university flowing freely between 84 and 101. 101 roadwork cleared traffic picked up northbound through palo alto menlo park. deadly shooting on the peninsula. amy hollyfield is live in east palo alto with new details on the victim. >> reporter: police have just released the victim's name 31-year-old cedric tippins jr. the sergeant tells me he is well-known to police. police officers found in the driveway of a home otherwise heard about the shooting before they a call they her the shots through their shot-spotter system, the system decked nine shots had been fired. police got -- detected nine shots had been fired. they have no suspects. sometimes it can be a problem. sometimes people are scared

street 7:30 last night. a man was taken to the hospital and is expected to survive. also another person questioned. terry mcsweeney will have the a live report in our next half hour. uc berkeley police facing strong criticism for handling of occupy protests last fall. police review board released is report saying it was disturbed by the use of batons by officers to clear a campsite on november 9th. the review faulted police campus leaders and protest organizers for poor communication. >> usually you have a student protest there are leaders of that protest. they endorsed it, i guess. the protesters were leaderless and it is difficult to communicate with them beforehand. >> campus leaders faced criticism for failing to carry out preestablished policies when it came to overseeing

police. crisis management team did not have a clear chain of command nor did it supervise important details of ucpd's activities throughout the day. this morning a judge will decide whether ross mirkarimi will have to turnover all records from his former criminal case to the mayor for an ethics commission probe. tuesday the judge balked at making a decision on the attorney's office request. the judge ordered both sides to be back in court this morning. the mayor wants the records to stolester his case to permanently remove mirkarimi -- to bolster his case to permanently remove mirkarimi from office. prop 29 the state cigarette tax increase too chose to call with ballots still needing to be counted. no leads were 50.8% no. yes 49.2%.

hidden public spaces a secret no more. later today the commission will determine whether they need to do a better job of letting the public know about secret rooftops and plazas that are private property but open to the public. that may include better signage, alerting pedestrians to the spots or a city map designating each location. a superstar in the world of base jumping has a new world record. he spent thirty days climbing a mountain in the indian part of the himalayas. the mountain is more than four miles tall. at the top the 47-year-old jumped off flying for 90 seconds reaching speeds more than 120 miles per hour. he's now the first to base jump from such a high peak in a winged suit. other feats jumping into an active volcano in russia.

tippins, jr. shot last night in a driveway on gloria way. police say he was well-known to officers in the area. police heard about the shooting before they got a 911 call. their shot spotter system alerted them nine shots had been fired so police came out here right away. >> i want to say that we were here within about a minute and a half. and all we found was a deceased 31-year-old male. >> reporter: the killer was out of here. >> gone. >> reporter: police say they really need people who -- to come forward. if anyone knows anything about what happened here last night they really need the public's help. at they time officers say they don't know the motive behind the shooting. amy hollyfield, abc7 news. we are continuing to follow a developing story from oakland for you.

police opened fire on a man and he's now in the hospital. terry mcsweeney joins us from opd headquarters with the latest. >> reporter: amy is getting more information from the east palo alto police than we are here. i talked to the police they say any information coming from the public information officer who not here yet. last night shooting involving an oakland police officer a man shot expected to survive. last night 7:30, this is 105th and e street. that is where police officers shot a man in his 20s. police are not saying what was the circumstances leading up to that. they are not saying how many times he was hit where whether the person who was hit had a gun. we can't call him a suspect because we don't know if there was anything along those lines they are not confirming that the officer who did the shooting is female. abc7 news crews last night did see a dark colored vehicle checked out by police they saw

someone being enter vied -- interviewed by police. we expect more information from oakland pd in a little bit. terry mcsweeney abc7 news. 6:34. in san mateo county the district attorney is investigating the fatal shooting involving a south san francisco police officer. 15-year-old derrick gaines was killed in that shooting tuesday night at the arco station on westborough boulevard. police say gaines and a friend were acting suspiciously. video shows them running past of the gas pump an officer ordered them to stop a friend complied police say gaines ran and pulled a handgun. >> at which time our officer in the protection of his own life discharged his weapon. >> i want a face-to-face apology to me and my family for killing my baby. >> i think that they could

have done a number of things besides shoot him. >> police recovered a gun at the scene. bart has hired a mental health expert to advise police officers on how to handle tense situations with individuals who might have mental healthish use. the mental health professional will help police officers defuse potentially dangerous situations like the one occurred last july that you are looking at. this morning we have new information in the sierra lamar case. she is the missing girl from morgan hill. the public defender for antolin torres-garcia will ask to be tan off the case today. the public defender will claim he has a conflict of interest and needs to be removed from the case. more suspensions at

heritage high are expected to be handed down today. which happens to be the last day of school. more than 50 students have been suspended for their participation in a prank which involved spreading paint throughout the campus. many students have not been allowed to take finals. seniors won't be able to take part in saturday's graduation. now some students and parents worry they risk losing scholarships. school officials say they are following policy. president obama is still in los angeles this morning. he will attend a fundraising breakfast before heading to nevada. the president basked in the support of his gay and lesbian backers last night. he ref heed up the crowd with a to not tolerate attempts to roll back rights that gay americans have gained under his administration. >> reporter: the fight for -- >> the president: the fight for equality and justice on behalf of the lbgt community is part of a broader fight on
