this case could phone shallly take years, specialsly if the district attorney intends to pursue the death penalty. garcia-torres did not enter a plea when asked if he would waive his leel right to a speedy trial. prosecutors charged him with one count of murder in the disappearance of sierra lamar. police say they have evidence garcia-torres is responsible the assault of a woman in 2009. >> that has been completed and sent to the district attorney for viewing. >> experts say that could play a key role in how the case looms forward. >> this charge may try to get him convicted of that. that could bolster the case if there is a pattern of the

behavior. >> investigators found his dna in garcia-torres's red jetta. despite 10 weeks of searches, there has been no sign of the missing teenager. and her family is not ready to kus the accused killer in court. >> this is too emotional, still, we're going to be at some point in the future. >> police say they're reviewing open cases dating back five years. >> we're seeing if there are any evidence or similarities that could tie him to those as well. >> there is one certainty in this case. there is outpouring of support into the court house in san jose. >> my son is friends with sierra. it's more personal for me. and i think this shows support for the family. >> and so far today, the

on. >> another scare this morning in an east bay school. date after an 18-year-old was not shoth in front of the campus, staff reported seeing an adult intruder on campus about 6:30 in the morning. the staff called police but they never responded. an hour later the school district police officers reported to work a peace officer investigated. school officials want to know why oakland police ignored the call for help. >> make sure that they understand our limitations and what hours they work. and to be atentive given the time of the year. >> and police told abc 7 news the department did not have any units available to respond at the school. >> republican presidential candidate mitt romney made a stop in fremont outside of the

shut-down offices of solyndra. the company went bankrupt after the year after receiving $535 million in loan guarantees from the obama administration. romney claims it benefited some of the president's campaign contributor autos if the business failedded as it did, tax payers get stuck with losing a half billion dollars, so it's his cronies win and tails, taxpayers lose. >> romney's campaign went to great lengths to conceal the appearance saying they feared solyndra or the obama administration would try to stop at peer yens. >> two time presidential candidate john edwards is free and clear tonight after the acquittal and a mistrial in this fraud trial. today they found edz wards not guilty on one count of fraud but that panel could not reach a verdict on five other charges. and prosecutors accused the

a republican plan to ban abortions based on a baby's gender has been defeated in the house of representatives. a pro life group released this video showing a texas planned parenthood employee caught helping a woman plan an abortion if her baby was a girl. today a lawmaker failed to reach a majority needed to pass the bill and would have fined and imprisoned doctors up to five years if knowingly performed a sex selection abortion. >> a morgan hill woman blaming the death of her dog on a dog tree. she's not alone in complaining. according to fda nearly a thousand pet owners complained about this product. >> and the fda became so concerned that it issued an alert. a wash -- warning about these chicken jerkies.
