around the perimeter. by occupy standards this was quiet. the occupy farmers are upset now they are losing the crops they've planted and cared for over the past three weeks. they say the police action was not necessary. the university disagrees. police in riot gear stand guard around 6:30 this morning. >> i saw about 80 to 100 cops in riot gear to try to disband what we had disbanded. we voluntarily disbanded saturday >> reporter: that is not entirely true. some members chose to stay and face the consequences. >> there were 10 sleeping on the property. two decided not to leave and were arrested. >> reporter: another seven were realized outside of the gates after police declare add unlawful assembly. uc berkeley uses the land for research. a university spokesman says

that research needs to resume this week. the occupy farmers and university could have shared the land but there were ground rules. >> all they needed to do was leave voluntarily they refused. they continued to sleep here last night. they insisted they would retain control and supervision of our property. that is impossible to do good science when you have a few dozen unwelcomed, untrained guests roaming around an open air lab. >> reporter: one occupier says it is not the camp they are fighting for it is the food they planted. >> encampment has never been part of our long term strategy the own reason it is here is because of things like this like that we -- we want to be able to access our crops. >> reporter: access is now denied. within protester jumped the fence -- one protester jumped the fence trying to water crops. he was egged on. >> water! water! >> reporter: and chased away by police. what is next is the big

question. the university says it is meeting with urban agriculture experts and they will try to preserve as many crops on the land as possible as long as it doesn't interfere with research. the occupyers for their part have not yet decided on their next move. -- katie marzullo, abc7 news. governor brown just unveiled his revised state budget, because the deficit is billions more than anticipated. the governor wants to increase spending on education. eric thomas is live in the newsroom with how he plans to do it. >> with the tax increases he has proposed for the november ballot, 3% income tax hike for the wealthiest californians overseven years and a quarter percent hike for four years for rest of us. if it passes the governor wants to raise k-12 spending. there are cuts, painful, 5% cuts to state workers, the state court was lose 300 million dollars which would postpone construction of new

happened last night. police have a previous contact with the suspect who was shot in -- amy hollyfield is in napa with the new developments. >> reporter: i just spoke with the captain at the sheriff's office. she told me they've arrested this man before. he is 25-years-old and he was shot in the face overnight by a napa police officer. the sheriff's office is now the lead agency on this investigation and deputies got the call after midnight that a police officer had fired his gun. they responded and found a man they were familiar with. >> i do know we've had contact with the past, the last time being november of 2011. >> reporter: what was that call about? >> a deputy contacted him and wound up arresting him for drug possession. >> reporter: she said he was arrested for possession of methamphetamine that charge was dropped. they put an immigration hold

on him. they've not released his name. she doesn't know where he was originally from. the man is now in a medically induced coma, he's expected to survive. as for why police were called in the first place and why police shot the man? the sheriff's office isn't saying. the captain says they are still working on answering those questions. they have nothing to indicate the suspect shot at the officer. the officer has been placed on paid leave which is standard procedure. amy hollyfield, abc7 news. president obama like we've never seen before. we'll show you how "newsweek" magazine depicted him after he came out in support of same-sex marriage. thousands of fans are watching stage two of the amgen tour of california, now underway. we'll go live to the starting line, next.

racing. here's how it looked a few moments ago from in spot as all those bicyclists from 16 teams, 128 riders from 22 countries, set off on a 117 mile journey. you can see them going through the presidio. they will see the bridge, angel island, south on highway 1 through daly city and pacifica to devils slide. then they turn inland to the scenic bonnie dunes in san mateo county. then they finish in santa cruz county. they estimate they will finish at 3:50 p.m., approximately. that's a good estimate. these bikes average 28 miles an hour. not an ounce of fat on any of those bike riders. back live now where we have other people who do have a few ounces of fat on them. but after seeing these bike riders takeoff i'm sure they will inspire go on diets, eat
