>> in the news this morning, june 3rd, pap low sandoval denies a report he's accused of sexual assault in santa cruz. thanks for joining us. i'm carolyn tyler. let's start with a quick first look at the weather. here's our meteorologist lisa argen. >> good morning, everyone. we are starting out with partly cloudy conditions, and the winds, once again, a little breezy around the bay. temperatures are mainly in the 50s, but we have cooled off everywhere with that marine layer at about 2,000 feet. 52 oakland, 54 in san carlos

with 53 san rafael, 65 in antioch. the 24 hour change is bringing numbers down anywhere from two to six degrees cooler than yesterday. now you probably heard of the possibility of showers in the forecast. well, that still holds. but this trend, does it tell us about the week ahead? i'll let you know. we have sunshine on tap for today. yeah, some changes as soon as tomorrow. we will get this those in a little bit. carolyn. >> thank you, the santa cruz county sheriff's department is investigating san francisco giants slugger pablo sandoval after receiving a sexual assault complaint against him. sandoval's attorney said the 25-year-old world series champ voluntarily spoke with sheriffs investigators early friday morning. so far no charges have been filed. abc7 news reporter reports the investigation is ongoing. >> reporter: san francisco

giants third baseman pablo sandoval is facing a strike that could end his career. he of a woman is alleging he sexually assaulted her but the giants had a short reply to the charge. >> i know i would be asked this question, and i saw the process going on so i can talk about it. >> the deputy with the santa cruz county sheriff's department said a woman reported the assault friday morning. >> she stated that pablo sandoval was the alleged suspect. and that he was still at the resort that this alleged crime happened. >> the resort is the seascape resort near santa cruz. this is where deputies questioned sandoval. >> he wasn't detained. he wasn't arrested. he cooperated with us and came down to the share you have's department and we interviewed him with his attorney present. >> his attorney, erik given, would not talkuous on record. he released this statement. he met the sheriff's department

related to a sexual assault investigation. he fully cooperated with the sheriff's department out of respect for the process. we have no further comment at this time. the deputy said the reporting victim and him met thursday night. a small group of people met in a downtown business, downtown santa cruz that. small group of people left, went to a resort. >> where the sexual assault was reported at 4:25 friday morning. a manager told abc7 that while theling incident may have happened here, sandoval was not a registered guest. sandoval has been with the giants since 2008. he has not played a major league game since may 2nd due to a wrist injury. he has been playing with the san jose giants while recuperating. the sheriff's department said they are taking the allegationings seriously. >> although the days is being investigated," they don't know how long it will take but the results will be turned over to

the district attorney. abc7 news. news of the investigation spread quickly at last night's giants-cubs game. all of the fans we spoke with stood behind the player, also known as the panda. >> pablo has been a pillar of the community, he has been a great guy his entire time in san francisco. there's no doubt in my mind whatever has been said about him will all be cleared up. >> as a man i think he's innocent. i think it's someone probably out to get him, and be i don't believe the allegations and he's a stand-up guy. >> as a die heart fan of the san francisco giants, the support will not behinderred one bit. i will continue to support the giants and i will continue to support pablo sandoval until i see hard facts. >> sandoval could be back in the giants' line-up as early as next friday. this morning vallejo police are looking for more information about a dark colored sedan connected to a fatal shooting last night in a city park.

four people were shot from a passing car during a barbecue at crest ranch park just after 8:00. at 57-year-old man died. three others remain hospitalized this morning, including two critically injured victims, a 60-year-old woman and a boy. a 33-year-old man suffered a less severe wound to his arm. the detectives are hoping anyone with information with the shooting or the car involved about give them a call. high winds made it hard to control few fires on the peninsula yesterday. a brush fired burn about 7 acres above brisbane. flames began burning in the canopy of trees and started heading toward other homes. one firefighter was taken to the hospital for heat exhaustion.

70 firefighters worked just after 6:00 last night bringing a fire under control. at one point 60 moments lost power because of the fire. the wind whipped flames, and searching even acres. >> if the wind changed directions we were concerned the fire might extent into areas of structures in the city of brisbane. in addition to that, there was some delay in us get to go some areas of the fire because of the fact the power lines were down. >> two air tankers and a helicopter made several passes dropping fire retard dent. they suspected wind brought down power lines in the area, setting off the fire. the bay shore off-ramp was closed for a time, but there were no evacuations and no injuries. tomorrow santa clara county dive teams will resume their search of uvis reservoir looking for missing morgan hill teenager sierra lamar. it's been 11 weeks since she

disappeared while heading to school. police have arrested a man from morgan hill on suspicion of murder and kidnapping in connection with her disappears, but her family and friends have not lost hope of find hearing alive. they continue to raise money to conduct weekly searches like the one held yesterday. the santa clara county dive teams tell us they will wrap-up their search of the reservoir on tuesday. in toronto please police are searching for a a gunman who opened fired in a popular shopping fall. witnesses say the man started firing inside the food court inside the mall at toronto. many were hurt in a stampede of panicked shoppers racing for the exits. in the confusion, suspect got away. >> the suspect right now, we don't have one, a confirmed one. we have to look at the cameras. as you can appreciate, a 25-year-old man died at the scene. two people are in critical

responsible saying, quote, not even monsters would carry out such an ugly crime." his government and opposition leaders have exchanged blame for the incident that has brought worldwide condemnation. in egypt this morning relative calm has been restored in cairo hours after nearly 10,000 protesters filled a square showing their anger following the verdict in the verdict of the former president, hosni mubarak. yesterday he was given a a life sentence after the court found him guilty by association in the killings of 900 protesters during last january's uprising that toppled him from power. thousands of people protested in the streets of cairo, calling for mubarak's execution instead of that life sentence. others were outraged that six top commanders were acquitted of the same charges mubarak faced. a race for the white house heats up and so does the

>> no. june in california. >> here's meteorologist lisa argen with the full accuweather forecast. >> the marine layer with us this morning but it's not everywhere. starting out with partly cloudy conditions and you can see from our high definition emeryville camera the clouds there are intact and the paw reason layer is kind of diffuse. we have seven mile visibility at our coast. really not bad out there, but it's going to take a little time to clear to the coast. and we will look for more sunshine and temperatures pretty much where we were yesterday. but, boy, a dig change is on the way. the winds will be with us, as well. 55 in mountain view, 49 santa rosa, 514 by the delta and antioch a warm 64 degrees. comfortable around the bay with the winds pretty breezy from concord gusting to 22 miles an hour, sfo at 20, and oakland, west wind at 10 but the winds will pick up again with the

winds out of the west 10 to 20 miles an hour this afternoon. we will call it partly cloudy this morning with cooler and breezy conditions. a few high clouds around the bay today. and tomorrow we are talking about measurable rain, windy conditions, and numbers in the 60s. so we have an unseasonably strong weather system headed our way. and here it is on our satellite and radar composite. you can see hits a cold front, and you see it lined up here to the north and west of us. today it's really not going to move much. so that's why the forecast remains pretty much the same. a few higher clouds. and with those winds offshore, we will allow for a pretty good breeze at times around the bay today. but still numbers will be comfortable. in fact, we are talking about the last day of some 80s for a while around here. so this area of low pressure, the front, it slides to the south and by tomorrow morning, yeah, here's what we are looking at. this is the overnight hours. and then by your morning

commute, 7:00, it looks like we could see the chance of rain as far south as the monterey coast. and then throughout the afternoon you see we still are painted in the green. some showers, a thunderstorm, high elevation snow in the sierra nevada. so we are talking from about a tenth to a quarter inch mainly in the north bay. but still it will be cloudy, cool and breezy for most of us out there. 97 in fresno. still very summer like here in the interior. 72 in los angeles. and back home we are looking at temperatures pretty comfortable again. but you have to go far east of the day for those low to mid-80s. concord 80. 82 livermore with mid-60s here. san francisco a breezy afternoon. 73 san mateo. 72, about the same in oakland. so enjoy it today. down by the monterey bay, sunshine with 70s and santa cruz and inland we are talking in the mid-80s around gilroy. our look ahead, we have the 70s and 80s bay and inlanded to. breezy winds.

>> welcome back, everyone. new this morning, a statewide voter poll finds california voters want to sidetrack the high-speed rail project they approved just four years ago. saying the state now has higher priorities on which to spend $68 billion. today's usc los angeles times poll shows a majority of voters would like another chance to vote on the bond measure approved in 2008. the outcome of the survey may put political leaders from president obama to governor jerry brown and state lawmakers on the defense for pushing efforts to begin construction

this year. according to the poll, 55% of voters statewide would like to see the issue placed back on the ballot. if they can vote on it today, 59% say they will vote against it. well, here we go again. sacramento's budget cuts are forcing cities to put partial tacks on tuesday's ballot to fund local schools. hayward has measure g, west contra costa county meche you shall k and union center is hoping to pass measure 8. school district warn without the taxes there will be dire consequences. here's education reporter lyanne melendez. >> 18, 12, 25. >> these first graders at alvarado elementary are learning about money, while the school district tries to operate with fewer state dollars. every year the district has been forced to make drastic cuts. for example, in just four years the district's budget has gone down from $114 million to

$88 million. >> its good to live within your means but that's a huge, huge cut to our means when you are trying to educate 13,000 children. that's a lot of money. >> that's why the unified school district is supporting measure 8. a partial tax to raid $3 million a year for the schools. it's not enough to get them where they were before but it will help save some programs. >> our libraries, kindergarten to third grade will go up to 30 next year. >> that puts added pressure on teach speakers students. >> the of in the past we've had 20 kids in a classroom and it's very manageable. >> in order to balance this year's budget about 100 teachers in this district have been laid off. >> i have ten. i'm here at the site. i believe i'm the school with the most. >> measure h would help vince keep his job. the parcel tax would chad $180 to a homeowners tax bill. that's $15 a month. last year a similar parcel tax

>> experts say ten states are facing above normal chance force big wildfires this summer. in fact this morning there are major fires already burning in eight states. abc news reporter clayton sandel looks ahead. >> it's an out of control monster. new mexico's biggest fire ever, destroying a dozen homes, torching more than 350 square miles, an area bigger than dallas, texas. flames driven by hot, dry winds. >> we are struggling and praying that everything turns out okay. >> it may be burning in an isolated area, but already this year wildfires have blackened more than 700,000 acres. ten states are facing above normal chances for big summer fires. >> in the west it's not a question of if, but when you are going to have a wildfire. >> with a potentially dangerous fire season on the way, there's renewed concern about a serious shortage of air tankers that are critical to fighting a blaze from above. critics worry the nation's tanker fleet is shrinking. in 2006 the us forest service

soil and drinking water across the state. >> at crist cal cleaning center in san mateo, owner lynette use as chemical called perk by nickname to clean the stains. >> it's a good solvent because of how well it cleans. >> she owns what is likely the last perk washing machine sold in california. she said if it is handled directly, it is safe but this method of dry cleaning is on the way out. >> i think it's a little bit of an extreme phaseout. california is really the only state that has taken such a progressive stand. >> dry-cleaners have been using the liquid solvent since the 1930s. other industries have also used it as a lubricant. in 2007 the state air resources board ordered perk phased out because it is linked to cancer in laboratory animals. >> there have been many studies now look at workers exposed, and the evidence is definitely suggestive that eats a human

carcinogen. >> according to the national institute of environmental health sciences, short term exposure can cause dizziness, fatigue, headaches, sweat being, lack of coordination is unconsciousness. long-term exposure can caution kidney and liver damage. it's toxic legacy will likely be around for years to come. >> it can get into the air from the soil. so it's very volatile. it would rather be in the air than in the soil. it also gets into the drinking water. >> so that's the problem with perk. it's found in too many place where's it shouldn't be. >> todd thompson is with the state water board. he said unsafe practices and accidental spills have contaminated ground water all over the state. it's even gotten into drinking water. >> it's a large problem statewide w we have over 1,000 cases active in the state that we are cleaning up. >> but it isn't just ground water. the soil is contaminated at this

site in emeryville. it was once a business that recycled perk. now it's considered so dangerous, workers need special training to even walk around here. the state department of toxic substance control shot this video for us. >> because of those operations and those active tis we now have a legacy associated with this contamination. >> not only is it potentially dangerous, it's expensive to clean up. this job alone costs $1.3 million to cleanup and it could take more than a year to finish. already more than 600 other contaminated sites have been identified around the state. some of the cleanup costs will be paid for by businesses,lan owners and insurance companies. taxpayers will pick up the rest. >> within the bay area we may have 100 projects that are dealing with the chemical that can go from military bases where they also had dry cleaning operations, all the way down to the local dry-clean they're might exist on the street corner. >> it is those smaller cleaners that have state officials most worried because many of them are

mom and pop shops. they likely don't have the money to pay for a big cleanup. that means taxpayers will most lickly foot the bill. dan ashley, abc7 news. though it's design initially inspired controversy, there's no arguing, the high rise condo tower at one rinkon hill in san francisco is an engineering achievement, built specifically to withstand a strong earthquake. it's now the subject of a scientific study. jonathan bloom explains. >> the glistening glass and white concrete are the epitome of modern but what is underneath exists because what have happened more than a century ago. >> if you were standing right here on rincon hill in 1906, you would have seen a city in rubble. >> the great earthquake began a movement in engineering to zone a building meant to stand up to violent shaking. a building like this one. >> it is one of the most structureally advanced design of any building in the united states.

>> sitting in a concrete box and reenforced by a metal sub structure. ice an early example of what's called performance based engineering. how well does it work? we are about to find out. >> the instruments of that been carefully placed in this building are here. >> connected by 2 1/2 miles of cable, they will silently measure the shaking whenever an earthquake occurs. >> the system is up and running and already taking the building's pulse. >> they are mounted in box like this each with two academy saleroomters, one for vertical and one for horizontal move men. kind of like the ones in your cell phone but much more expensive. >> it shows it is moving about nearly 1,000 of an inch you see that's high precision information we are getting. >> there are 72 of them placed on different corners on different floors of the 64 story building. they will let scientists create a 3d model of exactly how the building sways and flexes during

good morning. 54 there. 51 livermore with 50 in the city. plenty of airport delays yesterday. today the visibility at the coast is a good seven miles. so perhaps better start this morning for sfo. we will have to wait and see. a south wind gusting to 22 miles an hour and of in concord. you see the southwesterly wind in fairfield. enough of a moderate breeze here that it will keep the temperatures intact. low to mid-80s today there. nothing too extreme. in fact a little bit above normal in spots before we go the other direction tomorrow. so we are looking at the partly cloudy skies this morning. cooler and a little bit breezy today with a few high clouds from time to time. and then the windy conditions tomorrow with that incoming cold front bringing a chance of showers as far south as monterey. but more likely in the north bay. so here's a look at what's going on. we have a big dome of high pressure over the area yesterday. it continues to shut to the east. but the cold front, the trough still holding steady to the

north here. it will allow for that sea breeze and a few higher clouds, but overall still a pretty nice end to the weekend. yesterday it turned out pretty nice with numbers in the 80s, if you were protected from some of the wind gusts. now tomorrow as this system continues to drop to the south, it will bring a few showers, especially santa rosa, sonoma, marin looking like a few raindrops and maybe a few drops in san francisco and oakland. here's a look at the timing on that. you notice through the overnot hours we have plenty of clouds. by 3:00, 4:00 in the morning looking at most of the rain to the north. but by the afternoon you will see a couple of areas of green, even around san mateo perhaps. so it's going to be a cool, windy day out there tomorrow. in fact, it's going to take a couple days to recover. still cool and on the breezy side after this frontal passage on tuesday. some high elevation snow, way high, about 9,000 feet after this. so just a blustery day in the

sierra nevada for the first couple days of the work week. upper 90s, though, in fresno with low 70s in los angeles. lots of heat from vegas to palm springs. a nice day in the sierra. 76 there. and back home we are looking at 60 at our coast. we will see some sunshine, and it will be breezy here. the fog will peel back pretty soon. so by 9:00, 10:00, it should be a nice morning out there. and numbers climbing through the 70s throughout the day around the bay. 82 in morgan hill, with mid-60s in monterey with those gusty west winds anywhere from 10 to 20, maybe 25 miles an hour today. so the chance of showers comes in tomorrow through the afternoon. and then by tuesday we are on the back side of this system but not warming up until midweek with more low to mid-80s. so not unusual for june, but, you know, so nice yesterday. >> i know. i put my umbrella away. >> maybe you can dodge the showers. >> okay. i'll try. thanks, lisa. >> consumer advocates say california has one of the

strongest lemon laws in the nation. a recent case involving an alameda couple put that law to the test. here's 7 on your side's michael finney with the story. a lot of times we had to bring that car in to ford. the paperwork, it was a big, big stack. >> mel waldorf goes through the pile of repair orders he's accumulated since purchasing a ford flex like this one in 2010. a few weeks after he drove it off the lot he began noticing problems. >> there was a shutter in the braking, and there was a rattle in the roof. >> it was a problem noted by ford in a technical service bulletin. sent to its service centers just two months early. ford 2010, all-wheel drive areas may have a shutter vibration or a noise while driving at low speeds. mel said ford had barely fixed that problem when another developed. >> there was a chrome panel on

the rear hatch that was starting to liftoff from the body of the car. the rear left hand door, the driver's side rear door didn't close completely flush with the car. >> once again, the car went back to the shop. >> the experience was extremely successful. >> the dealer used it to both drive her daughter and for her business. >> i'm not a car enthusiast. i like my cars to be safe, practice, reliable and that's why we got this car and it turn out not to be the case. >> the biggest problem was with the transmission. >> when i first noticed the first problem, which was the problem to me was when it would stall as i was making a turn. the other things were sear stating, but that one just really scared me and i felt really unsafe driving. >> that was the same problem noted in a ford technical service bulletin in january of 2011. in fact, in all there had been

13 such bulletins issued about the flex since 2010. mark anderson is a lemon law attorney. >> a consumer industries substantial defects. defects that substantially effect the use or safety. no doubt about that because a transmission obviously is pretty essential. >> he said in california a new car is presumed to be a lemon if it's been in the shop 30 days within an 18-month period. records kept by mel show his flex was quickly approaching that threshold. he contacted 7 on your side. we contacted ford. and it graciously agreed to give mel and jessica a brand new flex. >> i want to thank michael finney and all the staff on 7 on your side that made it possible for us to get this car that we finally have been wanting for all these months. >> known from ford was available for comment. but mel tells us this is the eighth ford car he's owned and he's extremely pleased with the way the carmaker handled his concerns.
