looking good on this election day tuesday. thanks for joining us, i'm kristen sze. i'm remember i can thomas. police -- i'm eric thomas. a police standoff just ended. terry mcsweeney is live at the scene in the 500 block of high street. >> reporter: this wrapped up 3:00 this morning after hours worth of a standoff. the standoff occurred at this house at and high streets. look at what this was about -- it started with a deputy spotting a stolen dark green saturn. they chased it to high and jensen next to 880. the driver shot at a deputy deputy tried pull him over at 41st and international about 58 last night. it went on for seven hours. the chase ended when the sat turn stopped, the driver ran into highs. for a time, he had three

hostages. he let tell go and turned himself in around 3:00 this morning. >> primary mission to protect everyone involved, including the suspect. were were able to come down here and have a dialogue with the suspect and we were able to talk him out. >> reporter: investigators say there is some kind of relationship between the gunman and the man who lives this house, unclear what that is. it was a volatile situation, but it is over with the gunman in custody and no one injured. again, it wrapped up about 3:00 this morning. terry mcsweeney, abc7 news. in a few hours a federal appeals court in san francisco will announce a key decision in california's battle over same-sex. katie marzullo is live in our breaking news center. >> reporter: the court is deciding whether or not to review the ruling that declared the ban on same-sex

unconstitutional. the 9th circuit court of appeals will post its decision on its website at 10 this morning. you remember it was a three-judge panel that decided prop 8 violated the rights of same-sex couples in february. supporters of the marriage ban appealed. if the court today decides it will take another look at the ban with it will assemble an 11-judge panel to do so. that decision could take months maybe more than a year. then there's the question of the u.s. supreme court hearing the case. whether or not the appeals court decides to review the marriage ban today it will still ultimately get kicked up to the supreme court. the difference is will that happen now or the end of this appeals court review. however, some legal experts question if the supreme court wail agree to hear the case. that's because it is written so specifically to california it doesn't affect the entire

scheduled a hearing today after he ordered the records of calls and texts by suspended sheriff ross mirkarimi be turned over to mayor lee. mirkarimi's legal team is objecting to the tentative ruling it involves texts and calls made between mirkarimi and his wife eliana lopez, his campaign manager and his neighbors ivory madison lee used subpoena powers as mayor to see if records can reveal whether mirkarimi twraoeud to dissuade witnesses from cooperating with police in the domestic violence incident on new year's eve with his wife. authorities say the search for sierra lamar is winding down. she is the morgan hill teenager missing since mar: divers returned to the reservoir -- one last time yesterday. one of six waterways in the region they've been searching. authorities say it will be the last water search for sierra unless they get new tips. police arrested antolin

garcia-torres and charged him with kidnapping and murdering sierra. oakland mayor quan is proposing a 400 million dollar budget plan with no cuts or layoffs the first time in four years. she says better than expected revenue and cost savings from employee concessions are allowing the budget to be in the black. police department staffing would stay at the current level, 650 officers. the city council questions adding 13 new city positions when the city could be giving back worker concessions. a vote on the budget is tentatively set for june 29th. >> san jose city council set to vote on a measure that could fine parents for underaged drinking parties in their home. it makes a parent or adult liable for gatherings of four or more underaged drinkers on their property whether or not the party creates a disturbance. the homeowners would be responsible if they were not

at the property or not wear of the gathering. traffic back to normal in downtown san francisco this morning, following a shutdown of streets to downed live electrical lines. it began after 4:00 yesterday afternoon live wires from the muni bus broke off and fell into the street. a young woman was hit by one wire. she and two others were taken to the hospital with nonlife-threatening injuries. market street was shutdown between third and eighth streets for more than three hours. the hub on top of the trolley's pole got lose and snapped the wire. -- lanes could become available to all drivers in the reverse commute direction under the bill co-sponsored by san francisco east -- [ unintelligible ] we are waking up dry in

quiet in most areas there's that one storm we've been watching over the ocean ha is now weakening. first the breezes that's the other -- other story pretty stout as we look at the ferry middle -- at the ferry building. live doppler you can see up long the sonoma county coast one shower as we put this into motion you can see it heading southeast and yellows are disappearing becoming greens and even blues. that means weakening. maybe just a few sprinkles around inverness. we'll keep an eye on it there could be more developing in that northwesterly flow. look at how much cooler we are two degrees in hayward, 12 antioch. that puts us in the upper 40s in santa rosa, napa and redwood city, 46 los gatos everybody else low to mid 50s.
