the golden gate bridge getting ready for the big celebration sunday d not drive traffic is going to be a mess big fireworks show 9:30 monday evening ferry or bart coming from the east bay into san francisco be forewarned all kinds of activities while update you in a couple of minutes.2'f this afternoon, the man accused of kidnapping and murdering 15-year-old sierra lamar will make his first court appearance. amy hollyfield is live in san jose with the latest. >> reporter: prosecutors are expected to share more information about their case, the evidence today and why they believe the man held here in this jail is the killer. 21-year-old antolin garcia-torres will be arraigned on kidnapping and murder charges today. investigators say they found his dna on sierra lamar's clothing and that they found her dna in his car. police have not found her

body. her parents now want the suspect to help them. >> i just pray that he release information to help our search in finding sierra. >> we want some of the information to help us. if we don't get it, we are not going to stop we are going to continue with what we are doing and find her. >> reporter: they got help yesterday with that effort. 200 volunteers joined sierra's family to look for her and they say, they will keep looking until she is found. the sheriff says sierra did not know her killer and this was a stranger abduction. police say no murder weapon was found and they don't have the motive. garcia-torres' mother and sister say, they cannot believe he would have done this they believe that he is innocent. his father is also in this jail. he is accused of sexual abuse. amy hollyfield, abc7 news. coming up on 6:03.

president obama is waking up in san jose he will be attending a business round table this morning. after touching down last night he went to the atherton home of doug goldman where he took in more than $38,000 per guest. after that fox theater in redwood city he spoke to more than 1,000 supporters who paid up to $7500 to see and hear him speak. san francisco's suspended sheriff ross mirkarimi and his wife eliana lopez are firing back at city officials who are trying to remove him from office. they have both given interviews only to the abc7 news i-team. here's part two of dan noyes' report. >> when i met her in her hometown of venezuela saturday she told me leaving san francisco and the spotlight of the domestic violence scandal was like having a huge weight lifted

off her shoulders. a lot of people think you are not coming back. >> i think san francisco has never been nice with me >> reporter: eliana struggled as a new mother, workaholic husband, ross mirkarimi who became sheriff this year. she longed for her hometown and the security of her family. the tensions bubbled over new year's eve, ross cut short a drive to get pizza, because of an argument. >> i grabbed her arm. i caused a bruise. i will always regret that and always will be sorry for that >> the moment i said stop, he immediately apologized and he realized that was wrong and then i said, we were talking and i said we need therapy, we need help. >> reporter: before the couple could go for counseling the scandal exploded. eliana says her big mistake was trusting her neighbor ivory madison with the story.

whose idea was it to make the video? >> her idea. >> reporter: through an attorney madison says eliana never asked for it to remain confidential. madison called police and turned over the video showing a bruise on eliana's arm in response to a search warrant. >> when the police called me, they asked me, are you afraid? of course no. i am here making lunch for theo. i'm not afraid of anything. actually, if i want to go, i can go. if i want to call the police, i will call the police. >> reporter: still prosecutors charge murangira with domestic violence battery he -- charge mirkarimi with domestic violence violence battery and he pled down the mayor suspended mirkarimi without pay and asked the commission to fire him. mirkarimi is praeping his defense. >> with that conviction for a low level misdemeanor that does not at all inhibit me from being i think effective sheriff.

>> reporter: ross and eliana are also dealing with the remnant of the criminal case. the judge imposed a restaining order that neither wanted. >> is it painful? yes. but i want them to be happy. >> reporter: eliana and their 3-year-old son theo in caracas but he misses ross and cries for him often. >> last night he says, what day i'm -- one day i'm going to open the door and daddy is going to be there >> reporter: when the scandal first broke and the judge had not yet allowed nation for ross and little theo his mom says the boy broke out in a rash. >> i run to the hospital and i called the doctor and they told me this is allergy and this is an emotional thing for him. >> reporter: he an -- emotional thing because of the separation? >> i think so. it is why i to the family court to ask theo needs to see

his dad. >> reporter: now, theo has daily visits from his dad by skype. >> daddy. >> it is my lifeline. i regulate my whole day in anticipation of having that contact with our son with theo. >> reporter: the family is bracing for the next blow. mayor ed lee is pressing the d.a. to release the bruise video to the ethics commission and the public. eliana can't imagine it being on the internet. >> really right to release the video? don't think my son or my career, my life, my family. looks like it is right for them. >> reporter: eliana tells me she can't think about repairing her marriage until the ethics commission plays

etan patz. he was the first child whose image was put on a milk carton. katie marzullo with the latest. >> reporter: "the new york times" reporting the man in police custody is pedro hernandez. he owned a store in the soho neighborhood, the same neighborhood where 6-year-old etan patz disappeared in 1979. police took hernandez into custody at his new jersey home last they say he's implicated himself in the death of the boy. they are not calling him a suspect yet. "the new york times" says investigators have focused on hernandez as a suspect in the past in april investigators dug up a manhattan basement as part of renewed interest in the case they found no human remains and little forensic evidence not clear how that is related to this new development. we are also learning more details, more gruesome details in this alleged confession that coming up in 20 minutes. what's your name?

patient confession from the man who is in custody this morning in the disappearance of a 6-year-old new york city boy 33 years ago the first child to be pictured on a milk carton. >> reporter: this is from the "new york post", the man in custody pedro hernandez told investigators he lured the boy candy and stabbed him and then disposed of the body in plastic bags. police took hernandez into custody at his home in new jersey last night. the police commissioner said hernandez implicated himself in the death of the boy. one law enforcement official tells "the new york times" prosecutors and investigators were treating the man's admissions as a serious lead in 6-year-old etan patz. they have to verify the information he's giving. "the new york times" says investigators have focused on hernandez as a suspect in the past. he owned a convenience store in the soho neighborhood, the same neighborhood where etan

disappeared in 1979. in april investigators dug up a basement they found no human remains and very little forensic evidence there. there was a janitor, superintendent, who was a person of interest related to that location. his attorney is telling the "new york post" this morning his client was never involved and he does not believe his client knows pedro hernandez. the police commissioner will release more information later today. also new, for the first governor brown's disapproval rate something higher than his approval rating among likely voters in a major poll. according to the poll, 43% disapprove of the job that governor brown is doing. 42% approve. last month his rating was 47%. the dip after his announcement last week that the state deficit has by 60%. the poll shows 56% of voters
