build the trains in america. bart officials announced last month that canadian company had the best bid. that company is promising to build only 66% of each car with u.s. parts and labor, but the second place company promises

95% of the cars would be american. there is still a push to choose that second company. the vote is expected today. union workers will be holding a rally pushing for american made bart trains. then came this curveball. there will be a closed session meeting at the bart meeting and talk about starting all over again. high level source there is talk about throwing out all of the bids and waiting for this blast assessment technology that could take up to five years to even get developed. some bart officials are concerned say they don't have enough five years. they needed the new trains yesterday. so the bart meeting should be very interesting. we'll be there covering it for you. the staix stakes are pretty high. >> eric: other news, this morning, all golden gate transit buses will be running their

normal service. union workers called a strike because the two sides appeared to be heading toward a settlement. it would have affected 25,000 riders. they have been unable to agree for how much employees should pay for health benefits. >> they are investigating the cause of a fire that destroyed three homes under construction. fire started at about 10:00 last night in santa clara. some 50 firefighters battled the flames. it took them about an hour to get it under control. officials say they were fortunate there wasn't any wind last night which helped them keep flames from spreading to nearby townhomes. there are no reports of injuries. >> eric: u.c. berkeley police are increasing patrols on the east side of campus after a series of recent armed robberies. according to the daily californian, four armed

robberies happened on daily road in april. and may. they have increased the number of officers in the area. they are advising students to be more cautious when walking at night. >> u.c. berkeley has taken a legal step to remove the protestors in albany but they are ignoring it. they filed a lawsuit asking for a court order to remove 14 defendants and 150 others from u.c. farmland known as gill tract. the university is also asking for monetary damages and it says if they don't leave soon, the researchers will miss a crucial growing season. >> we need to start in the middle of may. we will honor our commitment to our faculty and students. >> i think it's a very visible sign that the u.c. administration is incredibly scared about the community

50s around the coast and bay and mid-70s for lunchtime temperatures. low 60s at the coast and 7:00 temperatures, playing tennis in the afternoon, mid-70s inland, upper 50s around the bay and even 60 at the coast. only problem, can't shake the pollen. we have high amounts of tree, grass and mold is remaining high. seven-day forecast, we'll take a look and see how long they will last, all seven days. but they will definitely be above average with no rain. good morning. can't find many bay area problems, no accidents to slow you down. 680 in walnut creek, traffic is looking good as you head southbound here and connect on to highway 24. westbound 80 for headlights moving through berkeley, drive time is 18 minutes from carquinez. no delays at the toll plaza.

terry mcsweeney joins us live from the scene. >> we still have san francisco police officers on the scene, homicide investigators are gone. firefighters gone, as well. the incident happened here on post street hyde. third floor of the building. that is where a suspect shot and killed by san francisco police. it's about 9:00 when it really started getting crazy down here. police from rohnert park had come to the three-story apartment building to talk to a man about a homicide in their area. the man's girlfriend answered the door. that is when the man started firing his gun. rohnert park police backed off and called in san francisco police for back-up. >> over the course of the next hour suspect fired multiple shots through walls and floors. the billion had other people in it. at some point in time, suspect

set fires within the apartment. >> reporter: firefighters were checking things out. that is the time police decided to take out the gunman. a san francisco police officer killed shot and killed the man. he with a wanted in the killing of a 66-year-old woman up in rohnert park. she died as a result of blunt force trauma. her car was missing and as far as we know still is but possibly police have found it. we hope to get an answer to the man's identity who was a suspect up in the killing in rohnert park and opened fire on police here in san francisco. >> eric: santa clara fire investigators say they will scour the scene of a fire in santa clara to figure out how i started. it destroyed three large

townhomes. this is home video of the fire that had flames shooting hundred feet into the air. it started around 10:00 last night at a residential complex in santa clara. about 50 firefighters battled the flames and took them about an hour to get it under control. they were fortunate there wasn't any wind last night and helped keep the flames from spreading from nearby homes. no reports of any injuries. >> an announcement that he supports same-sex marriage, president obama is coming to southern california for a fund-raiser. >> george clooney is hosting it. katie is here with more and a big announcement and a big fund-raiser. >> exactly. biggest of announcements. the president has now become the first sitting president to publicly endorse same-sex marriage. he certainly will find allies at a fund-raiser tonight. not everyone is on board. some are denouncing his new

stand which he revealed in an interview. some analysts say president obama will lose some voters over this and mitt romney addressed the issue quickly saying he is still believes marriage is between only a man and a woman. does any of this matter? the federal government doesn't have stand to go legalize same-sex marriage. >> so this president is not being worked out on the state level, 30th state to enact a ban. >> what i'm saying is different states are coming to different conclusions. i think it's important to recognize that folks who feel very strongly that marriage should be defined narrowly between a man and woman. many of them are not coming at it from a mean-spirited perspective. >> he went on that like pastors.

it took places at the house in castro valley early tuesday morning. deputies say they found many dangerous items inside the house and they arrested the parents. animal control officers provided pictures of pit bull and german sheppard mix that attacked the child. boy's father is being held at the jail in lieu $100,000 bond. >> in a few hours san rafael team included a chef's car and charged in a mill valley drive-by shooting last month is expected to be in court to enter a plea. two weeks ago max wade was charged as an adult for the crime. his hearing was delayed until today so his attorney could go over documents. wade is being held at juvenile hall on $2 million bail. >> teachers in the san francisco unified school district are set

there has been another attack by a patient at napa state hospital. a psychiatric technician was seriously injured. vic lee was the first to report on the incident. it happened in a unit that houses patients that were committed by their families. patient has been arrested. injured technician is recovering from injuries that required surgery. lawyers for johannes mehserle is asking a san francisco appeals court to overturn his conviction. they found had him guilty for voluntary manslaughter for shooting oscar grant. he was an unarmed passenger. mehserle has contended that the shooting was accidental. he claims he thought he had drawn his taser and not his gun. in a court filing, his attorney called a tragic and horrible error but did not act with the

level of recklessness that defines manslaughter. he is pursuing an appeal because he can't get another law enforcement job with a conviction on his record. >> they planned free rides for low income families may be in jeopardy now that the commission is considering similar proposals from other tran agencies. last month muni officials approved a travel program for free rides for low income riders under 18. the santa clara valley transportation authority also wants $4.5 million to give free passes to low income adults and transit is looking into the proposal. they are voting to release those funds. >> new unemployment numbers have come out. facebook plans to start a new app. >> an effort to recall oakland
