good thursday morning. i'm kristen sze. i'm eric thomas. we begin with breaking news in cupertino. terry mcsweeney is live at the 280/85 connect oar with latest on efforts to move anover turned cement truck. -- >> reporter: it is about 80,000 pounds worth of a project. you can see the calvary has arrived. two huge tow trucks are here they are getting ready to wrap

chains around the tractor and two trailers carrying the powder cement. take a look at pictures from closer up we shot a short time ago pacific this morning. again, tractor carrying -- pulling two trailers of powder cement, took this turn and it is a very sharp turn and over goes the truck, the driver telling photographer ian babcock he was not going too fast he's not sure what happened. chp says the back trailer went and the rest followed. they are going to wrap it up try to straighten it up and have this cleared in maybe an hour and a half from now. here's what the chp says is the plan. the dried concrete in the trailers the trailers are not breached or cracked open at this time. hopefully, it remains that way. >> reporter: what do you have leaking and how bad is it? >> only 5 10 gallons of motor oil leaking out of the engine no diesel fuel leaking.

everything else is intact. >> reporter: there's good news. the fuel of this truck is not leaking at this point. as we heard the powder cement in the trailers not liking. they've they got to right these things and get them off the road hopefully the powder will not start coming out or problem with the tpwaoul -- with the fuel in the truck itself. 85 off-ramp of 280 southbound closed until an hour and a half perhaps if everything goes as scheduled we'll keep you posted. terry mcsweeney, abc7 news. meantime better news in oakland. after a postal service big rig crashed overnight amy hollyfield is live near 880 at high street. lanes have been blocked are they open now? >> reporter: they are open now. we have good news to report. believe it or not, the truck is still here, check it out,

turns out it is quite an ordeal to haul a big rig truck out of here. they are taking a lot of time on this fortunately, they were able to open all lanes of northbound 880 here at high street. this won't impact you. ti'/xuá the hope is that you wil keep your eyes on the road and traffic will keep moving without problems. this is high street northbound 880. this happened inside a cement wall construction zone on the shoulder. they were doing refurbishing work that's the good news. the truck is not blocking lanes and that's why they were able to open the highway this accident happened about 1:30 the truck went over the wall they are trying to piece together why? >> as far as we can tell right now, it was a single vehicle collision into the wall. because we haven't been able to contact witnesses that phoned in, we can't rule anything out. >> reporter: you are looking at a shot of the driver of that trouble. he is okay, as you can see his

wife came to pick him up. he did not want to comment on what happened. he was hauling mail, u.s. mail, it is all intact, fine, no word on whether it will be delayed getting to its destination but it will arrive, everything is okay, it didn't spill. the truck did spill a little fuel they don't know how much they feel like they got it all cleaned up. now the big issue is hauling that truck out. again, traffic is okay through here. but, we want to turnover to our traffic expert sue hall to help you -- guide you through this crazy morning. good morning. i guess the big concern now is rubberneckers at this point with the big rig still there hanging on to that wall out of lanes we don't have traffic delays through the scene now hopefully they will get that out of there. expect slowing when traffic stars to pick up, thanks to rubberneckers. cupertino now -- terry mcsweeney was on the scene we

still have that closure highway 85, alternate around let as look at waze app, foothill to stevens creek boulevard to highway 85. terry reporting that should be open in an hour and a half. 5:05. in san ramon police searching for three suspects in an armed robbery attempt at a jewelry store. investigators say a fourth suspect was shot and killed by the store's owner. authorities say the four armed men tried to rob gold n treasures on san ramon valley boulevard yesterday afternoon one was shot in the store. witnesses say they saw one collapse in the middle of the cross back after being shot he later died at a hospital. the others were able to get away police believe they were driving a white four-door 90s -- 90s sedan. we should find out more about what happened when brian stow was savagely at the dodgers' home opener last year.

katie marzullo is in the breaking news center with more. >> reporter: best i can tell from everything i've read this morning, what we should learn today in court is that prosecutors plan to layout the details exactly what happened during that beating in the parking lot of dodger stadium. yesterday, a bombshell in core, prosecutors played a recorded cell phone conversation between defendant marvin nor wood and his mother during the call norwood confessed to some involvement. >> i got arrested for that dodger stadium thing, so not much i can say over the phone but i was involved. >> reporter: prosecutors are looking to connect norwood to the attack. authorities believe the other defendant louie sanchez was the aggressor. people sitting near them testified that the two were aggressive throughout the game. they said sanchez was throwing peanuts and swearing at

giants' fans at one point he sprayed soda over a man and woman in another row that man said he almost fought with sanchez in the stands but they were pulled apart. brian stow, father and paramedic, was punched so hard in the parking lot that he fell and his head slammed against the pavement. as you know he's been in the hospital with a traumatic brain injury ever since, which is more than a year. norwood and sanchez face charges of mayhem, assault and battery and inflicting great bodily injury. the judge will decide if the case goes to trial, the hearing is expected to last four days. protesters cleared from a 10 acre plot of uc owned land in albany vowed to be in court this morning when university officials argue for a lawsuit banning them from occupying that land again 100 uc police officers moved in and cleared the in albany more than two weeks ago. some of the protesters had been living and planting crops

on the property since mid april. uc uses the land for research. protesters want the land uses for sustainable agriculture. new poll finds state voters are in favor of a proposed one dollar a pack tax increase on cigarettes. prop 29 is on next tuesday's ballot. the poll shows 62% of voters are in favor of the tobacco tax with 33% opposed. the analyst office says 850 million dollars would be raised each year to fund cancer research and help law enforcement fight illegal cigarette sales. san francisco district officials rescinding half of the lay-off notice they say announced officials hope the move will show good faith as they continue contract negotiations with the teacher's union under the oversight of a mediator. the district notices to 218. officials say they are rescinding layoffs of 97

joining us i'm kristen sze. i'm eric thomas. we are following breaking news out of cupertino. terry mcsweeney is live at the connector ramp where that truck is overturned. what is the latest on efforts to remove it? >> reporter: they are making progress. in the last few minutes you can see back there the cables coming down from the tow truck wrapped around the overturned dry concrete trailer. there's two of 'em down they've got one and you can see maybe you can see they are moving it a bit lifting it up according to the chp nothing is coming out of that dry cement container. as we look to the right i want to show you maybe the saddest man in the south bay right now that is the driver of this truck that went over at 3:00 this morning. take a look at tight shots of the situation a little bit allege. trailers on their side,

if all goes well. so far, so good. we'll keep you posted. terry mcsweeney, abc7 news. also developing news in the south bay. san jose elementary schoolteacher is in jail this morning facing child porn charges. place arrested 50-year-old johnny urias yesterday at his home in san jose he faces charges of possessing and -- and manufacturing child pornography he taught first and second grade at will rogers elementary he was placed on leave last august after police launched an investigation. district officials say investigators told them there is no indication any students in the district were victims. this afternoon the man accused of killing sierra lamar is pecked to enter a lee when he returns to court -- is expected to enter a plea when he returns to court. he appeared before a judge a week ago. investigators believe garcia-torres took the girl from near her home march 16th. they say lamar's dna was found

inside his car and his dna was on her clothing found in a discarded backpack. search crews in morgan hill were out again yesterday looking for her. prosecutors have filed murder charges against garcia-torres, despite the fact that sierra lamar sire's body has -- sierra's body has not been found. mitt romney will attend a gathering on the peninsula this morning before leaving the bay area. it will be with a small group at a silicon valley location. last night romney tended a dinner at the sprawling carolyn chateau hosted by charles bartlett johnson and his wife. romney's arrival brought out protesters organized bye-bye area democratic officials they criticized romney and his big money supporters. the bay area is fertile ground for fundraising with president obama collecting millions for his campaign war chest last week. state officials say tax revenue from facebook could be

hundreds of millions less than expected. facebook shares have nosedived since the stock public two weeks ago. the department of finance estimated the sale of stock would bring in 1 1/2 billion dollars. facebook closed at just above $28 a share yesterday down a quarter of its value from initial offering at $38. the "los angeles times" reports the brown administration does not intend to redo its revenue forecast because the price will continue to fluctuate. police continue to hunt for the gunman who shot an oakland high school student the 18-year-old was among a group of students hanging out afterschool at park and mcarthur. a plan of man in dreadlocks opened fire on them hitting the victim in the leg. a spokesman said the victim was the intended target police have not revealed a motive the teen is recovering. it is the third gun-related incident at oakland high this year. contra costa county deputy d.a. accused of assaulting a

colleague is fighting back. prosecutors initially charged him with 13 criminal counts, including rape after the 2008 incident. a judge dismissed the case in october. he is suing the state, the county and the city of martinez. he claims the charges were politically might ed. he was fired but reinstated -- after the case was dismissed. currently he's on a leave. this morning san francisco mayor lee will unveil a new two year budget plan the plan will include money to hire more than 300 new police officers. the mayor wants to hire more than 250 new firefighters over the next six years. he wants to increase loans to small businesses and create new business corridors. the budget proposal will reveal how the mayor plans to close a 170 million dollar budget gap. the board of supervisors will take up the budget next month. privately owned dragon spacecraft is now detached from the international space station and getting ready for a bumpy ride back to earth.

welcome back. cuts to the san jose fire department are being blamed for hampering a battle against a fire that destroyed one home and damaged another in berryessa neighborhood. video from a shows flames and heavy smoke from the roof of the two story house yesterday afternoon. sky 7 was on the scene as firefighters had to get off the roof because it was about to collapse. the flames spread to a neighboring home and caused roof damage there. fire officials say staffing for a second engine was not available because of cost cutting brown-outs. the arriving crew had to set up its own water supply usually handled by a second engine. no one was hurt, thanks to the heroic actions of a neighbor who alerted a person in the house that it was on fire. the san rafael and larkspur fire departments

appear to be heading towards consolidation. the city managers of san rafael and larkspur have signed a contract which calls for the fire chiefs of both departments to create a shared fire service area. both cities have had to cut fire department funding over the past several years because of shrinking tax revenues. big donation putting the oakland police helicopter back into service. the chopper flew over a tense standoff with a home invasion robbery suspect yesterday. the chopper helped officers watch for any signs the man was trying to escape. police arrested him. the department hasn't used the helicopter fulltime since 2009 because of budget cuts. now it received a $10,000 donation from a non-profit alliance that will buy enough fuel for 80 hours of flight time. big shift in the real estate market. bloomberg business report coming up. move to save state parks

nearly 10,000 accidents could be prevented each year if tougher traffic laws and licensing standards are enacted for teenaged drivers. nhtsa says, states need to implement five parts of the strongest laws for young drivers that are used in some states to see the best results. those are: minimum license age of 17. minimum permit answer of 16. at least 65 supervised practice hours. night driving restriction that starts at 8 p.m.. a ban on teen passengers. a bill that would create new funding sources for california's state parks is now headed to the senate. the bipartisan bill passed on a unanimous 74-0 vote. it requires the state parks department to modernize fee collection process and it would allow californians to donate to parks by buying special license plates the measure is one of several moving through the legislature aimed at saving most of the 70 parks slated to close because
