joining us. >> i'm erik thomas. breaking news in hayward. several -- several law enforcement agencies are searching for a suspect near city hall. deputies and bart miss on the scene not known what the suspect is wanted for. terry mcsweeney is headed to the scene. developing news in san jose, firefighters are on the scene of a pair of suspicious fires at a high school. the fires started on the campus of evergreen valley high, 2:30 this morning. two separate fires one in a dumpster one at a campus building. pg&e is at the scene to inspect utility lines that may have been affected. school is not in session so kids will not be affected their summer break began monday. katie marzullo will have a live report coming up. 4:31. eliana lopez's attorney

threatening to sue san francisco over the release of the video that lead to domestic violence charges against her husband suspended sheriff ross mirkarimi. >> this happened yesterday. i'm going to use this just in case he wants to take theo away from me. >> the city attorney's office released the 45 second video yesterday after a judge ruled it could be used as evidence in the ethics hearings. mayor lee says the tape is a key piece of evidence as he pushes to have mirkarimi fired. mirkarimi says, he knew it was only a matter of time before his wife's video would become public. >> this is the politics of destruction, i think at its worst and they are exploiting eliana and our son in order to get to me. >> the video was made new year's eve day by the couple's neighbor ivory madison. she made the call to police that led to the domestic violence charges against mirkarimi. he pleaded guilty to

misdemeanor false imprisonment. the commission is scheduled to take up the case june 19th. we posted the video on the front page of our website. go to abc7news.com. right now police investigating a double shooting in north oakland it happened before 9:30 last night. they drove themselves to children's hospital and reported to be in stable condition. police are not releasing the identities of the victims, no word on motive. any suspects or details we have not heard about we will buy you the information as it becomes available. federal judge ordering an investigation into how oakland police investigate officer-involved shootings. he threatened the department with sanctions if misconduct is uncovered. the judge oakland a deadline of june 8th, to provide additional information showing how it complete internal investigations stemming from last year's occupy protests.

the judge warned we of he was still considering proceedings to place the department federal control. >> the preliminary hearing of two accused of beating brian stow resumes in los angeles. two of stow's friends will testify. the suspects marvin norwood and louie sanchez are accused of beating stow in the parking hot on opening day last year. yesterday a witness testified she saw a man matching the description of one of the defendants taunting fans and punching a teenaged boy. she also says she saw two men run after four giants' fans. she didn't see a confrontation she saw the two come running back jump into a car and tell a female driver to leave. >> they were out of breath. one of them had his jersey in his hand. and they were saying drive, drive, drive! >> two other witnesses say they saw stow being beaten none could positively identify

norwood or sanchez as the attackers. update to amazing story of survival. we told you two weeks ago a 25-year-old san jose man lost in the brush along highway 101 for a week is awake and alert. michael sanchez, jr. was badly injured when his truck veered off the off-ramp may 8th. highway patrol searched but found nothing. they went back seven days later after his family filed a missing persons report. searchers discovered him 50 feet from where his truck ended up. he is was in a coma and near death. his family says he can't talk yet. when he does they say one of the first questions they will ask is how he survived. an hour from now the labor department will release the may jobs report. they estimate employers only added 158,000 jobs last month. experts predict the unemployment rate will remain

at 8.5% nationally. california's unemployment rate was 11% in april. we'll bring you the latest report when the new figures are released this morning. state lawmakers hit with a pay cut. the board that determines salaries of top law make trimming the pay of statewide elected officials by 5%. the same amount state workers will lose under the governor's proposed budget. members of the legislature will see salaries drop to $90,000 a year that doesn't include that $142 per diem. the governor's salary will go from $174 to $165,000 a year. mike says the heat-up continues the line goes like this until the rain gets here. >> especially for those inland. for those of us close to the coast, a little cooling.

>> nearly 1,000 pet owners have complained to the fda. the agency put out an advisory warning that dogs that ate the treats have shown a condition that causes electrolytes to leak out of the body. the company maintains the fda and other organizations have found no connection between the illness and its treats. state senate has unanimously passed a measure making it easier to challenge tickets triggered by red light cameras. establishes standards for installation and operation of cameras. drivers often challenge tickets issued by them questioning accuracy. the measure was sponsored by palo alto democrat who says it will establish standardized ground rules and make sure that drivers' rights are protected. big shock for students in bakersfield. a bear strolling across campus as graduation ceremonies were getting underway yesterday the graduation was not affected.
