it gets. good morning. thursday, just about 4:31 a.m. thanks for joining us. you may not want to thank us after you hear the traffic news. i'm eric thomas. and i'm kristen sze. two issues. one in cupertino and one in oakland. we start with the cupertino one. >> that's where terry mcsweeney is. 280/85 connector ramp cement truck is overturned. >> reporter: he was coming down southbound 280 took the 85 connector that is how it ended up. hard to see from this distance. we have good video. take a look at pictures of what this truck like. it was a trailer pulling two loads of dry concrete you have seen them in the mixers the wet concrete it looks very same but it is dry concrete, good news. also good news that it doesn't seem to have compromised the concrete. the powder does not seem to be

coming out of this week. the only thing coming out of this vehicle eight to nine gallons of engine oil. there's crews on the scene throwing sand, throwing chemicals on top of that to try to absorb the oil as it comes down the off-ramp. talking to the ch about how long this is going to be closed. they are -- saying hour maybe two but don't quote me. right now it looks good because the contain there's came off the back of this semi don't seem to have broken open. they haven't gotten it righted, but they think they will have this open in an hour or two. again quote me on that is what the chp officer says. they have to take a better look. nobody injured the driver says he wasn't speeding. terry mcsweeney, abc7 news. we've got another big problem, breaking news in oakland. firefighters trying to get

spilled diesel cleaned up after a postal service big rig crashed on i-880 overnight. amy hollyfield is at high street with the latest. >> reporter: we are northbound i-880 at high street. there's the truck behind me. they've uprighted it. they are getting close to hauling it out. look at the highway, one lane is still shutdown. traffic is moving okay. it is not causing major problems. it is still early, they are hoping to get it cleared before it will cause any big problems. this accident happened at 1:30 this morning. first they did close two lanes for half an hour then they were able to get one lane open. this truck is not on the highway he's on the shoulder this is an area that has been under construction refurbishing this shoulder. it is hard to see -- understand what happened whether he got confused he did go over the concrete barrier

wall here to protect the construction zone. chp officers are still trying to figure out what happened. they are looking into the possibility that maybe some other cars were involved. >> as far as we can tell, it was a single vehicle collision into the wall. because we haven't been able to contact witnesses that phoned in, we can't rule anything out. >> reporter: here's a shot of the driver. you can see he is okay. his wife came here to pick him up. he didn't want to comment on what happened. the scene right now, they are mopping up all of the kitty litter they put out to absorb the fuel. they don't know how much fuel spilled they say it wasn't too much. they are hoping to get that lane on the highway open within the hour. it looks like they are close. looks like they are about to get the big rig out. stay with us we'll keep you

child pornography charges. police arrested 50-year-old johnny urias yesterday. he faces charges of possessing and manufacturing child pornography. he taught first and second grade students at will rogers elementary. he was placed on leave last august after police launched their investigation. school officials say investigators told them there is no indication any students in the district were victims. the 21-year-old man accused of killing sierra lamar is expected to enter a plea. antolin garcia-torres first appeared before a judge a week ago. investigators believe garcia-torres took the 15-year-old girl from near her morgan hill home on march 16th. they say lamar's dna was found in his car and his dna was on her clothing found in a discarded backpack. crews were out again yesterday looking for her. prosecutors filed murder charges against garcia-torres despite the fact that her body has not been found.

preliminary hearing continues for the two men accused in the savage beating of brian stow on opening day at dodger stadium last year. yesterday one woman testified that louie sanchez appeared ready to fight at the game he cursed at giants' fans near him, threw peanuts and spray soda on another couple. prosecutors played what they called a confession by the second suspect videotaped while police were investigating marvin norwood he was allowed to call his mother on a detective's phone. >> i got arrested for that dodger stadium thing. not much i can say over the phone. i was involved. >> defense attorneys argue that norwood and co-defendant sanchez might have been involved in an incident after the game but not necessarily the attack on stow. stow remains in rehab recover from a traumatic brain injury. mitt romney is waking up in the south bay this morning

forecast because the stock price will continue to fluctuate. this morning san francisco mayor lee will unveil a two year budget plan including money to hire more than 300 new police officers. the mayor also wants to hire more than 250 new firefighters over the next six years. lee wants to increase loans to small businesses and create new business corridors. the proposal will reveal how he plans to close the projected 170 million dollar budget gap. the board of supervisors will take up the budget next month. privately owned dragon spacecraft is detached from the international space station and preparing for a ride back to earth. the it delivered half a ton of cargo to the space station seven days ago the first private mission ever to the station. spacex is headed by elon musk chairman of tesla. the reusable dragon capsule is expected to splash down in the

camera. we have a couple of problems out there we are keeping track of both situations we'll tell you how it will affect your compute in a couple of minutes. cuts to the san jose fire department are being blamed for hampering the battle against a ferocious fire that destroyed one home and damaged another in the berryessa neighborhood. video shows flames and heavy smoke from the roof of this two story house yesterday afternoon. sky 7 was on the scene as firefighters had to get off the roof because it was about to collapse. flames spread to a neighboring home and caused some roof damage. fire officials say staffing for a second engine at the station that serves the neighborhood was not available because of cost cutting brown-outs. the arriving crew had to set up its own water supply which is usually handled by a second engine. no one was injured thanks to the heroic actions of a neighbor who an lefted the person in the house. new this morning, it --

appears the san rafael and larkburg fire departments are heading for a merger. the managers have signed a contract calling for fire chiefs of both dreamts to work together to create a shared fire service area both cities had to cut funding over the past few years because of shrinking tax dollars. big donation putting oakland's police helicopter back in service. the chopper flew over a tense standoff with a probably suspect. the chopper held officers watch for any signs the man was trying to escape. police arrested him. the department hasn't used the helicopter fulltime since 2009 because of budget cuts. now it has received a $10,000 donation from a non-profit consumer alliance. that will buy enough fuel for 80 hours of flight time. americans are kidnapped in egypt. that story is next. move to save state parks from closure gets a big boost
