off a highway 92 overpass on the way to the san mateo bridge claiming he was carjacked and had to get away. it happened around 2:00 this morning he fell into the bushes 30 feet below and called 911 one for help. the fire department put him on a stretcher and -- and hoisted him up from the embank. . police have a few questions for the man about his carjacking story >> developing news in san jose overnight shooting has turned into a homicide investigation. amy hollyfield is live at the scene to show us what happened. >> reporter: one of the victims just died a few hours ago 3:00 this morning now police have a murder investigation on their hands and they are still out here even though this happened 8:20 last night police say now that the sun is coming up they want to take a better look and make sure they found all of the evidence. they tell us two men were attacked on walnut woods drive in san jose last night.

one was shot and the other was beaten. the one who was shot died around 3:00 this morning he was 18-years-old. police have not released his name. the man who was beaten has been taken to the hospital. officers here at the scene don't know his condition. police haven't found a gun and they don't know what was used to beat the other victim. they also don't know the motive and no arrests have been may. detectives just left here. they -- they are head back to the station to work on the case some police officers are going to stay out here and make hurt they've found all of the evidence. amy hollyfield, abc7 news. 6:03. bay area protesters planning to greet former british prime minister tony blair this evening at stanford when he speaks at he's scheduled to talk about critical issues surrounding development on the african continent protesters say they will call attention to his par in the iraq war.

welcome back. 6:12. in north carolina closing arguments set to begin in morning in the corruption trial of john edwards the defense rested yesterday without calling edwards his daughter or his mistress. edwards is accused of authorizing more than one million dollars in secret payments to hide his then pregnant mistress during the 2008 campaign. the defense acknowledged edwards' improper behavior but maintain he broke no laws. what can ruin your day more easily than anything else? >> getting a speeding ticket.

the violation where the boy copied a classmate's homework and was booted from this advanced english class, a violation of the honesty which he signed with his mom. his dad says his due process rights was violated. he's suing the superintendent and principal for reinstatement immediately he says the rules are vague and contradictory but does not dispute his son cheated. one document says cheating is gunned grounds for immediate removal the boy and his mom signed that. a second document says a student will be removed only after a second plagiarism offense. the superintendent says that is an old two strikes policy was not part of the signed pledge. the father says this is going to jeopardize his son's academic future he wants an order that the son can go back into class. the school year ends june 8th.
