good morning. thanks for joining us i'm eric thomas. i'm kristen sze. that proposed cigarette tax to pay for cancer research has been narrowly . under 51% said no to prop 29. 49 voting yes winning margin, 63,000 votes with all presents reporting. it would have added a one dollar tax to a pack of cigarettes. the money was slated for cancer research. cigarette makers contributed 47 million dollars to advertising. prop 28 easily passed. 61% voted yes. 39% said no, it alters term limits for state legislature from 14 to 2010 of -- from 14 to 12: new this morning, union representing san jose city workers promising a fight

after voters passed a pension reform measure pushed by the mayor. katie marzullo is live with more. >> reporter: the mayor of san jose has won a wide victory with this one for pension reform, nearly 70% of voters voted in favor of measure with all precincts reporting this morning. it modifies the city charter and creates two pension plans for employees, within they can keep current benefits and pay more or two, keep paying what they are paying but receive fewer benefits and work longer. mayor reed says the current plan was costing san jose too much. >> this is more than 50% of payroll for the retirement benefits, impossible to sustain. >> we offered significant changes to retirement that would have saved the city millions and those would have been legal and we could have pwhofd forward. >> reporter: a coalition of city unions opposed the measure they claim it is illegal.

the union president tells the san jose mercury news they are definitely taking this to court. in san francisco voters decided on two city measures. measure a which would open the city's garbage contract to competitive bidding lost by a wide margin. voters came to the aid of coit tower 54% voted in favor of measure b limiting commercial activities and prioritize funds raised to preserve aging murals. we'll continue to bring results all morning. we are streaming them on the bottom of the screen. you can get the latest on abc7news.com. pg&e inspectors are conducting emergency leak surveys on 200 segments of pipeline after making a crucial admission about safety. terry mcsweeney is live in san bruno, the scene of that disastrous pipeline failure two years ago.

>> reporter: pg&e looking at 180 different segments of pipeline, natural gas pipeline after admitting it had ignored the fact that many of these lines are susceptible to corrosion. take a look at one of the pipelines that blew, the most infamous of all the pg&e this is line line 1 2 the one that failed september 9th, 2010 killing eight people, destroying 38 homes. while pg&e has a policy of coming up with a solution to problems within 60 days of finding problems, some pipes have been left alone going back to 2004. one of those is line 132, the company discovered a nine mile section of the pipe stretching into san francisco from san bruno is vulnerable to corrosion, but nothing has been done. another potentially problematic section is milpitas discovered in 2006. again, nothing done. chronicle says the

vulnerability is a lowered level of electric current running through the lines that prevents corrosion. pg&e is promising to complete emergency line inspections by the end of the month. puc considering a penalty against pg&e. terry mcsweeney, abc7 news. more sexual assault victims emerging in the case involving a physicians's assistant in san jose. authorities -- say ers are coming forward after arrest of the 35-year-old was publicized in march. he worked at the diet clinic in san jose. a client accused the livermore resident of sexually assaulting her while undergoing treatment. police want to know if there are more victims and asking anyone with information to call. the 19-year-old hayward man accused of taking part in a deadly robbery attempt at a jewelry store is charged with murder even though he didn't

kill anyone. the 18-year-old was shot and killed by the store's owner last wednesday police say it was in self-defense after he and three others tried to rob gold n treasures. yesterday the contra costa district attorney's office charged the man with murder in the death of his alleged accomplice. he's scheduled to be arraigned next week. supporters of prop 8 say they will take their battle to preserve a ban on same-sex in california to the u.s. supreme court. the 9th court of appeals has refused to reconsider a ruling declaring prop 8 unconstitutional. prop 8 is the vote area proved referendum making same-sex marriages illegal in california. the ban remains in effect for 90 days to give supports a chance to file with the u.s. supreme court. >> >> man who created the golden gate bridge in his backyard in kansas will be honored today at the bridge.

there's one-way traffic control in effect in both directions until 6:00. i've been picking up slowing in both directions right now looking a little sluggish eastbound towards i-80 at 36 miles per hour. wanted to check out the santa cruz mountains to see if the roadwork was slowing folks down. you will find lanes blocked in both direction of highway 17 reported by traffic spotter a few minutes ago this is near summit road, so far we are not picking up any slowing yet. we usually start to see it before 6:00 when they clear it. not too far away, live shot of highway 17 at 280, northbound 17 connector ramp to north 280 blocked until 6:00, you can see there's very light traffic in the south bay now. north bay 101 in san rafael looks good for head heights moving southbound all the way down to the -- headlights moving southbound all the way to the golden gate bridge.

proposed cigarette tax to pay for cancer research. >> reporter: good morning. the outcome just came down in the wee hours this morning. 100% of precincts were in after 3:30. prop 29 did not pass the opposition had 60,000 more votes and 50.8% of the vote. prop -- 58.-- it would have add a one dollar tax to a pack of cigarettes. cigarette makers contributed 47 million dollars to advertising that claimed the measure would create a government bureaucracy and the money wouldn't have to stay in california. >> it comes down to is this or not a bad measure? it is a bad measure no matter who pays for the advertising. >> you have american cancer, heart and lung associates, live strong, nobel prize winners on the side to the only group putting money into this is big tab o'tobacco, the only one. -- >> reporter: you heard a lot

of major health organizations supporting the proposition as well as lance armstrong. the tax seemed like a sure thing for a while, again the cigarette tax has failed. 5:30 right now. the only other proposition on the ballot is prop 28 which alters term limits for state legislature it passed more than 51% voted yes, 39% no. it reduces years from 14 to 12 but allows the lawmakers to step all in ear the senate for assembly. >> why in san -- in san jose workers say it is illegal 70% voted in favor of measure b with 30% opposed. that's with all precincts reporting. mayor reed pushed hard for measure b which will modify the charter and create two pension options they can keep current benefits but pay more

or the same for reduced benefits and more years of the service. runoff elections set for two races. pete stark of fremont will face fellow democrat in alameda county's 15th district. in the 9th district which includes parts of contra costa county, incumbent will battle the republican who received more than 48%. in the race now for the white house mitt romney easily won the republican primary he got 80% of the vote with ron paul and rick santorum, second and third. president obama ran unopposed. he won 100% of the vote. we'll continue to bring results all morning. you can get the latest on

recovering. the man wanted for attempted murder tried to escape by jumping into a car. deputies shot him when he refused to stop. the suspect drove a half mile before running to a home and hiding. a k-9 unit got him out. in oakland police questioning a suspect who returned to a home that was the scene after hour's long standoff monday night. that began when police pulled over a car with three suspects, one was arrested and one barricaded himself in a home on high street before he was quinned to surrender. the third got -- he was convinced to surrender. the third suspect got away but came back to the home last night identified as 47-year-old jimmy gregory. he had a gunshot wound to the leg investigators trying to find out who shot him. partial victory for suspended sheriff ross mirkarimi of san francisco.

a judge has ruled only selective phone records between mirkarimi and his wife and neighbor can be released. the neighbor shot video showing lopez crying and having a bruised arm. mayor lee wants the records to bolster his case to remove mirkarimi from office. "wall street journal" reporting the nasdaq will announce a 100 million dollar plan today to reimburse investors who bought facebook shares on the first day of trading. the debut was delayed 30 minutes because of technical glitches. some experts say that contributed to it the inauspicious opening. shares have slid 32% since the ipo. it closed yesterday under $26 a share, new low. 30 students who pulled senior pranks last week will be allowed to take fair finals today and tomorrow but won't be able to graduate with their

l.a. 85, palm springs near 100. the alameda county board of supervisors is deadlocked on who will replace nadia lockyer. she resigned april ten, amidst a drug and sex scandal. the board narrowed down her replacement yesterday. board members couldn't choose between the two and the bore has until june 19th to appoint somebody or governor brown will. in a closely watched contest with national implications wisconsin's republican governor has won a bitter contest. governor scott walker defeated a challenge by milwaukee's democratic mayor barrett. walker's recall followed his efforts to bust wisconsin's state labor unions. his campaign received 63 million dollars in out of state super pac money allowing him to vastly out-spend
