fighting for his life at san francisco general hospital. take a look at pictures. the official statement from the police department last night a solo officer came upon this person and decided to talk to him they are not saying why. they were within interview distance is the way they are describing it. the police officer felt he was in danger pulled his gun and shot the person who again according to relatives talking to employees here the victim 14 or 15 years of age. south san francisco police say a gun was found at the scene. the boy suffering from life-threatening injuries taken to san francisco general. we called san francisco general this morning and they are telling abc7 news they have no information to release pending notification of family. again, relatives telling employees here at the gas station the victim is 14 or 15. a couple different relatives had different age that is the relative age he was 14 on --

payroll for the retirement benefits. huge numbers impossible to sustain. >> we offered significant changes to retirement that would have saved the city millions and those would have been legal and we could have moved forward. >> reporter: the coalition of city unions opposed the measure they claim it is illegal. the union president tells the san jose mercury news they are definitely taking this measure to court. checking other returns now. the controversial cigarette tax to pay for cancer research has been narrowly defeated under 51% of voters said no to prop 29 49 voting yes. winning margin is 63,000 votes with all precincts reporting. prop 29 would have added a one dollar tax to a pack of cigarettes money slated for cancer research. cigarette makers contributed 47 million dollars to defeat the measure. prop 28 easily passed.

a police officer shooting a person. >> terry mcsweeney is live on the scene at a gas station. what do we know? >> reporter: here at the arco station is where it happened last night at 9:00. south san francisco police officer shooting a person we are told is a 14 or 15-year-old pwoeuplt take a look at pictures. i will tell you what police are saying. 9:00 last night a solo police officer came upon this young person and they are not saying what it was that took the officer to this person, but they were within interview distance is how it is described when the police officer believed the boy was armed, felt he was threatened and pulled his weapon and shot the person. we get the age from relatives talking to employees here at the gas station. one relative saying 14, another saying 15. police did find a gun at the scene. the boy was taken to san francisco general.

millions of dollars spent on both sides. >> reporter: that's right the outcome barely eked just in the wee hours this morning. 100% of precincts reporting just after 3:30. prop 29 did not pass. opposition had 60,000 more votes and 50.8% of the vote. prop 29 would have added a one dollar tax to a pack of cigarettes the money slated to go to cancer research. cigarette makers contributed 47 million dollars to a lot of advertising that claimed the measure would create a bureaucracy and the money wouldn't have to stay in california. >> it comes down to is this or not a bad measure? it is bad no matter who pays for advertising. >> you have american cancer heart and lung associations live strong nobel prize winners on the side to pass it. the only group putting money into this is big tobacco the only one. >> reporter: you heard the list there of the opposition alot of major health organizations i should say the

supporting side supporting the proposition as well as cycling star and cancer survivor lance armstrong. the cigarette tax has failed this morning. the only other proposition on the ballot prop 28 which alters term limits for members of the state legislature. it has passed. more than 61% voted yes 39% voted no. reduces total number of years from 14 to 12 but allows the lawmaker to spend all in the senate or assembly. runoff elections set for two races. stark of fremont will face county prosecutor and fellow democrat. stark received nearly 42% of the vote. the other got 36%. in the 9th district which includes parts of contra costa county incumbent will battle
