after election day. i'm kristen sze. i'm eric thomas. we begin with election results. proposed cigarette tax to pay for cancer research. katie marzullo is live in the breaking news center. you couldn't get away from those ads. >> reporter: they were everywhere. the time results for prop 29 just came down about an hour ago. this was close all night here are the final results. prop 29 did not pass. just barely by 60,000 votes is the difference. prop 29 would have added a one dollar tax to a pack of cigarettes the money was slated for cancer research. cigarette makers contributed 47 million dollars to advertising that claimed the measure would create a government bureaucracy and the money wouldn't have to stay in california. >> it comes down to is this or

not a bad measure? it is bad no matter who pays for the advertising. >> you have american cancer heart and lung associations, live strong, on the side to pass it. the only person putting the only group putting money into this is big tobacco, the only one. >> reporter: on the other side, you heard a lot of major health organizations supporting the proposition. he told us last night he did expect this to be a tossup. again this cigarette tax has failed. the only other proposition on the ballot is prop 28 which alters term limits for members of the state legislature. prop 28 has passed, more than 61% voted yes. nearly 39% voted no. it reduces total number of years for state legislators from 14 to 12. allows a lawmaker to spend all in ear the senate or assembly. -- in either the senate or

assembly. >> in san jose union leaders planning to challenge measure b which will cut pensionses of city workers. 70% voted in -- in favor with 30% opposed. the mayor pushed for measure b which will modify the city charter and create two pension options they can keep current benefits but pay more or pay the same now for reduced benefits and more years of service. the runoff elections are set for two races 80-year-old pete stark of fremont will face fellow county prosecutor and democrat in alameda county. you see one of the results of the congressional race. 9th district which includes part of contra costa county incumbent will battle with the republican gil. he received more than 48%, gil got nearly 40%.

>> reporter: as people know now when the president comes to town it shuts down streets he will be in downtown san francisco good news, quick trip, he's going to come and go during the workday. if you are thinking i thought the president was just here, you are correct. two weeks ago he was here in the bay area not the city of san francisco but he appeared at fundraisers on the peninsula. now he's back for two more fundraisers, no public events. he will be here 11:30, leaving 3:15 for l.a. so his visit won't impact rush shower traffic. be prepared foreclosed streets in the middle of the day in san francisco, first at one market street across from the ferry building then he will move over to the merchants exchange building on california street. protesters are expected outside of the events. he is expected to raise about five million dollars for his

campaign on this trip to california. amy hollyfield, abc7 news. 4:36 now. we are expecting to learn more from south san francisco police about a shooting involving one of its officers about 9:00 last night an our shot a man at a gas station after the suspect made a suspicious gesture that he might have a gun. he was rushed to the hospital with life-threatening injuries and a gun was found at the scene. >> in the east bay a man shot by deputies is recovering this morning. the man wanted for attempted murder tried to escape by jumping into a car. sky 7 hd was over the scene. deputies shot him when he refused to stop. he drove half mile before running to a home and hiding. a k-9 unit went in and him out. in oakland police are questioning a suspect who returned to an home that was the scene of a stand off

monday night. police pulled over a car with three suspects, one was arrested and one barricaded himself in a home on high street before negotiators convinced him to surrender. the third suspect got away investigators say he returned to that home last night. when police were called they found the man identified as 47-year-old jimmy gregory, with a again shot wound in his leg up investigators are trying to find out who shot him and what happened -- partial victory for suspended sheriff ross mirkarimi. a judge has ruled that only selected phone records between mirkarimi and his wife with their neighbor can be released. madison shot video showing lopez crying and having a bruised arm leading mirkarimi to plead guilty to to false imprisonment. mayor lee wants the records to bolster his case to remove mirkarimi from office. new this morning, "wall street journal" reporting nasdaq will announce a 100 million dollar plan today to reimburse some

investors who bought facebook shares on their first day of trading. it was delayed 30 minutes because of technical glitches some say that contributed to its inauspicious opening shares have slid 32% since the ip it closed yesterday under $26, the new low. some 30 students who pulled senior last week will be allowed to take finals today and tomorrow but still won't be able to graduate with their class. yesterday a judge upheld the school's suspension ruling again the parents of a dozen seniors who wand their children to take the exams and still walk in graduation with their class. the included painting the school with washable paint, chaining a lamb to a pole and placing banners with profanity around campus.

effectiveness of vaccines given to low income children. abc news has obtained new government report that says many providers of the immunizations did not store the vaccines at proper temperatures experts say that can make them ineffective and place children at risk for contracting serious diseases. 76% of the providers stored vaccines at temperatures that were too hot or cold. a dozen stored expired vaccines with ones that were still current. "good morning america" will have much more on this at 7 a.m. after our newscast. eight year study found a simple blood test can predict recurrence of breast cancer, can find cancer cells in the blood that have broken free from a tomb nor in the breast. women with nonmetastatic breast cancer who had cancer cells in their blood were five times more likely to relapse or die. the study is in the land set oncology. >> -- >> graduation big milestone
