at a high school. katie marzullo is live at evergreen high with the latest. >> reporter: i'm just on the scene so i'm going to turn it over to the fire captain he can fill us in on everything. good morning, thank you. let's start with the time, when you got here what you saw? >> 2:36 our dispatch received a call the alarm company. we sent a normal response when the fire crews got here they found there was alarm coming from the library area. upon further investigation they found two separate fires in the rear of the school. >> reporter: two where and how were they burning what were they burning? >> one dumpster on fire and one fire endangering the school up against the building. >> reporter: what kind of damage was done? >> minor to moderate. the library stuff was not affected the fire did not get inside only exterior damage. >> reporter: there is exterior damage to the wall of the

library? >> correct. >> reporter: where do we go from here? you say it is suspicious. >> it is. investigator on scene there are tapes around so the investigator will be reviewing those tapes. >> reporter: the school is in or out for the summer? >> from what i've been told the school had graduation last friday. there's no plan for summer school. >> reporter: does this give you the feeling of maybe a student prank or vandalism? >> i don't want to comment on that, it is suspicious. speculation is what it is >> reporter: captain thank you so much for joining us. that is the latest from evergreen valley high in san jose. we will be checking back in with you when more information becomes available. this morning the attorney representing the wife of suspended sheriff ross mirkarimi is threatening to sue the city of san francisco over the release of the video that lead to domestic violence

implement several anti-bullying measures following a heated discussion with parents who say they don't go far enough. the school acknowledges bullying is a problem and informed parents what they could do to minimize the problem. a woman's daughter was beaten by an 8th grade girl last month she was sent to the hospital with head injuries. now she is angry over the way the district handled the aftermath. >> they refused to expel her because they don't admit there's a problem so they do the normal two-day suspension. parents should have to pay for damages. when they start to put in measures like that you will get results. teachers and staff will be attending workshops over the summer. a few hours from now of schools will be in richmond for a ceremony to -- accept the -- [ unintelligible ]

[ unintelligible ] tonight friends and family of sierra lamar will hold a hope and faith rally in fremont. volunteers will be out again tomorrow morning searching the morgan hill area for any seen of the 15-year-old girl. she was last seen march 16th. yesterday the man suspected of kidnapping and killing her was in court but didn't enter a plea. he only uttered the words yes urn when asked if he understood what was happening -- yes your honor, when asked if he understand what was happening. friend of james capoot fired after e-mailing a disparaging photo that had a picture of the office with trayvon martin's face photo shopped over capoot's picture.

he e-mailed the picture to a pro law enforcement website seeking advice on how to respond to the e-mail which upset him. the website posted it to facebook. governor brown's office launched an investigation after receiving complaints. he was placed on leave in april later informed he would be fired. alameda county judge ordering two infamous east oakland motels to shutdown for a year. police say for years they've made rests at the national lodge and economy inn in east oakland in december of 2010, the city sued to force the owners to shutdown. the judge agreed and fined the owners $45,000 each. the closures are set to begin in july. this morning it appears the justice department will not seek another trial against former senator john edwards according to a knowledgeable law enforcement official. a jury in greensboro,

north carolina yesterday found edwards not guilty on one count of accepting illegal campaign contribution but failed to reach a verdict on five other charges and the judge declared a mistrial. prosecutors accused edwards of illegally using campaign contributions to conceal the affair he had during his 2008 bid for the white house. former aide to edwards was the prosecution's key witness. analysts say the fact he admitted to taking more than a million dollars of the contributions hurt the case. the united nations human rights council set to hold a special session in new york today to discuss the deteriorating situation in syria. deadline today for the syrian government to respond to a call for government troops to withdraw after last week's massacre in houla, 99, including 30 children were killed. rebel commanders are reported to be split on whether to abandon a peace treaty brokered by kofi annan if

good morning thanks for joining us i'm kristen sze. i'm eric thomas. katie marzullo is on the scene at evergreen valley high in san jose arson investigators are looking into two suspicious fires way is the latest? >> reporter: the fire department has since left. they did say arson investigators would be here and continue to look into the fires. you can see one near us this dumpster was set on fire pretty charred still left behind here the second fire was up against the library wall. the outside wall of the library did sustain some damage the fire captain says that they confirm no damage was done inside any building. school is already out for the

summer, so nobody was here. the call came from the alarm company. the captain does say these fires are suspicious. >> the cause of the fires are still being investigated. the cause so far is undetermined. there were two separate fires and they were related, started in separate places. >> reporter: you can see inside the dumpster as well it does appear there were some books or paper inside there that burned. not clear like i mentioned, school is out not clear if teachers or administrators would be here this morning and whether or not the campus would be closed to them. this is a large campus these fires are around the back in a remote area it was a little difficult to find from the front of the school that might be playing into why these fires are suspicious why somebody would have been back here this morning. the investigation continues with the arson team out here this morning. katie marzullo, abc7 news. berkeley's mayor making a

new move to turn commercial districts more inviting by trying to ban sitting on sidewalks. terry mcsweeney is live in berkeley to explain. >> reporter: in berkeley right now there is no line down on situations -- no lying down on sidewalks -- [ unintelligible ] take a look at the man suggesting this the mayor tell -- wants voters to decide in november if the city should ban sitting on sidewalks in commercial areas like telegraph avenue. he says residents stop him all the time and tell him please do something about the numbers of people sitting there, panhandling, making it difficult to walk didn't the street. it can get crowded at times especially here on telegraph.

downright scorching hot. mike is going to sort that out in a minute. family of a man gunned down in oakland is making an emotional plea for help in finding his killer, police say 30-year-old ronnie kidd of hayward had just gotten off work and was on his way to check on his kids. someone inside a dark colored audi shot him while he was in his car at market and 7th. his family can't understand why anyone would target him. >> not into it with anybody. he didn't live that kind of lifestyle. all he did was live and breathe his wife and his kids, that's all. that's it. >> police have not determined a motive but they are looking at the possibility it was gathered by road rage. new study suggests muni buses, trains and trolley do not run on time as much as the agency claims according to the bay citizen. the paper reports analysis

where the two men work -- at station 26 where the two men worked the public is invited. a stench has been traced to a closed waste management company landfill. students at two schools were evacuated authorities thought it was a gas leak they weren't far off. waste management says the source of the chemical vapors seeped from a drum in the landfill the vapors were from an additive added to natural gas which has no odor, the additive is added to give it an odor so leaks can be detected. 14-year-old girl from san diego is the best spell nation. you can call her the queen bee after she beat out 300 to take the top prize. >> reporter: it is the two-day nail-biteing, brain-busting battle that plays out on live tv. the 14-year-old would win it
